42 Transfer of surplus employees (1) A Chief Executive Officer may transfer under this section an ongoing employee declared under section 41(1) to be potentially surplus, including to perform duties in a different locality from the duties previously being performed by the employee. (2) The merit principle does not apply in relation to the exercise of a power under this section.
