57 Evidence
(1) Except as otherwise determined by the tribunal, an appeal must be
conducted by way of rehearing on the evidence at the original hearing,
but the tribunal may receive fresh evidence given orally or, if the
tribunal so determines, in writing.
Note It is an offence to make a false or misleading statement, give false or
misleading information or produce a false or misleading document (see
Criminal Code, pt 3.4).
(2) The tribunal may inform itself in any way it considers appropriate.
(3) The tribunal must give each party to an appeal a reasonable
opportunity to make submissions to the tribunal, to give evidence and
to call, examine or cross-examine witnesses.
