##### 87ZD Promotion of certain former officers (1) Where: (a) a person (in this section referred to as the former officer) who ceases to be an officer by reason of subsection 87D(1), 87V(2), 87Y(3), 87Z(3), 87ZA(5) or 87ZC(2), or is deemed, by reason of subsection 87J(6), to have ceased to be an officer: (i) had, on or before the day (in this section referred to as the relevant day) on which he was so deemed to have ceased to be an officer, been promoted under section 49B, 50 or 50DA to fill a vacant office in the Service; (ii) had, on or before the relevant day, appealed under section 50B against the promotion of another person to fill such an office; or (iii) would, if he had continued to be an officer on the relevant day, have had, on that day, a right to appeal under section 50B against the promotion of another person to fill such an office, being a promotion made before that day; and (b) the promotion had not taken effect, or had not been cancelled, before the relevant day; the relevant provisions of this Act apply to and in relation to the promotion as if: (c) the former officer had, on the day on which the promotion was made, been a person to whom Division 3 applies; and (d) anything done in relation to the former officer for the purposes of the promotion before the relevant day had been done under the relevant provisions of this Act. (2) In subsection (1), relevant provisions of this Act means the provisions of sections 49B, 50 to 50H (inclusive), 51AA and 53 or, if those provisions are, for the purposes of Division 3, modified by the regulations, those provisions as so modified.
