#### 118PB Eligibility for appointment (1) An individual is not eligible to be appointed by a person (the first person) in accordance with a requirement covered by paragraph 118PA(2)(a) if the individual is an officer, employee or agent of: (a) the first person; or (b) another person who is in a position to exercise control of the digital radio multiplex transmitter licence concerned; or (c) a company, where another person is in a position to exercise control of the company and the digital radio multiplex transmitter licence concerned. Application of control rules (2) Schedule 1 to the Broadcasting Services Act 1992 applies for the purposes of paragraphs (1)(b) and (c) in a corresponding way to the way in which it applies for the purposes of Part 5 of that Act.
