9D Incumbent digital radio broadcasting licensees

Incumbent digital commercial radio broadcasting licensee (1) For the purposes of this Act, if: (a) the licensee of a commercial radio broadcasting licence held the licence at the commencement of this section; and (b) the licence was not allocated under subsection 40(1) of the Broadcasting Services Act 1992; the licensee is an incumbent digital commercial radio broadcasting licensee. Incumbent digital community radio broadcasting licensee (2) For the purposes of this Act, if the licensee of a designated community radio broadcasting licence held the licence at the commencement of this section, the licensee is an incumbent digital community radio broadcasting licensee.
