Radioactive Ores and Concentrates (Packaging and Transport) Act 1980

This Act creates a statutory regime for packaging, storage and transport of specified radioactive ores and concentrates in the Northern Territory. It does four principal things, as set out in the text.

First, it defines the scope of regulated material and the contexts covered. The Act defines “radioactive material” as uranium ores and concentrates, uranium oxide (U3O8) and any other prescribed ore or concentrate with specific activity greater than 0.002 microcuries per gram (s 3). It expressly excludes operations within mining, treatment, milling or processing sites (s 4(1)), and it exempts material with a low measured dose rate and low parent radionuclide activity (s 4(2)). The Act binds the Crown (s 4(3)).

Second, it centralises administration in a Ministerially appointed Chief Inspector and inspectors. The Minister appoints a Chief Inspector (s 5) and may direct that officer (s 5(3)). The Chief Inspector may delegate many powers to other people (s 6) and appoint inspectors (s 7(1)). Inspectors are given wide compliance and enforcement powers: entry and inspection of licensed premises and suspected storage sites, stopping, detaining and requiring weighing of vehicles, installing sampling and measuring equipment, seizure of vehicles, containers and documents where an inspector reasonably believes an offence may have been committed, and requiring names and information (s 7(2)(a)-(g)).

Third, it makes licensing and agent arrangements mandatory. Owners who intend to transport radioactive material must be licensed (ss 12-13). Occupiers who intend to store material must obtain a storage licence (ss 12-13). Licences are in a prescribed form, are subject to conditions the Chief Inspector deems necessary and normally expire at 12 months after issue unless an earlier date is specified (s 14(1)(a)-(c)). Licences can include specific operational constraints such as the vehicle, driver, route, timing and load limits (s 14(2)). Owners must appoint a natural person resident in the Territory and employed by the owner as their agent for the purposes of the Act, and must notify the Chief Inspector of the appointment (s 9).

Fourth, it establishes offence and emergency duties and penalties. Core obligations are that persons must not possess, store, package or transport radioactive material except under and in accordance with a licence and, for packaging/transport/storage, in compliance with any code, rule, specification or regulation adopted under the Act (ss 16-18). The Act sets out emergency duties on vehicle controllers and licensees in the event of accidents, delays, leakage or damage (ss 20-21). Inspectors can take immediate measures to prevent danger, require remediation work and, if necessary, do or authorise such work; costs can be recovered as a debt from the owner (s 22(2)-(3)). Penalties are specified in the Act; for many principal offences the maximum is 40 penalty units plus daily continuing penalties of 4 penalty units (ss 16-18, 20-21), with default and lesser penalties set elsewhere (s 24).

Mechanically, compliance requires: registration of owner/occupier activity through licence applications (s 12); appointment of a local employed agent and deputy where necessary (ss 9-10); observance of licence conditions (s 14); adherence to adopted codes and prescribed records (ss 18, 23); and immediate notification and cooperation with inspectors in emergencies (ss 20-22). Administrative discretion is concentrated in the Minister (directions to Chief Inspector, adoption of codes by Gazette, s 25) and in the Chief Inspector’s power to grant/cancel licences and impose operationally specific conditions (ss 5, 13-15). The Act also sets procedural features for enforcement: seizure and a 60-day retention period with possible forfeiture on conviction (s 8), service by Gazette where addresses are unknown (s 26(d)), and an evidentiary averment provision allowing the prosecutor to assert licence or ownership status (s 27).

The Act depends on subsidiary instruments for practical technical requirements: the Minister may adopt codes, rules or specifications by Gazette (s 25(1)), and compliance with those adopted instruments is an express statutory duty (s 18). That mechanical link between ministerial adoption and mandatory technical standards is a central implementation mechanism.

This Act rests on a small set of legal and operational concepts that determine regulatory reach and compliance obligations. The core concepts are “radioactive material”, licence/licensing, the agent-of-owner framework, inspectorial powers, emergency duties, codes adopted by the Minister, and enforcement mechanisms including seizure, forfeiture and civil recovery of costs.

• Radioactive material (s 3): The Act’s regulated object is expressly defined. It covers uranium ores and concentrates, and any prescribed radioactive ore or concentrate above a numeric specific activity threshold (0.002 microcuries per gram). The definition is the statutory gatekeeper: whether material falls within it determines whether licensing, packaging standards and emergency duties apply.

• Application carve-outs (s 4): The Act expressly does not apply to packaging, storage or transport within a place where mining, treatment, milling, refining or processing has been or is carried on, nor to material with total measured dose rate less than 0.75 millirem per hour at one metre and parent radionuclide activity less than 2.4 × 10^-4 curie. These are statutory exemptions that delimit regulated activity.

• Licensing (Parts III, ss 12-15): Two licence types exist in substance: transport licences for owners/agents who intend to transport radioactive material (s 12(1), s 13(a)), and storage licences for occupiers intending to store material on premises (s 12(2), s 13(b)). Licences are prescribed in form, time-limited (maximum 12 months by default, s 14(1)(c)), and subject to licence conditions the Chief Inspector deems necessary for safety (s 14(1)(b)). The power to tailor conditions is detailed: routes, vehicles, drivers, load weights/number and timing may be specified (s 14(2)(a)-(e)).

• Agent framework (Division 2, ss 9-11): An owner must appoint a natural person resident in the Territory and employed by the owner as agent for purposes of the Act before transporting material (s 9(1)). Notice and written acceptance of appointment are required (s 9(2)-(3)). Deputy agents are required where the agent will be absent for more than three days (s 10). Requirements or orders served on an agent are deemed to be served on the owner (s 11). This makes the agent the operational and legally recognised contact point for regulatory interaction.

• Inspector and Chief Inspector powers (ss 5-8, 22): Inspectors (appointed by the Chief Inspector, s 7(1)) have inspection, detention and seizure powers (s 7(2)). In emergencies inspectors and the Chief Health Officer have statutory duties to act if there is danger or environmental damage risk (s 22(1)), including compelling medical examination (s 22(4)), ordering remediation and using reasonable force to exclude people (s 22(2)(a)-(b)), and carrying out or authorising remedial work if the owner fails to act, with costs recoverable as debt (s 22(2)(c)-(3)).

The Act identifies several discrete categories of affected parties and allocates duties and liabilities among them.

• Owners of radioactive material: Owners are the primary regulated actor. They must not transport material unless they (or their agent) hold a licence authorising transport (ss 12-13), and they must appoint an agent resident in the Territory and employed by the owner before transporting (s 9(1)). Owners are criminally liable where employees, agents or contracted persons commit offences in the course of employment or contract (s 19(1)), subject to a statutory defence of having taken “all reasonable steps” to ensure compliance (s 19(2)). Owners are also debtors for costs of remedial work carried out or authorised by inspectors where the owner fails to comply with a requirement to reduce or prevent danger (s 22(3)).

• Agents and deputy agents: Agents must be natural persons resident in the Territory and employed by the owner (s 9(1)). The agent must accept appointment in writing (s 9(3)). If the agent will be absent more than three days, the owner must appoint a deputy agent and give notice; the deputy must accept in writing (s 10). Requirements or orders given to the agent are treated as given to the owner (s 11). Practically, agents are the local, legally accountable contact: inspectors may serve notices, give instructions and act on the assumption the agent represents the owner.

• Occupiers of premises: Occupiers intending to use premises for storage must apply for a storage licence (s 12(2)) and may be criminally liable for using or permitting storage contrary to licence conditions (s 17). Licence conditions may specify the premises to be used (s 14(1)(d)).

• Licensees generally: Those holding licences (owners/occupiers) are subject to licence conditions, record keeping (s 23), reporting and emergency duties (ss 20-21), and potential cancellation of licence for breach, commission of an offence or where the Chief Inspector considers cancellation necessary in the interests of safety or preventing environmental damage (s 15).

• Employees, contractors and drivers: Individuals employed by owners, agents or contractors who engage in transportation, packaging or storage are directly subject to the Act, and their acts can attract liability for their principal owner under s 19(1). Drivers and vehicle controllers have specific duties upon accident, delay or suspected leakage: notify an inspector, obey instructions, and secure the scene (s 20).

This section identifies the principal statutory duties imposed, the legal rights created or preserved, and the procedural structures for exercising those duties and rights.

Key duties

• Licensing duty: Owners who intend to transport radioactive material must apply for a transport licence (s 12(1)). Occupiers who intend to use premises for storage must apply for a storage licence (s 12(2)). A person shall not have possession, control or use premises for storage except under and in accordance with licence conditions (ss 16-17). Licences are required before activity commences.

• Agent appointment and notification: Before transporting, an owner must have an agent who is a natural person resident in the Territory and employed by the owner (s 9(1)). Appointment must be notified to the Chief Inspector with the agent’s acceptance in writing (s 9(2)-(3)). Deputies must be appointed where agents are likely absent more than three days, with similar notice and written acceptance (s 10(1)-(3)). Service on agents is service on owners (s 11).

• Compliance with codes and regulations: A person must not package, store or transport radioactive material unless the packaging, storage and transport are in compliance with any code, rule, specification or regulation adopted under s 25(1) (s 18). The Minister adopts such instruments by Gazette (s 25(1)) and may make appointments necessary for an adopted instrument (s 25(2)). The Chief Inspector must sell copies on payment (s 25(3)), indicating adoption leads to a commercial access point for the instrument.

• Emergency and reporting obligations: The person in control of a vehicle involved in an accident or delay, or where contamination or possible contamination has occurred, must notify an inspector forthwith, obey inspector instructions and take reasonable steps to prevent unauthorised access (s 20). Licensees who become aware of damage to packages on licensed premises must notify an inspector and take reasonable steps to prevent unauthorised access (s 21). Inspectors and the Chief Health Officer may require medical examination of persons believed to be in danger (s 22(4)).

• Record keeping: Licensees must keep prescribed records (s 23(1)); failure to do so is an offence (s 23(2)).

Key rights and procedural protections

• Delegation and administrative structure: The Chief Inspector may delegate functions (s 6), and inspectors operate subject to the Chief Inspector’s directions (s 7(2) preface). The Chief Inspector is subject to Ministerial direction (s 5(3)). Delegation is revocable and does not prevent exercise by the Chief Inspector (s 6(4)). These provisions allocate and control administrative power.

The Act combines criminal penalties, administrative enforcement powers and civil recovery of costs into an enforcement architecture with graduated sanctions and operational enforcement tools.

Criminal penalties

• Principal offences and maxima: The Act sets maximum penalties for core offences:

  • Possession/possession control without complying licence: maximum 40 penalty units and, in addition, 4 penalty units for each day the offence continues (s 16).
  • Use/allowing premises to be used for storage without compliance with licence: maximum 40 penalty units and 4 penalty units per day during which the offence continues (s 17).
  • Packaging, storing or transporting not in compliance with an adopted code: maximum 40 penalty units and 4 penalty units per day during which the offence continues (s 18).
  • Failure by person in control of vehicle to notify inspector, obey instructions or prevent access after accident/delay/contamination: maximum 40 penalty units and 4 penalty units per day continuation (s 20).
  • Licensee failure to notify inspector upon package damage and obey instructions: maximum 40 penalty units and 4 penalty units per day (s 21).
  • Where none other provided, default penalty is maximum 8 penalty units (s 24(2)).

• Lesser and specific penalties: Certain breaches carry lower penalties. Failure to keep prescribed records carries a maximum of 8 penalty units (s 23(2)). Failure to comply with a medical examination requirement under s 22(4) attracts a maximum penalty of 8 penalty units (s 22(4) last line). The Act therefore differentiates between higher-risk operational breaches (transport and storage non-compliance) and less severe administrative defaults.

Administrative enforcement powers

• Entry, inspection and seizure: Inspectors may enter and inspect licensed premises and any premises they reasonably believe are used for storage (s 7(2)(a)-(b)). They may stop and detain vehicles believed to be used for transport and inspect the load (s 7(2)(c)-(d)). They may require weighing at nearest available weighing facility (s 7(2)(e)). Where an inspector reasonably believes an offence may have been committed, the inspector may seize vehicles, radioactive material, packages, documents and other things relating to packaging, storage or transport (s 7(2)(g)(i)) and require persons suspected to be offenders to give names and information (s 7(2)(g)(ii)).

The Act contains several textual links to other statutory instruments and leaves room for cross-regulatory interaction. The document itself lists amendments and related legislation in the endnotes; the statutory text contains specific cross-references.

Express statutory references

• Public Sector Employment and Management Act 1993 (definition of “employee”): The Act’s definition of “employee” is tied to that other Act (s 3: “employee has the same meaning as it has in the Public Sector Employment and Management Act 1993”). That definitional link affects who may be appointed Chief Inspector and inspectors if those offices are filled by public sector employees and shapes how employment status is interpreted for owner/agent/inspector contexts.

• Chief Health Officer: The Act requires inspectors to inform the Chief Health Officer where contamination risk is suspected and empowers the Chief Health Officer, with an inspector, to require medical examination of persons believed to be in danger (s 22(1), (4)). The Act therefore presupposes a public health statutory office exists, and that office’s roles and powers will intersect in emergency responses. The endnotes list the Public and Environmental Health Act 2011 among later statutes in the territory’s legislative framework; while the Act does not stipulate procedural coordination, the statutory reference to the Chief Health Officer creates a mandated line of interaction.

Delegation, direction and administrative hierarchy

• Ministerial direction and adoption of external standards: The Minister may direct the Chief Inspector (s 5(3)) and may adopt codes, rules, specifications or regulations by Gazette that deal with packaging, storing or transporting radioactive material (s 25(1)). Those adopted instruments will become the technical standards enforced under the Act (s 18). The Minister’s adoption power creates dependence on whichever external codes the Minister chooses, and establishes interface points with other regulators where the adopted codes originate (for example, national or international transport or radiation safety standards), though the Act itself does not require particular external standards.

• Delegation to other officers: The Chief Inspector can delegate functions by instrument in writing (s 6). That mechanism allows administrative interoperation with other agencies or departments where delegated officers are placed, subject to the limitation that the delegation is revocable and the Chief Inspector remains capable of exercising the powers directly (s 6(4)).

The Act as provided includes a history of enactment and later amendments in its endnotes. The following recites the information from the source and maps amendments where the source lists them.

The presence of this Act in the endnote list indicates later reworking of cross-references to public health structures (the principal Act text references the Chief Health Officer).

The legislative text and its endnotes, as provided, do not record any judicial decisions or specific litigation arising under this Act. The Act contains procedural and evidentiary provisions that affect litigation , for example:

• Forfeiture and prosecution interplay: seized items may be retained for 60 days or until prosecution disposal (s 8(2)); on conviction the court may order forfeiture (s 8(3)). Those provisions create recurring litigation points (constitutional and property procedural) in practice, but the source does not list any decided cases.

• Averment as evidence (s 27): The Act enables prosecutors to aver licence or ownership status, an evidentiary shortcut which would shape how prosecutions are pleaded, but again no cases are cited.

• Owner liability and “all reasonable steps” defence (s 19(1)-(2)): The defence is fact-intensive and likely to generate litigation over what counts as reasonable steps in practice. The text does not identify authoritative judicial interpretation.

• Emergency powers and recovery of costs (s 22(2)-(3)): Decisions to perform remedial work and recover costs can be challenged in court in practice; the statute provides civil debt recovery but the source does not reference cases.

Because the supplied Act text contains no list of cases or litigation history, practitioners must assume they will need to search Territory case law databases and higher court reports for any decisions construing these provisions. The Act itself provides mechanisms that are likely to recur as litigation issues, but the current source does not name any reported decisions or litigation history.

The Act contains specific drafting choices and operational features that create non-obvious compliance or enforcement consequences. These “gotchas” derive directly from the statutory text.

1. Agent must be a natural person resident in the Territory and employed by the owner (s 9(1))

   • Owners without local employees cannot lawfully transport material unless they appoint a resident, employed natural person as agent. Corporations that operate only through contractors or outsourcing may have to create employed positions or otherwise change employment arrangements. Service and enforcement will be made through that agent (s 11). The Act requires written acceptance and notice to the Chief Inspector (s 9(2)-(3)).

2. Deputy agent required for short absences (s 10)

   • If an agent will be absent for more than three days, the owner must appoint a deputy agent with written acceptance and notify the Chief Inspector. The three-day trigger is short and operationally significant for owners whose agents travel frequently.

3. Licence conditions may be highly prescriptive (s 14(2))

   • The Act expressly allows licence conditions to specify vehicle, driver, route, number and weight of loads, and times for transport. A licence may therefore tightly regulate operational details that owners typically consider commercial decisions. Failure to comply with conditions exposes the licensee to cancellation (s 15), criminal penalties (ss 16-18) and daily continuing fines.

4. Code compliance is mandatory once adopted by Minister (ss 25, 18)

   • The Act does not itself provide the technical packaging/transport rules; it makes compliance with whatever the Minister adopts mandatory (s 18). The Minister adopts by Gazette (s 25(1)). There is no statutory requirement in the Act for consultation, public availability before adoption, or notice periods; practical access is controlled by the Chief Inspector selling copies for a prescribed amount (s 25(3)). That can produce a timing and access risk for operators seeking to comply.

5. Seizure on inspector’s reasonable grounds and 60-day retention (ss 7(2)(g), 8)

   • Inspectors may seize things where they reasonably believe an offence may have been committed (s 7(2)(g)(i)). Seized items can be retained for 60 days or until the prosecution is disposed of (s 8(2)). If a prosecution is not commenced within 60 days, the item must be returned (s 8(4)). Owners should be aware of potential operational disruption for up to two months if items are seized and a prosecution is commenced; conversely, retained items may be held beyond 60 days if a prosecution is timely initiated.

The Act establishes a clear pathway to lawful operation. The following practical checklist is grounded in the statutory text and aims to convert statutory duties into operational steps for owners, occupiers and compliance professionals.

1. Determine whether material falls within the statutory definition (s 3) and whether the activity is within an excluded place or below the exemption threshold (s 4)

   • Confirm that the material is “uranium ores and concentrates, uranium oxide (U3O8) or any other prescribed radioactive ore or concentrate with a specific activity greater than 0.002 microcuries per gram” (s 3).
   • If packaging, storage or transport will occur within a mining, treatment, milling, refining or processing site, the Act does not apply to those activities (s 4(1)).
   • If the total measured dose rate at one metre is less than 0.75 millirem per hour and parent radionuclide activity is less than 2.4 × 10^-4 curie, the Act does not apply (s 4(2)). Use suitably calibrated measurement equipment and retain measurement records.

2. Appoint a resident employed agent and deputy as required (ss 9-10)

   • Before transporting material, appoint a natural person who is resident in the Territory and employed by the owner as agent (s 9(1)). Prepare and retain the written appointment notice and the agent’s written acceptance, and lodge notice with the Chief Inspector (s 9(2)-(3)).
   • If the agent will be absent for more than three days, appoint a deputy agent with the same notice and acceptance formalities (s 10(1)-(3)).
   • Maintain up-to-date agent contact details and file prompt notice of any changes (s 9(4), s 10(4)).

3. Apply for and obtain the necessary licence(s) in the prescribed form (ss 12-14)

   • Owners intending to transport must apply under s 12(1) in the prescribed form; occupiers intending to store must apply under s 12(2).
   • Expect licences to be granted by the Chief Inspector (s 13). Prepare for condition-setting: the Chief Inspector may attach conditions specifying vehicle, person transporting, route, load limits, number of loads and timing (s 14(1)(b), s 14(2)(a)-(e)).
   • Licences expire at the date specified or 12 months after issue, whichever is earlier (s 14(1)(c). Prepare administrative calendars to renew licences on time.

4. Obtain and comply with any adopted code, rule, specification or regulation (ss 18, 25)
