113Contravention of conditions

#### 113 Contravention of conditions (1) If a person: (a) is the holder of an apparatus licence; or (b) has been authorised under section 114 in relation to an apparatus licence; the person must not contravene a condition of the licence. Civil penalty: 100 penalty units. (2) Subsection (1) does not apply if the person has a reasonable excuse. > Note: A defendant bears an evidential burden in relation to the matter in this subsection (see section 96 of the Regulatory Powers Act).
