RACING AND WAGERING REGULATIONS 2024

The instrument organises its rules around licensing, financial obligations, governance of wagering systems, event reporting and an infringement scheme. Key concepts and how they are defined or instantiated in the Regulations follow.

• Licence classes and fees. The Regulations identify licence types and set application and renewal fees in revenue units (racecourse, betting exchange, on-course bookmaker, sports bookmaker, key person) and prescribe whether an annual fee applies. For some licences the application and renewal fees are stated to be sufficient for the licence term, with annual fees set to zero (rr 9-13). Licence term lengths are prescribed (5 or 20 years) (r 16).

• Fit and proper person checks. The Regulations implement s 7(1)(g) of the Act by prescribing a list of laws to be considered when assessing fitness and propriety. That list comprises many State and Territory gambling and gaming statutes and a residual category for “any other law ... consisting of an indictable offence” (r 4, Sch 1). The concept is operationalised by reference to prior or current contraventions under those laws as relevant evidence.

• Delegation. The Regulations specify the Commission’s powers that may be delegated (r 5). Delegated matters include document receipt, issuing certain permits and licences, varying minor administrative conditions, resolving some complaints and allowing late lodgement of complaints. The list limits delegation by excluding complaints involving wagers above $10 000 and problem gambling from delegation (r 5(1)(f)(i)-(ii)).

• Wagering control system approval and change control. A wagering control system must be approved by the Director; an application must describe and explain the system, and approval requires satisfaction that the system meets s 163(2) of the Act and is suitable to control wagering (r 21(1)-(3)). Material changes require Director approval; a change is “material” if it would reasonably be expected to affect compliance with s 163(2) or suitability to control wagering (r 22). The Director can direct changes or revoke approval if the system no longer meets s 163(2) or is unsuitable; procedural protections include notice, stated grounds and a 28-day window for written submissions (rr 23-24).

• Reportable events. The Regulations list events a licensee must report to the Director as soon as practicable (r 20(1)-(2)). The list includes insolvency/bankruptcy steps, ceasing operations, certain corporate notices, commencement of legal proceedings with claims exceeding $200 000, regulatory investigations and material breaches or failures of wagering control systems (including specified categories of personal information loss or account access outages exceeding 24 hours) (r 20).

• Levies and deductions. Levies are calculated monthly by formula for betting exchange and sports bookmaker licensees using a rate R = 0.05% applied to commissions retained or net wagers (rr 14(1)-(2)). The Director may allow a deduction equal to donations or sponsorships to Territory community organisations up to $250 000 per year, pro-rated monthly (rr 14(3)-(4)).

• Limits on sports information fees charged by control bodies. The Regulations set minimum and maximum percentage bands for fees charged by control bodies for approval to use sports information: 15-50% of commission for betting-exchange-type operators; 1.5-5% of total wagers for other wagering licensees (r 17).

• Wager receipts and recordkeeping. The Regulations specify required wager receipt information (selection, stake, odds, return, unique identifier, and, where issued on-course or at retail, licensee name, time and date) and require monthly returns to include daily amounts of wagers and commissions and related accounting records (rr 15, 26).

• Infringement notice offences and process. The Regulations define an “infringement notice offence” as an offence against any provision listed in Schedule 2 and tie the monetary expiation amount to the monetary value of the number of penalty units specified (r 27, Sch 2). Inspectors may issue notices when they reasonably believe an offence has occurred; the notice must contain prescribed particulars and explain payment, election to go to court, and potential recovery under the Fines and Penalties (Recovery) Act 2001 where that Act applies (rr 28-31).

These concepts are applied through prescriptive formulas, timeframes (notably a repeated 28-day submission period), and specific document and reporting content requirements. Many provisions reference sections of the Act (for example s 163(2) and s 7(1)(g)) which contain substantive obligations not reproduced in the Regulations; satisfaction of those Act provisions is a recurring approval test in the Regulations (rr 21-24, r 4).

The Regulations affect a defined set of market participants, regulatory actors and third parties.

• Wagering licensees. All categories of licence mentioned by the Regulations are directly affected: betting exchanges, sports bookmakers, on-course bookmakers, racecourse operators and key persons. Affected obligations include payment of application, renewal and annual fees (where prescribed), levy calculation and payment, monthly returns, compliance with wagering control system approval and change-control procedures, reporting obligations for specified events, recordkeeping and issuance of wager receipts with specified fields (rr 9-16, 14, 15, 21-26).

• Control bodies and providers of sports information. Control bodies that charge for approval to use sports information must set fees within prescribed percentage limits depending on the applicant’s business model (r 17). The caps and floors impose contractual and pricing constraints on control bodies when negotiating approvals with betting exchanges and other licensees.

• Licensee agents and on-course bookmakers. The Regulations set zero application fees for permits to act as an agent for an on-course bookmaker licensee (r 11). On-course bookmakers must issue receipts with a set of required fields in retail or course contexts (r 26(c)-(h)).

• Key persons and persons applying for key person licences. The Regulations prescribe application and renewal fees in revenue units for key person licences and set the term length at five years (rr 9-10, 16). Fit and proper person checks apply, with Schedule 1 listing laws the Commission must consider under s 7(1)(g) of the Act when assessing fitness and propriety (r 4, Sch 1).

• The Commission and the Director. Administrative responsibility rests with the Commission and the Director. The Regulations prescribe precisely which Commission powers may be delegated and to what extent (r 5). The Director receives and assesses wagering control system applications and changes, issues directions, revokes approvals, and receives reportable event notices (rr 5, 20-24).

• Inspectors and enforcement agencies. Inspectors are empowered to issue infringement notices when they reasonably believe an offence under Schedule 2 has occurred (rr 27-28). Enforcement agencies specified in infringement notices receive payments and process statements of election if recipients choose court rather than expiation (r 29).

• Community organisations. The levy mechanism allows betting exchange and sports bookmaker licensees to deduct up to the amount of donations or sponsorships given to Territory community organisations, up to $250 000 per year, from levy calculations, yielding a potential indirect financial benefit to such organisations (r 14(3)-(4)).

• Customers and account-holders. Customers are affected indirectly by wagering control system requirements (availability, data security requirements expressed through the reporting obligations for unauthorised disclosure and loss), receipt content requirements that enable clarity about a wager, and the potential for operators to shift levy and control-body fee costs into prices, odds or product availability (rr 20, 26, 14, 17).

The Regulations therefore impose burdens largely on operators in the wagering market in the Territory: compliance costs for systems approval and change control, administrative costs for fees and levies, reporting and recordkeeping costs, and potential commercial costs arising from limits on sports information fees and levy rates. Regulatory actors (the Commission, Director and inspectors) gain procedural powers and defined discretion, with statutory notice and consultation steps attached. Community organisations may gain concentrated financial benefit through donations that are explicitly deductible for levy purposes (r 14).

The Regulations create specific duties for licensees, the Commission, the Director and inspectors, and preserve enforcement and review rights for recipients of regulatory decisions and infringement notices.

Duties on wagering licensees

• Application, renewal and payment duties. Licence applicants must pay prescribed application and renewal fees in revenue units for relevant licence classes. Certain licences are exempt from annual fees because the application and renewal fees are stated to suffice for the licence term (rr 9-13).

• Security and reserve duties. Licensees may be required to provide security up to the prescribed maximum amount ($250 000) (r 12). The Commission may impose licence conditions requiring sufficiency of financial resources and reserves to meet potential liabilities (r 18(b)).

• Reporting duties. Licensees must report specified “reportable events” to the Director as soon as practicable, including bankruptcy, insolvency measures, winding up, notices to ASIC or the ASX, commencement of legal proceedings with claims exceeding $200 000, regulatory investigations, and material system breaches or failures including unauthorised access to certain categories of personal information or customer account inaccessibility for more than 24 hours (r 20(1)-(2)).

• Control system duties. Licensees must obtain Director approval before operating a wagering control system and must not make material changes without approval. Applications must describe and explain the system or proposed change. The Director may direct changes or revoke approvals with notice and an opportunity to make written submissions (rr 21-24).

• Levy and return duties. Betting exchange and sports bookmaker licensees must calculate and pay monthly levies according to prescribed formulas and may claim pro-rated deductions for eligible donations/sponsorships up to $250 000 per year. Licensees must lodge monthly returns with daily amounts of wagers and commissions and required accounting records (rr 14-15).

• Recordkeeping and receipt duties. Licensees must produce wager receipts containing prescribed information (name of event/selection, type of wager, stake, odds where applicable, return amount where applicable, unique identifier, and where issued on-course or at retail, licensee name, time and date) (r 26). They must also retain accounting records as required by s 186 and specified in monthly returns (r 15).

Duties on the Commission and Director

• Delegation and consultation. The Commission may delegate specific powers outlined in regulation 5, subject to the Act’s delegation framework. Delegated powers include issuing permits for agents, key person licences, and resolving certain complaints (r 5). The Commission must give written notice and allow 28 days for written submissions before varying or revoking licence conditions, consider those submissions and provide written notice of its decision; variations take effect on receipt or on the date stated (r 19).

• Decision-making and guidance duties. If the Director refuses approval of a wagering control system or a material change, the Director must give guidance on submitting a system or change that could be approved within 28 days (rr 21(4), 22(4)). Before directing a change, the Director must give notice advising the proposed change and grounds, allow 28 days for submissions, consider submissions, and then decide whether to issue the direction (r 23).

• Withdrawal of infringement notices. The Director may withdraw an issued infringement notice by written notice within 28 days of the infringement notice being given and before payment (r 32).

Rights preserved for regulated persons

• Right to make submissions. Licensees have a right to make written submissions within prescribed 28-day windows prior to varying/revoking licence conditions, prior to the Director issuing directions to change systems or revoking approvals and after refusals to approve systems or material changes (rr 19(2), 21(4), 22(3), 23(3), 24(3)).

• Right to elect court proceedings. A person served with an infringement notice may elect to have the matter dealt with by a court by lodging a statement of election and not paying the infringement amount; the notice must include a form for that purpose (r 29(2)(b)-(3)).

• Expiation and finality. Payment of the infringement amount in accordance with the notice expiates the alleged offence and precludes further proceedings in relation to that offence (r 31).

• Procedural notice rights. Notice requirements are embedded in the Director’s powers to refuse, direct change or revoke approvals and in the Commission’s power to vary or revoke licence conditions; decisions must be communicated in writing with stated grounds and a 28-day submission window (rr 19, 21-24).

Administrative enforcement powers and limits

• Inspector authority. Inspectors may issue infringement notices where they reasonably believe an infringement offence has been committed (r 28). The Regulations set out what an infringement notice must contain and the mechanisms for payment, election to go to court, and recovery under the Fines and Penalties (Recovery) Act 2001 where applicable (r 29).

• Limits on appeal for certain fines. The Regulations prescribe amounts for fines under specified provisions of the Act that carry no right of appeal (r 6). For example, for a provision referenced at section 85(a) of the Act the prescribed amount is $500 (r 6(1)). Other prescribed amounts tied to particular provisions are $5 000 and $1 000 under r 6(2)-(3).

These duties and rights create a procedural architecture where regulated entities must maintain specified financial records, system documentation, and reporting practices; have opportunities to be heard in multiple decision contexts; and face an infringement regime that allows administrative disposal by way of payment or contestation in court. Many duties are framed in mandatory terms (must not, must report, must lodge) with particular timing and content obligations rooted in specified regulations.

The Regulations establish an infringement notice enforcement pathway for specified contraventions and fix monetary expiation rates via penalty units, while otherwise preserving court-based enforcement and broader penalties available under the Act.

Infringement notice offences and amounts

• Definition. An “infringement notice offence” is an offence against any provision listed in Schedule 2 of the Regulations (r 27(1), Sch 2).

• Calculation of monetary expiation. The infringement amount corresponding to an infringement notice offence is the monetary value of the number of penalty units specified for the offence in Schedule 2. The Regulations do not convert penalty units to dollar figures; the monetary value therefore depends on the statutory value of a penalty unit as set elsewhere (r 27(2), Sch 2).

• Schedule 2 listings. Schedule 2 maps specific sections of the Act to specified numbers of penalty units. Examples include: section 35(1) and section 38(1) at 5 penalty units each; section 70(1) and section 81(1) at 3 penalty units each; section 120(2) at 10 penalty units; section 155(2) and section 164(5) at 100 penalty units each; and others listed in Schedule 2 (Sch 2). The monetary charge for expiation is therefore a function of the penalty unit value multiplied by the number of units in Schedule 2.

Issuance and content of infringement notices

• Who may issue. An inspector may give an infringement notice to a person if the inspector believes on reasonable grounds that the person committed an infringement notice offence (r 28).

• Required contents. An infringement notice must specify the recipient’s name and address if known, date the notice is given, date/time/place of the alleged offence, description of the offence, the infringement amount payable, and the enforcement agency to which payment is payable. It must also include a statement describing the right to expiate by payment within 28 days or to elect court proceedings by lodging a statement of election, and must include the election form (r 29(1)-(3)).

Payment mechanics and legal effects

• Effective date of payments. Electronic payments take effect when credited to the payee’s bank account. Cheques take effect when cleared on first presentation (r 30).

• Expiation. If the infringement amount is paid in accordance with the infringement notice, the alleged offence is expiated and no further proceedings may be taken in relation to that offence (r 31).

• Withdrawal. The Director may withdraw an infringement notice by written notice given within 28 days after the notice was given and before payment (r 32).

Relationship with court proceedings and other enforcement

• Preservation of prosecutorial options. The Part does not prevent the commencement or continuation of a court proceeding for an infringement offence unless the offence is expiated (r 33(1)(a)). It also does not limit penalties courts may impose or require that an infringement notice be given prior to prosecution; multiple infringement notices may be given for the same offence and a person may expiate by paying under any notice (r 33(1)(b)-(d), (2)).

• Interaction with recovery legislation. The content of infringement notices must state that where the Fines and Penalties (Recovery) Act 2001 applies, enforcement action may be taken under that Act if the person does nothing in response to the notice (r 29(2)(c)).

Other enforcement-related provisions

• Fines with no right of appeal. The Regulations prescribe that certain fines under specific Act provisions carry no right of appeal and the prescribed amounts for these are set out directly in the Regulations. For example, r 6 prescribes $500 for s 85(a) and $5 000 and $1 000 for other referenced subparagraphs. The Regulations also prescribe the fee for lodging an appeal in other circumstances (r 7).

• Director and Commission powers. The Director may direct licensees to change wagering control systems and may revoke approvals if the system no longer meets statutory requirements, subject to notice and a right for licensees to make written submissions (rr 23-24). The Commission may vary or revoke licence conditions following notice and a 28-day submission window (r 19).

Enforcement architecture summary

The Regulations create a two-track enforcement architecture. For less serious or specified contraventions listed in Schedule 2, inspectors can offer administrative expiation by way of infringement notices, with specified procedural protections and timeframes (rr 27-33). For other matters, the full suite of civil or criminal enforcement in the Act and related laws remains available, and the Regulations preserve prosecutorial discretion and court remedies. The monetary quantum of administrative expiation depends on the statutory penalty unit value multiplied by Schedule 2’s unit counts; the practical cost to regulated entities is thus jointly determined by the penalty unit definition outside these Regulations and the number of units assigned in Schedule 2.

The Regulations are tightly cross-referenced to the Racing and Wagering Act 2024 and to other legislation via prescribed units and external definitions. They embed several interactions that practitioners must track.

References to the Act

• The Regulations operate under and are to be read in conjunction with the Act. They regularly refer to particular Act provisions as qualification points for approval and compliance, for example the standard in s 163(2) for wagering control systems and s 7(1)(g) for fit and proper person assessments (rr 4, 21-24). The Regulations therefore provide procedural and numerical detail but rely on substantive tests contained in the Act,satisfaction of those tests is required for approvals and renewals.

Revenue units and penalty units

• Monetary figures are frequently expressed in revenue units (application, renewal and annual fees) and Schedule 2 quantifies infringement amounts in penalty units. The Regulations do not define the value of a revenue unit or penalty unit. These monetary unit values are therefore determined by the Act or by other Commonwealth or Territory instruments that define the monetary value of a revenue or penalty unit. Practitioners must therefore consult the Act or relevant financial instruments to convert revenue units and penalty units to dollar amounts (regs 9-13, 27, Sch 2).

Interaction with Fines and Penalties (Recovery) Act 2001

• Infringement notices must state that where the Fines and Penalties (Recovery) Act 2001 applies, enforcement may follow under that Act if the notice recipient does not respond (r 29(2)(c)). This explicitly connects the administrative expiation regime to the Territory’s recovery mechanisms.

Fit and proper person laws and other jurisdictions

• Regulation 4 prescribes a list of State and Territory gambling-related laws to be considered when assessing whether a person is “fit and proper” under s 7(1)(g) of the Act. The list includes legislation from ACT, NSW, Qld, SA, Tas, Vic and WA, plus a residual category for any other law that constitutes an indictable offence (r 4, Sch 1). The effect is to import cross-jurisdictional regulatory history into fitness assessments for licences in the Territory.

Interaction with corporate and financial laws

• Reportable events include giving notice to the Australian Stock Exchange or ASIC, and the commencement of legal proceedings exceeding $200 000. These references point to an interaction between the licensing regime and broader corporate disclosure, insolvency and litigation frameworks (r 20(1)(e)-(f)).

Control body contractual interactions

• Regulation 17 prescribes limits on fees charged by a control body for approval to use sports information. Those statutory caps and floors will bind private contracts between control bodies and licensees with differing percentage bands for betting exchange-like operators versus other wagering licensees (r 17). This imposes regulatory constraints on commercial negotiations over access to sports information.

Interaction with other regulatory regimes

• The list of prescribed laws in Schedule 1 includes interactive gambling and casino statutes from other jurisdictions. That listing channels findings or contraventions under those external laws into fitness assessments in the Territory. Similarly, the Director’s standard for wagering control systems is the Act’s s 163(2), requiring cross-reference to the Act for substantive technical standards (r 21(3)(a)).

Regulatory overlap and potential coordination

• Several provisions require the Director or Commission to give guidance or stated reasons within 28 days after refusals or before directions/revocations, or to consider submissions. These procedural obligations create points where action must align with administrative law principles and potentially coordinate with other enforcement bodies when reportable events trigger investigations outside the Territory (rr 19, 21-24).

In short, the Regulations are procedural and numerical companions to the Act, and their practical effect depends on definitions and substantive standards elsewhere. Conversion of revenue and penalty units into dollar values, the substance of s 163(2) and other Act provisions, and any interaction with external statutory regimes such as insolvency law, ASIC disclosure obligations and interstate gambling laws are material to compliance and enforcement. Practitioners should therefore read the Regulations and the Act together and track any instruments that determine the monetary value of revenue and penalty units.

The instrument includes a short record of its enactment and a single recorded amendment in the supplied text.

• Making and commencement. The Racing and Wagering Regulations 2024 (SL No. 14, 2024) were made on 27 June 2024 and commenced on 1 July 2024, aligned with the commencement of section 303 of the Act (Endnotes and r 2). The commencement note references s 2(1) of the Act.

• Amendment instrument. A subsequent instrument titled Racing and Wagering Amendment Regulations 2025 (SL No. 11, 2025) was made on 25 September 2025 and commenced on 26 September 2025 (Endnotes item 2).

• Specific amendment recorded. The legislative history records that regulation 5 was amended (r 5 amd No. 11, 2025, r 4). In other words, the delegation schedule (regulation 5) was revised by the 2025 amendment instrument. The Regulations as presented include reg 5(1)(a)-(g) listing the powers and functions that may be delegated; that list therefore reflects the updated post-amendment content.

• No other amendments listed. The Endnotes’ list of amendments shows only r 5 amended by No. 11, 2025. No other individual regulations are recorded as having been amended in the provided ENDNOTES excerpt.

• Effect of the amendment. The text of reg 5 as presented prescribes specific matters that the Commission may delegate, including document receipt, issuing permits for agents, key person licences, varying and revoking key person licence conditions, varying minor administrative conditions on wagering licences, resolving certain complaints (excluding high-stake wagers and problem gambling matters), and allowing late lodging of complaints under s 221(3)(b) of the Act (r 5(1)(a)-(g)). The 2025 amendment therefore altered the Commission’s delegation regime, though the instrument does not include the prior text of regulation 5 so comparisons to the pre-amendment regime cannot be made from this instrument alone.

• Practical implication. The recorded amendment demonstrates willingness to refine the administrative delegation framework within a year of initial commencement. For compliance teams and counsel, the amendment history indicates a point of administrative evolution in delegation practice that may affect how and by whom decisions are made within the Commission.

• No case law in the instrument. The Regulations contain no references to judicial interpretations or decisions and no litigation history is recorded in the text provided. Any reliance on judicially interpreted meaning must therefore be drawn from later decisions or related Act litigation outside the scope of this instrument.

Practitioners should monitor the Territory’s subordinate legislation register for further amendments and cross-reference the 2025 amendment instrument (SL No. 11, 2025) for full text and any transitional provisions affecting decisions made before or after the amendment date.

The Regulations, as supplied, do not contain reported litigation, case references, or judicial interpretation. There are no cases cited in the text. The instrument’s endnotes record legislative instruments and amendments but do not reference court proceedings or tribunal decisions interpreting the Regulations. Where the Regulations refer to review or appeal mechanisms under the Act (for example NTCAT review fees prescribed in r 8 and appeal fees in r 7), those pathways are procedural; the Regulations themselves do not record any litigation outcomes.

What the instrument does provide that relates to dispute resolution

• NTCAT and appeals. The Regulations set fees for NTCAT review and appeal lodgement (r 7 prescribes a fee of 200 revenue units for lodging an appeal under s 87(1) of the Act; r 8 prescribes amounts of $500 and $20 000 for certain NTCAT review elements under s 239(1)(g)(i)-(ii)). Those calibration points indicate where matters may be brought for review, but do not include any judicial outcomes or interpretative guidance.

• Infringement notices and elections. The infringement notice scheme permits recipients to elect court processes rather than pay expiation amounts (r 29(2)(b)). While the Regulations describe the election mechanism, they do not report any litigation arising from such elections.

• Director and Commission decisions. The Regulations impose procedural requirements for notice and submission opportunities before the Commission or Director makes certain decisions (for example varying licence conditions, directing changes, revoking approvals). These procedural rights create potential bases for judicial review or merits review, but the instrument contains no recorded cases.

Implication for legal research and practice

• Absence of litigation in the instrument means interpretative questions about the Regulations and their interface with the Act will be unresolved until exercised and reviewed by courts or tribunals. Practitioners should therefore treat ambiguous or discretionary provisions as areas where future proceedings might clarify scope and should preserve record evidence of consultation and submissions where procedural steps are required (rr 19, 21-24), anticipating potential judicial or tribunal scrutiny.

• For compliance readiness, do not assume settled jurisprudence; rely on the text of the Regulations and the Act for current obligations and consult tribunal and court decisions as they emerge.

This section highlights practical risks, compliance traps and implementation frictions that the Regulations create or fail to resolve directly, based on the text.

Revenue units and penalty units left undefined in the instrument

• Many monetary amounts are expressed in “revenue units” (application, renewal, annual fees) and Schedule 2 ties infringement sums to penalty units (regs 9-13, 27, Sch 2). The Regulations do not state the dollar value of a revenue or penalty unit. Practitioners must consult the Act or other Territory instruments to convert these into currency. Failure to do so can result in mistaken fee payments or miscalculated budgets.

Material change definition and operational ambiguity

• The Regulations define “material change” in relation to a wagering control system in a functional way: whether the change would reasonably be expected to affect compliance with s 163(2) or suitability to control wagering (r 22(4)). The practical threshold for what “would reasonably be expected” to affect compliance is subjective and likely to be tested on a case-by-case basis. Operators must therefore err on the side of seeking Director approval for substantive software, security or process changes, which may increase friction and transactional delay.

28‑day windows repeated but no express extension mechanism

• Multiple provisions give regulated persons 28 days to lodge written submissions after receiving notice in contexts including proposed licence condition variations, proposed directions to change systems, refusals to approve systems or material changes, and proposed revocations (rr 19(2), 21(4), 22(3), 23(3), 24(3)). The Regulations do not provide for extension of these windows. Practitioners must ensure timely response; missed deadlines may reduce the practical ability to influence a decision.

Director guidance obligations have mandatory timing but unclear content scope

• The Director must provide guidance within 28 days if refusing approval of a system or a material change (rr 21(4), 22(4)). The Regulations do not specify the form or minimum content of such guidance, which may lead to variable quality of direction from the Director and potential operational uncertainty for applicants.

Deduction for donations and sponsorships creates strategic incentives

• The levy calculation allows a deduction equal to donations or sponsorships given to Territory community organisations up to $250 000 per year, pro-rated monthly (r 14(3)-(4)). This creates a direct financial incentive for licensees to route spending into qualifying donations or sponsorships to reduce levy exposure. The Regulations do not define “community organisation” further. Licensees and control bodies must therefore confirm what qualifies operationally to avoid disputes with the Director.

Control body fee bands are wide and asymmetric

• Control bodies must set approval fees within 15-50% of betting exchange commission for betting-exchange-type operators, and 1.5-5% of total wagers for other wagering licensees (r 17). The 15-50% band for betting exchanges is broad; the choice of band within that range will materially affect economics for exchanges and for control bodies. The Regulations do not prescribe a process for setting or approving a particular percentage within the band, leaving room for commercial negotiation and potential bargaining concentration.

Delegation changes may change decision‑maker identity

• Regulation 5 prescribes specific Commission powers that may be delegated, including dispute resolution for complaints (subject to exclusions) and issuing certain licences. The 2025 amendment to reg 5 indicates delegation arrangements can change quickly (r 5, Endnotes). Practitioners must check the current delegated decision-maker before appealing or challenging a decision and should maintain records of who made a decision and under what delegated authority.

Infringement notices and the 28‑day payment window

• The expiation option requires payment within 28 days from the date the notice is given to avoid further action (r 29(2)(a)). The Director can withdraw an infringement notice within 28 days and before payment (r 32). A licensee that immediately pays an infringement that is later withdrawn may face administrative complications in obtaining reimbursement; the Regulations do not specify refund mechanics for withdrawn notices.

Reportable event thresholds and ambiguity over “material” incidents

• Reportable events include “any material breach or failure of a wagering control system” with examples such as unauthorised access to personal information that “a reasonable person would conclude is likely to result in serious harm” and inability of customers to access accounts for more than 24 hours (r 20(1)(h)). The standard “reasonable person” test and “serious harm” are judgement calls; operators must have incident evaluation processes to determine reportability quickly to avoid late reporting.

No transitional arrangements for systems and approvals visible

• The Regulations require approval of wagering control systems and approval for material changes, but do not detail transitional arrangements for systems in operation at commencement or during amendment processes. Operators should assume approvals are required for existing systems unless s 163(2) or other transitional provisions in the Act provide otherwise.

Scope of Schedule 1 is broad

• The fit and proper person schedule lists many interstate gambling statutes and includes “any other law ... consisting of an indictable offence” (Sch 1). This broad sweep potentially subjects applicants and key persons to scrutiny for a wide range of external conduct, increasing due diligence burdens and potentially affecting mobility of personnel with interstate histories.

These “gotchas” are concrete operational and legal friction points created by the Regulations’ structure: conversion of fee units outside the instrument, subjective thresholds for materiality and seriousness, tight but rigid procedural timelines, and significant delegation and discretion allocated to the Director and Commission. Addressing them requires careful internal processes, quick decision-making, and proactive stakeholder engagement.

This section sets out practical, text-grounded steps and internal controls a regulated entity should put in place to meet the Regulations’ mandatory requirements.

1. Know your fee exposure in revenue units and confirm unit values

• Identify all licences held or required (racecourse, betting exchange, on-course bookmaker, sports bookmaker, key person) and map application, renewal and annual fees as stated in regs 9-13.
• Because fees are in “revenue units,” confirm the monetary value of a revenue unit with the Act or the Territory’s financial instruments before budgeting or remitting payment. Also determine the dollar value of penalty units where Schedule 2 prescribes infringement amounts (r 27, Sch 2).

2. Prepare for licence term and renewal cycles

• Record licence term lengths (5 years for racecourse, on-course bookmaker, key person; 20 years for betting exchange and sports bookmaker) and calendarise renewal application windows (r 16).
• For licences where annual fees are set to zero and a note in r 13 states application and renewal fees suffice, ensure renewals are lodged timely so no unexpected annual fees arise.

3. Wagering control system lifecycle management

• Treat any system or process change as potentially “material” under r 22(4). Implement an internal change-control policy requiring technical, legal and compliance sign-off on any change that could affect compliance with s 163(2) of the Act or system suitability.
• Where approval is required, lodge applications with the Director and include full descriptions and explanations as required by r 21(1)-(2). If a requested change is refused, expect to receive guidance within 28 days and use that guidance to update resubmissions (r 21(4)).
• Keep a continuous audit trail of approvals, change requests, and any directions from the Director and ensure compliance with any Director directions under r 23.

4. Incident reporting and breach management

• Implement incident classification criteria aligned to r 20(1)(h), including thresholds for loss/unauthorised disclosure of personal information likely to result in serious harm and account inaccessibility for more than 24 consecutive hours.
• Establish a notification workflow that triggers reporting to the Director “as soon as practicable” with use of the approved form where applicable (r 20(2)). Maintain records of timing and content of notifications.

5. Monthly returns, accounting records and levy calculations

• Design accounting and reporting systems to capture daily wager amounts and commissions for each month and to produce the accounting records required under s 186 to satisfy monthly returns obligations (r 15).
• Implement levy calculation routines: for betting exchanges, compute AC (commissions retained/received excluding free/bonus wagers) and apply R = 0.05% then subtract any D deduction allowed. For sports bookmakers, compute AL (total wagers excluding free/bonus wagers) minus AW (total amounts paid to persons) to get net wagering exposure, multiply by R = 0.05% and subtract D (r 14(1)-(2)).
• If making donations or sponsorships to Territory community organisations, document amounts and eligibility criteria and seek pre-approval or confirmation from the Director where uncertain, since the Director may allow deductions up to $250 000 and the deduction may be pro-rated monthly (r 14(3)-(4)).

6. Wager receipts and record issuance

• Ensure retail and on-course receipt systems produce tickets/receipts that include all prescribed fields: event/race name and number, selection name, type of wager, stake, odds where applicable, return amount where applicable, unique identifier, and for on-course/retail receipts, licensee name, time and date accepted (r 26).
• Where wagers are accepted electronically, ensure logs include corresponding unique identifiers and data to generate compliant receipts on demand.

7. Fit and proper person checks and documentation

• For licensing under s 7(1)(g), check applicant records against the Schedule 1 list of prescribed laws and for any indictable offence history. Maintain clearance documentation evidencing review of specified interstate statutes and any indictable convictions or proceedings (r 4, Sch 1).

8. Governance for licence condition changes and submissions

• If the Commission notifies a proposed variation or revocation of licence conditions, prepare written submissions within 28 days to preserve rights and ensure the Commission considers them before decision (r 19(2)-(3)). Keep evidence of dispatch and receipt of submissions and seek written decisions promptly after outcome (r 19(4)-(5)).

9. Dispute handling and infringement notices

• Train staff on inspector interactions and the content of infringement notices. If served, evaluate whether to expiate by payment within 28 days or elect court proceedings by lodging a statement of election; use the form included with the notice (r 29(2)(a)-(b), (3)).
• Maintain a process to check whether the Fines and Penalties (Recovery) Act 2001 applies in a given matter and to handle recovery actions accordingly (r 29(2)(c)).
• If an infringement notice is withdrawn by the Director, maintain procedures for seeking refunds or accounting reconciliation where payment has already been made (r 32).

10. Commercial negotiation with control bodies

• When negotiating approval to use sports information, anticipate fee bands set in r 17: 15-50% of betting exchange commission for relevant operators, 1.5-5% of total wagers for other licensees. Model economics under worst- and best-case percentage outcomes and document negotiations; consider how fees will impact margins and customer pricing.

11. Delegation and decision-maker mapping

• Because regulation 5 prescribes delegation of specific powers, document which Commission functions are delegated in practice and to whom. Before contesting or appealing a decision, verify the identity of the decision-maker and whether the decision was made under delegation (r 5).

12. Record retention and auditability

• Keep detailed records supporting all reports, monthly returns, donations/sponsorship claims for levy deductions, wagering control system documentation, approvals, change requests, receipt issuance logs, and written submissions to the Director and Commission. These records will be necessary for audits, dispute resolution and regulatory review and to respond to the Director’s guidance obligations.

13. Budget for possible infringement exposures and levy liabilities

• Since infringement amounts are a multiple of penalty units specified in Schedule 2, calculate potential exposure once the penalty unit dollar value is known. Budget for levies at 0.05% of the relevant base and for potential deduction limitations.

By aligning internal policies to these procedural steps and by documenting decision-making and compliance evidence, licensees and related entities can reduce legal and operational risks under the Regulations. The common theme is proactive documentation, early engagement with the Director on uncertain matters, and conservative treatment of system changes as potentially material.
