#### 71A Issue of spectrum licence taken to be an acquisition of an asset and conduct (1) For the purposes of the provisions of the Competition and Consumer Act 2010 mentioned in subsection (2), the issue of a spectrum licence to a person is taken to be: (a) an acquisition by the person of an asset of another person; and (b) conduct engaged in by the person. (2) The provisions of the Competition and Consumer Act 2010 are: (a) section 50 and subsection 81(1); and (b) the remaining provisions of that Act, to the extent that those provisions relate to section 50 of that Act; and (c) the acquisitions provisions (within the meaning of that Act). (3) Subsection (1) does not apply to the issue of a spectrum licence under section 77C. (4) An acquisition to which paragraph (1)(a) of this section applies is not required to be notified under Division 2 of Part IVA of the Competition and Consumer Act 2010.
