### 5 Parliamentary Superannuation Committee
> > (1) For the purposes of determining the entitlements, of a member to whom [Part 3](#HP3@EN) or [4](#HP4@EN) applies, arising from ill-health or physical or mental incapacity, there is to be a committee to be known as the Parliamentary Superannuation Committee.

> > (2) The Committee consists of –
> >
> > > > (a) the President of the Legislative Council; and
> > >
> > > > (b) the Speaker of the House of Assembly; and
> > >
> > > > (c) [*\[Regulation 5 Subregulation (2) amended by No. 4 of 2017, Sched. 1, Applied:01 Jul 2019\]*](/view/html/inforce/2019-07-01/act-2017-004#JS1@Ja95@GC1@EN) the Secretary of the responsible Department in relation to the [Financial Management Act 2016](/view/html/inforce/2026-04-12/act-2016-042) or his or her nominee.

> > (3) If the President of the Legislative Council or the Speaker of the House of Assembly ceases to hold office by reason of the expiration of his or her term as a member of Parliament, he or she may continue to act as a member of the Committee until his or her successor in the office of President or Speaker is elected to that office.
>
> > (4) If a vacancy occurs in the office of a member of the Committee, the Governor may appoint a temporary member to hold office until the vacancy is filled by a person entitled by this regulation to hold that office.
