140 Issuing and renewing licence (1) The Commission may issue and renew a licence if: (a) the applicant is eligible to apply for and hold the licence under Division 2; and (b) issuing or renewing the licence is in the public interest, considering any risk to the reputation of the Commission or the Territory; and (c) the applicant or application meets any other criteria for licensing prescribed by regulation. (2) If the Commission proposes to refuse to issue or renew a licence, the applicant must be given a written notice: (a) advising the applicant of the proposed refusal; and (b) stating the grounds for the proposed refusal; and (c) inviting the applicant to show cause, within a specified period of at least 10 business days, why the application should not be refused.
Racing and Wagering Act 2024 65 (3) If the applicant wishes to show cause why the application should not be refused, the applicant must make written submissions to the Commission within the period specified in the notice. (4) After considering any written submissions made by the applicant, the Commission must decide to: (a) issue, or refuse to issue, the licence; or (b) renew, or refuse to renew, the licence.
