Radiocommunications (Allocation of Transmitter Licences – High Power Open Narrowcasting Licences) Determination 2024

Key legal and operational concepts are defined and used throughout the instrument. Several definitions and structural rules materially change how parties prepare and how the ACMA manages allocations.

HPON licence: The instrument defines HPON licence by reference to transmitter maximum power and the area in which the transmitter operates: more than 1 watt if in a “residential area” and more than 10 watts in a “non-residential area” (section 5, “HPON licence”). The residential/non-residential distinction is tied to the ABS geographic designations; “residential area” is the area bounded by a line 20 kilometres outside an urban centre or locality (section 5). The instrument also references the Broadcasting Services Act 1992 definition of “open narrowcasting service” (section 5, “open narrowcasting service” and note).

Licence Allocation Exercise: For contests (two or more registered applicants at the close), ACMA must conduct a Licence Allocation Exercise, a procedure with auction-like mechanisms: ACMA may set an opening price not exceeding the reserve price, provide bidding numbers or log-on details, accept bids at or above any opening price, terminate the exercise if no bids meet the reserve and ACMA is satisfied no likely bids will occur, determine disputes and set re-start prices, and close when satisfied no further bids will be made (sections 16, 17, 21 and 22).

Reserve price and opening price: ACMA must set a reserve price in writing before or at the closing date for applications; the opening price, if any, may be set by ACMA and must not exceed the reserve price (sections 10 and 22(2)-(3)). The notes state that if Part 5 applies (only one registered applicant), the reserve price becomes the total price for the licence (section 10 note; see Part 5 provisions).

Acknowledgement and payment obligations: A successful applicant must, within 10 business days after becoming successful, lodge a written acknowledgment as prescribed (section 23) and pay the winning price within 10 business days after the Licence Allocation Exercise was closed (section 25). For sole applicants, the successful applicant must pay the reserve price and lodge the specified acknowledgement on or before the day notified under section 28(d) (section 29). Failure to lodge the acknowledgement or pay within required time causes the successful applicant to cease to be the successful applicant (sections 24, 25(2), 30).

Indemnity and guarantees: Every application must be accompanied by an indemnity deed executed by the applicant indemnifying ACMA against losses or costs arising from the applicant’s or authorised agent’s act, default or omission during the allocation (section 11(1)(d)(i)). Where the applicant is a company or incorporated association, a deed executed by a director or office-bearer guaranteeing the applicant’s obligations under the indemnity is required (section 11(1)(d)(ii)).

ACMA discretion and protections: ACMA can terminate a proposed issue at any time before issue (section 33) and must refund any part of reserve or winning price paid if it terminates the issue (section 34). ACMA must not issue a licence if inconsistent with the spectrum plan or a frequency band plan (section 36). ACMA may appoint agents to perform administrative tasks, receive payments and conduct Licence Allocation Exercises (section 42).

Timing rules and interpretation of “day”: A “day” is taken to end at 5pm in the Australian Capital Territory unless section 38 provides otherwise (section 5(2)). “Business day” excludes Saturdays, Sundays, and public holidays in the ACT, NSW or Victoria (section 5). Extensions may be granted by ACMA (section 38).

These main concepts structure who may apply, how contests are run, what paperwork and payments are required, and how ACMA may exercise discretion during and after allocation.

This Determination primarily affects three groups: applicants (individuals, companies and incorporated associations), authorised agents acting for applicants, and the ACMA as regulator and allocating authority. Secondary impacts exist for persons who will hold issued HPON licences and for the Commonwealth’s revenue and tax collection practices.

Applicants

• Individuals and corporate entities may apply for one or more HPON licences, but only one application per licence is permitted and a separate application is required for each licence (section 13(1)(a)-(c); 13(1)(b)). Companies and incorporated associations must nominate at least one authorised agent before the application closing date for the application to be accepted (sections 13(2)(c) and 15(4)(a)). Applicants must pay an application fee (section 13(2)(b); section 9 defines the charge as fixed under subsection 60(1) of the Australian Communications and Media Authority Act 2005). The applicant pays any application fees, reserve price or winning price, and bank charges are not to reduce the net payment (section 12(4)).

Companies and incorporated associations

• They have extra procedural burdens: guarantee of the indemnity deed must be executed by a director or office-bearer (section 11(1)(d)(ii)); an authorised agent must be nominated before the closing date (section 15(4)(a)); if a company fails to nominate an agent the application will not be accepted (section 13(2)(c) note). Where the applicant is a company, the guarantee exposes directors/office-bearers to contingent obligations tied to the indemnity.

Authorised agents and contact persons

• An authorised agent may bid on behalf of an applicant and complete lodgement obligations if the applicant becomes successful (section 15(1)(a)-(b)). Evidence of identity for persons bidding must be produced to ACMA on the day the Licence Allocation Exercise is to commence (section 21(2)(a)(i)). Notices to applicants are taken to be given if given to an applicant’s authorised agent or contact person specified in the application (section 39(1)). Agents may be appointed, changed and must be nominated within specified timelines (section 15(4)).

ACMA

• ACMA is the decision-maker: it decides to invite applications (section 7), sets the reserve price (section 10), notifies commencement times and bidding procedures (section 18), receives payments and documents, determines disputes during Licence Allocation Exercises (section 22(6)), may terminate issue at any time (section 33), must refund payments when it terminates (section 34), and may appoint agents to conduct the process on its behalf (section 42). ACMA also has enforcement rights to recover damages (section 41).

Other entities and public finances

• Holders of issued licences will be liable for any transmitter licence tax imposed under relevant tax Acts as noted (sections 26 and 31 notes referencing the Radiocommunications (Transmitter Licence Tax) Act 1983 and the Radiocommunications Taxes Collection Act 1983). The Commonwealth receives application fees and winning/reserve prices; the instrument provides ACMA authority to accept and hold these funds (section 42).

Spectral stakeholders and broadcasting ecosystem

• The Determination only applies where the ACMA has made a section 34 determination declaring spectrum available for open narrowcasting providers (section 7). Thus broadcasters, existing spectrum licensees and those affected by frequency allocation and band plans are indirectly affected because issuance is constrained by consistency with spectrum and frequency band plans (section 36).

The practical effect is to concentrate obligations, timing and financial exposure on applicants and their authorised agents, while concentrating decision and discretion with ACMA.

This Determination imposes precise duties on applicants and on ACMA, and preserves rights for ACMA to exercise discretion and to recover losses. The following are the operative duties and the rights they generate.

Duties on the ACMA

• Publish a notice inviting applications on its website when the instrument applies (section 8(1)-(2)), and update the notice if information becomes incorrect (8(3)-(4)). Notices must contain location, nominal frequency or channel, section 34 determination details, closing date/time, application fee and how to obtain information packages (section 8(2)(a)-(h)).
• Set the closing date/time for applications before publishing the notice (section 8(5)) and may vary closing date/time prior to closing (section 8(6)).
• Maintain a register of applicants whose applications comply and have been accepted (section 14(1)-(3)).
• Set, in writing, the reserve price for each licence at or before the closing date/time (section 10).
• Where contests arise (Part 4), conduct the Licence Allocation Exercise and give at least 10 days’ notice of the commencement time and bidding procedures to registered applicants (sections 17, 18(1)-(2)). ACMA may hold multiple allocation exercises on a single day (section 17(2)).
• Determine disputes during Licence Allocation Exercises, and decide whether to continue, terminate or continue under a re-start price (section 22(6)).
• Issue a licence to a successful applicant as soon as reasonably practicable after the applicant complies with acknowledgement and payment obligations, unless issue is terminated or licence is inconsistent with spectrum/frequency plans (sections 26, 33, 36).

Duties on applicants

• Lodge an application that complies with the approved form and provide required information including contact details, nominated contact person and identification of the licence sought (section 11(1)(a)-(c)).
• Provide an indemnity deed executed by the applicant; if a company, provide a deed by a director/office-bearer guaranteeing performance under the indemnity (section 11(1)(d)(i)-(ii)).
• Pay the prescribed application fee (section 13(2)(b); section 9).
• If a company or incorporated association, nominate an authorised agent before the closing date (section 15(4)(a); 13(2)(c)). Agents must be nominated within prescribed timelines and can be changed subject to time limits (section 15(4)(b)-(d)).
• If bidding, produce evidence of identity on the day the Licence Allocation Exercise is to commence and use the bidding number or unique log on details provided by ACMA (section 21(2)-(3)).
• If successful at auction, lodge the written acknowledgment within 10 business days after becoming successful and pay the winning price within 10 business days after the exercise closed (sections 23 and 25(1)). For sole applicants, pay reserve price and lodge the acknowledgement on or before the day notified under section 28(d) (section 29).
• Ensure payments are made in Australian currency and by electronic transfer or electronic bill payment (section 12(1)-(2)). Evidence of transfer must be provided so the ACMA receives funds within defined time frames (section 12(3)).

ACMA rights and applicant liabilities

• ACMA may terminate proposed issue anytime before issue (section 33) and must refund payments if it does so (section 34).
• ACMA may refuse to issue a licence inconsistent with spectrum/frequency band plans (section 36).
• ACMA may recover damages from successful applicants for non-compliance with acknowledgement or payment obligations, including amounts exceeding the winning price (section 41). The indemnity deed is an applicant’s contractual duty to indemnify ACMA for losses caused by the applicant or authorised agent (section 11(1)(d)(i)).

Rights preserved for applicants

• Registered applicants have rights to be notified, to bid (if applicable), to withdraw applications before commencement time (section 19), and to a reasonable opportunity to alter applications if ACMA publishes corrected information (section 8(4)(b)). If ACMA decides to conduct a new Licence Allocation Exercise after termination, registered applicants generally continue in registration without having to re-apply or pay another fee (section 35(3)(c)). However, where a former successful applicant failed to comply with payment/acknowledgement obligations, ACMA may bar that former successful applicant from reapplication (section 35(6)).

These duties and rights create a high‑compliance, time‑sensitive process: ACMA centralises procedural control while applicants bear financial exposure, documentation obligations, and personal guarantees in the corporate applicant context.

The Determination itself does not create criminal offences or set out express monetary penalties; rather, enforcement is largely contractual and administrative, coupled with ACMA’s discretion and rights to recover damages and to refuse issue. The principal enforcement mechanisms are:

Loss recovery and damages

• ACMA retains the right to seek damages from a successful applicant, including amounts greater than the winning price, where the applicant fails to comply with the acknowledgment or payment obligations (section 41). The instrument explicitly preserves ACMA’s right to recover damages for failure by the successful applicant to comply with section 23 or 29, or failure to pay the winning price (section 41(a)-(b)).

Contractual remedies via indemnity and guarantee

• Each application must be accompanied by an indemnity deed executed by the applicant that gives ACMA an indemnity against any loss or costs arising from acts, defaults or omissions by the applicant or its authorised agent during an allocation (section 11(1)(d)(i)). For companies or incorporated associations, a director or office-bearer must execute a deed guaranteeing performance under the indemnity (section 11(1)(d)(ii)). These instruments create contractual bases for ACMA to enforce compensation obligations in the event of applicant-caused loss.

Forfeiture of successful applicant status

• Failure to lodge the prescribed acknowledgment (section 23) results in the successful applicant ceasing to be the successful applicant (section 24). Failure to pay the winning price within 10 business days after the Licence Allocation Exercise closed causes the successful applicant to cease to be the successful applicant at the end of that tenth business day (section 25(2)). For a sole applicant under Part 5, failure to pay the reserve price or lodge the acknowledgment by the notified day causes the successful applicant to cease to be the successful applicant (section 30).

Administrative refusal and reoffer consequences

• ACMA must not issue a licence if inconsistent with spectrum or frequency band plans (section 36). ACMA may terminate the issue at any time prior to issue (section 33) and must refund any part of reserve or winning prices paid if it does so (section 34). If ACMA re-publishes a notice and the former successful applicant failed to comply with payment/acknowledgement obligations, the former successful applicant ceases to be registered and may not reapply for the licence (section 35(5)-(6)).

Auction procedural powers

• During Licence Allocation Exercises, ACMA may set opening prices, re-start prices, determine disputes, continue or terminate exercises and close exercises when satisfied no further bids will be made (section 22). These procedural powers enable ACMA to control the allocation timetable and to halt allocations where reserve prices are not met or for dispute resolution.

Payment compliance measures

• Payments must be in Australian currency by electronic transfer or electronic bill payment and must include bank charges so that net amounts received equal the amounts due; if bank charges reduce net payment below the amount due, payment is not made in full (section 12(1)-(4)). ACMA’s right to require evidence of timely payment and to treat late receipt as non-payment are enforcement means to ensure compliance with payment timelines (section 12(3)).

Tax consequences

• The notes to sections 26 and 31 remind that transmitter licence tax is imposed under the Radiocommunications (Transmitter Licence Tax) Act 1983 and collected under the Radiocommunications Taxes Collection Act 1983. While not a penalty, tax obligations are an additional financial consequence of being issued a licence.

Overall, the enforcement architecture is administrative and contractual: the ACMA relies on contract (indemnity and guarantees), payment timing rules, the mechanism of forfeiting successful applicant status, and the prospect of damages recovery to enforce compliance. There are no express criminal penalties or licence suspension provisions in the Determination itself.

This Determination sits within a regulatory network and expressly cross-references or depends on several Commonwealth Acts and instruments. The instrument makes multiple cross-references and preserves constraints from other legal instruments.

Radiocommunications Act 1992

• The Determination is made under subsection 106(1) of the Radiocommunications Act 1992 (section 3). It operates in the context of the Act’s transmitter licence regime; for example, references to “transmitter licence”, “spectrum plan” and “frequency band plan” are defined in the Act (section 5 note). The Determination also invokes subsection 103(1) and 103(2) ideas about licence commencement and duration in prescribing that licences issued under the instrument must commence on the issue day and must specify duration as the shorter of the section 34 period or 20 years (section 37).

Broadcasting Services Act 1992

• The Determination applies only where ACMA has made a determination under subsection 34(1) of the Broadcasting Services Act that a specified part of the radiofrequency spectrum is available for allocation to providers of open narrowcasting services (section 7). The meaning of “open narrowcasting service” is the meaning given in section 18 of the Broadcasting Services Act (section 5).

Australian Communications and Media Authority Act 2005

• The application fee is the charge fixed by ACMA under subsection 60(1) of the Australian Communications and Media Authority Act 2005 (section 9). The Determination thus links procedural costs to ACMA’s charging powers under that Act and notes the Radiocommunications (Charges) Determination 2022 as the then-applicable charging instrument.

Corporations Act 2001

• The Determination uses the Corporations Act definitions of “company” and “foreign corporation” when addressing which entities require guarantees and agent nominations (section 5, “company”).

Acts Interpretation and Legislation Acts

• Section 6 makes standard interpretative references to other legislative instruments “as in force from time to time” and signals reliance upon the Acts Interpretation Act 1901 and the Legislation Act 2003 for Commonwealth Act cross-references and application (section 6 notes).

Radiocommunications (Transmitter Licence Tax) Act 1983 and Radiocommunications Taxes Collection Act 1983

• The instrument notes that the issue of a transmitter licence attracts tax under the Radiocommunications (Transmitter Licence Tax) Act 1983, collected under the Radiocommunications Taxes Collection Act 1983; the holding that licence holders will be liable for transmitter licence tax appears in the notes to sections 26 and 31.

Statistical Geography instruments

• Definitions of “urban centre” and “locality” reference ABS Statistical Geography: Volume 3 - Australian Standard Geographical Classification (ASGC) Urban Centres/Localities, 2001 (section 5 notes). That choice fixes the geographic baseline used to determine “residential area” for HPON thresholds.

Interaction principles and constraints

• The Determination preserves the primacy of spectrum planning and band plan consistency: ACMA must not issue a licence that is inconsistent with the spectrum plan or a frequency band plan (section 36). This operates as a substantive limit beyond the Determination’s administrative mechanics.

Instrument hierarchy and repeal

• The Determination repeals the 2014 Determination (section 4) and provides that references to other legislative instruments are to those instruments as in force (section 6). It therefore updates previous procedural rules and operates within the current legislative framework without purporting to amend the Radiocommunications Act itself.

In short, the Determination is an ACMA procedural instrument that implements allocation processes within the constraints of the Radiocommunications and Broadcasting Services Acts, interacts with ACMA’s charging powers, imposes contractual obligations on applicants consistent with company law definitions, and leaves tax consequences governed by separate tax Acts.

The instrument itself records a narrow legislative history in its text. The explicit amendment action taken by it is:

• Repeal: The Radiocommunications (Allocation of Transmitter Licences - High Power Open Narrowcasting Licences) Determination 2014 (F2014L00426) is repealed by this instrument (section 4).

Other recorded status items in the instrument

• The Determination contains commencement and registration rules: it commences at the start of the day after registration on the Federal Register of Legislation (section 2). It is made under subsection 106(1) of the Radiocommunications Act 1992 (section 3). The instrument provides notes directing readers to the Federal Register of Legislation and ABS material on classifications (section 2 note; section 5 notes).

No further amendments or historical changes are recorded within the provided text. The instrument does not include an amending schedule, transitional provisions beyond repealing the 2014 Determination, or savings clauses that preserve rights, licences or processes established under the earlier instrument. The absence of transitional provisions in the text means that any transitional arrangements would need to be located elsewhere (for example, in ACMA guidance or separate instruments), but the instrument itself does not create or state any such transitional measures.

Because the Determination operates by reference to Acts and other instruments “as in force from time to time” (section 6), subsequent amendments to those external instruments (for example to the Radiocommunications Act, Broadcasting Services Act, ACMA charging determinations, or ABS classifications) will affect how this Determination operates without direct amendment to the Determination itself.

The only express historical link recorded is the repeal of the 2014 Determination. Any other amendment history, prior drafts, consultation materials or legislative debates are not contained in the instrument text provided and therefore are outside the instrument’s recorded amendment history.

The Determination text contains no references to litigation, judicial decisions or precedential administrative decisions. It does not mention any cases, appeals, or tribunal matters. The instrument preserves ACMA’s rights to recover damages (section 41), but it does not specify dispute resolution pathways beyond ACMA’s in-exercise dispute determinations during Licence Allocation Exercises (section 22(6)). There is no statutory appeal route provided in the Determination’s text for allocation decisions, issuance refusals, or termination decisions; the Determination confines itself to procedural rules and contractual/administrative consequences.

Because the source contains no litigation history, none can be reported from the Determination itself. Practitioners should look to external sources, case law on ACMA administrative decisions, judicial review of syndicated allocation processes, and contract enforcement for indemnities and guarantees,to identify relevant judicial treatment. The Determination does not purport to limit judicial review under general administrative law, but it does not set out appeal mechanisms or privative clauses. Any litigation risks therefore arise from enforcement of contractual obligations (indemnity, guarantees, damages claims), ACMA’s exercise of discretionary powers (termination, dispute determinations, pricing), and issues of consistency with spectrum or frequency band plans.

In short, the instrument contains no litigation record. For litigation history relevant to these allocation processes, consult court and tribunal records, ACMA decisions, and any reported disputes concerning prior Determinations; none of those are cited or summarised in the provided text.

The Determination contains a number of timing, procedural and contractual traps that applicants and their advisers must notice and manage. These are concrete operational risks created by the text.

1. Strict timing and definitions of “day” and “business day”

• A day ends at 5pm ACT unless section 38 is engaged (section 5(2)). “Business day” excludes public holidays in the Australian Capital Territory, New South Wales or Victoria (section 5, definition of business day). Deadlines anchored to “business days” or “days” will therefore operate to ACT time and using a tri‑state public holiday calendar. Missing the 10 business day acknowledgement/payment windows (sections 23, 25) will result in the successful applicant ceasing to be the successful applicant (sections 24, 25(2)).

2. Payment mechanics and bank charges

• Payments must be in Australian currency and by electronic transfer or electronic bill payment (section 12(1)-(2)). If bank charges reduce the net payment below the amount due, ACMA treats the amount as unpaid (section 12(4)). Practically this requires applicants to add any bank fee to the transfer; failure to do so is treated as non-payment and may lead to losing the successful applicant status (sections 25(2), 30).

3. Indemnity deed and director guarantee for companies

• Every application must carry an indemnity deed executed by the applicant and, for companies or incorporated associations, a guarantee executed by a director or office-bearer (section 11(1)(d)). Directors and office-bearers should be aware they are providing a contractual guarantee tied to indemnity obligations; this is a non-trivial personal exposure generated by the administrative allocation process.

4. Nomination and timing of authorised agents

• Companies must nominate at least one authorised agent before the closing date for their application or ACMA must not accept the application (section 13(2)(c) and section 15(4)(a)). Changing nominations has timing constraints (section 15(4)(b)-(d)). Unprepared nominees or lapses in nomination windows can disqualify corporate applicants.

5. Successful applicant is not the same as licence holder until issue

• The Determination emphasises that being the highest bidder or the sole applicant does not itself entitle the applicant to a licence (section 23(b)-(c); section 29(ii)-(iii)). ACMA may refuse to issue if inconsistent with spectrum or frequency band plans (section 36) or may terminate the proposed issue at any time (section 33). Thus winners can expend effort and money and still not obtain an issued licence.

6. ACMA’s wide procedural discretion

• ACMA can set reserve and opening prices (sections 10, 22), terminate Licence Allocation Exercises when satisfied no likely bids will be made (section 22(5)), determine disputes and set re-start prices (section 22(6)). This discretion creates uncertainty around allocation pacing, pricing and dispute outcomes.

7. Refunds limited to ACMA termination

• If ACMA terminates the issue, it must refund paid sums (section 34). The Determination does not require refunds in other circumstances (for example, if a successful applicant defaults and ACMA reoffers the licence), and former successful applicants who default may be barred from reapplying (section 35(6)). The instrument therefore creates exposure if an applicant’s bid is disqualified or default causes re-offer,recoverability of funds may be limited.

8. Reserve price becomes total price for sole applicant

• The note to section 10 states that if Part 5 applies (only one registered applicant), the reserve price becomes the total price for the licence. For sole applicants that may be a material cost that must be paid by the notified day (section 29(a)).

9. Licence commencement and duration constraints

• ACMA must not set the licence commencement later than the issue day (section 37(1)), and must specify the shorter of the remainder of the section 34 determination period or 20 years as the licence duration (section 37(2)). Applicants must be aware that any expected longer term may be cut by the section 34 timeframe.

10. Evidence of identity and bidding access on exercise day

• Bidders must produce identity evidence on the day the Licence Allocation Exercise is to commence and use the bidding number/log on details provided by ACMA (section 21(2)-(3)). Failure to produce ID or use the provided credentials will preclude bidding.

11. Register and unique registration numbers

• ACMA assigns unique registration numbers and maintains a register of accepted applicants (section 14). The Determination prescribes that one application only per licence is accepted (section 13(1)(b)), so mistakes in identifying licence reference numbers or errors in the application form risk misapplication or rejection.

12. Tax and incidental costs

• Notes to sections 26 and 31 identify transmitter licence tax obligations under separate Acts. Applicants should account for tax liabilities beyond the winning/reserve price. The Determination is silent on allocation of incidental costs; the indemnity shifts some potential costs to applicants.

These “gotchas” are procedural and financial. They translate into real-world risks: missed deadlines can eliminate success; bank transfer mistakes can suffice to forfeit licences; director guarantees can create personal obligations; ACMA discretion can change outcomes. Each is grounded in the cited sections.

Compliance under this Determination requires coordinated legal, financial and operational steps before, during and after application and allocation. The following is a practical compliance checklist mapped to the instrument’s provisions.

Pre-application and application stage

1. Confirm scope: Ensure ACMA has made a section 34 determination covering the spectrum part and period and that ACMA has decided to invite applications under this instrument (section 7). Obtain and review the section 34 determination for its time limits and geographic/frequency parameters.

2. Monitor ACMA notice: Regularly check ACMA’s website for the notice under section 8. The notice will describe the proposed geographic location, the nominal carrier frequency or channel, section 34 determination details, closing date/time, application fee and information package access procedures (section 8(2)(c)-(h)).

3. Prepare application materials: Use the ACMA-approved form (if any) available on its website and ensure the application includes applicant name and contact details, nominated contact person, and identification of the HPON licence sought (section 11(1)(a)-(c)). For each licence, make a separate application (section 13(1)(c)).

4. Indemnity and guarantee (section 11): Have the indemnity deed executed by the applicant and, for companies or incorporated associations, obtain a deed executed by a director or office-bearer guaranteeing the applicant’s performance of the indemnity. Get legal advice on the indemnity scope and the guarantee’s implications for directors/office-bearers.

5. Nominate authorised agent(s): If the applicant is a company or incorporated association, nominate an authorised agent in writing before the closing date (section 15(4)(a)). If you intend to change nominations, observe the timing constraints (section 15(4)(b)-(d)). Consider nominating more than one authorised agent (section 15(5)) but provide separate nominations for each.

6. Pay application fee correctly: Identify the fee set by ACMA under the ACMA Act (section 9). Make payment by electronic transfer or electronic bill payment and ensure that bank charges are added so the net received equals the required fee (section 12(1)-(4)). Obtain and retain evidence of payment showing the date/time of the transfer.

7. Note reserve price timing: ACMA must set the reserve price at or before the closing date/time in writing (section 10) and will notify successful sole applicants of the reserve price and payment deadline under Part 5 (section 28). If you are the only applicant, treat the reserve price as the total price you must pay if you proceed (section 10 note; section 29).

Registration and pre‑auction steps 8. Confirm registration: ACMA must accept and register applications that comply with section 11 and payment and agent requirements (section 13(2)). After acceptance ACMA will register the applicant and allocate a unique registration number (section 14(2)),record this number.

9. Read and act on ACMA notices: If ACMA varies commencement times or corrections are published, it must give registered applicants notice and provide reasonable opportunity to alter applications if the change materially affects the application (sections 8(3)-(4) and 18(2)-(3)). Respond within the timeframes.

Preparation for bidding/sole applicant payment 10. Identity documents for bidders: On the day the Licence Allocation Exercise is to commence, bidders and authorised agents must produce evidence of identity to ACMA and use the bidding number or unique log on details provided (section 21(2)-(3)). Prepare certified ID and have it available at short notice.

11. Manage funds for winning/reserve price: Ensure liquidity for the winning price (contested allocation) or the reserve price (sole applicant path). For contested allocations, be ready to pay the winning price within 10 business days after the Licence Allocation Exercise closes (section 25(1)). For the sole applicant route, pay the reserve price and lodge the acknowledgment by the date ACMA specifies (section 29). Plan transfers to ensure ACMA receives funds within the three-business-day buffer for evidence-based transfers (section 12(3)).

12. Add bank charges/duties: In transfers, include bank charges and insurance for intermediary fees so that the net funds received by ACMA equal the required amounts (section 12(4)). Retain transfer receipts and proof of instructions.

During the Licence Allocation Exercise (if contested) 13. Use provided bidding credentials: Bid only using the bidding number or unique log in details provided by ACMA (section 21(3); section 22(4)). Follow ACMA bidding instructions supplied at least 10 days before the commencement time (section 18(2)(b)).

14. Expect ACMA procedural decisions: ACMA may set an opening price (not exceeding reserve) (section 22(2)-(3)), determine disputes and set a re-start price (section 22(6)), and close or terminate the exercise when satisfied no further bids will be made (sections 22(5), (8)-(9)). Factor this uncertainty into bidding strategy and legal advice.

Post-allocation and issue 15. Lodge the acknowledgement on time: Successful applicants must lodge the written acknowledgment within 10 business days after becoming successful (section 23). The required content is explicit; ensure the acknowledgment meets the elements in section 23(a)-(e) or section 29(b) for sole applicants.

16. Pay the winning/reserve price on time: Ensure the winning price is paid by the 10-business-day deadline following the Licence Allocation Exercise closure (section 25(1)). For sole applicants, pay the reserve price by the day notified in section 28(d) (section 29).

17. Track issuance conditions: ACMA must not issue licences inconsistent with the spectrum plan or frequency band plan (section 36) and may terminate the proposed issue anytime before issue (section 33). Be prepared for ACMA to delay or refuse issue and, in the event ACMA terminates, seek the prescribed refund (section 34).

Administration and risk management 18. Keep documented proof of all communications and payments: Given the tight deadlines and ACMA’s ability to treat payments as unpaid where net funds are reduced by charges (section 12(4)), maintain robust payment records and all ACMA correspondence.

19. Protect directors and office-bearers: If acting for a company, ensure guarantees are properly negotiated and understood. Consider legal advice and possible indemnity insurance to manage contingent exposures created by the guarantee under section 11.

20. Plan for tax liability: Account for transmitter licence tax under the Radiocommunications (Transmitter Licence Tax) Act 1983 as part of the project economics (notes to sections 26 and 31).

21. Prepare contingency plans: Because ACMA can terminate or reoffer licences and because failure to comply with payment/acknowledgement can bar reapplication (section 35(6)), establish contingency procedures including escrow arrangements for funds, pre-authorised payments, and internal sign-off processes to meet 10-business-day deadlines.

22. Consider contractual protections with agents: Ensure nomination forms for authorised agents comply with ACMA’s form if published (section 15(2)-(3)), and implement written agency agreements to govern bidding strategy, payment responsibilities, and indemnities between applicant and agent.

23. Validate technical compatibility: Confirm that the intended transmitter use would be consistent with the applicable spectrum plan and frequency band plan before bidding, because inconsistency will preclude issue (section 36).

Following these steps, aligned to the cited sections, will materially reduce the common compliance failures the Determination’s text creates: missed deadlines, payment shortfalls, defective documentation and guarantee exposures.
