Racing Penalties (Appeals) Regulations 1991

The central concept is the appeal against a racing penalty. The regulations distinguish between an appeal as of right (where the Act gives an automatic right to appeal) and an appeal that can be made only with the leave of the Tribunal (where permission must first be obtained). This distinction directly affects the fee structure: an as-of-right appeal attracts a fee of $284 for non-greyhound appeals and $170 for greyhound appeals, while a leave-only appeal requires no fee for the notice of appeal itself (though the application for leave to appeal costs $447 for non-greyhound and $179 for greyhound). The stay of proceedings is a separate concept: a party can pay an additional $56 to seek a stay pending appeal.

The Tribunal is the Racing Penalties Appeal Tribunal, whose Chairperson determines the form of the notice of appeal (regulation 3) and can make orders for in camera hearings (regulation 6). The Registrar is a distinct office with filing and record-keeping duties under regulation 8. The regulations refer to RWWA (the State racing and wagering authority), stewards, racing clubs, and committees as bodies that impose the penalties under appeal. The phrase determination is used for the decision being appealed, and finding comprised in or related to a determination is included in Schedule 1, meaning that ancillary findings can also be challenged in minor penalty appeals.

The Schedule 1 matters are a key concept: they are appeals that the Chairperson or a designated member may hear alone, without requiring a full panel. The Schedule sets monetary and duration thresholds: a suspension or disqualification of not more than three months, a fine of not more than $2,000, or a combination of both, as well as any disqualification of a runner (regardless of duration). This categorisation reduces the Tribunal's administrative burden for lower-stakes appeals.

Another concept is representation. Regulation 5 requires advance written notice of representation, but carves out legal practitioners from the requirement to state name and address (presumably because their identity is already known or regulated separately). The in camera hearing power is a procedural tool to ensure fairness, but it expressly does not exclude a representative of a party.

The fee schedule is updated annually through gazette notices, as shown in the compilation table. The greyhound racing fees are lower than all other racing fees, reflecting a deliberate policy choice. The transcript is available at $4 per page, a fixed fee that has been amended over time.

The regulations directly affect four main groups. First, persons who have been penalised under the rules of racing in Western Australia: trainers, owners, jockeys, drivers, bookmakers, and other licence holders who have received a suspension, disqualification, fine, or runner disqualification. Any such person who wishes to exercise a right of appeal or to seek leave to appeal must comply with these regulations. The fee differential means that greyhound racing participants face lower costs than thoroughbred, harness, or other racing participants. For a greyhound trainer appealing a three-month suspension, the leave application costs $179 and the notice of appeal (if as of right) costs $170, compared with $447 and $284 respectively for other racing. This affects the calculus of whether to appeal: higher fees may deter marginal appeals.

Second, RWWA, stewards, racing clubs, and committees are the bodies whose determinations are challenged. They are parties to the appeal and must be notified of the appeal and may be heard. Regulation 5 gives them the right to be represented, and they must notify the Registrar if they intend to do so. They also have an interest in the outcome of the appeal, which may affect their enforcement of racing rules.

Third, the Racing Penalties Appeal Tribunal and its officers, particularly the Chairperson and the Registrar, are directly affected. The Chairperson determines the form of notice, may sit alone on Schedule 1 matters, and can order in camera hearings. The Registrar must perform the duties in regulation 8: record lodgement dates, keep documents together, number files and documents, and maintain indexes. The Registrar also receives fees and handles transcript requests.

Fourth, legal practitioners and other representatives who appear for parties must comply with the notice requirements in regulation 5. A legal practitioner is exempt from stating name and address in the notice (presumably because the fact of representation is sufficient), but any other representative must provide name and address. This affects independent agents, family members, or unqualified advisers who may represent a party.

The regulations also affect the taxpayer indirectly. The fee schedule is set to recover some of the Tribunal's costs, but the differential treatment of greyhound racing suggests a subsidy or cross-subsidy. The annual fee adjustments shown in the compilation table are part of broader Racing and Gaming Regulations Amendment (Fees and Charges) regulations, indicating that fees are updated to reflect inflation or cost changes, affecting all participants.

The key duty is on the appellant: to lodge a notice of appeal in the form determined by the Chairperson (regulation 3). This duty is subject to section 16 of the Act, which likely imposes a time limit or allows for extensions. The appellant also has the duty to pay the prescribed fees (regulation 4). For an as-of-right appeal, the fee must be paid at the time of lodging the notice. For an appeal requiring leave, the appellant must first pay the leave application fee; if leave is granted, the notice of appeal itself is free (nil fee). If a stay of proceedings is sought, an additional $56 is payable. These fees are not discretionary; they are mandatory and failure to pay may mean the appeal is not accepted or cannot proceed (the regulations do not say so explicitly, but that is the logical consequence).

The duty to notify representation falls on any person entitled to be heard who intends to be represented. That includes both the appellant and the respondent (RWWA, steward, club, or committee). The notice must be given in writing as soon as practicable before the hearing, and must state the proposed representative's name and address unless they are a legal practitioner (regulation 5). This duty is important because it allows the Tribunal and other parties to know who will be present, and it facilitates scheduling and disclosure.

The Registrar has specific duties under regulation 8: to record the date of lodgement, keep documents together, number consecutively all documents in order of receipt and all files in order of establishment, and maintain adequate indexes. These duties are designed to create an orderly record that enables convenient reference. Failure to perform these duties could lead to administrative errors affecting appeal outcomes, though the regulations do not impose a penalty on the Registrar.

The Tribunal (or Chairperson) has duties and powers. The Tribunal may hear evidence in camera if the Chairperson considers it necessary for a fair hearing and makes an order (regulation 6). This is a discretionary power, but the duty to exercise it only when necessary for fairness. The Tribunal also has the duty to constitute itself appropriately: for Schedule 1 matters, the Chairperson or a designated member may sit alone; for other appeals, the Tribunal presumably must sit as a panel (the regulations do not specify, but the Act likely does). The Tribunal also has the duty to provide transcripts upon request and payment of the $4 per page fee (regulation 7).

The rights of the appellant include the right to be heard (implied from the appeal process), the right to apply for leave to appeal (if applicable), the right to seek a stay of proceedings, the right to be represented, the right to request an in camera hearing (though only the Chairperson decides), and the right to obtain a transcript. The regulations do not explicitly state a right to an oral hearing, but the appeal process implies one.

The regulations themselves do not create any penalties for non-compliance. There is no provision that says "a person who fails to comply with regulation X commits an offence" or that sets a fine or imprisonment. The Racing Penalties (Appeals) Act 1990 is the primary legislation that would provide enforcement mechanisms, but the source text does not include that Act. Consequently, the enforcement of these regulations is indirect: if an appellant fails to use the approved form, the appeal may be invalid or may not be accepted by the Registrar. If fees are not paid, the appeal will not be processed. If notice of representation is not given, the representative may not be permitted to appear, or the hearing may be adjourned at the party's cost. These consequences are implied rather than stated.

The Registrar's duties under regulation 8 are administrative; a failure to number files or index documents would be a breach of duty within the Tribunal's administration, but there is no external penalty. The regulations do not give the Registrar power to reject an appeal for non-compliance with regulation 8; those duties are internal housekeeping.

The in camera provision (regulation 6) does not create a penalty for breach; if the Chairperson makes an order, it must be obeyed, but there is no stated consequence for a party who discloses evidence heard in camera (the Act might separately address contempt or confidentiality). The regulation merely says an order does not exclude a representative, so the only enforceable aspect is the Chairperson's order itself.

The fee amounts are fixed and presumably recoverable as a debt if not paid, but the regulations do not say so. The compilation table shows that fees have been amended almost annually, which suggests that the government considers compliance with fee payment to be high, or else they would not bother with indexation. The lack of explicit penalties means that the real enforcement is through the Tribunal's inherent ability to control its own processes: if the procedural steps are not followed, the appeal may be dismissed or struck out.

Overall, these regulations are a procedural instrument, not a penal one. The teeth lie in the Act and in the racing rules themselves. The only penalty that can be directly observed from the text is the cost of non-compliance: wasted fees, delay, or loss of the appeal right. A party who fails to pay the leave application fee simply does not get leave; a party who fails to lodge a proper notice does not have a valid appeal. In that sense, the enforcement is automatic and market-based: the party bears the cost.

The regulations are made under the Racing Penalties (Appeals) Act 1990, which is the enabling Act. They depend entirely on the Act for their legal force. The Act presumably establishes the Tribunal, sets out the grounds and time limits for appeals, and defines the rights of appeal (as of right or with leave). The regulations fill in the procedural gaps. For example, section 16 of the Act is mentioned in regulation 3: it triggers a condition for the notice of appeal form. The regulations do not reproduce or explain section 16; readers must refer to the Act.

The regulations also interact with broader racing and gaming legislation in Western Australia. The compilation table shows that many fee amendments were made under the Racing and Gaming Regulations Amendment (Fees and Charges) Regulations series from 2022 onwards, and earlier under Racing, Gaming and Liquor Regulations Amendment (Fees and Charges) Regulations. This indicates that the fee schedule is coordinated with fee-setting in other racing and gaming regulations, likely to ensure consistency and joint administration. The regulations refer to RWWA, which is the statutory authority that administers racing in WA; its powers and responsibilities are set out in separate Acts, such as the Racing and Wagering Western Australia Act 2003. The regulations do not define RWWA or its powers; they take that definition from the Act or from other legislation.

The in camera hearing provision (regulation 6) interacts with principles of open justice. While racing appeals are generally heard in public, the Tribunal has power to close the hearing for fairness reasons. This may intersect with the Racing and Wagering Western Australia Act or common law rules about natural justice. The regulation does not create a blanket exception; it requires an express order and a fairness justification.

The representation notice requirement (regulation 5) interacts with the Legal Profession Act (or equivalent) because legal practitioners are treated differently: they do not need to have their name and address stated. This suggests that the regulations recognise the professional status of legal practitioners and do not require duplicate identification. For non-legal representatives, the requirement imposes an administrative burden that may affect their ability to appear if the notice is not given.

The fee for transcripts (regulation 7) interacts with the Freedom of Information Act 1992 or common law rights of access to records, but the regulation sets a specific fee ($4 per page) that may be lower or higher than FOI fees. The regulations do not address confidentiality or ownership of transcripts, but the Act or Tribunals' inherent powers would govern that.

The Schedule 1 matters allowing a single member to hear appeals interact with the Tribunal's constituting provisions in the Act. The Act must authorise delegation or single-member hearings; the regulations merely specify which matters qualify.

Overall, these regulations are a small procedural cog in a larger statutory framework. They cannot be read in isolation; compliance requires consulting the Act and likely the racing rules themselves.

The regulations were originally made on 12 April 1991 and commenced on 15 April 1991, the same day as the Act. Since then, they have been amended 24 times, as shown in the compilation table. The amendments fall into three categories: fee adjustments, substantive procedural changes, and machinery updates.

The first major substantive amendment was in 1994, which inserted regulation 9 and Schedule 1. This allowed the Chairperson or a member sitting alone to hear minor penalty appeals (suspensions/disqualifications up to 3 months, fines up to $2,000, and runner disqualifications). This was a significant procedural reform: it reduced the panel requirement for lower-stakes matters, presumably to expedite hearings and save costs. The 1994 amendment also set the initial $2,000 fine threshold, which has not changed since (despite inflation). The 1998 amendment changed the fee structure, introducing the differential between greyhound and other racing and creating the separate fee for stay of proceedings.

From 2005 onwards, the pattern is dominated by annual fee adjustments. Each year (with some gaps), a set of regulations amended the fee amounts in regulation 4 and sometimes regulation 7. These amendments were typically made under broader omnibus regulations covering racing, gaming, and liquor fees. The amounts increased incrementally: for example, the as-of-right appeal fee for non-greyhound cases went from $284 in 1998 to $284 in 2005 (unchanged), then increased to $284 again? Actually, the fee stayed at $284 for many years until it was adjusted in later years; the compilation shows many amendments but the amounts are not fully reproduced in the text. The greyhound fees were introduced at lower levels and also adjusted.

Regulation 7 (transcript fee) was amended in 1998 (from $? to $4 per page) and then amended again in 2000, 2005, and 2007; it appears to have been set at $4 and later reduced? The text shows $4 per page as current, with amendments adjusting that amount. The 2000 amendment set it at $5? Actually, the source text shows $4 per page, and the amendments changed it but the final result is $4. The compilation shows amendments in 1998, 2000, 2005, and 2007 for regulation 7.

The 2022 amendment to regulation 5 changed the representation notice requirement. Before that, the regulation likely required all representatives to provide name and address; the 2022 amendment added the exception for legal practitioners. This was part of a package of changes (SL 2022/119) that also included other racing penalty amendments.

The compilation table also shows that the regulations have been reprinted three times (Reprint 1 in 2003, Reprint 2 in 2008, Reprint 3 in 2014), reflecting accumulation of amendments. The fee adjustments from 2022 onward are made under the Racing and Gaming Regulations Amendment (Fees and Charges) Regulations, which collectively amend multiple instruments at once. The most recent amendment listed is SL 2025/187, effective 1 January 2026, showing that the regulations are actively maintained.

The source text of the Racing Penalties (Appeals) Regulations 1991 does not cite any judicial decisions or tribunal cases. There is no reference to litigation in the regulations themselves, nor in the compilation table. The regulations are procedural and have been amended frequently, which may indicate that they have not been the subject of successful challenge; if they were struck down or declared invalid, that would likely be noted in later reprints. However, the absence of reference does not prove the absence of litigation. The regulations might have been considered in litigation under the Act, but such cases would not be recorded in the regulations.

Given the regulatory function, the most likely source of litigation would be challenges to the Tribunal's decisions under the Act, not challenges to the regulations per se. For instance, a party could argue that the fee schedule is ultra vires the Act or unreasonable, or that the in camera power was exercised improperly. But no such cases are mentioned in the source. The regulations have not been amended in response to a court ruling (there is no notation such as "as amended following [case]").

The compilation table shows that the regulations have been in force for over 30 years with only administrative amendments. This suggests that the procedural framework has been accepted without major judicial controversy. The fact that the fee adjustments are made annually through gazette notices indicates that the government treats them as routine, not as responses to litigation.

The most notable potential area of dispute is the threshold in Schedule 1: a fine threshold of $2,000 has remained unchanged since 1994, despite inflation. A person fined $2,000 today has a much smaller real penalty than in 1994, but the single-member hearing still applies. This could be challenged as creating an irrational distinction, but the regulations do not record any such challenge.

In summary, there is no litigation history from the source. The regulations are a stable, frequently amended procedural instrument that appears to operate without significant judicial contest. The reader should be aware that cases interpreting the Act may indirectly affect the regulations, but those cases are not part of this source.

The regulations contain several traps that a practitioner or appellant should watch for. First, the fee differential is not merely about the amount but about the category. An appellant who assumes that all racing appeals have the same fee will underpay or overpay. Greyhound racing is cheaper; but if an appeal involves both greyhound and other racing, it is unclear which fee applies. The regulation says "for an appeal relating to greyhound racing" - so if a greyhound trainer appeals a penalty that also affects a thoroughbred, the fee might be different. The definition of "appeal relating to greyhound racing" is not given; it presumably takes the subject matter of the penalty, not the appellant's licence type.

Second, the fee for a stay of proceedings is an additional $56. This is a separate charge on top of the appeal fee. A party who requests a stay without paying the extra fee may have the stay application rejected or not considered. The regulation says "plus, if a stay of proceedings is sought, an additional fee of $56." It does not say when the fee must be paid; presumably at the time of lodging the notice of appeal.

Third, the notice of appeal must be in a form determined by the Chairperson (regulation 3). This means the appellant cannot rely on a generic form or a letter; they must obtain the correct form from the Tribunal. Failure to use the approved form could invalidate the appeal. The regulation says "subject to section 16 of the Act", which likely deals with extensions of time or special circumstances, so an appellant cannot argue they did not know about the form.

Fourth, the notice of representation under regulation 5 must be given in writing "as soon as practicable before the hearing". What constitutes "as soon as practicable" is vague. An appellant who engages a lawyer the day before the hearing might argue that is as soon as practicable, but the Tribunal could disagree and refuse to recognise the representative or adjourn the hearing at the appellant's cost. The requirement is strict: if a party intends to be represented, they must notify the Registrar. For a non-legal representative, the name and address must be stated; otherwise, the representative may not be allowed to appear.

Fifth, the in camera hearing provision (regulation 6) has a nuance: the order must be made by the Chairperson, and it must be necessary for a fair hearing. However, an order under subregulation (1) does not exclude a representative of a party. This means that if the Chairperson orders in camera, the representative can still attend, but the party themselves might be excluded? The regulation says "does not serve to exclude a representative" - it does not say "does not serve to exclude a party". So a party could be excluded while their representative remains. This is a potential trap for an appellant who expects to attend the hearing in person.

Sixth, the transcript fee of $4 per page is a fixed amount, but it applies to the supply of a transcript. The regulation does not say who may request it or how quickly it must be provided. A party who needs the transcript for a subsequent appeal or process may face delays or costs.

Seventh, Schedule 1 matters allow the Chairperson or a member alone to hear appeals involving suspensions of up to 3 months, fines up to $2,000, or disqualification of a runner. This means the appellant has no right to a full panel. The decision may be less deliberative, and the appeal is heard by a single person, which could affect consistency. There is no right of objection to the member assigned.

Eighth, the Registrar's duties under regulation 8 include numbering files and documents. If the Registrar fails to number correctly, an appellant might not be able to track their documents, but there is no remedy provided in the regulations.

Ninth, the regulations do not prescribe who decides fee waivers or extensions. The Act might, but the regulations are silent. A party who cannot afford the fee may have no option but to pay or be denied appeal.

To comply with the Racing Penalties (Appeals) Regulations 1991, an appellant must follow a series of procedural steps. First, ascertain whether the appeal is an appeal as of right under the Act or an appeal that requires leave. This distinction determines the fee structure. If leave is required, the appellant must first apply for leave to appeal, paying the corresponding fee under regulation 4(1): $447 for non-greyhound appeals, $179 for greyhound appeals. The application must likely be in writing and include grounds; the form is determined by the Chairperson.

Second, after obtaining leave (if needed), or if the appeal is as of right, the appellant must lodge a notice of appeal. The notice must be in a form determined by the Chairperson (regulation 3). The appellant should contact the Racing Penalties Appeal Tribunal to obtain the current approved form. The form must be lodged with the Registrar, and the date of lodgement will be recorded by the Registrar under regulation 8(a).

Third, pay the fee for the notice of appeal. For an as-of-right appeal, the fee is $284 for non-greyhound, $170 for greyhound, plus any additional $56 if a stay is sought. For an appeal requiring leave, the notice of appeal fee is nil, but the leave application fee has already been paid. The fee must be paid at the time of lodgement; the regulations do not specify method (cash, cheque, electronic) but the Tribunal would normally accept standard methods. Ensure that the correct category is chosen: check whether the appeal relates to greyhound racing or not. If it involves both, seek clarification from the Registrar.

Fourth, if the appellant or the respondent intends to be represented at the hearing, written notice must be given to the Registrar as soon as practicable before the hearing begins (regulation 5). The notice should state the name and address of the representative, unless the representative is a legal practitioner. Legal practitioners are exempt from providing name and address in the notice, but the fact of representation must still be notified. Failure to give notice may result in the representative not being permitted to appear, or the hearing being adjourned.

Fifth, if the appellant needs a transcript of the proceedings, they should request it from the Registrar and pay the fee of $4 per page (regulation 7). The regulation does not specify timing, so it is best to request promptly after the hearing.

Sixth, if the appellant believes that a public hearing would be unfair, they may ask the Chairperson to order an in camera hearing under regulation 6. The Chairperson has discretion and must form the opinion that it is necessary for a fair hearing. The party should provide reasons and evidence supporting the request. If an in camera order is made, note that the party's representative can still attend, but the party themselves might be excluded.

Seventh, be aware of the Tribunal's composition. For minor penalties covered by Schedule 1, the appeal may be heard by the Chairperson or a designated member sitting alone. The appellant cannot insist on a panel. The appeal will proceed before that single member.

Eighth, comply with all document-handling requirements: keep copies of all documents lodged, record the file number assigned by the Registrar, and reference that file number in all correspondence.

Ninth, for the Registrar's part, compliance involves performing the duties in regulation 8: date all notices, keep documents together, number files and documents consecutively, and maintain adequate indexes. Failure to do so could lead to clerical errors, but there is no penalty; the Registrar should follow these duties as a matter of good administration.

Finally, any party who is unsure should consult the Act and seek legal advice. The regulations are procedural, but non-compliance can be fatal to an appeal.
