39 Harness Racing Victoria S. 39(1) substituted by No. 7000 s. 3(1), amended by Nos 8989 s. 2, 9671 s. 29, 16/2001 s. 10. (1) For the purpose of this Act there shall be a Board which shall be a body corporate in the name of Harness Racing Victoria and shall have perpetual succession and a common seal and be capable in law of suing and being sued and, subject to and for the purposes of this Act, of purchasing taking holding selling leasing taking on lease exchanging mortgaging or disposing of land or any real or personal property and of doing and suffering all such other acts and things as bodies corporate may by law do and suffer. (2) The Board consists of at least 5 but not more than 7 members appointed by the Governor in Council on the recommendation of the Minister. S. 39(2A) inserted by No. 50/2015 s. 6. (2A) The Governor in Council, on the recommendation of the Minister, must appoint a member of the Board to be chairperson. S. 39(2B) inserted by No. 50/2015 s. 6. (2B) The Minister may make a recommendation referred to in subsection (2) if, in the Minister's opinion, the individual has the necessary skills, experience and knowledge to assist the Board to carry out its functions. (4) Each member of the Board is severally entitled to be paid remuneration and travelling and other allowances (if any) that are fixed by the Governor in Council in respect of that member.
