RADIOACTIVE ORES AND CONCENTRATES (PACKAGING AND TRANSPORT) REGULATIONS 1980

These Regulations are subordinate legislation made under the Radioactive Ores and Concentrates (Packaging and Transport) Act 1980 (the Act). They set out the procedural and administrative machinery without which the licensing regime in the Act could not function. They do not create new substantive obligations to package or transport material in a particular way; instead they prescribe the forms, record-keeping requirements, reporting formats, and fees that operationalise the Act.

Mechanically, the Regulations achieve six things. First, they require that applications for licences to transport or store radioactive material be made in the forms set out in the Schedule. An owner or agent who wishes to transport material must use Form 1; a person who intends to use premises he occupies for storage must use Form 2. Second, they prescribe the licence forms themselves: Form 3 for transport and Form 4 for storage. Those forms include blank condition fields, meaning the Chief Inspector can attach bespoke conditions to each licence. Third, they specify the records a transport licensee must keep: for each load, the dates, nature and quantity of material, departure and destination, route, names of transporter and vehicle driver, and vehicle registration number, as well as copies of licences and details of agents appointed. Fourth, they specify the records a storage licensee must keep for material received and removed, including condition of containers and packaging. Fifth, they set the fee for a copy of any code, rule, specification or regulation adopted under section 25(1) of the Act at 23 revenue units. Sixth, they prescribe the forms for reports on the operation of a licence (Form 5 for transport, Form 6 for storage) and allow a company to have its application or report signed by the person in control of the company in the Northern Territory.

The Regulations do not themselves prohibit unlicensed transport or storage, nor do they set penalties. Those are the province of the parent Act. The Regulations are purely facilitative and compliance-oriented. They shift the administrative cost of licensing onto the applicant and licensee, who must fill out forms, keep detailed records, and report periodically. The scope is limited to the Northern Territory. The Regulations came into force on 1 August 1980 and as at 1 January 2010 had been amended once in relation to the fee in regulation 6. The fee was updated from an unspecified earlier amount to 23 revenue units by the Fees and Charges Amendment Regulations 2009. The forms still refer to the year "19" in the date field, which is a drafting legacy that may cause confusion if the forms are still in use unchanged.

The Regulations rely on the Act for key definitions, but several concepts appear directly in the text. Radioactive material is the subject of the licensing regime: the Act applies to radioactive ores and concentrates, and the Regulations refer to "radioactive material" consistently. A licence to transport radioactive material and a licence to store radioactive material are the two categories of authorisation. The forms make clear that a transport licence is issued to the owner of the material (not necessarily the carrier), while a storage licence is issued to the occupier of the premises. An owner is the person who owns the radioactive material; an agent may act on the owner's behalf under section 9 of the Act. The Chief Inspector is the issuing authority named in the forms and the recipient of applications and reports.

The concept of prescribed records is central. Regulation 4 requires a transport licensee to keep a record of each load: the dates transport began and ceased, nature and quantity of material, place of departure and destination, route, names of transporter and person in charge of the vehicle, and vehicle registration number. The licensee must also keep copies of each licence granted under the Act and the names and dates of appointment of each agent and deputy agent. Regulation 5 imposes more extensive record-keeping on storage licensees, covering material received and removed, including the condition of containers and packaging at receipt, the period of storage, and the transport details of the vehicle. These records are separate from any operational log required by the Act or by conditions on the licence.

The concept of adopted code appears in regulation 6. Section 25(1) of the Act allows the Minister to adopt codes, rules, specifications and regulations relating to the packaging and transport of radioactive material. The prescribed fee of 23 revenue units is the price a person must pay to obtain a copy of any such adopted instrument. Revenue units are a unit of measurement defined in Northern Territory legislation (likely the Fees and Charges Act) and adjusted periodically, so the dollar amount changes over time. The fee was last amended by the Fees and Charges Amendment Regulations 2009.

The forms themselves introduce the concept of conditions on a licence. The licences (Forms 3 and 4) have blank fields for conditions, implying that the Chief Inspector has discretion to impose tailored requirements. The report forms (Forms 5 and 6) require details of delays or accidents (for transport) or damage to packaging (for storage). The concept of is addressed in regulation 8: only the person in control of the company in the Northern Territory may sign applications, notices or reports. This limits who can bind the company for regulatory purposes and avoids ambiguity about authority.

The Regulations directly affect three categories of persons: owners of radioactive material, occupiers of premises used for storage, and their agents. An owner who wishes to transport radioactive material within or through the Northern Territory must hold a licence under the Act. The Regulations require that owner (or his agent) submit an application in Form 1. If the owner is a company, the application must be signed by the person in control of that company in the Northern Territory. That person may be a director, manager or other officer with authority, but the Regulations do not define "person in control". The same signature requirement applies to notices and reports. This creates a compliance risk for companies: if the person in control is absent or difficult to identify, the company may be unable to submit a valid application or report.

Occupiers of premises who intend to store radioactive material must apply using Form 2. The applicant must provide details of the location, owner of premises, nature of occupation, description of storage premises, and security arrangements. This places a burden on the occupier to describe and maintain security measures that satisfy the Chief Inspector. The occupier is also responsible for keeping the storage records prescribed in regulation 5, including recording the condition of containers at receipt and the transport details of incoming and outgoing vehicles.

Transporters and carriers are affected indirectly. Although the licence is issued to the owner (not the carrier), the transport records require the licensee to record the name of the person transporting the load and the person in charge of the vehicle, as well as the vehicle registration number. That means the owner must obtain and retain that information from the carrier, and the carrier must provide it. If the carrier changes between trips, the records must reflect that. The person in charge of the vehicle is a natural person, so the licensee must know who was driving on each leg.

The Chief Inspector is affected as the recipient of applications, the issuer of licences, and the recipient of reports. The Regulations prescribe the forms he must use, but they give him significant discretion to impose conditions on licences. The fee for copies of adopted codes is set at 23 revenue units, but the Chief Inspector must supply those copies upon request and payment.

The Regulations also affect anyone who wants to access an adopted code. The fee may be a barrier for small operators or individuals who need to understand the technical requirements for packaging and transport. The 23 revenue unit fee is not trivial; at current revenue unit values it could be tens of dollars per copy, and the code may be lengthy.

The Regulations impose specific duties on licensees. A person licensed to transport radioactive material must keep the records listed in regulation 4 for each load transported. These records must include the dates transport began and ceased, the nature and quantity of the material, the place of departure and destination, the route taken, the name of the transporter and the person in charge of the vehicle, and the vehicle registration number. The licensee must also keep copies of each licence granted under the Act and a record of each agent and deputy agent appointed under section 9 of the Act. These records are not filed with the Chief Inspector unless a condition of the licence requires them to be reported; they are simply to be kept by the licensee. The duty is ongoing, lasting for the duration of the licence and presumably for any statutory retention period under the Act or general law. Failure to keep the records would be a breach of a regulatory requirement, and the Act likely makes such failure an offence.

A person licensed to store radioactive material has a broader duty under regulation 5. For any material received at the licensed premises, the licensee must record the date received, nature and quantity, name of owner, name of transporter and person in charge of the vehicle, vehicle registration number, and the condition of the containers and packaging. For material removed from the premises, the licensee must record the date removed, nature and quantity, name of owner, period stored, destination, transporter and person in charge, vehicle registration number, and condition of containers and packaging. The condition of containers is a subjective assessment, raising potential disputes if later damage is discovered. The licensee must also keep a copy of each licence granted under the Act.

Licensees may be subject to a condition requiring them to report on the operation of the licence. Regulation 7 prescribes the form of report: Form 5 for transport licensees and Form 6 for storage licensees. The report must include details of material transported or stored since the last report, place and destination, delays or accidents (for transport), damage to packaging (for storage), and names of persons who transported material. The reporting duty only arises if the licence is subject to such a condition; not all licences will have it. The Chief Inspector may impose this condition on some licences and not others, creating an asymmetry in compliance burden.

Licensees have the right to apply for a licence using the prescribed forms. They also have the right to request a copy of any code adopted under section 25(1) of the Act upon payment of 23 revenue units. The Chief Inspector must provide that copy, presumably within a reasonable time. Companies have the right to have applications, notices and reports signed by the person in control of the company in the Northern Territory, as an alternative to requiring a director's signature from interstate. This simplifies compliance for companies with a local presence.

The Regulations do not themselves prescribe penalties. They are subordinate legislation under the Act, and the Act must contain the penalty provisions for breaches of the Regulations. Typically, a regulation-making power allows a breach of a regulation to be an offence with a specified penalty, but the text of these Regulations does not include penalty units. The parent Act likely creates offences for transporting or storing radioactive material without a licence, for failing to comply with a condition of a licence, and for failing to keep records as required. The Regulations would be read as imposing duties, and the Act would provide the enforcement mechanism.

Enforcement is likely the responsibility of the Chief Inspector, who may conduct inspections of transport loads and storage premises. The records required by regulations 4 and 5 must be kept and could be inspected. Failure to keep accurate records could result in prosecution. The Forms 5 and 6 reports, if required by a licence condition, would also be enforceable; submitting a false report could lead to charges of providing false or misleading information, possibly under the Act or under general criminal law.

The fee regulation (regulation 6) does not impose a penalty; it merely sets a price. However, if a person pays the fee and the Chief Inspector fails to provide the copy, the person would have a contractual or administrative law remedy, but the Regulations do not specify a penalty for non-provision.

The Regulations do not empower the Chief Inspector to suspend or cancel a licence. That power would be in the Act. Nor do they specify appeal rights. A person aggrieved by a refusal to grant a licence, or by conditions imposed, would need to look to the Act or to general administrative law for judicial review.

The enforcement posture is therefore that the Regulations create strict record-keeping and reporting duties, and the Act backs them up with penalties. The absence of penalty amounts in the Regulations means any reader must cross-reference the parent Act to understand the financial or custodial consequences of non-compliance. This is a typical division between substantive provisions in an Act and procedural machinery in regulations.

These Regulations are part of a regulatory framework specific to the Northern Territory and to radioactive ores and concentrates. They sit under the Radioactive Ores and Concentrates (Packaging and Transport) Act 1980 (NT). That Act would define terms such as "radioactive material", "owner", and "Chief Inspector". The Regulations fill in the administrative details. The Act likely also addresses packaging requirements, liability for damage, and enforcement powers. The two instruments must be read together.

On a federal level, the transport of radioactive materials is subject to the Australian Nuclear Science and Technology Organisation Act 1987 (Cth) and the Australian Radiation Protection and Nuclear Safety Act 1998 (Cth). The Australian Radiation Protection and Nuclear Safety Agency (ARPANSA) issues codes and standards, including the Code for the Transport of Radioactive Material based on International Atomic Energy Agency regulations. The Northern Territory Act adopts codes, rules, specifications and regulations under section 25(1), and the Regulations set the fee for obtaining copies of those adopted instruments. This means the substantive technical standards for packaging and transport are likely set by documents adopted from time to time, not by the Regulations themselves. A transporter or storekeeper must obtain and comply with those adopted codes, and the 23 revenue unit fee is the price of access.

The Regulations also interact with dangerous goods transport laws. The Road Transport Reform (Dangerous Goods) Act 1995 (Cth) and related NT legislation apply to the transport of dangerous goods by road. Radioactive materials are a class of dangerous goods. The package and labelling requirements under dangerous goods laws may overlap or impose additional obligations. A licence holder under these Regulations still needs to comply with road transport legislation, including driver licensing, vehicle standards, and incident reporting. The Regulations do not purport to override those laws; they add the specific NT licensing layer for radioactive ores and concentrates.

Work health and safety laws, including the Work Health and Safety (National Uniform Legislation) Act 2011 (NT) (if in force by 2010, though it replaced earlier legislation), impose duties on persons conducting a business or undertaking to manage risks from hazardous chemicals, including radioactive materials. The storage premises must comply with those duties in addition to the licence conditions and records under these Regulations. The condition of containers recorded at receipt (reg 5(a)(vi)) may serve as evidence for WHS purposes if a leak or contamination occurs.

The Radioactive Ores and Concentrates (Packaging and Transport) Regulations 1980 (SL No. 30, 1980) were notified in the Northern Territory Government Gazette on 1 August 1980 and commenced on that same date. This was a single instrument that created the entire regulatory scheme as originally made. The Regulations have been amended infrequently.

The first and only amendment reflected in the text as at 1 January 2010 is the Fees and Charges Amendment Regulations 2009 (SL No. 34, 2009), notified 14 December 2009 and commenced 1 January 2010. That amendment changed regulation 6, which prescribes the fee for a copy of an adopted code. The fee was amended from an unspecified previous amount to 23 revenue units. The word "revenue units" indicates a statutory indexation mechanism, so the actual dollar amount fluctuates. The amendment was made by regulation 10 of the amending instrument. No other regulations were amended at that time.

The endnotes to the reprint also record that the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) made general amendments of a formal nature to regulation 1 (citation) and the Schedule. Those amendments would have updated the citation heading and possibly the Schedule formatting to conform to modern legislative drafting standards. The text as at 1 January 2010 does not yet reflect the 2018 amendments; they are noted only as prospective. The reader using this version must be aware that later formal amendments may have changed the citation or schedule layout.

There is no indication that the Regulations have been repealed. They appear to remain in force as at the date of the reprint (1 January 2010). Given the age of the Act and the specific subject matter (radioactive ores and concentrates, which are primarily of interest to uranium mines in the NT), it is possible that the Regulations have been superseded by newer instruments or that the Act itself has been amended to change the regulatory approach. However, the source provided does not indicate any later repeal or substitution.

The lack of frequent amendment suggests that the administrative requirements have remained stable for decades. The forms still use the year placeholder "19", indicating they were designed in the 1980s and have not been updated. This is a sign of regulatory inertia rather than active management.

The source provides no reference to any court cases involving these Regulations. Given the narrow subject matter and the fact that the Regulations are purely procedural, litigation directly on their terms would be unlikely. Disputes would more likely arise under the parent Act: challenges to the refusal or revocation of a licence, disputes over conditions, or prosecutions for transporting without a licence or failing to keep records. In any such proceeding, the Regulations would be relevant as setting out the required forms and record-keeping standards.

If a person were charged with an offence under the Act for failing to keep records, the court would need to determine whether the records kept satisfied the requirements of regulations 4 or 5. That could involve interpretation of terms like "condition of the containers" or "route taken". It is conceivable that a transport operator might argue that the route was not recorded because it varied from the planned route, but the regulation requires the actual route taken. That could be litigated.

The requirement that a company's application or report be signed by the "person in control of that company in the Northern Territory" could also generate litigation if a signature is challenged as unauthorised. The Regulations do not define "person in control", so a court might need to construe that phrase. It could mean the company's sole director resident in the Northern Territory, or the manager of the local branch, or anyone with actual authority to bind the company. No published case law appears to have settled this.

The fee regulation (23 revenue units for a copy of an adopted code) could be challenged if the adopted code is not made reasonably available. But again, no cases are reported.

The absence of litigation history is itself informative: it suggests that the Regulations operate without significant controversy, that the industry is small, or that disputes are resolved administratively. Lawyers advising clients in the NT uranium sector should still treat the Regulations as potentially subject to judicial interpretation, especially if the Chief Inspector takes a strict view of the record-keeping or reporting obligations.

Several traps await the unwary licensee or advisor. First, the forms in the Schedule still use "19" as the year in the date fields. As at 1 January 2010, a licensee filling out an application or report would need to cross out "19" and write "20" and the appropriate year. It would be easy for a signatory to absent-mindedly write the wrong year or to use a pre-printed form that still says "19" without correction. That could render the document defective if the Chief Inspector rejects non-compliant forms. The Regulations do not say that immaterial errors can be corrected. A prudent licensee should modify the forms before use.

Second, the record-keeping obligations for storage licensees (regulation 5) require recording the condition of containers "in the load and the packaging of the radioactive material" at the time of receipt. This is a subjective assessment. If damage is later discovered, the licensee may be unable to prove whether it existed on arrival unless the condition was described in detail. Vague statements like "good condition" could be challenged. The regulation does not prescribe a minimum standard of description. To avoid disputes, a licensee should adopt a more rigorous system, such as photographs or a checklist.

Third, the transport record-keeping obligation under regulation 4 includes recording "the route taken between the place of departure and the destination". If the driver deviates from the planned route (for example, due to road closures or detours), the licensee must ensure the actual route is recorded. This is easy to overlook if the licensee relies on the carrier to provide the route. The carrier may not report deviations, or may report a generic route. The licensee remains responsible for keeping an accurate record. Failure to record the actual route could be a breach.

Fourth, the report forms (Forms 5 and 6) require details of delays or accidents. The form does not define "delay". A minor mechanical stop might not be considered a delay, but a cautious operator should report any unplanned stop that affects the transport timeline. The Chief Inspector could take a broad view. Similarly, "damage to packaging" on Form 6 requires the licensee to report damage at receipt. If the damage is minor, the licensee may be tempted not to report it, but the form is mandatory if the licence condition requires a report.

Fifth, the signature requirement for companies (regulation 8) is narrow: only "the person in control of the company in the Northern Territory" may sign. If that person is absent, ill, or leaves the company, there may be no one authorised to sign an application or report. The company would need to appoint a new person in control (perhaps a local manager) before submitting documents. This could cause delays if the Chief Inspector requires immediate reporting. The Regulation does not allow delegation to an employee who is not in control.

Compliance begins with determining whether an activity requires a licence. Any person who owns radioactive material and wishes to transport it within the Northern Territory must apply for a licence to transport. The applicant must be the owner (or an agent of the owner). An occupier who intends to store radioactive material on premises he occupies must apply for a licence to store. The application must be made to the Chief Inspector using Form 1 (transport) or Form 2 (storage), as set out in the Schedule. The forms require the applicant's name and address, the owner's details, agent details, and comprehensive information about the proposed transport or storage: nature and quantity of material, method of transport, vehicle description, route, security arrangements, and estimated period. For storage, the applicant must describe the premises and security arrangements. The forms must be signed; if the applicant is a company, only the person in control of the company in the Northern Territory may sign. Applications should be submitted before any transport or storage commences.

Once the licence is granted (in Form 3 or 4), the licensee must note that the licence expires 12 months after the date of issue or on an earlier date specified in the licence. The licence may include conditions; the licensee must read those conditions carefully and comply with them. The conditions may include a requirement to report on the operation of the licence. If so, reports must be made using Form 5 (transport) or Form 6 (storage) and must be submitted as often as the conditions require (likely periodic, or on request).

The licensee must keep the records prescribed by regulations 4 and 5. For transport, a record must be made for each load. The record should be prepared contemporaneously, not reconstructed later. It must include the actual dates, nature and quantity of material, actual departure and destination, actual route taken, names of the transporter and driver, and vehicle registration number. Copies of all current and past licences should be kept, as well as a list of all agents and deputy agents appointed under section 9 of the Act, with dates of appointment.

For storage, records must be kept for each receipt and each removal of material. At receipt, record the date, nature and quantity, owner name, transporter name and driver, vehicle registration, and condition of containers and packaging. A systematic inspection and description of condition is advisable, perhaps using a standardised checklist. At removal, record the same details plus the period of storage and the destination. Again, keep copies of licences.

If a licensee or any other person wants a copy of any code, rule, specification or regulation adopted under section 25(1) of the Act, they must pay a fee of 23 revenue units to the Chief Inspector. The amount should be calculated by converting revenue units to dollars using the current rate set under Northern Territory law. The request should be in writing.
