Public Order in Streets Act 1984

The Act rests on a set of statutory definitions and operational concepts that determine scope, thresholds and legal consequences.

• Street and thoroughfare. The term street is defined broadly to include any road or highway open to, or used by, the public, even if on private property, and includes every thoroughfare, carriageway, footpath, reservation, median strip or traffic island associated with it and any steps, doorways or entrances abutting it (s 3). Thoroughfare is extended to include bridges, tunnels, underpasses, arcades, pavements, courts and passages that permit access to or from a street (s 3). This means locations that might be privately owned but used by the public can be captured by the Act.

• Public meeting and procession thresholds. An assembly is not a public meeting unless it comprises three or more persons, is for communication or expression of views to the public or a section of the public or for demonstrating, and members of the public in general are invited, induced or permitted to attend (s 4(3)(a)). Assemblies convened solely for divine worship are not public meetings (s 4(3)(b)). A procession is an assembly of three or more persons that intend to move, or move, by a common route along a street (s 4(4)).

• Notice and permit. The procedural core is the notice requirement. A person or body proposing a public meeting or procession must give written notice to the Commissioner (or at a police station) setting out, with reasonable detail, date, times, place and boundaries, route, halting places and durations in the case of processions, organiser details, purpose and estimated numbers (s 5(1)-(2)). Notices must be given not less than four days before the event, unless a shorter period is agreed by the Commissioner or an authorised officer, and the notice may need verification as acceptable to the Commissioner or authorised officer (s 5(3)). On receipt, the Commissioner or authorised officer must act expeditiously (s 5(4)).

• Permits, conditions and refusal grounds. The Commissioner or authorised officer may grant a permit, grant it subject to conditions, or refuse it (s 7(1)). The statutory grounds for refusing are limited to reasonable grounds to apprehend that the proposed meeting or procession may occasion serious public disorder or property damage, create a public nuisance, cause an obstruction too great or too prolonged in the circumstances, or place the safety of any person in jeopardy (s 7(2)). Notably, every permit is deemed to contain a condition prohibiting obstruction of emergency vehicles and contravention renders the meeting or procession as not having conformed with the permit (s 4(2)).

• Delegation and authorised officers. The Commissioner may delegate powers under the Act (other than the power of delegation itself) to commissioned officers by Gazette determination; the authorised officer then exercises those functions on behalf of the Commissioner and the exercise is legally treated as the Commissioner’s act (s 6(1), (3)-(4)). The Gazette entry need only identify the authorised officer and the part of the State or circumstances; publishing the conditions or limitations is not required (s 6(2)).

• Police instructions and directions. The Commissioner may give instructions to the Police Force for maintaining order in streets, including regulating traffic and preventing or removing obstructions (s 9A(1)). Those instructions cannot be used to frustrate a meeting or procession authorised under a permit, an event on a road closed under Part VA of the Road Traffic Act 1974, or a major event on a road closed under the Major Events Act 2023 section 26(1) (s 9A(2)). Members acting under instructions may give reasonable directions to persons; failure to comply when aware of the direction is an offence with a higher penalty (s 9A(3)-(4)).

• Evidentiary presumptions and civil immunity. The Act simplifies certain proofs: where an accused satisfies a court that an assembly was conducted pursuant to a permit, the Act presumes in the absence of evidence to the contrary that the permit was validly granted and that the holding or conduct substantially conformed with the permit (s 9(3)). Conversely, in prosecutions under s 9(1) it is not necessary for the prosecutor to prove that a permit had been granted or that the meeting was pursuant to a permit if the charge alleges it, absent evidence to the contrary (s 9(2)). Officers acting under the Act are protected from civil actions for acts done in purported execution of the Act unless the act was malicious and without reasonable and probable cause (s 10).

These definitions and procedural rules structure who must take action, what evidence is presumptive in criminal or civil proceedings, and how police discretion and delegation operate. They also create automatic substantive effects, such as the implied permit condition about emergency vehicles and the evidentiary presumptions that carry across to prosecutions under other traffic and obstruction laws (s 4(2); s 9(2)-(3)).

The Act creates obligations, rights and risks for particular actors. The statutory language identifies the primary parties affected and the legal roles they play.

• Organisers and proposing bodies. A person who, or body which, proposes to hold a public meeting in a street or to conduct a procession must give written notice to the Commissioner if they want the permit protection afforded by the Act (s 5(1)). The notice must be detailed and timely (s 5(2)-(3)). Organisers thereby carry pre-event administrative obligations, including providing the organiser’s name and address, the body conducting the meeting, purpose, estimated numbers and route particulars.

• Participants. Persons participating in a public meeting or procession who comply with the terms of a permit may position themselves in, or proceed over, streets referred to in the permit and are exempted, for the purpose only of participating, from offences against other Acts regulating movement of traffic or pedestrians, or relating to obstruction of a street, provided they substantially conform with the permit and any police directions (s 4(1)). This creates an operational privilege for participants but ties it to permit compliance. Participants also risk criminal liability under s 9(1) for disorderly conduct that prevents the meeting’s business, obstructing emergency vehicles or impeding use of the street beyond what the permit authorises.

• Commissioner of Police and authorised officers. The Commissioner is the statutory decision-maker for permits and the official who may issue instructions to maintain order in streets (ss 3; 9A(1)). The Commissioner may delegate most of his powers under the Act to commissioned officers by Gazette determination; those authorised officers then exercise those powers with the same legal effect as the Commissioner (s 6). This affects administrative responsibility and decision-making pathways in the police hierarchy.

• Police members. Members of the Police Force are subject to the Commissioner’s instructions to regulate traffic and maintain order (s 9A(1)). Police may give reasonable directions to enforce those instructions and can prosecute offences under s 9A(4) for non-compliance. Police also engage in operational liaison with organisers when permits are sought and policing resources are deployed.

• Ambulance, fire brigade and emergency services. The Act expressly protects the free passage of ambulances, fire brigade vehicles and police vehicles by deeming permits to contain a condition that participants not obstruct such vehicles (s 4(2)). Organisers and participants therefore have a statutory duty to avoid obstruction that causes permit non-conformity.

• Courts and tribunals. The courts are affected through evidentiary presumptions: in prosecutions under other Acts regulating movement of traffic or obstruction, if the accused shows the assembly was pursuant to a permit, the court shall presume, absent contrary evidence, that the permit was regular and conformity occurred (s 9(3)). The State Administrative Tribunal is the statutory review forum for permit refusals or conditions where notice was given not less than four days prior; applicants aggrieved by refusal or conditions may apply to the Tribunal (s 8).

• The general public and road users. Members of the public who use streets are affected because permits can lawfully justify assemblies occupying streets and because police direction powers aim to regulate pedestrian and vehicular traffic for order and safety (ss 4(1); 9A(1)). The Act balances the public’s access to streets against the organisers’ ability to use streets for meetings and processions.

• Event organisers for major events and road closures. Section 9A(2) expressly protects authorised meetings and events held on roads closed under Part VA of the Road Traffic Act 1974 and major events closed under the Major Events Act 2023 s 26(1) from being frustrated by police instructions. This places major event organisers and road closure orders in a protected category when those closures are lawfully made.

Financially, the Act also places fines on participants who breach the statutory offences: an offence under s 9(1) carries a penalty of $200 and failure to comply with a police direction under s 9A(4) carries a penalty of $2,000. Organisers bear the time and administrative cost of preparing and serving notices and may have to engage with police as part of the permit process. The Commissioner and authorised officers bear administrative decision-making responsibilities and must manage the balance between public order and lawful assemblies.

The Act assigns specific duties to organisers, police and decision-makers and confers rights and privileges that derive from compliance with the regime. These duties and rights are statutory and programmatic, and they determine legal exposure and protection.

Duties for organisers and proposers

• Give notice. A person or body proposing to hold a public meeting or procession must give written notice to the Commissioner with the detailed particulars set out in s 5(2), including date, assembly and disband times, place and boundaries, route for processions, organiser’s name and address, purpose and estimated numbers. Notices may be given at any police station (s 5(2)).

• Meet timing and verification requirements. Notices must be given not less than four days before the event, unless a shorter period is agreed by the Commissioner or an authorised officer. The Commissioner or authorised officer may require verification of the notice in a manner acceptable to them (s 5(3)).

• Ensure conformity with permit conditions. Where a permit is granted, persons participating must observe the permit conditions. All permits are deemed to contain an implied condition prohibiting obstruction of ambulances, fire brigade vehicles and police vehicles; breaching that condition results in the meeting or procession being taken not to have conformed with the permit (s 4(2)).

Rights for organisers and participants

• Privilege against certain traffic and obstruction offences. A participant who substantially conforms with permit terms may position in or proceed over streets referred to in the permit and is not, for purpose-only acts of participation, guilty of offences under other Acts regulating traffic and pedestrians or relating to obstruction (s 4(1)). This is a selective immunity tied to conformity.

• Right to administrative review. When a notice was given not less than four days before the event, a person or body refused a permit, aggrieved by a permit condition, or who believes the application was dealt with unreasonably may apply to the State Administrative Tribunal for review (s 8(1)). The Act defines circumstances constituting “unreasonable” dealing for the purposes of review (s 8(2)).

Duties and powers for the Commissioner and authorised officers

• Decision duty and discretion. The Commissioner or an authorised officer must consider the notice particulars and any other relevant information and may grant a permit, grant it with conditions, or refuse it (s 7(1)). They are barred from refusing a permit unless there are reasonable grounds to apprehend serious public disorder or property damage, public nuisance, excessive obstruction, or jeopardy to personal safety (s 7(2)). They must act expeditiously once a notice is received (s 5(4)).

• Delegation and exercise of opinion-based powers. The Commissioner may delegate duties and powers to commissioned officers by Gazette determination, with the exercise of those functions by an authorised officer being treated as the Commissioner’s exercise (s 6(1), (3)). Where an exercise of power depends on the Commissioner’s opinion, belief or state of mind, a delegated authorised officer may exercise the power on his own opinion or belief (s 6(4)).

Police powers and duties

• Maintain order and regulate traffic. The Commissioner may instruct members of the Police Force to regulate pedestrian and vehicular traffic, prevent or remove obstructions, and maintain order in streets (s 9A(1)). Police must not use instructions to frustrate a meeting or procession authorised under a permit, or certain events closed under road closure laws (s 9A(2)).

• Issue reasonable directions. Members acting under an instruction may give reasonable directions to persons to give effect to the instruction. A person who knows of the existence of a direction and does not comply commits an offence subject to a penalty of $2,000 (s 9A(3)-(4)).

Rights and protections for officers

• Civil immunity. No action or claim for damages shall lie against any person for anything done or purportedly done in carrying out the Act unless the act was done maliciously and without reasonable and probable cause (s 10). This provides protection against civil suits for lawful or reasonably grounded exercise of statutory functions.

Evidence and procedural rights

• Evidentiary presumptions. In prosecutions under s 9(1) the prosecutor need not prove that a permit had been granted or that the meeting was pursuant to a permit if the charge alleges it, absent evidence to the contrary (s 9(2)). In proceedings for offences under other Acts regulating movement of traffic or obstruction, where the accused satisfies the court a meeting was held pursuant to a permit, it is presumed, absent contrary evidence, that the permit was properly granted and the conduct conformed with it (s 9(3)). These provisions structure burden-shifting in court and tribunal processes.

Regulatory powers

• The Governor may make regulations to prescribe matters necessary to give effect to the Act (s 11). The Act therefore contemplates further operational detail and obligations being set by regulation.

Together, these duties and rights create a framework in which organisers have a route to secure legal protection for assemblies in streets but must satisfy pre-event procedural requirements; police have express powers to regulate street order but are constrained from using those powers to frustrate authorised assemblies; and officers acting in execution of the Act enjoy civil protections absent malicious conduct.

The Act sets out criminal offences, specified penalties, police enforcement powers and procedural presumptions that affect prosecution and defence strategies.

Statutory offences and penalties

• Disorderly conduct and obstruction at permitted events. Section 9(1) criminalises three categories of conduct at, or in relation to, a public meeting held or a procession conducted pursuant to a permit: acting in a disorderly manner with the purpose of preventing the transaction of the meeting’s business; obstructing the free passage of ambulance, fire brigade or police vehicles or otherwise impeding or disrupting public use of any street beyond what the permit authorises; and inciting others to do so. The prescribed penalty for an offence under s 9(1) is $200.

• Failure to comply with police directions. Section 9A(4) makes it an offence to refuse to comply with a reasonable direction given by a police member acting under an instruction to maintain order in streets, where the person knows of the existence of the direction. The penalty for this offence is $2,000.

Enforcement mechanisms

• Police instructions and directions. The Commissioner has express power to issue instructions to police members to regulate traffic and maintain order in streets (s 9A(1)). Members acting under such instructions may give reasonable directions to persons to effect the instruction (s 9A(3)). These directions are the principal operational enforcement tool for on-the-ground order management.

• Permit refusal and conditions. The Commissioner or authorised officer can refuse a permit or impose conditions under s 7(1). Refusal or conditions can be objected to via an administrative review to the State Administrative Tribunal if the statutory notice timing requirements are met (s 8). Administrative decisions may therefore be enforced at the tribunal level.

• Delegated enforcement. The Commissioner may delegate functions to authorised officers who then exercise those powers on his behalf (s 6). Delegations are published by Gazette. Delegated officers therefore can enforce the permit regime.

Evidentiary provisions that shape enforcement outcomes

• Easier proof for prosecutors. Where a charge alleges that a permit had been granted or that a meeting was held or procession conducted pursuant to a permit, the prosecutor need not prove those facts in the absence of evidence to the contrary (s 9(2)). This feature simplifies prosecution of the s 9(1) offence when the charge relies on the existence of a permit.

• Presumptions in other proceedings. In prosecutions for offences against other Acts regulating movement of traffic or relating to obstruction of a street, if the accused proves that the meeting or procession was conducted pursuant to a permit purporting to relate to it, the court shall presume, absent contrary evidence, that no irregularity occurred in the grant of the permit and that the meeting or procession substantially conformed with its terms (s 9(3)). This shifts the evidentiary burden onto the prosecution in those proceedings once an accused establishes the permit link.

Protections for officers

• Civil immunity limits liability. Section 10 bars civil actions against persons for acts done under the Act unless the act was done maliciously and without reasonable and probable cause. This reduces civil exposure for police and other authorised persons carrying out the Act’s provisions.

Operational and implementation considerations

• Delegation opacity. Delegations are published by Gazette in short form identifying authorised officers and the parts of the State or circumstances where they exercise powers (s 6(1)-(2)). The Act expressly permits not publishing conditions or limitations attached to the determination (s 6(2)). This creates enforcement discretion at the local level but can reduce transparency about delegated limits.

• Limits on police instructions. Section 9A(2) prevents police instructions designed to frustrate permitted meetings or processions, or certain events closed by road closure laws. That acts as an explicit statutory constraint on enforcement tactics, but gives police room to manage traffic and obstructions where public safety or movement concerns arise.

• Penalty levels and proportionality. The statutory penalties are stated in dollar amounts ($200 for s 9(1) and $2,000 for s 9A(4)); these are enforceable fines that apply in addition to any other civil or administrative measures permitted under other laws.

Taken together, the Act establishes a mixed enforcement regime: administrative control through permits, on-the-ground policing powers to regulate and direct, criminal penalties for disorderly and non-compliant conduct, and statutory evidentiary presumptions that streamline certain prosecutions and defences. The Act also protects officers from civil suits except in cases of malice, while leaving room for administrative review through the State Administrative Tribunal where statutory notice thresholds are met.

The Act is designed to operate alongside and sometimes modify the practical application of other statutory regimes. The text contains explicit cross-references and presumptive effects relevant to other laws.

• Relationship with traffic and obstruction laws. Section 4(1) grants participants in a permitted public meeting or procession an exemption from offences under any other Act or law regulating the movement of traffic or pedestrians, or relating to the obstruction of a street, for acts done solely for the purpose of participating, provided the holding or conduct substantially conforms with the permit and subject to any directions under s 9A. Conversely, s 9(3) provides that, in proceedings for other traffic or obstruction offences, if an accused satisfies the court that the assembly was pursuant to a permit, the court shall presume, absent contrary evidence, that no irregularity occurred in the grant of the permit and that the meeting or procession substantially conformed with that permit. These provisions create an inter-act evidentiary and substantive interface between this Act and traffic/obstruction statutes.

• Interaction with road closure and major events laws. Section 9A(2) expressly prevents police instructions from being used to frustrate events authorised under a permit granted under this Act, events on a road closed under an order under Part VA of the Road Traffic Act 1974, and major events as defined in the Major Events Act 2023 s 4 on roads closed under the Major Events Act 2023 s 26(1). The Act therefore defers to lawful road closure orders and designated major event closures when considering police instructions to maintain order.

• Delegation and Police Act reference. The Commissioner referenced in the Act is the Commissioner of Police appointed under the Police Act 1892 (s 3). The delegation mechanism in s 6 ties the Act to police administrative structure and the Gazette publication process, meaning decisions under this Act are exercised within police administrative law and transparency channels.

• Administrative review under State Administrative Tribunal. Section 8 confers jurisdiction on the State Administrative Tribunal to review refusals and permit conditions where the notice was given not less than 4 days prior, and where the applicant was aggrieved or believes the application was dealt with unreasonably. This integrates the Act’s decision-making with the administrative review architecture established by the State Administrative Tribunal Act and associated transitional provisions noted in the compilation table and notes.

• Civil liability regime and common law claims. Section 10 protects persons from civil claims for acts done in purported compliance with the Act unless the act was malicious and without reasonable and probable cause. This provision interacts with common law tort claims for trespass, nuisance or wrongful exercise of public powers. The statutory immunity narrows civil recourse to cases where malice and lack of reasonable cause can be proved.

• Regulatory complement. Section 11 permits the Governor to make regulations necessary or convenient to give effect to the Act. This enables subordinate legislation to add procedural or substantive details that operate in conjunction with the Act and other statutes.

• Evidentiary interplay with criminal procedure provisions. The evidentiary presumptions in s 9(2) and (3) will be applied in the context of criminal prosecutions under other Acts. The compilation table and notes indicate consequential amendments and reprints that changed processes for administrative review and criminal procedure (for example the State Administrative Tribunal amendments in 2004 and consequential criminal procedure amendments in 2004).

In sum, the Act is not standalone. It creates privileges and presumptions that modify how traffic, obstruction, civil liability and administrative review laws apply where a meeting or procession has a permit. It also expressly protects events closed under road closure legislation and major events legislation from being undermined by police instructions under s 9A, thereby preserving the legal effect of road closure orders and major event closures in operational policing.

The Act’s compilation table and notes in the provided text record the primary legislative amendments and reprints. The following summary is confined to the amendments and dates listed in the source document.

• Enactment and original title. The Act was originally enacted as the Public Meetings and Processions Act 1984 (No. 23 of 1984), assented 31 May 1984, and commenced 1 December 1984 (see compilation table, entry for 23 of 1984 and note under s 2).

• Reprints. A reprint of the Public Meetings and Processions Act 1984 as at 16 August 2002 is recorded in the compilation table. A later reprint as at 22 July 2005 is also recorded and noted to include amendments listed in the table.

• 2004 amendments. Multiple amendments in 2004 are recorded:

  • The State Administrative Tribunal (Conferral of Jurisdiction) Amendment and Repeal Act 2004 (No. 55 of 2004) effected changes relevant to administrative review and conferral of jurisdiction, with commencement 1 January 2005 (compilation table). The Act notes that Pt. 2 Div. 109 Subdiv. 1 and related amendments are included.

  • The Criminal Law Amendment (Simple Offences) Act 2004 (No. 70 of 2004) made substantive changes, including the insertion of s 9A (Maintaining order in streets) (the Act’s notes record s 9A was inserted by No. 70 of 2004 s 78). The compilation table shows assent 8 December 2004 and commencement 31 May 2005 for its changes.

  • The Criminal Procedure and Appeals (Consequential and Other Provisions) Act 2004 (No. 84 of 2004) amended sections 80 and 82, with commencement 2 May 2005 (compilation table entries). The compilation table also records consequential amendments to evidentiary or procedural provisions, notably s 9.

• Renaming. The Act is now cited as the Public Order in Streets Act 1984; a note indicates the short title was changed (see other notes point 1 and heading at the top of the text).

• 2023 amendment. The Major Events Act 2023 s 112 (No. 12 of 2023, assent 22 May 2023) amended the Act, with commencement 23 May 2023 (compilation table). Section 9A(2) references the Major Events Act 2023 s 4 and s 26(1), reflecting this amendment that protects major events road closures from being frustrated by police instructions.

• Deletions. Section 12 is recorded as deleted by No. 70 of 2004 s 79 (the Criminal Law Amendment (Simple Offences) Act 2004). The schedule has been omitted under the Reprints Act 1984 s 7(4)(e).

• Amendment notes. The provisions of the State Administrative Tribunal Act 2004 and related regulations are noted as dealing with transitional issues relevant to this Act (other notes point 2). The compilation table records the sequence of reprints and amendments that the current text includes.

The Act’s amendment history, as contained in the provided materials, shows a notable mid-2000s consolidation of administrative review and criminal procedure aspects and a more recent amendment aligning the Act with major events road closure provisions in 2023. The Gazette publication requirement for delegation determinations under s 6 remains an administrative feature throughout the amendments.

The statutory text supplied contains no citations to judicial decisions and does not list litigation history. The Act itself creates several points at which litigation or tribunal proceedings could arise, and those statutory hooks are described below in terms of how they would structure litigation risk and procedures, based solely on the Act’s provisions.

• Administrative review pathway. Section 8 expressly permits a person or body who has given notice not less than four days before the event to apply to the State Administrative Tribunal for review where a permit was refused, where the applicant is aggrieved by permit conditions, or where the applicant believes the application was dealt with unreasonably. This provision identifies the Tribunal as the statutory venue for administrative review and indicates the legislative intent for judicial or quasi-judicial oversight of permit refusals and conditions. The Act defines what constitutes dealing unreasonably for review purposes (s 8(2)).

• Criminal prosecutions. The Act creates offences under s 9(1) and s 9A(4). Prosecutions will proceed in the relevant criminal courts, and the evidentiary rules in s 9(2)-(3) will control proof strategies. Section 9(2) allows the prosecutor in s 9(1) matters to rely on an allegation that a permit was granted without needing to prove it in the absence of contrary evidence. Section 9(3) provides a presumption in favour of permit validity and conformity in prosecutions for other traffic or obstruction offences, where the accused shows the meeting was pursuant to a permit purporting to relate to it.

• Civil claims against officers. Section 10 limits civil actions against persons doing things under the Act, creating a statutory bar except where the act was malicious and without reasonable and probable cause. Any civil litigation alleging trespass, nuisance or other tort arising from the exercise of powers under the Act would therefore have to confront s 10’s immunity provision.

• Potential litigation themes arising from the Act. While the text provides no case law, the Act suggests the following potential issues that could be litigated, with reference to sections:

  • Whether a proposed meeting or procession falls within the Act’s definitions of public meeting or procession (s 4(3)-(4)), for example disputes over the number threshold or whether the assembly was for communicating with the public or for divine worship.

  • Whether the Commissioner or authorised officer acted within s 7(2) limits when refusing a permit, that is whether there were reasonable grounds to apprehend serious public disorder, damage to property, public nuisance, excessive obstruction, or jeopardy to safety.

  • Procedural fairness and timeliness in the Commissioner’s handling of notices (s 5(4) requires expeditious action) and whether an applicant can establish that the application was dealt with unreasonably for purposes of Tribunal review (s 8(2)).

  • Application and scope of evidentiary presumptions in s 9(2)-(3), including whether the absence of permitting documentation can be remedied by statutory presumptions and the evidential burden on prosecution or defence.

  • The scope and limits of police instructions under s 9A(1) and whether particular directions frustrated authorised permits contrary to s 9A(2).

  • Whether a civil claim can proceed under s 10 given the requirement to prove malice and lack of reasonable and probable cause.

Because the supplied text contains no reported judgments or litigation examples, this section cannot report case law. Instead, it points to the statutory mechanisms and dispute loci that the courts and tribunal would be expected to adjudicate when permit refusals, conduct at meetings, police directions, or civil claims arise under the Act. Any analysis of actual litigation outcomes would require consulting case reports or databases not contained in the source material provided.

The Act contains several provisions and structural features that create practical traps, uncertainties and compliance risks for organisers, participants and authorities. These are concrete statutory features to watch for.

• Broad spatial definition of "street". The definition of street in s 3 includes roads or highways open to, or used by, the public, even if situated on private property, and it includes associated footpaths, doorways and entrances. That means assemblies in privately owned arcades, shopping centres or courtyards used by the public may fall within the Act’s ambit, triggering the notice and permit obligations.

• Low numerical threshold but content requirement. An assembly becomes a public meeting only if it has three or more persons, is for communicating or expressing a view or ascertaining public opinion or demonstrating, and is open to the public in general (s 4(3)(a)). Some groups might not appreciate that informal gatherings of three or more with a protest element could require notice and a permit. Conversely, assemblies convened solely for divine worship are excluded (s 4(3)(b)).

• Funeral processions excluded from the notice requirement. Section 5(1)(b) excludes funeral processions from the notice requirement for processions, which is a specific statutory carve-out. Organisers of other processions must therefore be careful to distinguish funerals from other processions.

• Stringent notice particulars and timing. The notice must specify detailed particulars (s 5(2)), and must be given not less than four days before the event unless the Commissioner or an authorised officer agrees to a shorter period (s 5(3)). Failure to satisfy the timing and content requirements may expose organisers and participants to prosecution or may prevent them from obtaining permit protections.

• Implied permit condition about emergency vehicles. Every permit is deemed to contain a condition requiring participants not to obstruct ambulance, fire brigade or police vehicles. If participants contravene that condition, the holding or conduct is taken not to have conformed with the permit (s 4(2)). That statutory deeming has operational consequences: losing the permit’s protective effect can expose participants to otherwise applicable traffic and obstruction offences and to criminal liability under s 9(1).

• Evidentiary shifts can work both ways. Section 9(2) allows a prosecutor to allege that a permit was granted without proving it absent contrary evidence. Conversely, s 9(3) provides a presumption in favour of permit validity in other traffic and obstruction proceedings once the accused shows the meeting was pursuant to a permit purporting to relate to it. These shifting presumptions can surprise litigants if documentation is not kept or if evidence contradicts the allegations.

• Delegation transparency gap. The Commissioner’s delegation to authorised officers is published in the Government Gazette with short particulars identifying the authorised officer and the part of the State or circumstances in which the power is exercised (s 6(1)-(2)). However, the Act permits not publishing the conditions or limitations attached to the delegation (s 6(2)). That can create practical uncertainty about the scope of an authorised officer’s delegated authority and the limitations on decision-making in particular localities.

• Limited statutory standards for refusal. Section 7(2) allows refusal only on reasonable grounds relating to serious public disorder, damage to property, public nuisance, excessive obstruction or jeopardy to safety. These terms are not further defined in the Act. The absence of statutory definitions leaves considerable discretion to the Commissioner or authorised officer, which can lead to disputes about what constitutes "too great or too prolonged" an obstruction or "serious public disorder".

• Police instructions restriction but operational judgment remains. Section 9A(2) prohibits instructions intended to frustrate authorised meetings or certain closed-road events. That does not prevent police from using instructions and directions to regulate traffic or remove obstructions. Determining whether a particular instruction amounts to frustration of the permit can be factually complex.

• Civil immunity with a high threshold. Section 10 protects persons from civil suits for acts done under the Act unless the act was malicious and without reasonable and probable cause. This immunity raises the evidentiary bar for civil claimants and may discourage civil litigation in borderline cases, but claimants with evidence of malice may still pursue damages.

• Penalty disparity. The penalty for disorderly conduct at a meeting under s 9(1) is $200, whereas the penalty for failing to comply with a police direction under s 9A(4) is $2,000. Parties should be aware that non-compliance with police directions carries a substantially higher fine than some forms of disorderly conduct under the Act.

• Interaction with other statutory closures. Events authorised under road closure orders or under the Major Events Act 2023 s 26(1) are protected from police instructions designed to frustrate them (s 9A(2)). Organisers of events relying on such closures must confirm the legal basis for the closure and ensure it is properly executed to attract the protection.

These are statutory features that can produce unintended consequences for organisers, participants and enforcing officers unless they are understood and planned for. Practical mitigation requires close attention to definitions, notice particulars and timing, preserving permit documentation, liaising with police about delegation and authorised officers, and ensuring participants are briefed about the automatic emergency-vehicle non-obstruction condition.

Compliance under the Act requires a sequence of pre-event administrative steps, on-site operational practices and post-event record-keeping. The following checklist follows the statutory requirements and anticipates the practical steps implied by the Act’s provisions.

1. Determine whether the assembly falls within the Act.

• Confirm that the assembly is a public meeting or procession as defined in s 4. Verify that it comprises three or more persons, is for communication, expression or demonstration, and that members of the public in general are invited or permitted to attend (s 4(3)-(4)). If the assembly is solely for divine worship, it is excluded (s 4(3)(b)). If it is a funeral procession, note the specific exclusion for notice in s 5(1)(b).

2. Prepare and serve the notice.

• Draft a written notice that contains all particulars listed in s 5(2): date, assembly and disband times, place and boundaries, route details and halting places for processions, organiser’s name and address, name and address of the conducting body, purpose, estimated number of participants, and any prescribed particulars. The notice may be given at any police station (s 5(2)).

• Serve the notice at least four days before the event. If timeframes prevent four days’ notice, apply to the Commissioner or an authorised officer for agreement to a shorter period; such agreement must be obtained before the event to rely on the permit scheme (s 5(3)).

• Be prepared to verify the notice in the manner acceptable to the Commissioner or authorised officer if requested (s 5(3)(b)).

3. Liaise with the Commissioner or authorised officer.

• Expect the Commissioner or an authorised officer to act expeditiously on receipt of the notice (s 5(4)). Proactively contact the police to discuss routing, expected numbers, and safety arrangements, particularly where the assembly may affect major traffic routes or emergency access.

• Request written confirmation of any agreement to shorten the notice period and of any delegated authorised officer handling the permit if relevant to your locality. Check the Government Gazette to identify authorised officers and the part of the State where they exercise powers (s 6(1)-(2)).

4. Obtain and review the permit.

• If a permit is granted, ensure you receive the grant in writing and review all conditions and limitations specified under s 7(1). All permits are deemed to include the condition prohibiting obstruction of ambulances, fire brigade vehicles and police vehicles; plan routes and marshals to prevent such obstruction (s 4(2)).

• If a permit is refused or contains conditions you cannot accept, be aware of your right to apply to the State Administrative Tribunal for review where the notice was given at least four days prior (s 8). Prepare to challenge refusal or conditions on grounds set out in s 8(2) where appropriate.

5. Prepare operational management for the event.

• Ensure stewards or marshals know to avoid obstruction of emergency vehicles and to comply immediately with any reasonable directions given by police acting under s 9A(3) to regulate traffic or maintain order.

• Provide participants with clear instructions about permitted boundaries and behaviour, emphasise the automatic condition regarding emergency vehicles, and communicate that non-compliance can result in a criminal offence under s 9(1) or s 9A(4).

6. Record-keeping and evidence.

• Keep physical copies of the notice served, the permit granted, and any correspondence or agreement about shortened notice periods or delegated authorised officers. These records are important because s 9(2) and s 9(3) create evidentiary presumptions regarding permits and conformity.

• If the event proceeds pursuant to a permit, ensure documentation demonstrating conformity (route plans, marshals’ logs, photographs, communications) is retained in case of subsequent prosecutions under other traffic or obstruction laws where s 9(3) may be engaged.

7. Responding to police directions.

• If police give reasonable directions under s 9A(3) while acting under a Commissioner instruction, ensure marshals and participants comply promptly. Failure to comply with a known direction is an offence carrying a $2,000 penalty under s 9A(4).

• If you believe a police direction unlawfully frustrates the exercise of a permit right, document the interaction and seek legal advice. The Act prohibits instructions intended to frustrate a meeting or procession authorised under a permit (s 9A(2)), but dispute resolution may require after‑the‑fact administrative review or litigation.

8. Post-event compliance and review.

• If the Commissioner imposed conditions you consider unreasonable or handled the application unreasonably, and you provided notice not less than four days before the event, prepare an application to the State Administrative Tribunal under s 8. Grounds for unreasonable dealing are laid out in s 8(2).

• If any civil claim arises against organisers or marshals, note that s 10 provides civil immunity for actions done for the purpose of carrying out the Act unless malicious and without reasonable and probable cause. Keep records demonstrating actions were taken pursuant to permit conditions and in good faith to rebut any civil allegation.

9. For events on closed roads or major events.

• Confirm whether the event falls under a road closure order under the Road Traffic Act 1974 Part VA or is a major event under the Major Events Act 2023. Such events have explicit statutory protection from police instructions designed to frustrate them under s 9A(2). Ensure road closure orders are properly obtained and documented.

10. Seek clarity on delegation.

• Because delegations can be made to authorised officers by Gazette determination with minimal detail about limitations (s 6(2)), request written confirmation of the authorised officer’s scope if dealing with a regional office. If unclear, consider directing queries to the Commissioner or seeking legal advice.

Following these steps aligns practical compliance with the statutory text. The Act rewards careful planning, documentary evidence and constructive liaison with police authorities while imposing penalties for non-compliance with police directions and certain forms of disorderly conduct.
