#### 40 Offence of causing or permitting animal to trespass 40 Offence of causing or permitting animal to trespass > > (1) A person must not allow an animal under the person’s control to be on private land without the permission of the occupier of the land. > > > > Maximum penalty— > > > > > (a) for the first animal—25 penalty units, and > > > > > (b) for each additional animal—5 penalty units, but not more than a maximum of 50 penalty units. > > > (2) A court that convicts a person of an offence under this section may order the person to pay to an authority the amount payable under section 55 in relation to taking possession of, keeping and disposing of the animal, whether or not the court imposes a penalty for the offence.
