108 Stay of decision (1) An application for an appeal under this Division does not stay the operation of the decision. (2) Despite subsection (1), the Chair of the Tribunal may stay the operation of the decision pending completion of the appeal. (3) In determining whether or not to stay the operation of a decision, the Chair must: (a) invite submissions from the appellant and the steward, race club or the race control body whose decision is the subject of the appeal; and (b) take into account any submissions received.
