43 Exemption for relevant tritium device

(1)  Each of the following dealings with a relevant tritium device is exempt from the operation of section 13(1) of the Act:

(a) sale of the device;

(b) acquisition of the device;

(c) possession of the device;

(d) storage of the device;

(e) transport of the device.

(2)  It is a condition of the exemption specified in subregulation (1)(a) that any person who sells one or more relevant tritium devices in any one financial year is to provide to the Director of Public Health, as soon as practicable after the end of that financial year and not later than 1 October, an annual sales report specifying the name and address of each person who purchased such a device from the vendor during that year.

(3)  A relevant tritium device is exempt from the operation of section 14 of the Act.
