#### 41 Offence of unlawfully recovering property 41 Offence of unlawfully recovering property > > (1) A person must not, without lawful authority— > > > > > (a) recover or attempt to recover property the person knows has been taken into the possession of an authority under this Act, or > > > > > (b) incite or assist another person to recover property the person knows has been taken into the possession of an authority under this Act. > > > > Maximum penalty—50 penalty units. > > > (2) A court that finds a person guilty of an offence under this section may order the person to pay to the authority the fees that would have been payable to the authority for the return of the item had it not been recovered, whether or not the court imposes a penalty for the offence.
