#### 19 Review of other APS actions Division 3 provides for the following: (a) applications for primary review of other APS actions to be made to the relevant Agency Head or, in certain circumstances, to the Merit Protection Commissioner; (b) applications for secondary review of an APS action if: (i) the relevant Agency Head told the employee under section 40 that the action is not a reviewable action; or (ii) the employee is dissatisfied with the outcome of the relevant Agency Head’s review of the action under section 41. > Note: A recommendation made on an application to the Merit Protection Commissioner for primary or secondary review is not binding on an Agency Head (see section 46).
