Racing (Specified Race-course) Regulations 2016

The instrument rests on three core concepts: prescription, cadastral identification, and statutory cross‑referencing. Prescription: reg 5 prescribes the listed parcels as "specified race‑courses" for paragraph (b) of the definition in s 3(1) of the Racing Act 1958. This is a classical subordinate‑legislation technique where the parent Act defines an authorised category, and a regulation fills in the particulars by naming the places. Cadastral identification: Schedule 1 provides specific land identifiers. These take the form of Torrens title references (Volume and Folio), Crown allotment descriptions (Crown Allotment X of Section Y, Parish Z, County Q), and references to reservation instruments and Gazette notices with dates and page numbers. Many entries also record the stated purpose of the reservation (for example "Site for Racecourse", "Public Recreation", "Showgrounds") and whether the reservation is temporary or permanent. The Schedule sometimes states that land is "deemed to be unalienated land of the Crown temporarily reserved" in accordance with other Acts, reflecting historical statutory machinery that was used prior to later legislative changes.

Statutory cross‑referencing: the Regulations refer to external Acts and to particular provisions of other Acts. For example, Item 21 refers to the Crown Land (Reserves) Act 1978 and to s 127(3) of the Racing Act as it existed before repeal by the Gaming and Betting Act 1994. Item 42 invokes the Land Act 1958 for a deemed reservation. The endnotes and "Interpretation" material include references to the Interpretation of Legislation Act 1984 (ILA) and state that headings, punctuation and certain non‑statutory materials are treated as part of the Statutory Rule in accordance with ILA provisions. The explanatory endnotes explicitly state that explanatory memoranda, tables of provisions, endnotes and other printed material do not form part of the Statutory Rule.

Temporal mechanics are also central. The Regulations commence on a fixed date (25 September 2016, reg 3) and incorporate later amendments dated 12 September 2017 that commenced 1 October 2017 (Table of Amendments). The endnotes further indicate that the Statutory Rule will sunset 10 years after the day of making, on 13 September 2026, under s 5 of the Subordinate Legislation Act 1994. The Schedule itself records some historical temporal events relating to reservations and partial revocations, which can be relevant when reconciling title, reservation purpose and current land use.

A final concept is revocation and consolidation. Reg 4 expressly revokes the prior Racing (Specified Race-course) Regulations 2006 and their 2013 and 2015 amendment instruments. That revocation consolidates the prescription list into the 2016 instrument, with the 2017 amendment further altering the Schedule. The Regulations thereby act as both an operative list and a consolidating snapshot of the statutory prescription at the relevant times.

The Regulations affect several identifiable groups and rights‑holders through the change in legal designation of land. The primary immediate beneficiaries or subjects of the change are the bodies that operate or have an interest in the listed racecourse lands: race clubs, harness or trotting clubs, local showground committees, and other entities that use, manage or hold titles over the parcels described in Schedule 1. The Schedule identifies specific lands by Torrens title or Crown allotment, which means that titleholders, occupiers and land managers must recognise that their land is prescribed as a specified race‑course for the purposes of the Racing Act (reg 5; Schedule 1 items).

Crown entities and land managers are affected because many items are Crown reservations. The Schedule repeatedly records "Instrument and date of reservation", and the stated "Purpose of reservation" such as "Site for Racecourse", "Public Recreation", or "Showgrounds". These references identify reserves that are administered under Crown land statutes, so responsible agencies (for example the State’s land management agency or local municipal managers) will need to reconcile the prescribed status in these Regulations with existing reservation instruments. Several items explicitly state a statutory basis that interacts with other Acts (for example Item 21’s reference to the Crown Land (Reserves) Act 1978, Item 42’s reference to the Land Act 1958). Where the Schedule says a parcel is "deemed to be unalienated land of the Crown temporarily reserved", the agencies that manage Crown land must note the prescribed status.

Local government and planning authorities are indirectly affected because the designation may alter how land is treated in administrative processes, funding, community use, and planning. Although the Regulations do not themselves alter planning controls, the prescription may be material to licensing, permits or funding decisions tied to the Racing Act’s regime. Where item entries include Government Gazette notices and reservation purposes, councils should take those cadastral facts into account when handling land use applications or community events.

Participants in racing economies, trainers, jockeys, owners, suppliers, and patrons, are affected to the extent that the statutory classification triggers or enables rights, prohibitions, or regulatory standards under the Racing Act’s Division 5. The Regulations do not state those downstream effects, but by prescribing the land the instrument places those sites within the statutory framework that applies to specified race‑courses.

Finally, legal advisers, conveyancers and title searchers are affected because the Schedule relies on precise title and Gazette references. Any party undertaking transactions, licences or encumbrances involving parcels identified in Schedule 1 will need to check the listed references (Volume/Folio, Crown Allotment, Gazette page and date) and reconcile them with current titles and reservation instruments. The instrument’s endnotes also affect practitioners because they make explicit that the statutory rule will sunset on 13 September 2026, which may prompt renewal or replacement action by agencies or stakeholders prior to that date.

The Regulations themselves do not create granular duties or rights in the text beyond the act of prescription. Regulation 5 is the operative provision: it prescribes land described in items in Schedule 1 to be specified race‑courses for the purposes of paragraph (b) of the definition of "specified race‑course" in s 3(1) of the Racing Act 1958. Therefore the duties and rights triggered by this instrument are those conferred by the Racing Act 1958 and any subordinate instruments or policies that operate under Division 5 of Part I of that Act. The Regulations direct readers to that parent Act for the detailed legal consequences.

Nevertheless, the Regulations impose two practical duties on administrators and affected parties. First, the public officials who prepare and maintain land records must ensure that the Schedule’s cadastral descriptions match land title records and reservation instruments. Schedule 1 items provide detailed title or reservation references (for example "Volume 11712 Folio 416" for Ararat Racecourse, Item 1A), and many items include the instrument and date of reservation plus Gazette references. The duty of reconciliation falls on land registries, conveyancers and the agencies administering Crown land to ensure statutory prescriptions align with title records.

Second, parties who use or manage the prescribed sites must recognise and operate in a manner consistent with their status under the Racing Act. Although the Regulations do not specify licences, safety standards, or event approvals, the status of "specified race‑course" will likely connect a site with statutory regimes in the parent Act (for example access to particular regulatory exemptions, obligations to permit testing, or requirements to allow inspections), which must be complied with under the Racing Act and any relevant subordinate instruments. Practitioners must consult the Racing Act for the exact content of duties or rights tied to being a specified race‑course.

The Schedule also documents reservation purposes and whether reservations are temporary or permanent. These statements indicate that some land is reserved for public recreation or racecourse purposes and in some cases the reservation is "temporary". That difference can affect duties relating to maintenance, access and permissible uses under Crown land law. For example, a "temporary" reservation may be subject to different administrative controls and potential revocation than a "permanent" reservation. The Regulations record these facts but do not themselves create administrative procedures for changing reservation status.

Finally, the instrument creates obligations on the executive responsible for making the statute. The making of the Regulations under s 36 of the Racing Act 1958 (reg 2) means that any subsequent amendment to the list of specified race‑courses should be made under the same statutory authority and published as a Statutory Rule. The Table of Amendments shows the process used in 2017 (S.R. No. 94/2017), which illustrates the practical duty of the executive to follow the Statutory Rule process for additions or substitutions to the Schedule.

The Regulations do not include penalty provisions, enforcement mechanisms, or criminal or civil sanctioning rules within their text. The instrument is purely declaratory and cadastral in nature: reg 5 prescribes land as specified race‑courses, reg 4 revokes earlier statutory rules, reg 3 sets commencement, and reg 1 states the objective. No regulation or Schedule entry imposes a fine, prescribes an offence, or establishes an enforcement agency within this Statutory Rule. Consequently, if compliance obligations or sanctions apply to specified race‑courses, those must be identified in the Racing Act 1958,specifically in Division 5 of Part I or other relevant provisions, which are not reproduced in this instrument.

Enforcement of any duties that flow from being a specified race‑course will therefore be administered under the parent Act and any other statute that confers regulatory powers relevant to racing or land management. The Schedule’s cross‑references to other Acts (for example the Crown Land (Reserves) Act 1978, the Land Act 1958, the Survey Co-ordination Act 1958, and the Gaming and Betting Act 1994 in certain items) indicate that enforcement of reservation purposes, land management duties and title matters may sit with the agencies responsible under those statutes. But such enforcement is outside the text of these Regulations.

The absence of penalties in the Statutory Rule carries two practical consequences. First, disputes about whether an activity contravenes an obligation attached to "specified race‑course" status cannot be resolved by reference to a specific penalty in this instrument; the Racing Act must be consulted to identify any enforcement recourse. Second, the instrument’s function is administrative and declaratory; enforcement resources, inspection powers, licensing sanctions and fines, if any, remain matters for primary legislation and other subordinate instruments.

Administratively, the Registrar of Statutory Rules and public land registries have an obligation to publish and maintain the current list of prescribed racecourses. The endnotes clarify that explanatory memoranda and tables of provisions do not form part of the Statutory Rule, but that headings and punctuation do form part where authorised by the Interpretation of Legislation Act 1984 (ILA). These interpretative provisions may affect how the Regulation is read in enforcement contexts, but they do not create any separate penalties.

The Regulations operate in a nested statutory environment and expressly interact with other Victorian statutes through the way the Schedule records land titles and reservation instruments. The primary interaction is with the Racing Act 1958: reg 5 prescribes land as specified race‑courses for the purposes of paragraph (b) of the definition of "specified race‑course" in s 3(1) of that Act and for Division 5 of Part I. Therefore the substantive rights, obligations and regulatory consequences that attach to this prescribed status will depend on provisions of the Racing Act and any subordinate instruments made under that Act.

Beyond the Racing Act, Schedule 1 explicitly invokes other land statutes and historical provisions. Examples include:

• Crown Land (Reserves) Act 1978: Item 21 (Dowling Forest Racecourse) records that certain land is "deemed to be unalienated land of the Crown temporarily reserved pursuant to the Crown Land (Reserves) Act 1978 for the purposes of section 127(3) of the Racing Act 1958 as in force before its repeal by section 194(7) of the Gaming and Betting Act 1994". This demonstrates how the Schedule accommodates historic reservation machinery and links the parcel’s status to earlier statutory conceptions.

• Land Act 1958: Item 42 (Lord's Raceway) refers to land being "deemed to be unalienated land of the Crown temporarily reserved pursuant to the Land Act 1958 for the purposes of section 127(3) of the Racing Act 1958 as in force before its repeal". This cross‑reference signals that the legal character of some reserves depends on older Land Act mechanisms.

• Survey Co‑ordination Act 1958: Item 25 (Frank Ryan Raceway, Echuca) includes a reference to an Original Plan lodged in the Central Plan Office maintained under s 4 of the Survey Co‑ordination Act 1958, indicating that cadastral boundaries may be fixed by survey plans that the Schedule expects readers to consult.

• Gaming and Betting Act 1994: The Schedule notes the repeal history affecting how certain land was to be treated under prior versions of the Racing Act, for example the repeal by s 194(7) of the Gaming and Betting Act 1994. The Schedule therefore records historical legal states that may be relevant to land status and rights.

The "Interpretation" endnotes and the ILA references affect statutory reading and procedural form. The publication notes explain that headings, punctuation and examples included in a Statutory Rule made on or after 1 January 2001 form part of the rule (ILA s 36 and related provisions), and that explanatory memoranda and endnotes do not form part of the Statutory Rule. For legal practitioners, this matters when construing Schedule 1 entries and when determining whether ancillary text in the published instrument is authoritative.

The Regulations also function alongside the statutory rulemaking process. Reg 2 points to the authorising provision, s 36 of the Racing Act 1958. The Table of Amendments records the 2017 amendment instrument (S.R. No. 94/2017), which shows the usual practice of updating the Schedule by further Statutory Rules under the same authority. The endnote on sunsetting under the Subordinate Legislation Act 1994 (endnote 1) requires a separate check: because the Statutory Rule will sunset in 2026, any ongoing interaction with other laws may be contingent on re‑making or replacing this prescription list before that date.

In short, the Regulations are a cadastral overlay that interacts with the Racing Act for substantive consequences, with Crown land and land title statutes for land characterisation, and with the Interpretation of Legislation Act 1984 and the Subordinate Legislation Act 1994 for interpretative and lifecycle rules. Practitioners should trace rights and duties to the parent Act and consult title and reservation documents referenced in the Schedule when resolving legal issues.

The Regulations were made on 13 September 2016 by the Administrator of the State of Victoria with the advice of the Executive Council under s 36 of the Racing Act 1958, and they commenced on 25 September 2016 (see endnote 1 and reg 3). Regulation 4 revived the list by revoking the prior Racing (Specified Race-course) Regulations 2006 and its 2013 and 2015 amendment instruments, consolidating prescription into the 2016 instrument. The Table of Amendments records a substantive amendment made in 2017: the Racing (Specified Race-course) Amendment Regulations 2017, S.R. No. 94/2017, which was made on 12 September 2017 and commenced on 1 October 2017.

The Schedule itself includes notations that identify which items were substituted or inserted by S.R. No. 94/2017 reg 4 and its subparagraphs. For example, the text records "Sch. 1 item 1 substituted by S.R. No. 94/2017 reg. 4(1)" and indicates where items 1A, 4A, 6A, 11A and many others were inserted by the same 2017 amendment (see the Schedule notations such as "Sch. 1 item 1A inserted by S.R. No. 94/2017 reg. 4(1)"). Those marginal notes identify the exact amendment instrument and subregulation that effected each change to the Schedule. The endnote 2 in the Table of Amendments reproduces the making and commencement dates of S.R. No. 94/2017.

The publication includes a "Table of Amendments" section in the Endnotes to show that the 2017 amendment is the only amendment incorporated in this version (Version No. 002). Endnote 3 states that there are no amendments not in operation at the date of publication. Endnote 4 provides explanatory details linking revocations in reg 4 to specific prior instruments by their S.R. numbers and years.

The Statutory Rule will sunset 10 years after making, that is on 13 September 2026, pursuant to s 5 of the Subordinate Legislation Act 1994. This sunset provision means that unless a further Statutory Rule re‑prescribes the list or the parent Act is amended to remove the need for these Regulations, the prescribed list will lapse in 2026. Practically, this requires agencies and stakeholders to consider replacement or re‑establishment before that date if the legal status is to be preserved.

No other amendments or amendment instruments are recorded in this publication beyond the 2017 instrument. The Schedule marginalia identify precisely which items were added or changed by the 2017 amendment and the reg 4 subclauses responsible. For practitioners, the amendment history in the published instrument provides an auditable chain showing when and how particular parcels were first prescribed or later added.

The Regulations themselves and the published version do not record any litigation concerning their validity, interpretation, or application. The Endnotes include administrative and interpretative material, a Table of Amendments, and explanatory details, but there are no cases, court decisions, or judicial comments cited in the Statutory Rule or its Endnotes. The explanatory material explicitly states that explanatory memoranda, tables of provisions and endnotes do not form part of the Statutory Rule; they do not document litigation.

Given the narrow, cadastral nature of the instrument, prescribing land parcels as specified race‑courses, the kinds of litigation that could theoretically arise include challenges to whether a particular parcel is correctly described, disputes over reservation purpose and Crown authority, or proceedings concerning the consequences of being a specified race‑course under the Racing Act. However, there is no record of such litigation in the text provided.

Users who require litigation history should consult court databases and decisions under the Racing Act 1958, Crown land statutes, and any administrative law challenges that post‑date this Statutory Rule or relate to the 2017 amendment S.R. No. 94/2017. As published, the Statutory Rule itself contains no litigation references or judgments. The only procedural note relevant to legal contest is that the Statutory Rule was made by the Administrator with the advice of the Executive Council under s 36 of the Racing Act 1958 (endnote 1), which explains the executive provenance but does not indicate any judicial review or litigation.

Several technical and practical pitfalls arise from the form and content of the Regulations. These are the concrete issues to watch for, grounded in the text.

1. Prescription does not explain consequence. Regulation 5 prescribes land as specified race‑courses for the purposes of the Racing Act definition. The Regulations do not set out what being a specified race‑course enables or restricts. Practitioners must not assume the Regulations themselves grant licences, rights to income streams, or land use permissions , those follow from the Racing Act and potentially other statutes. The text (reg 5; Schedule 1) records designation only.

2. Cadastral form requires title verification. The Schedule uses multiple reference systems: Torrens title Volume/Folio, Crown Allotment descriptions, Order in Council dates, and Government Gazette citations. Discrepancies between the Schedule and current land registry records are possible. Users need to reconcile the Schedule entry against the current title, survey plans and reservation instruments, particularly where items refer to "deemed" reservations under earlier Acts (see Items 21 and 42).

3. Temporary versus permanent reservation. Many Schedule entries record the reservation as "temporary" or "permanent". This distinction matters for administrative control and may affect revocation, permitted uses, and grants of interests. The Schedule records the status but does not explain the legal differences between temporary and permanent reserves , that material is contained in the reservation instruments and in land statutes. Assume additional steps are needed to ascertain the operative consequences.

4. Historic statutory cross‑references. Several items incorporate language tied to older provisions of the Racing Act, the Gaming and Betting Act 1994, the Crown Land (Reserves) Act 1978 or the Land Act 1958. For example, Item 21 refers to s 127(3) of the Racing Act as in force before repeal by the Gaming and Betting Act 1994. Those historical references may complicate tracing current legal effects and require review of repeal and transitional provisions.

5. Sunset date. The endnotes state that the Statutory Rule will sunset on 13 September 2026 under the Subordinate Legislation Act 1994. That creates a hard deadline after which the prescription will lapse unless re‑made or replaced. Stakeholders should not assume permanence and should plan for re‑prescription if the legal classification must continue beyond that date.

6. No penalty or enforcement language in the instrument. Because the Regulation contains no enforcement provisions, any compliance obligations or sanctions will be located in the Racing Act or other statutes. Parties should not rely on the Statutory Rule alone to determine enforcement risk.

7. Explanatory material not part of the rule. The publication notes that explanatory memoranda, tables of provisions and endnotes do not form part of the Statutory Rule. Conversely, ILA provisions mean certain formatting elements (headings, punctuation, examples) do form part. Misreading the publication as if the endnotes were operative text could lead to error.

8. Amendment marginalia as legal trace. The Schedule contains marginal notes indicating which items were substituted or inserted by S.R. No. 94/2017 reg 4(1) and similar. Those marginal notes are useful for provenance but they are not a substitute for consulting the amending instrument for precise wording or interpretation. Users should read the amending Statutory Rule as published to confirm the exact changes.

9. Multiple stakeholders with overlapping duties. Because reservations involve Crown land, local authorities and private entities, responsibility for compliance, maintenance, licensing and funding may be split. The Regulations do not allocate these duties; that allocation is made by other statutory instruments or administrative arrangements. Parties should determine which agency manages the reserve and which statutory regime governs any particular function.

10. Survey plan dependencies. Item 25 and similar entries reference original plans lodged under the Survey Co‑ordination Act 1958. When boundaries are in dispute or non‑Torrens descriptions are used, reliance on survey plans and original plan numbers may be necessary to establish precise parcels.

These "gotchas" reflect the instrument’s technical nature and its reliance on external statutes, title records and reservation instruments. They are concrete procedural and legal points that must be addressed before treating the Schedule as a full statement of rights and duties.

Compliance with the legal change effected by these Regulations requires two parallel courses: administrative reconciliation of land records and legal alignment with duties and rights under the Racing Act and related statutes.

1. Verify cadastral references. For any parcel you manage, own or are interested in, obtain current title particulars and compare them against the Schedule entry. The Schedule uses Torrens references (Volume/Folio) and Crown Allotment descriptions together with Order in Council and Government Gazette citations. Where the Schedule lists a Volume and Folio (for example Item 1A Ararat Racecourse, "Volume 11712 Folio 416"), obtain a current title search to confirm ownership, encumbrances and whether the Schedule’s description corresponds to the extant parcel boundaries. Where the Schedule uses Crown Allotment or Gazette references, obtain copies of the Order in Council and Government Gazette notice cited to confirm reservation terms.

2. Confirm reservation status. Many schedule entries state the reservation purpose and whether the reservation is temporary or permanent. Determine which authority administers the reserve (for example the Crown land agency, local council or a trustee body) and whether any management plan, licence, lease or permit is required for activities on the site. Because the Regulations do not create operational rules, compliance will typically involve aligning site activities with the Racing Act obligations and with Crown land management rules applicable to the reservation type.

3. Trace substantive obligations to the Racing Act. The designation in reg 5 only triggers the Racing Act’s provisions. Identify the operative sections of the Racing Act 1958 , notably Division 5 of Part I and the definition in s 3(1) paragraph (b) , to understand which rights and obligations now apply. Those could include licensing, safety standards, wagering rules, or inspection powers. Do not assume obligations from the Regulations themselves; extract them from the parent Act and any subordinate instruments or statutory codes that implement Division 5.

4. Liaise with the making authority. The Statutory Rule was made under s 36 of the Racing Act 1958 by the Administrator with Executive Council advice (endnote 1). For operational clarifications, approach the agency that administered the amending process or the department responsible for racing regulation. They can confirm administrative expectations and whether any operational guidance or transitional arrangements were issued contemporaneously with the Statutory Rule.

5. Check for amendments and sunsetting. The Schedule records amendments made by S.R. No. 94/2017. Confirm whether any further amendments post‑date the version you are using. Also note the sunset date of 13 September 2026 under the Subordinate Legislation Act 1994. For long‑term planning (capital works, leases, financing), ensure the legal classification will persist beyond the sunset date by obtaining confirmation from the relevant minister or agency about intended re‑making or legislative replacement.

6. Update internal registers and contracts. Where your organisation operates a listed racecourse or enters into contracts referencing the site, update asset registers, lease schedules and statutory compliance files to reflect the site’s prescription under the Racing Act. Make contractual adjustments where necessary to reflect any statutory obligations that fall on operators of specified racecourses.

7. Engage land counsel and surveyors where boundaries or historic reservations are involved. If Schedule entries refer to original plans, "deemed" reservations under older Acts, or partial revocations noted in Gazette entries, obtain surveyor confirmation and legal advice to resolve uncertainties. These technical items can affect rights to encroachments, easements or improvements, and may matter for financing and insurance.

8. Coordinate with local government and community users. Racecourses frequently host community events and involve local councils. Ensure that event approvals, planning permits and public liability arrangements account for the prescribed status and any obligations under the Racing Act or Crown land management regimes.

9. Document reliance and due diligence. Where commercial counterparties require evidence of the site’s status, maintain certified extracts of the Statutory Rule, title searches, Order in Council and Government Gazette notices. Because the Statutory Rule uses specific citations, certified copies will be necessary to establish the legal classification for lenders, insurers and regulators.

10. Consider transitional and historical implications. Some Schedule items refer to historical legal treatments and repeals (for example references to the Gaming and Betting Act 1994). If historical rights or transitional arrangements affect current operations, review the parent Act and any transitional provisions arising from past repeals to determine whether legacy obligations or entitlements persist.

Taken together, these steps ensure that both the technical cadastral accuracy and the substantive regulatory obligations are identified and managed. The Regulations are a pointer to where duties and rights may lie; compliance requires consulting the Racing Act, title instruments, reservation documents and the agencies that administer them.
