sec.53 Trading hours
A provision of a retail shop lease that purports to impose on the lessee an obligation to open the leased shop for trading outside the core trading hours for the retail shopping centre is void. However, a provision of a retail shop lease that permits the lessee to open the leased shop for trading outside the core trading hours for the retail shopping centre by written agreement between the lessee and the lessor is not void under subsection (1) . For an existing lease, a provision mentioned in subsection (1) is void only to the extent that it requires the lessee to open the leased shop for trading outside the core trading hours for the centre. Also, for an existing lease, the lessor must not require the lessee to extend the hours that, immediately before the commencement of the Trading (Allowable Hours) Amendment Act 1994 , the lessee was required to keep the leased shop open for trading. Maximum penalty—100 penalty units. s 53 sub 2016 No. 21 s 53 (sec.53-ssec.1) A provision of a retail shop lease that purports to impose on the lessee an obligation to open the leased shop for trading outside the core trading hours for the retail shopping centre is void.
