87 Promotion on advice of joint selection committee
(1) The head of service may promote an officer to fill a vacant office if—
(a) a joint selection committee is established in relation to the
promotion; and
(b) the committee recommends the promotion.
(2) If a joint selection committee makes a recommendation to the head of
service about a promotion the head of service may—
(a) accept the recommendation; or
(b) not accept the recommendation.
(3) A decision to promote under this section is not an appellable decision
or a reviewable decision if the promotion is in accordance with—
(a) the recommendation of a joint selection committee agreed to by
the principal union (a union agreed joint selection committee);
or
(b) the unanimous recommendation of a management initiated joint
selection committee.
(4) A decision to promote under this section is an appellable decision and
a reviewable decision if—
(a) an officer is promoted to an appellable classification; and
(b) the officer seeking to appeal applied for promotion to the
position; and
(c) the promotion is not in accordance with—
(i) the recommendation of a union agreed joint selection
committee; or
(ii) the unanimous recommendation of a management initiated
joint selection committee.
