Public Trustee Regulations 1942

This instrument defines and operationalises a narrow set of concepts central to the Public Trustee’s day-to-day administration. The following are the main concepts the regulations introduce or clarify.

Estate (Regulation 1(2)): The regulations define the term “estate” very broadly for the purposes of the regulations. The definition explicitly includes trusts, estates and property which the Public Trustee may control, manage, administer or deal with in various representative capacities: trustee, executor, administrator, guardian, next friend, committee, manager, receiver, attorney or otherwise. That inclusive definition aligns the scope of these regulations with the diverse representative roles the Public Trustee can occupy under the Act (Regulation 1(2)).

Public Trust Office (Regulation 2): The regulations identify the Public Trust Office’s location as the city of Perth and state that any premises the Public Trustee occupies for carrying on the Public Trust Office’s business will be treated as the Public Trust Office for the purposes of the Act and regulations (Regulation 2). This operational definition ties regulatory obligations and procedural acts to an office located in Perth, while allowing the Public Trustee to move premises without further regulatory amendment.

Common seal (Regulation 3): The regulations prescribe the exact wording of the Public Trustee’s common seal , “The Common Seal of the Public Trustee, Western Australia” , and require it to be kept in the custody of the Public Trustee or another authorised officer (Regulation 3(i)-(ii)). The rule fixes formal identification for executed documents and allocates custody responsibility.

Forms and procedure (Regulations 4-5, First Schedule): The regulations require that claims against the Public Trustee be made in the form required by the Public Trustee (Regulation 4). They mandate the use of the specified forms in the First Schedule “for the purposes to which they are respectively applicable, with such variations as may be required” (Regulation 5). The First Schedule sets out a set of standardised notices, election forms for administering estates (intestate and testate), a revocation memorandum, and certificates of appointment and of Common Account advances (Forms Nos 1-7). These forms are tied to specific sections of the Act (for example, Section 14(1) is invoked in Forms 3, 3A, 3B) or to the Public Trustee’s own procedural processes (Form 5, Form 7).

Matters for written agreement (Regulation 6): Where the Act requires a written agreement under section 6B(1), the regulations prescribe the topics that must be addressed in that agreement. These are concentrated on financial and operational items: determining a scale of fees (s 38A(1) referenced), the proportion of fees to be credited to the Consolidated Account, the establishment and operation of reserve funds and strategic common accounts, transfers to and from reserve funds, uses for reserve funds, and the fixing of Common Account interest rates (Regulation 6(a)-(h)). The effect is to standardise what a written agreement under the Act must cover, focusing on the financial governance of the Public Trustee’s operations.

Public Trustee as next friend (Regulation 10): If the Public Trustee is the administrator or joint administrator of a represented person’s estate, any proceeding about property of that represented person, or recovery of damages for conversion or injury to such property, must be taken in the name of the represented person with the Public Trustee acting as next friend (Regulation 10). This requires litigation to be conducted nominally in the represented person’s name while recognising the trustee’s role in managing the action.

Prescribed amount (Regulation 10A): The regulations fix a specific monetary figure as the “prescribed amount” referenced in section 45(2) of the Act: $1,500 (Regulation 10A). That figure is used in Forms and in the Act to determine eligibility for certain procedures (see Forms 3/3A/3B referencing section 14(6) and the prescribed amount).

Court direction for procedure (Regulation 11): Where there is doubt about the mode of procedure the Public Trustee should adopt in a particular case, the regulations direct that the procedure should be such as the Court directs (Regulation 11). This delegates unresolved procedural matters to judicial direction.

Compilation and amendment history (Notes): The regulations include a compilation table showing successive Gazettal dates, reprints, and amendments. The table lists key amendments that inserted or deleted provisions, and it identifies the dates when reprints were authorised.

Collectively, these concepts show the regulations operate at the intersection of administrative formalities (seal, office location), standardised paperwork and notices (First Schedule forms), financial governance (matters to be included in written agreements under section 6B(1)), and procedural default rules (use forms; if in doubt, the Court decides). The regulations therefore function as a toolkit of procedural standardisation for the Public Trustee’s administrative and court-facing activities.

The regulations affect a narrowly defined set of actors whose rights, duties or procedures intersect with the Public Trustee’s administration of estates. The primary parties affected and how they are affected under the text follow.

Public Trustee: The regulations are directed at the Public Trustee first and foremost. The Public Trustee must keep the common seal bearing specified words, keep it in custody or authorise another officer to do so (Regulation 3). The Public Trustee is empowered to require claims to be presented in a form he or she prescribes (Regulation 4) and to use and adapt the forms set out in the First Schedule, with variations where required (Regulation 5). The Public Trustee also has the operational responsibility for establishing and operating reserve funds, fixing Common Account interest rates and fee scales to the extent those matters are dealt with under a written agreement per Regulation 6 and the Act.

Estate beneficiaries, creditors, and claimants: Persons with claims or demands against estates administered by the Public Trustee are affected by the notice and form requirements. Form No. 1 and Form No. 2 show the mechanism for notifying creditors and claimants and set deadlines for submitting particulars of claims if persons wish to participate in distributions. Regulation 4 requires that every claim upon the Public Trustee be made in the form required by the Public Trustee, so these persons must comply with the Public Trustee’s prescribed format.

Represented persons: Where the Public Trustee is administrator or joint administrator of a represented person’s estate, the regulations require proceedings to be taken in the name of the represented person with the Public Trustee acting as next friend (Regulation 10). This affects legal capacity in litigation and the nominal party to proceedings.

Legal practitioners and the Supreme Court: The forms are expressly drafted for use in the Supreme Court’s probate jurisdiction (see Form No. 1 heading: “In the Supreme Court of Western Australia , Probate Jurisdiction”; Forms Nos 3, 3A, 3B, 4). The Court is given the final procedural direction where doubt exists about the mode of proceeding the Public Trustee should adopt (Regulation 11). Lawyers acting for estates, claimants, or the Public Trustee must therefore operate within the forms and procedural directions set out.

Media or notice publishers: Form No. 2 requires the Public Trustee to arrange insertion of the notice to creditors in a newspaper and to forward the account with a copy of the paper to the Public Trust Office. The regulation therefore indirectly affects newspaper managers or publishers who carry such notices (First Schedule, Form No. 2).

Treasury/Consolidated Account and public finance: Regulation 6 explicitly contemplates the proportion of fees received by the Public Trustee that are to be credited to the Consolidated Account and the establishment and crediting of reserve funds, and these items are to be dealt with in written agreements under section 6B(1) of the Act. Parties responsible for public accounts and the Consolidated Account (for example Treasury) will be affected by agreements on crediting proportions and reserve fund arrangements, though the regulatory text itself does not specify the counterparties.

Persons or entities dealing with the Public Trustee’s Common Account: Regulation 6(g) addresses the fixing of the rate or rates of Common Account interest, and Form No. 7 is a certificate of amount owing for advances from the Public Trustee Common Account (First Schedule, Form No. 7). Anyone transacting with the Public Trustee’s Common Account or relying on certificates of amount owing will be affected.

Administrators of estates (other than the Public Trustee): The forms anticipate other administrators or executors, and Form No. 4 permits revocation of an election by the Public Trustee where the gross value of the property exceeds the prescribed amount or where property lies outside the State. That affects the administration choices of private administrators and the interface between private and public administration.

Regulatory and judicial actors: The Court’s role in directing procedure (Regulation 11) places judges in a gatekeeping role if procedural uncertainty arises. Administrative officers who may be authorised by the Public Trustee to keep the common seal or carry out office functions are also implicated by the custody rule (Regulation 3(ii)).

Who pays and who decides: The regulations establish that claimants must present claims in the forms the Public Trustee requires (Regulation 4); the Public Trustee determines form content and may vary the standard forms (Regulation 5). Fee-setting and the allocation of fee income to consolidated public funds are matters to be dealt with in written agreements (Regulation 6), thereby affecting who ultimately bears the cost of administration (estate assets, beneficiaries, or public accounts) but leaving the specific incidence of fees to be determined under those agreements. The Court retains the power to direct procedure when the Public Trustee faces uncertainty (Regulation 11).

In short, the instrument primarily affects the Public Trustee and the persons who interact with the Public Trustee in the administration of estates, court litigation concerning estates, and the financial governance of trustee operations; it also touches ancillary actors such as media publishers and those responsible for public accounts where the written agreements contemplated by the regulations transfer fees to the Consolidated Account or establish reserve funds.

The regulations create several discrete duties for the Public Trustee and impose procedural obligations on third parties interacting with the Public Trustee. They also establish specific rights or capacities. Below are the principal duties and rights the instrument contains, with references to the operative provisions.

Duties placed on the Public Trustee

• Maintain the Public Trust Office in Perth: The Public Trustee must treat the premises occupied for carrying on the business as the Public Trust Office for the purposes of the Act and these regulations (Regulation 2). The duty establishes a regulatory address and administrative locus.

• Keep the common seal and ensure custody: The regulations require the common seal to bear prescribed wording and to be kept in the custody of the Public Trustee or an authorised officer (Regulation 3(i)-(ii)). The duty includes ensuring authorised custody and using the seal to identify documents.

• Prescribe forms and require their use: The Public Trustee must require that every claim upon the Public Trustee be made in the form he or she requires (Regulation 4). In practice the Public Trustee must adopt the First Schedule forms for the purposes to which they apply, allowing whatever variations are required (Regulation 5). These duties delegate considerable procedural detail to the office-holder to determine specific form content and permissible variations.

• Include specified matters in written agreements under section 6B(1): Where section 6B(1) of the Act requires a written agreement, the Public Trustee must ensure that the agreement deals with the matters listed in Regulation 6(a)-(h): fee scale determination under s 38A(1), the proportion of fees credited to the Consolidated Account, reserve funds (establishment, moneys credited, circumstances for transfers, permitted uses), Common Account interest rates, and strategic common accounts (Regulation 6). The duty channels operational financial governance into written agreements.

• Conduct litigation for represented persons as next friend: If the Public Trustee is administrator or joint administrator for a represented person, proceedings about that person’s property, or recovery of damages, must be taken in the name of the represented person with the Public Trustee as next friend (Regulation 10). This is a duty about how proceedings are to be framed.

• Certify appointments and advances: The Public Trustee must provide certificates of appointment or authority in the prescribed form (Form No. 5), and certificates of amount of advance from the Common Account in the prescribed form (Form No. 7). These certifications are official acts the Public Trustee must perform where applicable.

Procedural duty to seek Court direction in doubt: Where there is doubt as to the mode of procedure to be adopted by the Public Trustee in any particular case, the regulations require the Public Trustee to adopt the procedure directed by the Court (Regulation 11). This duty imposes a pathway to resolve procedural uncertainty through the judiciary.

Obligations placed on third parties and rights conferred

• Claims must be in prescribed form: Any person making a claim on the Public Trustee must do so in the form required by the Public Trustee (Regulation 4). That is an obligation of claimants and creditors.

• Creditors and claimants must provide particulars by a set date: The notice forms (Form No. 1) require persons with claims or demands against an estate to send particulars in writing before a specified day, after which distribution will proceed having regard only to claims of which the Public Trustee has notice. That places a duty on claimants to lodge claims within the timeframe set and grants the Public Trustee the practical right to proceed to distribution after the date without regard to claims not notified.

• Right to elect administration in low-value estates: Forms No. 3/3A/3B provide the vehicle for the Public Trustee to elect to administer intestate or testate estates where their gross value does not exceed the prescribed amount (see references to section 14(1) in those Forms and the prescribed amount defined in Regulation 10A). Where the Public Trustee elects, this creates an administered estate under Public Trustee authority; Form No. 4 allows the Public Trustee to revoke that election if the estate later exceeds the prescribed amount or contains property outside the State.

• Right to certification: The Public Trustee may issue certificatory documents formally recognising appointment or amounts owing under the Common Account (Forms No. 5 and No. 7). Those certificates function as evidentiary instruments in dealings with third parties.

• Right to require newspaper publication and recover costs: Form No. 2 is a template instruction to a newspaper manager to insert a notice to creditors and to forward the account and a copy of the paper to the Public Trust Office, implying the Public Trustee may require publication of notices as part of the administration process and obtain the newspaper’s account for payment.

Matters left to other law or to the Act

• Fee scales and financial allocation: While the regulations require certain topics to be addressed in written agreements (Regulation 6), they do not themselves set fee levels or specify proportions for credit to the Consolidated Account. Those substantive determinations are left to the written agreements required by the Act and to the Act’s fee provisions such as section 38A(1), which is referenced.

• Procedure where not specified: The regulations do not specify every procedural contingency; in cases of doubt the Court will decide (Regulation 11).

Notable absences

• The regulations do not create penalties or administrative sanctions for non-compliance with the procedural requirements set out here. They also do not specify enforcement mechanisms beyond Court proceedings and the Public Trustee’s own administrative acts. Any substantive enforcement or criminal offences would lie in the principal Act or other statutes, not in these regulations.

Taken together, the instrument places procedural duties on the Public Trustee to adopt and use specified formalities and to address specified financial governance matters in written agreements, while imposing form-based obligations on claimants and creditors and granting the Public Trustee certain administrative rights (to certify, to elect to administer small estates, to publish notices). The Court retains a supervisory procedural role when the regulations leave ambiguity.

The regulations contain no express penalty or offence provisions. They do not prescribe fines, imprisonment, or specific administrative sanctions for failing to comply with the forms or procedural directions set out. Enforcement mechanisms are therefore implicit and occur through one or more of these channels set out or implied in the regulations and First Schedule.

Judicial supervision and direction (Regulation 11): Where there is doubt as to the mode of procedure to be adopted by the Public Trustee in any particular case, the regulations direct that the procedure shall be such as the Court directs (Regulation 11). This provision establishes the Court as the ultimate procedural arbiter for the Public Trustee. In practice, challenging procedures or seeking direction about compliance would occur by application to the Supreme Court (referenced in the First Schedule forms as the Probate Jurisdiction). Judicial directions can be enforced by the Court’s powers under the Supreme Court’s jurisdiction, including orders about the conduct of litigation and administration.

Effect of form and notice deadlines on distribution (First Schedule, Form No. 1): The notice to creditors and claimants (Form No. 1) informs readers that the Public Trustee will proceed to distribute assets after a specified date “having regard only to those claims of which I shall then have had notice.” Although no penalty is stated for late claims, the procedural consequence formulated in the notice is clear: claims not lodged by the date may be excluded from distribution. Exclusion from participation in distribution is a practical and financial enforcement mechanism, not a criminal sanction.

Certification of entitlements and amounts (Forms Nos 5 and 7): The ability of the Public Trustee to furnish a certificate of appointment or of amounts owing for advances from the Common Account supplies evidence enforceable in dealings or litigation. These documents carry legal weight in commercial dealings and litigation, and their issuance and use would be enforceable in courts as admissible evidence; the regulations do not create the power but set the form for those certificates.

Publication requirements and associated costs (Form No. 2): The First Schedule contemplates the Public Trustee instructing a newspaper to publish a notice to creditors and forwarding the account for payment. While the regulation does not itself create an offence for failing to publish, the implication is that the Public Trustee may rely on publication as a procedural step in administering estates and may incur costs recoverable from estate assets. Failure to publish could expose an administration to challenge in Court, but the regulations themselves do not set penalties.

Financial governance via written agreements (Regulation 6): Regulation 6 prescribes matters that must be dealt with in a written agreement under section 6B(1) of the Act, including the determination of fee scales and crediting of fees to the Consolidated Account. Any enforcement of those contractual or statutory obligations will be through contractual remedies and applicable public finance law rather than through an express penalty in the regulations themselves.

Absence of administratively imposed fines or internal disciplinary rules: The regulations do not provide internal disciplinary or administrative penalty mechanisms for officers of the Public Trustee or for third parties who fail to follow the prescribed forms. That does not exclude such measures elsewhere under the Act, public sector employment law, or general legal mechanisms (e.g., contempt of Court), but the regulation text is silent on such instruments.

Interaction with the Act and other statutes: Enforcement in practice will therefore rely on the Public Trustee Act 1941 and other written laws for penalties, and on the Court’s jurisdiction to give directions and enforce compliance with judicial orders (Regulation 11 and numerous references to the Supreme Court in the First Schedule). The compilation notes also draw attention to savings provisions in amendment regulations related to property under the Crimes (Confiscation of Profits) Act 1988 and consequential provisions, indicating transitional enforcement or application arrangements may have been preserved by later amendments (Notes, compilation table and Note 3).

In summary, the regulations set procedural and evidential forms and delegate unresolved procedural issues to judicial direction, but they do not themselves articulate penalty regimes. The practical enforcement levers available under these regulations are judicial direction, evidentiary weight of certificates and notices, and the statutory framework and contractual remedies provided in the principal Act and associated written laws.

The regulations operate as subordinate instruments to the Public Trustee Act 1941 and repeatedly cross‑refer to sections of that Act. They also interact indirectly with public finance mechanisms (the Consolidated Account), and with other statutes by way of transitional or savings provisions recorded in the compilation notes. The key interactions and how they are structured are set out below.

Direct references to the Public Trustee Act 1941

• Section cross-references in the forms and regulations: Several regulations and forms expressly reference sections of the Act. Regulation 6 prescribes matters “for the purposes of section 6B(1) of the Act,” listing the matters a written agreement must address, including determining a scale of fees under section 38A(1) (Regulation 6(a) and 6(g)). The First Schedule’s Form No. 3 and related election forms refer to “section 14(1)” and “section 14(6)” of the Act, which determine when the Public Trustee is entitled to elect to administer small (prescribed amount) estates. The certificate form links to “Section 59” and Form No. 7 refers to “Section 44(6)” (First Schedule, Forms Nos 5 and 7). Regulation 10A explicitly designates the “prescribed amount” referred to in section 45(2) of the Act as $1,500. Those cross-references show the regulations function primarily to operationalise the Act’s provisions.

• Matters left to the Act and written agreements: Regulation 6 requires written agreements to address certain topics, but it does not itself set fees, interest rates, or reserve balances; instead, it prescribes the topics that must be covered in agreements required by section 6B(1). The substantive content of fee scales and financial allocations therefore depend on the Act’s powers and the terms of those written agreements.

Interaction with court jurisdiction and procedure

• Supreme Court and Probate Jurisdiction: The First Schedule’s forms are explicitly framed for use in the Supreme Court of Western Australia in its probate jurisdiction. Regulation 11 provides that in the event of doubt about the Public Trustee’s procedure, the procedure must be such as the Court directs. The regulations thereby funnel unresolved procedural disputes into the Court’s supervisory jurisdiction.

Interaction with public finance and Consolidated Account

• Crediting fees to the Consolidated Account: Regulation 6(b) requires written agreements under s 6B(1) to deal with “the proportion of fees received by the Public Trustee to be credited to the Consolidated Account.” This links the Public Trustee’s fee income to State consolidated revenue mechanisms. Although the regulation does not specify the proportion, it mandates that the allocation be addressed contractually or administratively in the written agreement envisaged by the Act.

Interaction with other Acts through compilation notes and savings

• Crimes (Confiscation of Profits) Act 1988 and Criminal Property Confiscation: The compilation notes include a specific saving provision reproduced from the Public Trustee (Amendment) Regulations (No. 2) 2000 r. 5. That provision preserves the application of pre-existing fee provisions to property that was in the Public Trustee’s control under the Crimes (Confiscation of Profits) Act 1988 immediately before commencement of the amendment regulations, and to property of which the Public Trustee has care or control under that Act as a result of later consequential provisions. This indicates that the regulations have been adjusted with attention to the interaction of confiscation property administration and the Public Trustee’s fee regime, leaving transitional arrangements in place (Compilation table note 3). The regulations therefore do not operate in isolation where property subject to confiscation or criminal property legislation is involved.

State public law and regulations architecture

• Reprints and amendment history: The compilation table shows repeated amendments and reprints across decades, indicating the regulations’ terms and specific thresholds (such as the prescribed amount) have been revised and that the regulations are treated as a dynamic instrument within Western Australia’s subordinate legislation framework. Amendments that delete provisions (for example, 6AA, 6A, 7, 8, 9, and the Second Schedule) may reflect consequential changes to the Act or to administrative practice requiring that the regulations be kept in step with other statutory reforms.

Implications for regulatory and contractual relationships

• Written agreements under section 6B(1): By fixing the subjects to be dealt with in written agreements (Regulation 6), the regulations shape the contractual interface between the Public Trustee and other parties (potentially the Treasurer, the State, or contractors). Those agreements will interact with public finance laws (Consolidated Account rules) and with the Act’s fee provisions to define the financial regime for operation of the Public Trustee.

Gaps where the Act provides substantive law: The regulations intentionally leave substantive determinations to the Act or to instruments and agreements the Act empowers (such as fee scales under s 38A(1) and the written agreements under s 6B(1)). The regulations are therefore a procedural and evidential complement to the Act, not a substitute for it.

In summary, the regulations operationally interact with the Public Trustee Act 1941 through explicit cross‑references, funnel procedural uncertainty to the Supreme Court, tie fee and reserve fund issues to public finance mechanisms such as the Consolidated Account via required written agreements, and are sensitive to other statutory domains such as confiscation and criminal property regimes through transitional provisions recorded in the compilation notes. The regulatory design reserves substantive financial and enforcement detail to the Act and to specific written agreements, while standardising forms and office practice.

The regulations include a detailed compilation table and embedded amendment notes showing a long history of amendment, repeals of particular provisions, reprints and consolidations. The table records initial Gazettal in 1942 and multiple subsequent amendments and reprints through to at least 2008. The amendment history in the instrument provides both the timeline of changes and specific insertions, deletions and reprints, as summarised below.

Early enactment and immediate amendments (1942-1956): The regulations began as untitled regulations Gazetted on 26 June 1942, followed by subsequent Gazettal entries in November 1942, July 1943 and January and May 1944. A reprint was authorised 28 June 1956 (Gazette 5 July 1956). Regulation 2 was amended as early as 19 May 1944, which corresponds to the change in the Public Trust Office location clause.

Mid‑20th century modifications and reprint (1969-1979): The compilation table lists Gazettal entries in 1969 and a set of amendments published on 30 June 1972, with a commencement date of 1 July 1972 for that instrument. Another Gazettal entry in December 1973 noted an effect from 1 January 1974. A set of amendments on 18 August 1978 was recorded and a reprint was authorised on 10 January 1979 (Gazette 17 January 1979).

Further amendments (1980s-1990s): The table records amendments in 1980 and an important 1984 amendment which inserted Regulation 1 (citation and interpretation) and the estate definition (Gazette 28 September 1984, operative 1 October 1984). The 1986 amendments included insertion of Regulation 10A (prescribed amount) at Gazette 5 September 1986, and the 1991 amendments revised Regulation 10A again (Gazette 6 September 1991). Amendments continued in 1992 and 1993 with the insertion of Regulation 10 regarding next friend (Gazette 20 July 1993). Several additional amendments were made in the 1990s to adjust procedural and administrative details.

Reprints and consolidations (2000-2006): A reprint of the Public Trustee Regulations as at 3 October 2000 was issued, covering prior amendments. Amendment regulations in 2000 (two instruments) and 2001-2004 continued to adjust the regulations, with a reprint (Reprint 4) of the Public Trustee Regulations 1942 as at 17 March 2006.

2008 amendments and deletions: The Public Trustee Amendment Regulations 2008 (Gazette 24 June 2008) inserted Regulation 6 prescribing the matters to be dealt with in written agreements under s 6B(1) of the Act, and made other changes including the deletion of several provisions (Regulations 6AA, 6A and 7 and other numbered provisions had been deleted in earlier Gazettes as recorded in the text). The 2008 instrument also amended the First Schedule forms and consolidated changes that had occurred since the prior reprint.

Notable insertions and deletions documented in the regulations: The instrument includes bracketed notes indicating deletion of provisions: “6AA, 6A and 7. Deleted: Gazette 24 Jun 2008 p. 2888.” It also records deletion of earlier provisions by Gazette references in 1947 and 1969. The First Schedule heading was inserted in 1972, and some forms have been inserted, amended or deleted across time (for example, Form No. 6 was deleted in 1978; Forms 3A and 3B were inserted in 1978).

Savings and transitional provisions in amendment instruments: The compilation notes include a specific saving clause reproduced from the Public Trustee (Amendment) Regulations (No. 2) 2000 r. 5. That clause preserved the application of prior fee arrangements to property under the Crimes (Confiscation of Profits) Act 1988 or to property taken into care or control under related consequential legislation. This note indicates the drafters and amenders have paid attention to transitional continuity where the regulations interface with other statutory regimes.

Temporal effect of amendments: The compilation table gives precise Gazettal dates and the commencement dates (where specified) for each amending instrument. For instance, the 1984 amendment had an operative commencement date of 1 October 1984 (see r. 2), and the 2008 amendment instrument’s regulations other than r. 1 and 2 took effect on 1 July 2008.

Practical consequence of the amendment history: The regulatory text shows an evolutionary approach: the regulations started with a basic set of administrative rules in the 1940s, with successive amendments adding forms, specifying interpretation, and later focusing the instrument around procedural matters and financial governance (notably Regulation 6 in 2008 addressing fee allocation and reserve funds). The regular reprints indicate consolidation steps to gather amendments into a coherent printed text, while specific deletion notes indicate removal of now-unnecessary provisions.

Conclusion on history: The amendment history in the document is detailed and provides a transparent trail of when the regulations were modified. Because the instrument leaves substantive matters such as fee quantum and certain governance choices to written agreements or the principal Act, many amendments have addressed procedural form, interpretative clarifications, thresholds (such as the prescribed amount) and deletions of obsolete clauses. The compilation table and Gazette references contained within the regulations are the authoritative source for the legislative chronology of these regulations.

The regulations themselves do not include a record of litigation concerning their interpretation or application. No decided cases are cited or reproduced in the instrument. The First Schedule nevertheless frames many actions explicitly in the Supreme Court’s probate jurisdiction (for example, Forms Nos 1, 3, 3A, 3B, 4 refer to “In the Supreme Court of Western Australia , Probate Jurisdiction”), and Regulation 11 expressly provides that where there is doubt about procedural mode the Public Trustee shall adopt the procedure directed by the Court. Those features point to the Supreme Court as the forum in which disputes about procedure or the proper exercise of the Public Trustee’s powers under these regulations would be litigated.

What the instrument itself reveals about litigation avenues

• Probate jurisdiction as the primary forum: The forms are designed for use in the Supreme Court , Probate Jurisdiction , indicating that probate and administration disputes that involve the Public Trustee are expected to be determined by the Supreme Court. The forms anticipate the Public Trustee filing election forms, revocations, and certificates in the Court (First Schedule, Forms Nos 3-5).

• Court direction for procedural doubt (Regulation 11): By designating the Court as the decision-maker where procedural doubt exists, the regulations channel procedural disputes to judicial resolution. This establishes litigation risk for novel procedural questions and anticipates the Supreme Court’s role in supervising the Public Trustee’s conduct.

• Use of certificates as documentary evidence (Forms Nos 5 and 7): The availability of statutory forms for certificates implies that evidentiary disputes about appointment or amounts owing can be addressed in Court with those certificates forming substantive documentary evidence. Disputes may arise over the correctness of certificates or the underlying transactions.

Lack of recorded cases or reported decisions in the instrument

• No cases are named in the regulations: The instrument does not cite, summarise, or list any litigation involving the Public Trustee or these regulations. Therefore the regulations do not themselves provide a litigation history.

• Implication for research: To identify litigation that has interpreted these regulations or the corresponding Act, one must search the Supreme Court of Western Australia’s probate decisions, any appellate decisions involving the Public Trustee, and regulatory or administrative law reports dealing with the Public Trustee’s functions. The regulations do not provide those references.

Potential categories of disputes that would be litigated, based on the text

• Procedural disputes: Given Regulation 11’s default to Court direction, disputes about the appropriate procedure the Public Trustee should adopt in ambiguous cases would be litigated.

• Notice and adjudication of creditor claims: Form No. 1 sets a deadline for creditor claims; disputes over late claims, sufficiency of notice, or whether the Public Trustee properly excluded a claimant from distribution would be for Court resolution.

• Election and revocation to administer estates: The Public Trustee’s election to administer small estates (Forms Nos 3/3A/3B) and subsequent revocation (Form No. 4) , for instance where the prescribed amount threshold or presence of property outside the State is contested , could give rise to litigation about the Public Trustee’s entitlement to administer and the effects on other persons’ rights.

• Financial governance and written agreements: Regulation 6 requires written agreements to address specified items (fees, reserve funds, Common Account interest). Disputes about whether an agreement complies with Regulation 6 or about how fees are allocated could be litigated or subject to administrative review.

• Evidentiary disputes about certificates: Challenges to the contents or effect of certificates of appointment or of Common Account advances (Forms Nos 5 and 7) could arise in commercial disputes or claims against the Public Trustee.

Conclusion on litigation history: The regulations designate the Supreme Court as the forum for procedural direction and provide forms used in that jurisdiction, but they contain no internal litigation history. To compile a litigation history relevant to these regulations one must consult external case law databases and published judgments of the Supreme Court of Western Australia and appellate courts, since the regulations themselves contain no case citations or summaries.

Several practical pitfalls and sources of uncertainty arise from the regulatory text. Below are the principal “gotchas” that practitioners and administrators should watch for, with references to the regulatory provisions that create or expose the risks.

Mandatory form compliance with discretionary detail (Regulation 4; Regulation 5): Regulation 4 requires every claim upon the Public Trustee to be made “in the form required by the Public Trustee.” Regulation 5 requires the use of the First Schedule forms “with such variations as may be required.” Practically, those provisions grant the Public Trustee significant procedural discretion to prescribe form content and to require variations. A claimant who files a claim that does not conform to the Public Trustee’s required form risks procedural rejection or delay; because “such variations as may be required” is open-ended, parties cannot always anticipate the precise content the Public Trustee will insist on. Legal practitioners should confirm the current form requirements with the Public Trust Office before filing.

Prescribed amount fixed by regulation (Regulation 10A) and potential obsolescence: Regulation 10A sets the “prescribed amount” referred to in section 45(2) of the Act at $1,500. The regulation does not tie the figure to inflation, indexation, or periodic review. Consequently, the monetary threshold could become out of step with economic conditions. Any reliance on the threshold for eligibility to Public Trustee administration or other statutory effects must account for the possibility that the figure may be old and set by regulatory amendment rather than indexed statutory formula. Practitioners should verify whether the prescribed amount has been amended since Gazette entries recorded here.

Use of Court direction in cases of doubt (Regulation 11): Regulation 11 makes the Court the fallback for procedural doubt. That is practical if clarity is required, but it creates a time and cost risk: obtaining a Court direction can be slow and expensive relative to an administrative clarification. Where the Public Trustee or a counterparty faces a novel procedural question, expect potential litigation or an application for directions in the Supreme Court.

Notice deadlines and distribution consequences (First Schedule, Form No. 1): The notice to creditors warns the public that after a specified date the Public Trustee “will proceed to distribute the assets … having regard only to those claims of which I shall then have had notice.” There is no express provision in the regulations for reopening distributions if a valid claim is late. The practical consequence is that late claimants may be excluded unless they obtain relief from the Court; this raises the risk of litigation against the Public Trustee or applications to the Court for relief.

Delegation and custody of the common seal (Regulation 3(ii)): The regulations permit custody of the common seal to be with the Public Trustee or “such other officer as is authorised by him.” The text gives the Public Trustee the power to authorise custody, but does not state the conditions or records required for authorisation. Absent internal policy or Act provisions on delegation, disputes could arise over the validity of sealed documents if authorisation is informal or not documented.

Financial governance left to written agreements (Regulation 6): Regulation 6 prescribes the matters that must be dealt with in written agreements under section 6B(1) of the Act (fee scale, proportion to Consolidated Account, reserve funds, Common Account interest rates, strategic common accounts). However, it does not specify the required form, approval process or ministerial counterparty for such agreements. The absence of a detailed governance procedure or an express approval path might create uncertainty about who signs, how public funds are credited, or how reserve funds are audited.

Form language invoking the Supreme Court (First Schedule): The First Schedule forms are drafted for the Supreme Court’s probate jurisdiction. Using those forms in administrative processes outside the Court context might be inappropriate or misapplied. Practitioners should ensure the chosen form matches the forum and procedural context.

Deleted provisions (notes and bracketed deletions): The regulations show multiple deletions (for example, 6AA, 6A and 7; Second Schedule) across the instrument’s history. If a practitioner expects certain previously present powers or procedures, they must verify whether those provisions remain in force or have been removed by amendment.

Transitional savings and special categories of property (Compilation notes, Note 3): The compilation notes include a saving for property in the Public Trustee’s control under the Crimes (Confiscation of Profits) Act 1988 and for property affected by the Criminal Property Confiscation (Consequential Provisions) Act 2000. Those transitional arrangements can affect how fees and charges are applied to confiscated property or property subject to criminal confiscation, and practitioners dealing with such property must check the saving provisions in the relevant amending regulations.

Practical “gotchas” checklist

• Always obtain the current version of the Public Trustee’s required claim form before lodging a claim (Regulation 4).

• Check whether the prescribed amount of $1,500 (Regulation 10A) remains current in the reprint or subsequent amendments for eligibility thresholds.

• When in doubt about procedure, be prepared to seek a Court direction (Regulation 11); do not assume administrative clarification will suffice.

• Use the First Schedule forms for their intended Probate Jurisdiction context and verify that any modifications are permissible under Regulation 5.

• Expect the Public Trustee to require publication of notices and to recover publication costs from the estate; confirm publication practice and timing so claimants are not disadvantaged (Form No. 2).

• For financial and contract issues (fees, reserve funds, Common Account interest), look for a written agreement under s 6B(1) that complies with Regulation 6’s list of topics; absence of such an agreement or lack of clarity within one is a likely point of dispute.

By understanding these specific operational risks embedded in the regulatory text, practitioners can avoid procedural mistakes and reduce exposure to costly litigation or unintended loss of rights.

Compliance with these regulations requires attention to form, timely action on deadlines, proper administrative practice within the Public Trustee’s office, and an understanding of where substantive matters are governed by the Act or by written agreements. The following practical steps and checks align with the text.

1. Use and confirm current forms before acting (Regulations 4-5; First Schedule)

• Before lodging any claim against the Public Trustee, obtain the Public Trustee’s currently required claim form. Regulation 4 mandates that every claim upon the Public Trustee be made in the form required by the Public Trustee.
• Where an action or notice involves a form in the First Schedule, use the relevant Form No. (for example, Form No. 1 for “Notice to Creditors and Claimants”; Forms Nos 3/3A/3B for election by the Public Trustee to administer an estate). Regulation 5 requires the use of those forms for their respective purposes, subject to necessary variations. If a variation is needed, confirm in writing whether the Public Trustee permits it and record the basis for the variation.

2. Observe notice deadlines and publication requirements (First Schedule, Form No. 1 and Form No. 2)

• If you represent creditors or claimants, monitor notices published by the Public Trustee and ensure particulars of claims are provided in writing by the date specified in the public notice (Form No. 1). The notice unambiguously states distribution will proceed after the specified date having regard only to claims notified by then.
• If you are the Public Trustee ordering publication of a notice, use Form No. 2 as the template for instructing a newspaper manager, ensure the advertisement is placed once in the next issue as requested, and keep the publisher’s account for payment and record-keeping.

3. For estate administration elections and revocations, follow the probate form procedures (First Schedule, Forms Nos 3-4)

• When the Public Trustee elects to administer an intestate or testate estate under section 14(1) of the Act, complete the applicable Form No. 3 (intestate) or Form No. 3A/3B (testate), and ensure the form accurately states the gross value and whether the estate is within the prescribed amount as defined in Regulation 10A.
• If circumstances change (e.g., the gross value later exceeds the prescribed amount or property is found outside the State), use Form No. 4 to revoke an election; ensure the revocation states the factual basis (location outside State or valuation exceeding prescribed amount).

4. Ensure certificates are issued in prescribed form when required (First Schedule, Forms Nos 5 and 7)

• When issuing a certificate of appointment or authority (Form No. 5) or a certificate of amount of advance from the Common Account (Form No. 7), complete the prescribed form and affix the common seal if appropriate (Regulation 3 and First Schedule references). Maintain accurate internal records supporting the certificate to withstand scrutiny in Court or commercial transactions.

5. Where written agreements are required under section 6B(1), ensure they address Regulation 6’s topics

• For any written agreement required under s 6B(1) of the Act, include the matters listed in Regulation 6(a)-(h): fee scale determination under s 38A(1); the proportion of fees to be credited to the Consolidated Account; establishment and operation of reserve funds; moneys to be credited to reserve funds; circumstances for transfers to/from a reserve fund; permitted uses for reserve funds; fixing Common Account interest rate(s); and the establishment and operation of strategic common accounts.
• Ensure the agreement is executed by authorised signatories and that records are kept for public finance audits or scrutiny regarding crediting to the Consolidated Account.

6. Maintain proper custody and delegation records for the common seal (Regulation 3)

• The common seal must bear the specified words and be kept in the custody of the Public Trustee or an authorised officer (Regulation 3). If custody is delegated, document the authorisation carefully (who authorised it, when, under what authority) and maintain a seal register recording use, date, document sealed and authorising officer.

7. Prepare for Court direction where procedure is uncertain (Regulation 11)

• If a procedural question cannot be answered administratively, seek a Court direction promptly. Regulation 11 requires that in case of doubt the Public Trustee adopt the procedure the Court directs; therefore procedural compliance may necessitate an interlocutory application for directions in the Supreme Court. Budget for delay and legal costs in such cases.

8. Track and apply the prescribed amount correctly (Regulation 10A)

• For threshold determinations under the Act that reference the “prescribed amount,” apply the figure specified in Regulation 10A ($1,500) unless a later amending regulation has altered it. Confirm the currency of that figure before relying on it in valuation-based determinations or elections to administer estates.

9. Record-keeping and audit trail

• Keep contemporaneous records showing that forms were used as required, notices were published, certificates were issued and sealed documents were properly authorised. These records will be important in defending challenges, proving compliance, and responding to public finance audits concerning fees credited to the Consolidated Account or reserve fund operations under Regulation 6.

10. Be aware of transitional or special categories of property

• If dealing with property subject to confiscation or criminal property regimes (as referred to in compilation note 3), check the relevant amendment instruments and the specific saving clauses that preserve pre-existing fee or procedural arrangements. Transitional instruments may preserve earlier regulatory regimes for particular classes of property.

Practical compliance checklist for lawyers and administrators

• Confirm the current version of the Public Trustee’s claim form and use it (Regulation 4).
• Verify the prescribed amount for threshold tests and whether any subsequent amendments have changed it (Regulation 10A).
• When drafting or reviewing written agreements under s 6B(1), ensure Regulation 6 topics are comprehensively addressed.
• If a dispute about procedure is likely, prepare an application for directions to the Supreme Court early to reduce uncertainty (Regulation 11).
• Maintain a documented seal register and clear delegation records if custody is delegated (Regulation 3).
• For notice-based processes, ensure publication is effected as required, retain proofs of publication and accounts (First Schedule, Form No. 2).
• Ensure certificates (Forms Nos 5 and 7) are issued in the prescribed form and that underlying records support their content.

Following these steps aligns administrative practice with the written requirements of the regulations and reduces procedural risk. Where the regulations do not prescribe substance (for example, fee quantum or proportion to be credited to Consolidated Account), ensure that contracts and written agreements under the Act explicitly address the Regulation 6(a)-(h) items and record any ministerial or Treasury approvals required by public finance laws.
