sec.453 Dispute resolution in layered arrangement of community titles schemes

This section applies if— before the commencement, a person applied under former chapter 6, part 4 for the resolution of a dispute about a by-law made by a body corporate for a community titles scheme in a layered arrangement of community titles schemes; and the dispute is between the person and— the body corporate of another community titles scheme in the layered arrangement; or the owner or occupier of a lot in another community titles scheme in the layered arrangement; and immediately before the commencement, the dispute is not resolved. The dispute must be resolved under the Act as if the Body Corporate and Community Management and Other Legislation Amendment Act 2023 had not been enacted. s 453 ins 2023 No. 29 s 41 (sec.453-ssec.1) This section applies if— before the commencement, a person applied under former chapter 6, part 4 for the resolution of a dispute about a by-law made by a body corporate for a community titles scheme in a layered arrangement of community titles schemes; and the dispute is between the person and— the body corporate of another community titles scheme in the layered arrangement; or the owner or occupier of a lot in another community titles scheme in the layered arrangement; and immediately before the commencement, the dispute is not resolved. (sec.453-ssec.2) The dispute must be resolved under the Act as if the Body Corporate and Community Management and Other Legislation Amendment Act 2023 had not been enacted.

• (a) before the commencement, a person applied under former chapter 6, part 4 for the resolution of a dispute about a by-law made by a body corporate for a community titles scheme in a layered arrangement of community titles schemes; and
• (b) the dispute is between the person and— (i) the body corporate of another community titles scheme in the layered arrangement; or (ii) the owner or occupier of a lot in another community titles scheme in the layered arrangement; and
• (i) the body corporate of another community titles scheme in the layered arrangement; or
• (ii) the owner or occupier of a lot in another community titles scheme in the layered arrangement; and
• (c) immediately before the commencement, the dispute is not resolved.
• (i) the body corporate of another community titles scheme in the layered arrangement; or
• (ii) the owner or occupier of a lot in another community titles scheme in the layered arrangement; and
