96C Transitional provision for change of expiry date of certificates of registration—Racing Acts (Amendment) Act 2002 (1) Any certificate of registration as a bookmaker issued under Part IV and in force at the commencement of section 9(3) of the **Racing Acts (Amendment) Act 2002** is deemed to cease to have effect on 30 September 2004 unless the certificate is sooner revoked by the Committee or sooner surrendered to the Committee. (2) Any certificate of registration as a bookmaker's clerk issued under Part IV and in force at the commencement of section 12(3) of the **Racing Acts (Amendment) Act 2002** is deemed to cease to have effect on 30 September 2004 unless the certificate is sooner revoked by the Committee. S. 96D inserted by No. 52/2009 s. 10. 96D Transitional provision for Racing Appeals Tribunal proceedings—Racing Legislation Amendment (Racing Integrity Assurance) Act 2009 (1) In this section— ***commencement day*** means the day on which section 9 of the **Racing Legislation Amendment (Racing Integrity Assurance) Act 2009** comes into operation. (2) If a hearing of an appeal by the Racing Appeals Tribunal under Part IIIB has begun and is not completed before the commencement day, on and after that day, Part IIIB is to continue to apply with respect to that appeal as if Part IIIB had not been repealed by section 9 of the **Racing Legislation Amendment (Racing Integrity Assurance) Act 2009**. (3) If an appeal has been made to the Racing Appeals Tribunal under Part IIIB before the commencement day, and the hearing of that appeal has not commenced before that day, on and after that day, the appeal is taken to be an application for review by VCAT under Part IIIBA.
