What it does
This instrument, the Public Service (Terms and Conditions of Employment) (Parliamentary Workplace Support Service) Determination 2024, applies a pre‑existing enterprise agreement as the operative terms and conditions of employment for a defined group of Commonwealth public servants. Mechanically it does four principal things.
First, it declares that the terms and conditions applying to non‑SES employees in the Parliamentary Workplace Support Service (PWSS) are the terms and conditions in the Department of Finance Enterprise Agreement 2024-2027 as it stood immediately before this determination commenced (see s 5; definitions of Enterprise Agreement; s 7(1)). The instrument operates "by force" to import that agreement into the employment relationship.
Second, it amends specific textual references in that Enterprise Agreement so the Enterprise Agreement reads as if it applies to the PWSS and its Agency Head: references to the Department of Finance or Finance are read as references to the Parliamentary Workplace Support Service; references to an employee covered by the Agreement are read as references to a non‑SES Employee to whom this instrument applies; references to the Secretary of the Department of Finance are read as references to the Agency Head; and references to "the Agreement" are read as references to the Agreement as applied by this instrument (see s 7(2) items 1-5).
Third, it expressly makes the Enterprise Agreement dispute resolution clauses (clauses 496-505) a term or condition of employment for those employees and identifies those clauses as providing a disputes procedure for the purposes of s 738(d) of the Fair Work Act 2009 (see s 8(1) items 1-2). That ties the internal dispute procedure into the Fair Work Act regime to the extent stated.
Fourth, it sets the boundaries and interactions with other instruments: the determination commences the day after registration (s 2); it ceases to apply to an Employee if an enterprise agreement under the FW Act that covers the employee commences operation or if a workplace determination under the FW Act covers the employee (s 6(a)-(b)); while in force it displaces the application of the APS Award to non‑SES employees in PWSS (s 10(2)); and it does not have effect so as to exclude the National Employment Standards (NES) (s 10(1)). The instrument is made under subsection 24(3) of the Public Service Act 1999 (s 3) and may be revoked or otherwise varied by further determination under that same PS Act power (s 6 note).
