What it does
This instrument is a class licence that authorises the operation of a narrow set of radiocommunications devices for the specific purpose of facilitating search and rescue operations (s 6(1)). The class licence lists the device types covered: satellite distress beacons (with an explicit exclusion for certain aircraft EPIRBs), EPIRB‑AIS devices, MSLS (man‑overboard or similar locating systems), AIS‑SARTs, and Radar‑SARTs (s 6(2); notes). For each device type the instrument limits the frequencies on which the device may be operated (ss 7-9). It also prescribes an operational constraint that the devices may only be used to activate an emergency signal in response to a distress situation defined as a risk of imminent or grave danger to a person who requires immediate assistance (s 10(1)-(2)). Compliance with technical standards or equipment rules is mandatory; devices must meet the applicable instrument in force on the device compliance day (s 11(1)). In addition, the instrument prohibits operation where the electromagnetic energy emitted would exceed general public exposure limits specified in the ARPANSA Standard in places accessible by the public (s 11(2)).
Mechanically, the instrument authorises only operation; it does not itself set out manufacturing obligations, nor does it specify enforcement sanctions within the supplied text. It also contains an interpretative provision that references to other instruments are references to those instruments as in force from time to time (s 5A(a)-(b)), and notes directing readers to the Acts Interpretation Act 1901 and the Legislation Act 2003 for the interpretation and registration of Commonwealth instruments. The instrument also clarifies that it does not apply where an apparatus licence already authorises operation for a substantially similar purpose (s 6(3)). Where the Radiocommunications Legislation Amendment (Reform and Modernisation) Act 2020 has commenced, the applicable instrument changes from "standards" to "equipment rules" for determining compliance (s 11(1)(a)-(b); note after s 11).
