Public Sector Management (General) Regulations 1994

This instrument deploys a small set of regulatory devices repeatedly: deeming, prescription of amounts/periods/classes, procedural minimums, cross‑instrument linkage and capped remuneration frameworks. Each device has predictable legal effects that are visible in the Regulation text.

Deeming: Regulations 4A and 4B treat particular statutory office‑holders as chief executive officers or a chief employee for the Act’s purposes (Reg 4A(1)‑(3); Reg 4B). A deeming provision changes legal identity for application of the Act’s powers and duties without amending the parent Act. For example, once the Director of Public Prosecutions is “deemed” a chief executive officer, provisions of the Act that apply to CEOs apply to that Director unless the Act provides otherwise. The Regulations identify three office‑holders for such treatment in Reg 4A and one in Reg 4B, and they cross‑reference the other Acts that create those offices (see Reg 4A, which lists the Director of Public Prosecutions Act 1991, Inspector of Custodial Services Act 2003, and the Information Commissioner Act 2024).

Prescription of amounts, periods and classes: Multiple provisions simply fix numeric or categorical parameters that the Act requires be prescribed. Examples include: the prescribed amount for certain payments being equivalent to 12 weeks’ remuneration (Regs 7 and 8(a)); the prescribed minimum in Reg 8(b) being the amount payable on the last day of remuneration; a prescribed compensation period equalling the period used to calculate the compensation paid (Regs 9, 11, 26); prescribed classes of employees for s 64(5)(b) (Reg 10) and s 76(1)(b) (Reg 14); the prescribed period of 14 days for s 92(2) (Reg 23); the prescribed salary level tied to a specified level in the Public Sector CSA Agreement 2024 (Reg 6). These prescriptions convert broad statutory discretion into a fixed administrative rule and establish predictable calculation formulas for entitlements and thresholds.

Cross‑instrument linkage: Several regulations explicitly link statutory operation to other instruments and determinations. Reg 6 uses the Public Sector CSA Agreement 2024 to fix a salary level (Reg 6(2)). Reg 8A links non‑SAT CEO remuneration limits to SAT salary bands determined under the Salaries and Allowances Act 1975 (Reg 8A(3)‑(4)) and provides continuity if a Tribunal determination is revoked or amended (Reg 8A(9)‑(10)). Deeming provisions reference other Acts that create offices (Reg 4A). These cross‑links transfer some measurement and rate‑setting authority to industrial instruments and to the Tribunal.

Procedural minimums for discipline: Reg 16 prescribes the minimum contents of written notice when investigating a suspected breach of discipline. It sets out required notice of initiation, purpose, possible findings and actions, steps that may be taken prior to findings, meetings or interviews to be attended, and the right to have a representative present at interviews (Reg 16(a)‑(e)). This makes procedural fairness elements obligatory under the Act’s disciplinary framework.

Remuneration architecture for CEOs: Reg 8A is a compact but nuanced scheme. It differentiates SAT and non‑SAT CEOs, maps PSC classes to SAT bands (Reg 8A(3) Table), caps non‑salary components by comparison to corresponding SAT allowances (Reg 8A(4)), preserves transitional protections for transfers from SAT to non‑SAT roles (Reg 8A(7)‑(8)), and allows employing authorities to depart from the caps where necessary to recruit and retain a particular person (Reg 8A(6)). It also contains continuity provisions in the event of Tribunal determinations being amended or revoked (Reg 8A(9)‑(10)).

Record‑keeping and transfer obligations: Reg 25 prescribes minimum contents of personnel records for permanent and contract employees, and for Public Service employees it adds name, date of birth, date of appointment to the Public Service, title and classification (Reg 25(1)‑(2)). It requires bodies to seek transfer of records when employees move between public sector bodies and obliges the transferring body to provide the record (Reg 25(3)(a)‑(b)).

Definition of “serious offence”: Reg 15 prescribes offences to be treated as serious for the Act’s definition (Reg 15(a)‑(c)), namely those involving fraud/dishonesty or wilful damage to property, offences against persons, and offences punishable by 2 years imprisonment or more. This affects how the Act treats misconduct and related processes.

Delegation to entities: Reg 6A prescribes the Police Force as an entity for delegations by the Commissioner of Police under s 33 of the Act, narrowly applied to Commissioner delegations (Reg 6A(1)‑(2)).

Collectively, these devices tighten the Act’s operational detail. They also allocate decision rights: employing authorities retain selection and recruitment decisions and (in specified circumstances) authority to increase CEO remuneration beyond the prescribed caps (Reg 8A(6)), while the Tribunal, industrial agreements and other Acts provide external anchors that influence salary ceilings and calculation methods (Reg 6; Reg 8A).

The Regulations directly affect a concentrated set of public sector actors and a broader class of employees by imposing specific procedural and record obligations. Primary affected parties are:

• Chief executive officers and deemed CEOs or chief employees: Regs 4A and 4B deem particular office‑holders to be chief executive officers or chief employee for the Act’s purposes. The Director (Director of Public Prosecutions), Inspector of Custodial Services, Information Commissioner (Information Commissioner Act 2024), and the Director under the Health Services (Conciliation and Review) Act 1995 are explicitly included (Regs 4A and 4B). Those persons are therefore brought within the Act’s governance architecture, including remuneration, delegation and employment rules that apply to CEOs where the Act so directs.

• Employing authorities: Reg 5 identifies particular employing authorities (for example the Law Reform Commission , Reg 5(c) , and historical State Housing Commission arrangements preserved under other Acts , Reg 5(d)). Employing authorities bear many duties under the Act and these Regulations: they decide remuneration subject to Reg 8A constraints, they must keep and transfer personnel records (Reg 25), they conduct and provide written notice for disciplinary investigations (Reg 16), and they decide whether to depart from CEO remuneration caps if recruitment/retention difficulties justify it (Reg 8A(6)).

• Public sector bodies that employ staff (permanent, contract, trainees, cadets): Reg 25 requires such bodies to establish, keep and maintain personnel records with specific minimum contents (Reg 25(1)‑(2)). Bodies must also effect record transfers when employees move between bodies (Reg 25(3)). These obligations fall on any public sector body exercising employment functions.

• Chief executive office (CEO) employing authorities and SAT/non‑SAT CEOs: Reg 8A distinguishes SAT CEOs (offices listed in s 6(1)(d)‑(e) of the Salaries and Allowances Act 1975) and non‑SAT CEOs, and prescribes remuneration ceilings for non‑SAT CEOs relative to Tribunal bands (Reg 8A(1)‑(4)). The employing authority for a non‑SAT CEO must structure a contract’s remuneration in accordance with Reg 8A unless it invokes the recruitment/retention exception (Reg 8A(6)). This affects both the employing authority’s bargaining position and potential recruits.

• Commissioned officers of the Police Force: Reg 6A prescribes the Police Force as an entity for delegations made by the Commissioner of Police. That prescription applies only to delegations by that Commissioner and therefore affects the internal delegation architecture of police employment and authority.

• Ministerial officers and executive officers in payment calculations: Several regulations fix the amounts used to calculate compensation or prescribed payments by reference to amounts payable to the executive/ministerial officer during specified recent periods (Regs 7, 8, 12). Executive officers who cease to be paid may therefore determine the quantum of subsequent compensation entitlements for particular statutory purposes.

• Employees subject to disciplinary procedures: Reg 16 prescribes notice content and the right to representation in disciplinary investigations. Employees subject to a suspected breach investigation will have statutory minimum rights as to notification and representation.

• Persons whose offences are classified as “serious”: Reg 15 prescribes the kinds of offences treated as “serious” under s 80A of the Act. Employees convicted of the listed offences,fraud/dishonesty, wilful property damage, offences against persons, and offences punishable by 2+ years imprisonment, are classified under the Act as having committed serious offences, triggering the Act’s more onerous consequences.

Secondary impacts extend to payroll administrators, industrial relations negotiators and human resources professionals. Payroll and HR are affected by the requirement to calculate prescribed amounts using specific look‑back periods (for example the 12‑week remuneration period referenced in Regs 7, 8(a) and 12). Industrial relations teams must reconcile enterprise instruments (for example the Public Sector CSA Agreement 2024 referenced in Reg 6) and Tribunal determinations with the regulatory caps and mappings in Reg 8A. Legal and compliance teams will be involved where an employing authority considers invoking the Reg 8A(6) exception to exceed caps, or when disciplinary matters proceed under Reg 16.

Finally, because the Regulations tie certain matters to external determinations (Tribunal bands, industrial agreements), parties who negotiate those external instruments indirectly affect how these Regulations operate in practice. For example, changes to the Public Sector CSA Agreement 2024 or to a Tribunal determination may alter the salary anchors used by these Regulations (Reg 6(2); Reg 8A(9)‑(10)).

The Regulations create duties for employing authorities and public sector bodies and confer specified procedural rights on employees. These duties and rights are narrowly prescribed and often linked to other instruments.

Duties

• Deeming compliance: Bodies must treat certain office‑holders as CEOs or chief employee for the Act’s operation (Reg 4A; Reg 4B). Practically, this means applying CEO‑related provisions of the Act to those offices without separate legislative amendment.

• Employing‑authority obligations: Reg 5 identifies employing authorities for specific appointments. Those employing authorities are responsible for recruiting, contracting, remuneration within the regulatory caps, and implementing HR processes for their staff (Reg 5(c)‑(d)).

• Remuneration design for non‑SAT CEOs: Where a CEO is a non‑SAT CEO (Reg 8A(1)), the employing authority must ensure the salary component does not exceed the upper limit of the corresponding Tribunal salary range indicated in the mapping table. Non‑salary components are likewise capped by comparison to corresponding SAT non‑salary components (Reg 8A(3)‑(4)). Employing authorities must also follow the transitional rules in Reg 8A(7)‑(8) and the continuity rules in Reg 8A(9)‑(10). The employing authority may, however, depart from these caps under Reg 8A(6) where necessary to recruit and retain a particular person.

• Record‑keeping and transfers: Public sector bodies must create and maintain personnel records for each permanent or contract employee, including trainees and cadets, with specific minimum content: appointment information, employment history, performance and disciplinary matters, and cessation information (Reg 25(1)). For Public Service employees, additional fields are required: name and date of birth, date of appointment to the Public Service, title and classification (Reg 25(2)). When an employee moves between public sector bodies, the destination body must seek the record and the origin body must transfer it (Reg 25(3)(a)‑(b)).

• Investigation procedures: When a suspected breach of discipline is under investigation, employing authorities must notify the respondent in writing with specific information: initiation and purpose of the investigation, possible findings and actions under Division 3 of Part 5 of the Act, steps that may be taken before findings, any required interviews/meetings, and the respondent’s right to have a representative present at interviews (Reg 16(a)‑(e)). These are minimum procedural obligations.

• Delegation and entity identification: The Commissioner of Police may delegate within the Police Force as an entity prescribed by Reg 6A, subject to the limitation that Reg 6A(2) applies only to delegations by that Commissioner.

• Calculation obligations: Several regulations require specific calculations when determining prescribed payments or compensation. Examples include equating prescribed amounts to remuneration paid over the 12 weeks immediately before cessation (Regs 7; 8(a); 12) or to the last day of remuneration (Reg 8(b)). For compensation periods, the prescribed period equals the period used to calculate a person’s compensation (Regs 9, 11, 26).

Rights

• Right to representation in investigations: Reg 16(e) gives respondents the right to have a representative present during interviews or meetings where the representative can provide advice. The right is procedural and tied to the investigation process.

• Procedural information rights: Reg 16 requires written notification of the investigation’s initiation, its purpose, possible findings and actions, and the steps that may be taken. This gives employees rights to know the scope and possible consequences of an investigation.

• Employing authority discretion with transparency: Reg 8A(6) permits employing authorities to set higher remuneration where necessary to recruit and retain a particular person, but the text conditions this on the employing authority being satisfied that otherwise payable remuneration would be insufficient. While not expressed as a statutory right of the CEO or candidate, it affords an employing authority discretion to make offers beyond the regulatory caps.

• Transitional protections: Reg 8A(7)‑(8) protects persons transferred from SAT CEO contracts to other Senior Executive Service functions, restricting remuneration to the SAT upper limits and corresponding non‑salary components to what would be available in the SAT band immediately before transfer. This creates a rights‑like protection for those transferred.

• Continuity rights where Tribunal determinations change: Reg 8A(9)‑(10) allow salary and non‑salary components to continue as if the previously existing Tribunal determination remains in force where that determination is revoked or amended so the relevant bands or components cannot be identified. This provides protection for existing remuneration arrangements against Tribunal adjustments.

Penalties are not mostly set in the Regulations; instead the Regulations inform procedural triggers and threshold classifications that the Act uses to determine disciplinary or other consequences. Reg 15 defines “serious offence” categories which connect to the Act’s sanctions framework.

In sum, the Regulations allocate compliance duties (record‑keeping, notice, calculation, remuneration design), confer procedural rights (notice, representation, transitional protections), and create decision points where employing authorities exercise substantive discretion (notably Reg 8A(6)). The Regulations operationalise the Act’s high‑level provisions by setting clear low‑level duties and some bounded rights.

The Regulations themselves do not create a broad new penalty scheme but operate as the Act’s delegated instrument to specify matters that trigger the Act’s enforcement and sanctioning mechanisms. The Regulations therefore influence enforcement by setting thresholds, definitions and procedural minima that the Act uses when disciplining employees, determining serious offences, calculating compensation and adjudicating remuneration arrangements.

Direct enforcement obligations arising from the Regulations:

• Record‑keeping enforcement: Reg 25 prescribes specific minimum content for personnel records and requires transfer of records when employees move between public sector bodies (Reg 25(1)‑(3)). The Regulations do not spell out a dedicated penalty provision for non‑compliance with Reg 25; enforcement of record obligations would arise through the Act’s general compliance and disciplinary mechanisms or other statutory instruments empowered to enforce public sector administrative obligations.

• Procedural compliance during investigations: Reg 16 prescribes the written notice contents and the right to have a representative present during interviews. Failure to follow Reg 16 could attract procedural challenge or administrative review under the Act’s disciplinary regime, as the prescribed procedures under s 81(2) are to be followed (Reg 16 preamble). The Regulations state that these are the prescribed procedures "in accordance with which a suspected breach of discipline is to be investigated" (Reg 16). That language embeds Reg 16 into the Act’s disciplinary process; non‑compliance with prescribed procedures could be material to the validity of disciplinary findings and any consequent action taken under Division 3 of Part 5 of the Act.

• Classification of serious offences: Reg 15 prescribes the kinds of offences that constitute a “serious offence” under s 80A of the Act (Reg 15(a)‑(c)). The practical enforcement effect is that offences falling within those classes will engage the Act’s more severe disciplinary pathways. For example, if an employee is convicted of an offence punishable by 2 years imprisonment (Reg 15(c)), the Act’s sanctions for serious offences (which the Act itself sets) become available to employing authorities.

• Remuneration non‑compliance: Reg 8A constrains remuneration arrangements for non‑SAT CEOs by capping salary and non‑salary components at levels corresponding to Tribunal bands, subject to exceptions. Employing authorities that enter contracts outside the prescribed arrangements where no recruitment/retention justification exists could be open to internal administrative censure or other compliance action. The Regulations do not create criminal sanctions for paying beyond the caps; enforcement would be administrative and operate through the Act’s general governance and financial accountability processes.

• Delegation compliance: Reg 6A prescribes the Police Force as an entity for delegation by the Commissioner of Police. If a Commissioner delegates outside statutory limits the Act and general administrative law remedies would be the route for challenge rather than a regulation‑specific penalty.

Enforcement mechanisms are therefore largely those provided by the parent Act and other governance frameworks, such as:

• Disciplinary processes under the Act (Division 3 of Part 5), into which Reg 16 procedure integrates.

• Administrative review processes or internal appeals that arise from statutory frameworks governing the public sector.

• Potential external scrutiny where related statutes (for example the Salaries and Allowances Act 1975, Industrial Relations Act 1979 or sector‑specific Acts referenced in the Regulations) impose their own sanctions or oversight.

The Regulations do not specify monetary penalties or criminal sanctions directly for non‑observance of, for example, record‑keeping or remuneration rules. Enforcement will therefore rely on the Act’s disciplinary and management provisions, financial accountability instruments, judicial review and, where relevant, criminal law in the underlying offence classifications for conduct that is separately criminal (Reg 15).

Risks in enforcement stem from the Regulations’ reliance on cross‑instrument links and employing authority discretion. For instance, the Reg 8A(6) recruitment/retention exception vests substantive discretion in employing authorities to exceed the caps. Oversight of that discretion will depend on the Act, the employing authority’s internal governance and any external audit or public sector standards. Similarly, Reg 25’s transfer requirement imposes an operational duty; failure to comply may be actionable administratively, but the Regulations do not prescribe distinct fines or direct enforcement routes. Practitioners advising clients should therefore consider both the Act’s enforcement framework and applicable public sector transparency, procurement and financial accountability regimes where compliance issues arise.

The Regulations are expressly connective: they integrate the operation of the Public Sector Management Act 1994 with multiple other statutes, industrial instruments and Tribunal determinations. The text repeatedly cross‑references other laws to define persons, classes, salary references, and to preserve continuity where external determinations change.

Statutes explicitly referenced and how the Regulations use them

• Director of Public Prosecutions Act 1991: Reg 4A(1) deems the Director within the meaning of that Act to be the CEO of the department designated under s 35 of the Act as the Office of the Director of Public Prosecutions. The Regulations therefore import an office created by the DPP Act into the Act’s CEO framework.

• Inspector of Custodial Services Act 2003: Reg 4A(2) deems the statutory Inspector to be the CEO of the Office of the Inspector of Custodial Services as designated under s 35 of the Act. This ties the inspectorate into the Act’s public sector management architecture.

• Information Commissioner Act 2024: Reg 4A(3) treats the Information Commissioner under the 2024 Act as a CEO for the Act’s purposes, extending the Act’s employment and management provisions to that new office.

• Health Services (Conciliation and Review) Act 1995: Reg 4B deems the Director under that Act to be the chief employee of the Office of Health Review established by section 6(1) of that Act.

• Police Act 1892: Reg 6A(1) prescribes the Police Force (within the meaning of the Police Act 1892) as an entity for delegation purposes under s 33 of the Act; Reg 6A(2) limits the application to delegations by the Commissioner of Police.

• Salaries and Allowances Act 1975: Reg 8A works in conjunction with the Salaries and Allowances Tribunal established by that Act. Reg 8A treats SAT classes and bands as comparative anchors for non‑SAT CEO remuneration (Reg 8A(1)‑(4)), and provides for continuity where Tribunal determinations change (Reg 8A(9)‑(10)).

• Industrial Relations Act 1979 and related awards: Reg 6 defines “industrial agreement” and links the prescribed salary level to the Public Sector CSA Agreement 2024. Reg 13 prescribes salary level under the Public Service Award 1992 (Industrial Commission under the Industrial Relations Act 1979) for the purposes of s 75(2)(a). Reg 14 prescribes classes of employees defined by the Vocational Education and Training Act 1996 and by specific awards made under the Industrial Relations Act 1979.

• Government Employees’ Housing Act 1964 and related housing Acts: Reg 5(d) preserves employing authority roles arising under earlier housing legislation, referencing the Government Employees’ Housing Act 1964 and its repeals and continuations.

Cross‑instrument consequences

• Anchoring remuneration to external instruments: The Regulations rely on industrial agreements and Tribunal determinations to set salary anchors (Reg 6; Reg 8A). That design shifts rate‑setting authority partly out of the Regulations and into collective bargaining and the Tribunal, meaning changes in those instruments can alter the operation of the Regulations without amending them.

• Continuity and transition where external instruments change: Reg 8A(9)‑(10) and other rules preserve remuneration arrangements when Tribunal determinations are revoked or amended in ways that make prior bands or components unidentifiable. This mitigates legal uncertainty for existing contracts but creates a dependence on historical Tribunal determinations when new determinations depart from previous structures.

• Interlocking procedural obligations: Reg 16 prescribes notification and representation rights for discipline investigations. Those procedural minima must be read with the Act’s disciplinary division (Division 3 of Part 5) and any appeal/ review rights in the Act or other administrative law. The Regulations therefore operate as an input into broader statutory procedural fairness frameworks.

• Definitions and application of “serious offence”: Reg 15 uses criminal law concepts (fraud, wilful damage, offences against persons, offences carrying 2+ years imprisonment) to determine what the Act treats as a serious offence. That classification ties employment consequences under the Act to determinations made in criminal or quasi‑criminal law contexts.

• Delegation and internal structures: Reg 6A’s prescription that the Police Force is an entity for Commissioner delegations interacts with the Police Act 1892’s definition of the Force and with internal governance under the Police Act and the Act; delegations made by the Commissioner will therefore be filtered through both statutory sources.

• Historical legislative continuity: Reg 5 preserves employing authority arrangements for legacy housing Acts and references repeals and continuations (see compilation note 1 and 2). This maintains continuity for staff affected by machinery‑of‑government changes.

Practical implications for practitioners

• Advisers must cross‑check industrial agreements and Tribunal determinations: Where the Regulations link remuneration to the Public Sector CSA Agreement 2024 or to Tribunal bands, practitioners must review those external instruments to calculate caps and entitlements (Reg 6; Reg 8A).

• Contracts must be consistent with multiple instruments: CEO employment contracts need to be drafted with attention to Reg 8A, Tribunal determinations, and the Salaries and Allowances Act 1975 where SAT classifications are relevant. Transitional clauses in Reg 8A(7)‑(10) may require bespoke drafting to capture existing rights.

• Record transfer obligations intersect with privacy laws and HR systems: Reg 25 requires transfer of personnel records between public sector bodies; advisers must reconcile this with privacy legislation, records management standards and secure data transfer protocols.

• Enforcement and review: Because the Regulations embed themselves into the Act’s disciplinary framework and rely on external instruments, disputes may involve administrative review, industrial law channels, or broader judicial review questions about procedural fairness or the exercise of employing authority discretion.

In short, the Regulations are an instrument of statutory integration: they operate by cross‑reference to other laws and instruments, thereby shaping administrative governance through external anchors as much as by their own text.

The Regulations have been amended repeatedly since their first publication in 1994. The compilation table in the instrument lists amendment instruments and commencement dates, and the Regulations’ marginal notes track insertion and deletion of particular provisions. The history shows iterative adjustment to accommodate new offices, changes in industrial instruments, and administrative modernization.

Key amendment milestones visible in the compilation table and marginal notes:

• 1994-1997 early amendments: The Regulations were originally published 16 September 1994 and commenced 1 October 1994 (compilation table). Amendments followed in December 1994, August 1995, June 1996, September 1996, October 1996 and April 1997, refining definitions and adding provisions such as Reg 4A inserted 18 Aug 1995, Reg 4B inserted 7 Jun 1996 (marginal notes).

• Late 1990s adjustments: The November 1999 amendment inserted Reg 8A governing CEO remuneration mapping to SAT bands (Reg 8A inserted Gazette 19 Nov 1999 p. 5792‑4). That amendment substantially structured non‑SAT CEO remuneration by reference to Tribunal bands.

• 2000s additions for inspectorates: Amendment in 2000 and the Inspector of Custodial Services Act 2003 (s 56(1)) led to deeming that office as a CEO under Reg 4A (Reg 4A amended in 2000 and by No. 75 of 2003 s.56(1)). The compilation table records a reprint as at 18 Dec 1997 and later reprints at 25 Jul 2003 and 3 Jun 2011, showing consolidation points.

• 2002-2012 technical updates: Amendments in 2002, 2005 and 2012 further adjusted remuneration rules and delegation prescriptions (Reg 6A inserted Gazette 24 Jan 2012 p. 555‑6 to prescribe Police Force entity for Commissioner delegations). Reg 16 was amended 5 Nov 2010 to update procedural content for investigations.

• 2014 and 2020 amendments: Reg 14 (classes of employees) was amended 19 Aug 2014 and subsequently in 2020 (SL 2020/2 and SL 2020/189), showing periodic adjustments to the classes covered by specified Act provisions and to employing authority listings.

• 2024-2025 updates related to new Acts and industrial instruments: The Regulations were amended to reference the Information Commissioner Act 2024 in Reg 4A(3). Recent instruments in 2025 (SL 2025/116 and SL 2025/122) appear in the compilation table and marginal notes, with SL 2025/122 deleting provisions 3 and 4 and other regs, and SL 2025/116 amending Reg 4A and others. Reg 6 was inserted by SL 2025/122 r.20 to prescribe a salary level tied to the Public Sector CSA Agreement 2024, and Reg 10 and Reg 14 were amended by SL 2025/122 and SL 2025/122 r.22 respectively.

• Deletions and consolidations: The marginal notes indicate various deletions, for example regs 3 and 4 deleted by SL 2025/122 r. 19, and regs 17-22 deleted by SL 2025/122 r. 23. These deletions indicate pruning of older transitional or obsolete provisions.

• Continuity provisions: Several regulations include express transitional or continuity provisions to cope with changes in external determinations: Reg 8A(9)‑(10) allow salary and non‑salary components to continue under prior Tribunal determinations if new determinations make mapping impossible; Reg 9, 11 and 26 tie prescribed periods to compensation calculation periods to preserve consistency.

What the amendment record implies about regulatory design

• Responsive to institutional change: The insertion of Reg 4A(3) to include the Information Commissioner Act 2024 shows the Regulations are used to fold new public offices into the Act’s framework without amending the principal Act.

• Reliance on external instruments: The late insertion of Reg 6 referencing the Public Sector CSA Agreement 2024 (SL 2025/122 r.20) illustrates how the Regulations adapt to changes in industrial architecture by pointing to contemporary agreements as measurement points.

• Iterative simplification: Deletions of whole blocks of regulations in SL 2025/122 and other instruments show periodic pruning and restructuring as machinery‑of‑government arrangements and industrial instruments evolve.

• Preservation of rights and continuity: The Regulations include transition protections when external determinants (Tribunal determinations) change; this indicates a deliberate choice to protect incumbent remuneration arrangements against abrupt disruption (Reg 8A(9)‑(10)).

For practitioners, the amendment history is important because many of the Regulations’ operative measures are time‑sensitive and linked to external determinations that change over time. To interpret or apply these Regulations in a transactional or dispute context, one must verify the version in force at the relevant date, consult the compilation table entries for commencement dates, and examine any transitional provisions in both the Regulations and the external instruments (for example Tribunal determinations or industrial agreements).

The Regulations themselves do not list litigation. The instrument contains no case citations and does not reference judicial or tribunal decisions. The Regulations are an administrative delegated instrument that prescribes operational details for the Public Sector Management Act 1994; any litigation arising from their application will appear in external case law or tribunal decisions rather than in the Regulations text.

What the Regulations reveal for litigation potential

• Procedural non‑compliance claims: Reg 16 prescribes investigation procedure minimums that integrate into the Act’s disciplinary framework. Failures to comply with Reg 16 (for example failing to provide written notice describing possible findings and right to representation) could be the basis for administrative law challenges or internal appeals where an employee contends that disciplinary action was procedurally unfair. Such claims would rely on the Act’s disciplinary and review provisions and on general administrative law doctrines like procedural fairness.

• Remuneration disputes and judicial review: Reg 8A imposes remuneration ceilings linked to Tribunal determinations for non‑SAT CEOs and permits exceptions where an employing authority is satisfied recruitment/retention requires departure. Litigation risk arises where an employee, a candidate, or a public interest body disputes the validity of a remuneration arrangement that appears to breach Reg 8A,either because an employing authority exceeded caps without a proper basis or because the mapping to SAT bands is contested. Remedies could include administrative review or judicial review of the employing authority’s decision‑making process, but any such litigation would depend on facts, the Act’s internal review rights, and whether the dispute engages justiciable error.

• Record‑keeping and privacy claims: Reg 25 requires transfer of personnel records and specific record content. Disputes about non‑transfer, incorrect records or disclosure may lead to employment litigation, judicial review, or privacy complaints, depending on the overlap with privacy legislation and public sector standards.

• Classification and sanctions predicated on “serious offence”: Reg 15’s definition influences whether certain misconduct is treated as a “serious offence” under the Act. Litigation could arise where an employee disputes whether a specific criminal conviction falls within Reg 15’s classes, and thus whether the Act’s severe sanctions apply. This may involve interpreting Reg 15 in light of the underlying criminal law.

• Delegation and authority challenges: Reg 6A prescribes the Police Force as an entity for delegation by the Commissioner of Police. Challenges could arise where delegation is asserted to exceed statutory power or contradict other legal limits, leading to administrative law review of the Commissioner’s exercise of delegation.

Absence of reported cases in the Regulations

Because the Regulations do not include case citations, and the instrument before us contains no litigation appendices, there is no litigation history recorded within the Regulations themselves. Practitioners seeking precedents about application or interpretation should search external databases for cases that reference the Regulations or the specific Act provisions the Regulations affect, and for Tribunal determinations cited by Reg 8A where remuneration mapping might have been litigated. Any litigation history relevant to the Regulations will therefore be found outside this instrument in court and tribunal archives.

The Regulations are compact and technical, but they contain several practical pitfalls that advisers and practitioners should anticipate. Below are precise issues and their legal mechanisms as set out in the Regulations.

1. Cross‑reference dependency: Several regulatory prescriptions hinge on external instruments. For example, Reg 6 prescribes a salary level by reference to the maximum salary for a level 8 officer under Schedule 2 of the Public Sector CSA Agreement 2024. Reg 8A ties non‑SAT CEO remuneration to SAT bands. If those external instruments change, the regulatory ceiling and calculations change or require careful continuity treatment (Reg 8A(9)‑(10)). Gotcha: failing to check the current version of the referenced industrial agreement or Tribunal determination can result in incorrect salary setting or contractual offers.

2. Employing authority discretion but limited transparency: Reg 8A(6) allows an employing authority to exceed salary and non‑salary caps where satisfied higher remuneration is needed to recruit and retain a particular person. Gotcha: that discretion is unilateral , the employing authority’s “satisfaction” is the trigger. There is no prescribed process or approval level specified in the Regulation, which raises governance and audit questions. Practitioners should document the rationale and consider internal approvals and value‑for‑money checks.

3. Narrow application of Police delegation prescription: Reg 6A prescribes the Police Force as an entity only for delegations by the Commissioner of Police (Reg 6A(2)). Gotcha: other agency delegations may not enjoy the same prescription; assuming the Police Force is a general entity for all delegations under the Act would be incorrect.

4. Notice content binds disciplinary processes: Reg 16 prescribes minimum required notice content for investigations of suspected breaches of discipline. Gotcha: failing to include one of the specific elements (for example, advising the respondent of the range of possible findings and possible action) could jeopardise the lawfulness of any subsequent disciplinary action under the Act.

5. Personnel record transfer obligations interact with privacy: Reg 25 obliges outgoing bodies to transfer personnel records to the incoming body when an employee moves. Gotcha: transfer must comply with privacy and records standards; archival or retention policies may conflict with immediate transfer or with the format of transfer. Practitioners should plan secure, auditable transfer mechanisms.

6. Calculations based on recent remuneration periods: Regs 7, 8, 12 and related provisions use the 12 weeks immediately preceding cessation (or the last day of remuneration) as the basis for prescribed amounts and minimums. Gotcha: payroll teams must be precise about which payments are included (for example, allowances vs. base salary) when calculating the “amount of remuneration payable” for these purposes. The Regulations do not elaborate the definition of remuneration beyond referencing the “amount of remuneration payable,” so interpretation issues may arise.

7. “Serious offence” is relatively broad: Reg 15 defines serious offences to include offences punishable by 2 or more years’ imprisonment. Gotcha: one‑off offences that carry a 2‑year maximum penalty may trigger the Act’s serious‑offence consequences even if the factual gravity differs; practitioners should map criminal law penalties to employment consequences.

8. Transitional ambiguities where Tribunal determinations change: Reg 8A(9)‑(10) permit continuity if Tribunal determinations are revoked or amended such that SAT classes or non‑salary components can no longer be identified. Gotcha: determining when a Tribunal determination has been changed “in such a way that” mapping is impossible may be non‑trivial and factual. Employers should obtain legal advice before assuming continuity applies.

9. Deletions and historical remnants: The Regulations contain a number of deleted provisions (for example regs 3, 4 and 17-22 deleted by SL 2025/122), and some changes preserve references to repealed Acts with historical notes. Gotcha: relying on pre‑2025 practice without checking the current reg text risks applying deleted rules.

10. Wide definition of personnel records: Reg 25(1) requires inclusion of details of performance and any disciplinary matters. Gotcha: employers must be cautious about privacy, defamation and data retention obligations when recording “performance and disciplinary matters”; they must ensure records are accurate, securely stored, and that employees have access or correction rights where relevant.

11. Multiple calculation points for compensation periods: Regs 9, 11 and 26 say the prescribed period is equal to the period in respect of which the compensation was calculated. Gotcha: this circular language means administrative practice must reference the underlying compensation calculation; recordkeeping should capture how the compensation period was determined to avoid later disputes.

12. Definitions are local to the Regulations: Defined terms such as “non‑SAT CEO”, “PSC class”, “Public Sector CSA Agreement 2024” and “Tribunal” are listed at the end. Gotcha: these definitions are instrument‑specific and must not be conflated with differently defined terms in the parent Act or other statutes.

In short, the practical risks cluster around cross‑instrument dependencies, employing authority discretion without specified oversight pathways, procedural notice requirements, calculation ambiguities, and privacy/records management. Each “gotcha” is traceable to a specific regulation and can be mitigated by documentary governance, reconciling external instruments, and obtaining pre‑emptive legal advice on remuneration and disciplinary matters.

Compliance under these Regulations requires a combination of documentary processes, governance decisions, payroll calculation routines and staff‑facing procedural practices. Below are concrete, actionable steps, mapped to the provisions.

1. Keep the correct version and cross‑references

• Maintain a legal or compliance library that records the current operative version of the Regulations, the Act, relevant Tribunal determinations and the Public Sector CSA Agreement 2024, and any other industrial instruments referenced (Reg 6; Reg 8A). Check the compilation table for commencement dates of amendments (compilation table entries).

2. Personnel records: establish, secure and transfer

• For each permanent or contract employee (including trainees and cadets) maintain personnel records with, at minimum, the items in Reg 25(1): appointment information, employment history, performance details and disciplinary matters, and cessation information.
• For Public Service employees record the additional fields in Reg 25(2): name and date of birth, date of appointment to the Public Service, and title and classification.
• Create a documented transfer protocol for internal moves: when an employee moves, the receiving body must seek the record and the originating body must transfer it (Reg 25(3)(a)‑(b)). Log transfer requests and transfers with timestamps and secure transmission receipts.
• Ensure records management practices comply with privacy law and security standards: limit access, use encryption in transit, and keep an audit trail that can be produced if compliance queries arise.

3. Investigations and disciplinary processes

• Adopt templates for written notices that incorporate all elements in Reg 16(a)‑(e): initiation and purpose, possible findings and actions, pre‑finding steps that may be taken, meetings/interviews required, and the right to have a representative present at interviews. Use these templates to ensure uniform compliance.
• Train investigators and HR staff on Reg 16 obligations and the link to Division 3 of Part 5 of the Act. Retain copies of notices in personnel files.
• Log any deviations from the prescribed procedure and seek advice before proceeding, because failure to follow Reg 16 can compromise disciplinary outcomes.

4. CEO remuneration and contract design

• For non‑SAT CEOs, map the PSC class to the SAT band per Reg 8A(3) Table. Ensure employment contracts do not exceed the salary upper limit of the corresponding SAT band, and ensure non‑salary components do not exceed the value of corresponding SAT non‑salary components (Reg 8A(3)‑(4)).
• Where an employing authority considers exceeding the caps under Reg 8A(6), document the recruitment and retention rationale, show market analysis, alternatives considered, and obtain appropriate internal approvals and records of the employing authority’s satisfaction. Consider seeking Ministerial, Treasury or audit confirmation if internal policy requires.
• For persons transferred from SAT CEO contracts to other Senior Executive Service functions, apply the transitional limits in Reg 8A(7)‑(8) and include explicit contract terms referencing these limits.
• If a Tribunal determination is revoked or amended, consult Reg 8A(9)‑(10) to confirm whether continuity applies; retain legal advice and contemporaneous records supporting the interpretation used.

5. Salary‑related calculations and payroll

• For prescribed amounts relying on remuneration over the 12 weeks immediately preceding cessation, standardise payroll routines to compute and document the “amount of remuneration payable” for the relevant look‑back period (Regs 7; 8(a); 12). Define clearly what counts as remuneration (base salary, taxable allowances) in line with internal payroll policy and any relevant industrial definitions.
• For prescribed minimum amounts tied to the last day of remuneration (Reg 8(b)), ensure payroll can extract daily rates and last‑day entitlements accurately.
• Ensure payroll documentation is retained to support calculations used for statutory entitlements and potential audits.

6. “Serious offence” classifications and HR consequences

• Treat offences meeting Reg 15(a)‑(c) as serious for the purposes of the Act and apply the Act’s disciplinary and sanction framework accordingly. Keep legal input when assessing whether a particular offence qualifies as “serious” under Reg 15.
• Document decisions to take action based on a conviction or charge and ensure any action is consistent with Reg 16 procedural obligations.

7. Delegation and entity issues

• If delegations involve the Police Force, confirm that delegation practice aligns with Reg 6A by ensuring that delegations made by the Commissioner of Police to the Police Force are properly recorded and constrained to the limits prescribed (Reg 6A(1)‑(2)). Retain records of delegation instruments.

8. Record retention and transition management

• Where Tribunal determinations, industrial agreements or other referenced instruments change, perform a cross‑walk to determine whether the Regulation’s mapping or caps are altered and whether transitional rules (for example Reg 8A(9)‑(10)) apply.
• Maintain an index of external instruments referenced by the Regulations and timestamped copies of those instruments as at relevant dates.

9. Governance and audit trails

• For decisions that involve discretion under the Regulations (notably Reg 8A(6)), implement a mandatory internal approval route (for example CFO/Treasurer sign‑off, or internal remuneration committee approval) and require documented market benchmarking and recruitment risk analysis.
• Retain minutes of remuneration committees, approval forms, and copies of offers and contracts.

10. Training and policy updates

• Update staff handbooks and HR policies to reflect Reg 25 obligations, Reg 16 investigation procedures, and CEO remuneration rules under Reg 8A. Train HR, payroll, legal and senior management teams on these requirements.
• Review and test record‑transfer processes periodically and incorporate them into HR onboarding/offboarding checklists.

11. Seek legal advice when in doubt

• Where the Regulations refer to external mapping or where an employing authority proposes to exceed remuneration caps under Reg 8A(6), obtain legal advice documenting the statutory basis for the decision and the factual basis for departures from the prescribed ceilings.
• When disciplinary cases raise questions about compliance with Reg 16 or whether an offence qualifies as “serious” under Reg 15, secure legal review before action.

Following these steps aligns operations with the specific prescriptions in these Regulations and creates evidentiary records in case of audits, reviews or litigation. Practitioners should also maintain contemporaneous records of external instruments (Tribunal determinations, industrial agreements) that the Regulations reference.
