sec.114 Ordinary protection and immunity allowed

A mediator has, in the performance of the mediator’s function, the same protection and immunity as a Supreme Court judge carrying out the functions of a judge. A person who is a party, or the party’s agent, appearing at a mediation process for a retail tenancy dispute or small business dispute has the same protection and immunity the person would have if the dispute were in the Supreme Court. A document produced at, or used for, a mediation process has the same protection during the process it would have if produced before the Supreme Court. In this section— mediation process includes a mediation process under the Small Business Commissioner Act 2022 . s 114 amd 2009 No. 24 s 1590 ; 2022 No. 5 s 70 (sec.114-ssec.1) A mediator has, in the performance of the mediator’s function, the same protection and immunity as a Supreme Court judge carrying out the functions of a judge.
