282 Criminal responsibility of individual for employee or agent (1) A physical element of an offence committed by an employee or agent of an individual must also be attributed to the individual if the employee or agent was acting within: (a) the actual or apparent scope of the employee's or agent's employment; or (b) the employee's or agent's actual or apparent authority. (2) If intention, knowledge or recklessness is a fault element in relation to a physical element of an offence committed by an employee or agent of an individual, that fault element must be attributed to the individual if the individual expressly, tacitly or impliedly authorised or permitted the commission of the offence. Note for section 282 Part IIAA, Division 5, of the Criminal Code provides for the criminal responsibility of a body corporate for its employees and agents.
