Radiocommunications (Cellular Mobile Telecommunications Devices) Class Licence 2024

Definitions and inter-locking instruments are central. The instrument defines key terms and points to external instruments and standards as part of the legal structure:

• ARPANSA standard: the instrument explicitly adopts the Radiation Protection Standard for Limiting Exposure to Radiofrequency Fields - 100 kHz to 300 GHz (2021) published by ARPANSA, and permits future replacements (s 5(1)). That standard sets the general public exposure limits for electromagnetic energy referenced in s 11(6).

• Device compliance day: the operative compliance regime for a device depends on its device compliance day, which is defined as the later of the manufacture date (if manufactured in Australia), import date (if imported) or the date of a material alteration in Australia (s 5(1) definition). The device compliance day determines whether older "standards" or the newer "equipment rules" regime applies when assessing radiocommunications compliance (s 11(4)-(5)).

• PTS device and relevant PTS licence: a PTS device is a radiocommunications transmitter authorised by a PTS licence (a PTS transmitter) and, where that transmitter is part of a station, each radiocommunications receiver at the same station (PTS receiver) (s 5(3)). The relevant PTS licence for a PTS device is the PTS licence that authorises operation of the transmitter (s 5(4)). The class licence authorises operation of devices that communicate with those PTS devices (s 7(1)).

• Communicate: the instrument defines communication in terms of intent and design of the operator; a transmitter communicates with a receiver where the operator designs or intends radiocommunications from the transmitter to be received by the receiver (s 5(2)(a)), and vice versa for receivers (s 5(2)(b)). This definition bounds the permitted interactions and prevents characterising incidental receipt as authorised communication.

• Interplay with other instruments: references to legislative instruments and other writings operate as references to those instruments "as in force from time to time" (s 6). The instrument expressly incorporates telecommunication labelling and compliance obligations imposed under instruments made under s 407(1) and s 376(1) of the Telecommunications Act 1997 (s 11(1)-(3)). For radiocommunications rules, devices are subject either to standards (pre-17 June 2021) or to equipment rules (post-17 June 2021) as applicable (s 11(4)-(5)).

Operational prohibitions and constraints are the other main concepts:

• Use limitation: devices authorised under this class licence may only be operated to communicate with PTS devices (s 8). They cannot be used to communicate with licensed devices (s 7(2)).

• Frequency constraints: receivers must operate on frequencies on which the PTS transmitter they communicate with is authorised by the relevant PTS licence (s 9(1)); transmitters must communicate with a PTS receiver and operate on a frequency specified for that receiver in the relevant PTS licence (s 9(2)), recognising that PTS licences authorise transmitters but may nonetheless specify receiver frequencies (note to s 9).

• Interference prohibition: operation that causes interference to radiocommunications is forbidden (s 10). The instrument references s 197 of the Act for substantial interference, disruption or disturbance and records that ACMA will generally not afford protection from interference to communications involving devices operated under this instrument (note to s 10).

These concepts produce a regulatory architecture where the class licence grants a constrained right to operate, while technical compliance, labelling, and exposure limits are enforced through cross-referenced regulatory instruments and standards. Authority to operate is therefore conditional on: (a) the operator’s intent to communicate with PTS devices; (b) adherence to frequencies specified in PTS licences; (c) non-interference; and (d) compliance with telecommunications labelling and radiocommunications technical rules, including ARPANSA exposure limits.

The instrument allocates responsibilities and legal effects across several groups; the text identifies these parties explicitly or by necessary implication.

Device operators

• Persons who operate radiocommunications devices that communicate with PTS devices are directly affected. Such operators receive the benefit of a class authorisation (s 7(1)) but are constrained to operate only for communications with PTS devices (s 8), must use authorised frequencies (s 9), must avoid causing interference (s 10), and must ensure devices meet labelling and equipment technical requirements (s 11).

Manufacturers and importers

• The instrument places obligations on manufacturers and importers of devices that are customer equipment. An operator may not lawfully operate such equipment unless the manufacturer or importer complied with any requirements imposed under an instrument made under s 407(1) of the Telecommunications Act 1997 (s 11(1)), and the device itself must comply with any applicable requirements under an instrument made under s 376(1) of that Act (s 11(2)). Thus compliance upstream by manufacturers/importers affects downstream operators’ legal entitlement to use the device under this class licence.

PTS licence holders (and stations)

• Holders of PTS licences and their stations are indirectly affected because the class licence only permits operation to communicate with PTS devices, and frequency permissions are determined by the relevant PTS licence (s 5(3)-(4); s 9). The instrument recognises that a PTS licence authorises transmitters but may still specify receiver frequencies (note to s 9).

ACMA and other regulators

• The Australian Communications and Media Authority is the administrative authority in practice; the instrument is made under the Radiocommunications Act by reference to ACMA’s legislative functions (s 3 notes and s 5 Note 1 referencing ACMA definitions). ACMA’s practices are directly relevant because the instrument warns that ACMA will generally not afford protection from interference for devices operated under this instrument (note to s 10). ARPANSA is also referenced as the holder of the radiation exposure standard that operators must respect (s 5(1) definition and s 11(6)).

Users of licensed devices and apparatus licence holders

• The class licence expressly does not authorise operation of licensed devices (s 7(2)). Therefore persons operating under other licensing regimes (apparatus licences) remain governed by their apparatus licences; interactions between class-licensed devices and licensed devices are constrained by the interference prohibition (s 10) and frequency alignment requirements (s 9), but the class licence does not confer rights to operate devices that already require an apparatus licence.

Secondary market actors and installers

• Parties altering or modifying devices in Australia need to note the device compliance day definition, which treats the date of material alteration in Australia as potentially resetting the device compliance day (s 5(1) definition). That affects which standards/equipment rules apply and therefore affects installers and modders whose actions may change the applicable compliance regime.

Third parties and the public

• The ARPANSA public exposure limits (s 11(6)) and the instrument’s prohibition on emissions that exceed those limits mean public-health-related obligations attach. Also, because the instrument provides that ACMA will generally not afford interference protection (note to s 10), third parties who rely on radiocommunications protection cannot assume priority where the other party operates under this class licence.

In sum, manufacturers/importers, device operators, PTS licence holders, installers and the ACMA are the primary actors. The instrument creates compliance obligations upstream (manufacture/import) and operational constraints for on-the-ground users, and it frames ACMA’s protection stance in relation to interference.

Key rights

• A person is authorised, by this instrument, to operate a radiocommunications device to communicate with a PTS device, subject to the conditions in Part 3 (s 7(1)). That is the core substantive right created by the class licence: a permission to operate without obtaining an apparatus licence, provided the conditions are met.

• The right is conditional and bounded: it does not authorise operation of licensed devices that require an apparatus licence (s 7(2)). The right is further qualified by the detailed operation conditions in Part 3 (ss 8-11).

Key duties and prohibitions

• Operation limited to communication with PTS devices: A person must not operate the radiocommunications device otherwise than to communicate with a PTS device (s 8). The instrument defines what "communicate" means (s 5(2)), which ties operational permissibility to the operator’s design or intent for the radiocommunications.

• Frequency alignment with PTS licences: Receivers must be operated only on frequencies on which the PTS transmitter they communicate with is authorised by the relevant PTS licence (s 9(1)). Transmitters must communicate with a PTS receiver and operate on frequencies specified for that PTS receiver by the relevant PTS licence (s 9(2)(a)-(b)). This shifts primary responsibility for frequency authorisation to the PTS licence holder and requires operators under the class licence to align with those licence terms.

• No interference: A person must not operate a radiocommunications device if the operation causes interference to radiocommunications (s 10). The instrument references s 197 of the Radiocommunications Act for the prohibition against conduct causing substantial interference, disruption or disturbance (note to s 10). The instrument also records that ACMA will generally not afford protection from interference to radiocommunications involving devices operated under this class licence (note to s 10), signalling limited regulatory protection for such operators.

• Compliance with telecommunications labelling and device requirements: Operators must not use customer equipment unless the manufacturer or importer of the device has complied with any requirements imposed on the manufacturer or importer by an instrument made under s 407(1) of the Telecommunications Act 1997 (s 11(1)). Operators must not use customer equipment unless the device complies with each requirement specified by an instrument made under s 376(1) of the Telecommunications Act 1997 (s 11(2)). The instrument adopts the Telecommunications Act’s definitions for "customer equipment" and "import" via s 11(3).

• Compliance with radiocommunications standards/equipment rules: The duty to comply with applicable technical rules is time-dependent. For devices whose device compliance day occurs between 1 March 2003 and before 17 June 2021, the device must comply with any relevant standards as in force on the device compliance day (s 11(4)(a)). For devices whose device compliance day is on or after 17 June 2021, the operation of the device must not contravene prohibitions or obligations in any equipment rules as in force on the device compliance day (s 11(4)(b)). The instrument expressly notes the regulatory transition on 17 June 2021, when Part 4.1 of the Act was replaced and standards were replaced by equipment rules (s 11(5) and the note).

• ARPANSA exposure limits: Operators must not operate a radiocommunications device, or a group of devices, if electromagnetic energy emitted by the device or group exceeds the general public exposure limits in the ARPANSA standard in a place accessible by the public (s 11(6); s 5(1) defines ARPANSA standard).

Interactional duties and hierarchy

• The instrument states that, unless the contrary intention appears, no condition in Part 3 limits any other condition in that Part (s 5(6)). This means the duties in ss 8-11 are cumulative: compliance requires satisfying each applicable condition. References to other instruments operate as references to those instruments as in force from time to time (s 6), which means duties can change as the referenced instruments change.

Who decides and who pays

• Decision authority for frequency allocations and the content of PTS licences resides with the decision-making process that issues PTS licences (the instrument references the relevant PTS licence but does not alter who can authorise frequencies , s 5(4) and s 9). Manufacturers and importers decide on compliance with Telecommunications Act labelling and product requirements because non-compliance by those actors will block the downstream operator’s right to use the device under the class licence (s 11(1)-(2)). The operator pays compliance costs in practice , labelling, technical conformance testing, and ensuring emissions meet ARPANSA limits , but those costs are funded by manufacturers/importers and operators depending on the supply chain.

Rights limited by non-protection from interference

• The instrument grants a right to operate subject to an important protective limitation: the ACMA will generally not afford protection from interference for communications involving class-licensed devices (note to s 10). That affects the practical security of the right: users cannot assume regulatory priority against interference from other spectrum users.

Taken together, the instrument forms a compact: a conditional grant of operational permission (with associated rights) paired with a set of technical, labelling and interference-related duties that must be satisfied concurrently.

The instrument itself does not set out specific monetary penalties or criminal sanctions. It instead anchors enforcement and offences to the Radiocommunications Act 1992 and to instruments under the Telecommunications Act 1997 by cross-reference and by note. The instrument therefore functions as a permissions-and-conditions document; consequences for non-compliance attach through the underlying Acts and the enforcement regimes those Acts create.

Linked enforcement bases in the instrument

• Interference-related enforcement: The instrument refers to section 197 of the Radiocommunications Act in the note to s 10. Section 197 (as cited in the instrument) makes it an offence to engage in conduct that will result, or is likely to result in, substantial interference, substantial disruption or substantial disturbance to radiocommunications within Australia or between Australia and overseas. The inclusion of that note indicates that non-compliance with the interference prohibition in s 10 has an enforcement connection to the Act’s offence provisions.

• Compliance with telecommunications instruments: The instrument requires compliance with obligations imposed under instruments made under ss 376(1) and 407(1) of the Telecommunications Act 1997 (s 11(1)-(2)). Those instruments and the Telecommunications Act contain their own enforcement measures or legal consequences for non-compliance; the class licence makes operation conditional on compliance, so operating a device that does not meet those requirements means the person is not operating within the class licence conditions and may thus be subject to enforcement linked to the Telecommunications Act instruments.

Regulatory enforcement actors and practical protection

• ACMA is the administrative regulator for radiocommunications. The instrument notes that ACMA will generally not afford protection from interference to radiocommunications involving devices operated under this instrument (note to s 10). That statement has two immediate enforcement implications: (a) ACMA’s practical assistance or regulatory remedies to class-licensed operators complaining about interference will generally not be forthcoming, and (b) operators may be exposed to interference risks without expectation of ACMA intervention to secure their communications.

Other enforcement mechanisms remain in the Acts

• While the instrument does not attempt to itemise penalties, contraventions of the Radiocommunications Act (including the s 197 prohibition) and of the Telecommunications Act and related instruments can carry penalties and enforcement remedies under those Acts. The class licence’s conditions operate as a basis on which ACMA can treat operation as unauthorised if conditions are not met, thereby exposing the operator to any enforcement responses available under the Radiocommunications Act and the Telecommunications Act. The instrument’s repeated cross-references mean that enforcement is distributed across multiple statutory regimes rather than concentrated in this instrument itself.

Practical enforcement risk and compliance posture

• Because the class licence explicitly disclaims usual regulatory protection from interference (note to s 10), operators whose business depends on interference protection should not rely on the licence for regulatory priority. Non-compliance with labelling or device requirements under the Telecommunications Act instruments can also remove the operator’s lawful basis to use the device under this class licence (s 11(1)-(2)), which in practice can lead to enforcement action for unauthorised operation. The instrument’s obligation that no condition limits any other (s 5(6)) means that multiple compliance failures could be aggregated by ACMA as a basis to find that the operation is outside the class licence authorisation.

What the instrument does not specify

• The instrument does not list penalties, infringement notices, specific administrative sanctions, or detailed ACMA enforcement processes. It relies on the enforcement provisions and penalty regimes of the Radiocommunications Act 1992 and the Telecommunications Act 1997 and other legislative instruments (as in force from time to time). This design means readers must consult those Acts and any relevant enforcement policies or determination documents for concrete penalty amounts, notice procedures, or remedial processes.

The class licence explicitly cross-references and depends on multiple other statutory instruments and standards. Understanding who has the decisive authority and what legal materials govern compliance requires reading it alongside the Radiocommunications Act 1992, the Telecommunications Act 1997, the Radiocommunications Equipment (General Rules) 2021, and the ARPANSA standard.

Radiocommunications Act 1992

• The class licence is made under s 132 of the Radiocommunications Act 1992 (s 3). The instrument’s substantive prohibitions and references rely on the Act for enforcement and definitions. The instrument refers to s 197 of the Act (note to s 10) as the statutory provision addressing conduct that causes substantial interference, disruption or disturbance. Many expressions used in the instrument are defined in the Act (s 5 Note 1 lists ACMA, apparatus licence, equipment rules, radiocommunication, radiocommunications device, receiver and transmitter). Thus the instrument is not self-contained; the Act supplies definitions, enforcement powers and penalties.

Telecommunications Act 1997

• The instrument incorporates obligations under instruments made under s 376(1) and s 407(1) of the Telecommunications Act 1997 (s 11(1)-(3)). Instruments under s 376(1) set requirements for devices (standards etc.), and instruments under s 407(1) may impose labelling and other requirements on manufacturers/importers of customer equipment. In practice that means the Telecommunications Act’s instruments determine technical compliance and labelling obligations for customer equipment; a person operating customer equipment under this class licence must ensure the manufacturer/importer complied with s 407(1) instruments and that the device itself complies with any relevant s 376(1) instrument.

Radiocommunications Equipment (General Rules) 2021 and the standards/equipment rules transition

• The instrument recognises the legal transition on 17 June 2021, when Part 4.1 of the Radiocommunications Act was replaced and "standards" were replaced by "equipment rules" (s 11(4)-(5) and the related notes). For device compliance day occurrences before that transition date, the applicable obligations arise from the standards regime; for device compliance days on or after that date, the equipment rules regime applies. The instrument specifically references the Radiocommunications Equipment (General Rules) 2021 as imposing prohibitions and obligations in relation to equipment possession, operation and supply (see note under s 11(4)(b)). Compliance assessment therefore requires checking the version of the equipment rules or pre-2021 standards applicable at the device compliance day.

ARPANSA standards and public-health law

• The instrument adopts the ARPANSA Radiation Protection Standard (2021) as the ARPANSA standard (s 5(1)). Section 11(6) ties permissible operation to compliance with the ARPANSA general public exposure limits in places accessible by the public. This interaction injects a public-health regulatory standard into the radiocommunications compliance mix. If ARPANSA replaces the 2021 standard with a later standard, the instrument automatically adopts the later standard (s 5(1)(b)).

ACMA Act determinations and defined expressions

• The instrument notes that other expressions used may be defined in a determination under subsection 64(1) of the Australian Communications and Media Authority Act 2005 that applies to the instrument, including "Act", "PTS licence" and "station" (s 5 Note 2). That means certain cross-referenced terms may be fixed by ACMA determinations, which in turn can affect how the class licence applies.

Statutory interpretation and continuing-force clauses

• References to other legislative instruments are references to those instruments "as in force from time to time" (s 6(a)), and references to other kinds of instruments or writings are similarly dynamic (s 6(b)). This design means that the class licence is intentionally forward-looking: changes to the VRs, equipment rules, Telecommunications Act instruments, or ARPANSA standards will change the compliance landscape for devices operating under the class licence.

Practical legal interaction consequences

• Operators must navigate at least three regimes to establish compliance: the Radiocommunications Act for authorisation and interference rules; the Telecommunications Act instruments for device labelling and product-specific requirements; and the equipment rules/standards (plus ARPANSA) for technical and exposure limits. The instrument does not displace or rewrite those regimes; rather, it places the class licence permission subject to them. Because of s 5(6) (no condition limits another), operators must satisfy all applicable duties concurrently.

What the instrument does not change in other Acts

• The instrument does not purport to alter apparatus licences, PTS licences, or the substantive rights those licences confer. It restricts class-licensed operation to communicating with PTS devices and to following frequency authorisations set by PTS licences (s 9). Any conflict between apparatus licence rights and this class licence would likely be resolved by reference to the Act and the specific licence terms; the instrument does not rewrite those allocations.

The instrument contains limited internal amendment history in its text; it primarily records a repeal and notes a statutory transition that affects which technical regime applies.

Repeal of the 2014 class licence

• Section 4 expressly repeals the Radiocommunications (Cellular Mobile Telecommunications Devices) Class Licence 2014 [F2014L01794]. The instrument therefore replaces the 2014 class licence as the operative class licence governing cellular mobile telecommunications devices. The text does not include any other amendment history or earlier versions.

Transition from standards to equipment rules

• The instrument records the regulatory transition that occurred on 17 June 2021. It instructs that devices with device compliance days on or after 17 June 2021 must be operated so as not to contravene prohibitions or obligations in equipment rules, as in force on the device compliance day (s 11(4)(b)). For devices with device compliance days between 1 March 2003 and before 17 June 2021, compliance with standards as in force on the device compliance day remains the applicable test (s 11(4)(a)). This dual-path test preserves continuity across the policy change where "standards" were replaced by "equipment rules" in the statutory architecture (s 11(5) and the note stating Part 4.1 of the Act was replaced on 17 June 2021).

ARPANSA standard update provision

• The instrument defines "ARPANSA standard" to include the 2021 ARPANSA Radiation Protection Standard and any later standard published by ARPANSA as a replacement (s 5(1)(a)-(b)). This clause automates adoption of future ARPANSA replacements, effectively making the public exposure limits dynamic without requiring instrument amendment each time ARPANSA revises the standard.

Dynamic references to other instruments

• Section 6 provides that references to other legislative instruments are to those instruments as in force from time to time, and other referenced instruments or writings are likewise to be read as in force or existing from time to time (s 6). This has the practical effect of absorbing later amendments to external instruments without the need to amend the class licence for each change.

What the instrument does not record

• The instrument does not provide a legislative history of prior amendments other than the 2014 repeal. It does not list modifications made between 2014 and 2024, nor does it record explanatory memoranda or ministerial second-reading statements in the text provided. To trace a fuller amendment history or policy evolution would therefore require consulting the Federal Register of Legislation, ACMA records, and the explanatory materials associated with this instrument’s registration.

Practical implication for users

• The automatic-adoption clauses and the explicit post-2021 equipment rules pathway mean that the substantive technical obligations placed on device operators and manufacturers/importers will change whenever ARPANSA or the relevant equipment rules or Telecommunications Act instruments are updated. Businesses and compliance teams must therefore monitor changes in those external instruments rather than expect the class licence itself to be the locus of future amendments.

The text of the class licence provided contains no litigation history, case references, or judicial decisions. The instrument itself does not cite any court decisions, nor does it name any cases. The only statutory cross-references are to the Radiocommunications Act 1992 (for authority and offence provisions), the Telecommunications Act 1997 (for labelling and device requirements), the Radiocommunications Equipment (General Rules) 2021 (note), and the ARPANSA standard (2021) as the technical public exposure standard (s 5(1); s 11(4) note).

What the instrument records about legal enforcement

• The instrument references s 197 of the Radiocommunications Act (note to s 10) concerning conduct that results in substantial interference and signals the ACMA’s general position that it will not afford protection from interference to communications involving devices operated under the class licence (note to s 10). These are statutory and administrative statements, not judicial holdings.

How to find litigation and precedents relevant to the class licence

• Because the instrument makes compliance dependent on the Radiocommunications Act, the Telecommunications Act instruments, equipment rules and ARPANSA standards, litigation relevant to the practical application of this class licence would likely arise under those statutes or in disputes where ACMA enforcement decisions are challenged. The instrument itself does not list any such decisions. Researchers seeking litigation history will need to search ACMA enforcement records, administrative appeals to the Administrative Appeals Tribunal (where applicable), federal court decisions involving the Radiocommunications Act or Telecommunications Act and any case law that interprets s 197 or equipment rules. The instrument does not supply those materials.

Absence of judicial shaping in the instrument

• The instrument is a legislative instrument: its text reflects regulatory policy and legal requirements, but it does not incorporate judicial interpretations. Without court decisions quoted, the instrument’s provisions must be read against primary legislation and any case law interpreting those primary instruments. For practical compliance advice or litigation risk assessment, practitioners must therefore examine relevant case law under the Radiocommunications Act and Telecommunications Act separately from this instrument.

The instrument contains several drafting and structural features that produce compliance traps or operational surprises if not read carefully. These are concrete points where downstream actors commonly misread class licences.

1. Right to operate is conditional and strictly limited to PTS communications (s 7(1); s 8)

• The licence authorises operation only to communicate with a PTS device (s 7(1) and s 8). Operators cannot lawfully use class-licensed devices for other purposes. Failure to construe "communicate" in line with the instrument’s definition (s 5(2)) can result in unauthorised operation. The definition depends on the operator’s design or intent, so incidental reception or broadcasting that was not intended as communication with a PTS device may not be covered.

2. Class licence does not authorise licensed devices (s 7(2))

• Operators sometimes assume a class licence replaces the need for apparatus licences. It does not. If a device requires an apparatus licence, this class licence does not authorise its operation (s 7(2)). Operating a device that is a licensed device under the class licence would be outside the instrument’s permission.

3. Frequency alignment is determined by the relevant PTS licence (s 9)

• Receivers must operate only on frequencies on which operation of the PTS transmitter is authorised (s 9(1)), and transmitters must operate on frequencies specified for the PTS receiver by the relevant PTS licence (s 9(2)(b)). A PTS licence authorises transmitters but may still specify receiver frequencies (note to s 9). Practically, operators must check the specific PTS licence terms; they cannot rely on general band permissions alone.

4. Device compliance day can shift the applicable compliance regime (s 5 definition; s 11(4))

• Device compliance day is the later of the manufacture date (if manufactured in Australia), import date (if imported), or the date of a material alteration in Australia (s 5 definition). If a device is materially modified in Australia, the device compliance day may be the date of the modification, which can move the device into a different compliance regime (standards vs equipment rules). Installers and parties that modify devices can inadvertently change which rules apply.

5. Two parallel technical regimes: standards vs equipment rules (s 11(4)-(5))

• Devices with compliance days before 17 June 2021 are tested against standards as in force on that date (s 11(4)(a)); devices with compliance days on or after that date are judged by equipment rules as in force on the device compliance day (s 11(4)(b)). Practitioners must check the correct temporal test; applying the wrong standard/equipment rules can lead to a mistaken compliance conclusion.

6. Manufacturer/importer obligations affect operator rights (s 11(1)-(3))

• The class licence makes operation of customer equipment contingent on manufacturer/importer compliance with Telecommunications Act instruments. Operators should insist on manufacturer/importer evidence of compliance; otherwise, operation is not permitted under the class licence. This upstream dependency can be a contractual and due-diligence issue in procurement.

7. ARPANSA public exposure limits apply in places accessible by the public (s 11(6); s 5(1))

• The obligation to ensure electromagnetic emissions do not exceed ARPANSA general public exposure limits applies in publically accessible places. Operators deploying groups of devices (for example, small-cell networks, distributed equipment) must consider aggregate emissions and the locations where the public might be exposed.

8. ACMA will generally not afford protection from interference (note to s 10)

• This administrative caveat materially reduces practical protection for class-licensed operations. Operators should not assume regulatory recourse to obtain spectrum protection against other users. In contexts where interference risk is material, apparatus licences or other forms of protection might be necessary.

9. No condition in Part 3 limits any other (s 5(6))

• Operators must satisfy all Part 3 conditions concurrently. Treating any one condition as primary and sacrificing compliance with others is not supported by the instrument’s text.

10. Dynamic incorporation of other instruments (s 6)

• The instrument references other legislative instruments "as in force from time to time" (s 6). Compliance obligations can therefore shift without amendment to this class licence. Active compliance monitoring of ARPANSA, equipment rules, the Radiocommunications Equipment (General Rules) 2021 and Telecommunications Act instruments is required.

11. Gaps in the instrument’s enforcement detail

• The instrument does not list penalties or administrative processes. Practitioners must consult the Radiocommunications Act, the Telecommunications Act, and ACMA enforcement policies to identify specific sanctions and procedures.

12. Intent matters for "communicate" (s 5(2))

• Because "communicate" is defined by design or intent, evidence of operator intent (technical design choices, documentation, marketing, configuration) can be decisive if a compliance question arises. Operators should document the intended use-case and confirm frequency authorisations in writing.

These points are documentable and concrete from the instrument’s text and should shape procurement, installation, labelling checks, frequency planning, and risk assessments.

Compliance requires integrating the class licence conditions with upstream manufacturing/import and downstream operation. Below are practical, source-grounded steps keyed to the instrument’s provisions (ss 5-11).

1. Confirm the legal basis for operation

• Verify that the device will be used only to communicate with a PTS device. The class licence authorises operation to communicate with a PTS device (s 7(1)) and forbids operation otherwise (s 8). Document the intended communication counterpart as a PTS device and retain evidence (contracts, technical design documents, PTS licence references).

2. Check whether the device is a "licensed device"

• Confirm the device is not a licensed device (an apparatus-licensed device). The class licence does not authorise operation of licensed devices (s 7(2)). If the device requires an apparatus licence, obtain that licence instead.

3. Establish the device compliance day

• Record the device compliance day per s 5(1) definition: the later of (a) manufacture day (if manufactured in Australia), (b) import day (if imported), or (c) the day it was materially altered or modified in Australia. If the device will be materially modified or updated in Australia, record the date and reassess applicable standards/equipment rules because a material alteration may reset compliance obligations.

4. Determine the applicable technical regime (standards or equipment rules)

• If the device compliance day is on or after 17 June 2021, check the equipment rules as in force on that day and ensure the device’s operation would not contravene prohibitions or obligations in those equipment rules (s 11(4)(b)). If the device compliance day is between 1 March 2003 and before 17 June 2021, ensure compliance with any applicable standards as in force on the device compliance day (s 11(4)(a)). Consult the Radiocommunications Equipment (General Rules) 2021 and any relevant schedules or parts referenced by the instrument.

5. Verify Telecommunications Act requirements for customer equipment

• If the device is customer equipment, obtain written confirmation from the manufacturer or importer that they complied with each requirement imposed by any instrument under s 407(1) of the Telecommunications Act 1997 (labelling and related obligations) (s 11(1)). Also confirm the device itself complies with any requirements imposed under an instrument under s 376(1) of that Act (s 11(2)). Retain certificates, declarations of conformity, test reports, labelling evidence, and import documentation to demonstrate compliance.

6. Align frequencies with the relevant PTS licence

• For receivers, operate only on frequencies where the PTS transmitter they communicate with is authorised by the relevant PTS licence (s 9(1)). For transmitters, ensure the transmitter communicates with a PTS receiver and operates on a frequency specified for that PTS receiver by the relevant PTS licence (s 9(2)(a)-(b)). Obtain and archive the relevant PTS licence documents, frequency assignments and any station specifications.

7. Prevent interference and understand limited ACMA protection

• Design deployments to avoid causing interference (s 10). Given the instrument’s note that ACMA will generally not afford protection from interference for communications involving class-licensed devices, implement technical mitigations: spectrum planning, guard bands, power control, directional antennas and site engineering to reduce likelihood of interference. Consider whether an apparatus licence or other regulatory protection is necessary where interference risk is material.

8. Ensure emissions meet ARPANSA exposure limits

• For single devices or groups of devices, confirm that electromagnetic energy emitted does not exceed the ARPANSA general public exposure limits in places accessible by the public (s 11(6); s 5(1) defines ARPANSA standard). Use accredited testing to produce reports that demonstrate compliance with the ARPANSA limits, including cumulative exposure assessments for groups of devices.

9. Maintain documentation and change control

• Because many obligations depend on device compliance day and on external instruments that operate "as in force from time to time" (s 6), maintain robust records: manufacture/import dates, dates of any material alteration, conformity declarations, test reports, labelling evidence, PTS licence copies, and any equipment rules/standards applied. Implement change-control procedures to detect when a device modification would reset compliance obligations under s 5(1).

10. Contractual due diligence with suppliers

• Make manufacturer/importer compliance a contractual condition. The class licence conditions make operator use of customer equipment contingent on manufacturer/importer compliance with Telecommunications Act instruments (s 11(1)). Contractual warranties and hold-harmless provisions should confirm upstream compliance and provide remedies if labelling or product-standard conformance is deficient.

11. Monitor regulatory updates

• Because the instrument dynamically incorporates other instruments and standards as they change (s 6), subscribe to updates from ACMA, ARPANSA and relevant equipment rules and Telecommunications Act instruments. Where possible, obtain manufacturer evidence that devices remain compliant after regulatory changes.

12. Consider insurance and operational risk mitigation

• Given ACMA’s usual non-protection stance for these class-licensed devices (note to s 10), consider operational insurance and redundancy strategies to manage risk from interference that cannot be cured administratively.

13. Where protection is required, seek apparatus licences

• If operations require protection from interference, the class licence may not be appropriate. Determine whether obtaining an apparatus licence, or negotiating PTS licence terms, is necessary to secure the needed regulatory protections.

14. Legal review before deployment

• Have legal and technical counsel review deployment against the Radiocommunications Act, the Telecommunications Act instruments, equipment rules/ standards and ARPANSA limits to ensure full compliance. The class licence is an enabling instrument but compliance is multi-layered.

Following these steps, anchored directly in ss 5-11 and their notes, provides a practical compliance path. Documentation of intent, technical conformity, frequency authorisation, and manufacturer/importer compliance is the central compliance strategy the instrument requires.
