Public Notaries Act 2001

Core statutory concepts are defined or imported into the Act and determine how the regime functions. The Act uses short, concrete definitions rather than open-ended regulatory standards. The principal terms and their operational meaning in the text are:

• Public notary, public notary enrolment, roll. The Act defines public notary as a person enrolled in accordance with s 8 as a public notary, and requires the Supreme Court to maintain a roll containing name, date of birth and date of appointment (s 3; s 8(1)-(2)). The enrolment process is a formal act of the Court and is effective on signing the roll (s 8(3)-(4)). Removal of names is express, either at the notary’s request, or when the person ceases to be an Australian lawyer, in which case the Court must remove the name (s 8(5)-(6)).

• Australian lawyer and Australian practising certificate. The Act operates by reference to the governance framework under the Legal Profession Uniform Law (Victoria). It treats an Australian practising certificate that authorises engagement in legal practice as a principal as a material eligibility requirement (s 4(1)(c)). Definitions are imported so that the Act interoperates with the Uniform Law and the Legal Profession Uniform Law Application Act 2014 (s 3; amendments recorded in the endnotes).

• Fit and proper person. The Victorian Legal Admissions Board must be satisfied that an applicant is a fit and proper person to be a public notary (s 4(2)). The Act lists specific factors the Board must have regard to in that assessment, including past suspensions from practice, findings of professional misconduct or unsatisfactory professional conduct under the Legal Profession Uniform Law or corresponding laws, and whether the applicant is being investigated for a disciplinary complaint (s 5(4A)(a)-(d)). The Board may require further evidence or the applicant’s appearance, and may make other enquiries (s 5(5)-(6)).

• Course of study related to notarial practice. The applicant must have completed a course of study related to notarial practice approved by the Victorian Legal Admissions Board (s 4(1)(d)). The Board thus controls substantive education content through its approval power.

• Discretion to dispense with 5-year principal practice requirement. The Board may, in an individual case and subject to any conditions it thinks fit, dispense with or vary the 5-year practising-principal requirement where the Board considers the dispensation or variation does not, or if conditions are complied with will not, materially diminish the value of that requirement (s 5(7)). That creates an administrative discretion with a materiality test.

• Offence of unauthorised practice or holding out. The Act criminalises holding out or practising as a public notary by a person not on the roll and not holding the requisite practising certificate authorising practice as a principal (s 9(1)(a)-(d)). The penalty is specified as 120 penalty units in the text. The Act preserves transitional arrangements for persons appointed under antecedent law (s 9(2); s 12).

• Interaction with Oaths and Affirmations Act 2018. Parts 2, 3 and 4 of the Oaths and Affirmations Act 2018 apply, with any necessary modification, to any notarial act (s 9A). This imports procedural rules relevant to taking oaths and affirmations when performing notarial acts.

• Procedural rules and fees. The Act delegates form and procedural detail to rules of the Supreme Court (s 5(2); s 5(8); s 6(2)) and allows regulations by Governor in Council for matters required to be prescribed or necessary to give effect to the Act (s 11). The applicant pays an application fee to the Prothonotary (29 fee units, s 5(3)) and may pay other fees prescribed by regulations when applying to the Court (s 6(3)).

These concepts allocate responsibilities across judicial and regulatory institutions, and convert a professional legal credential plus a specialist course plus a fit and proper threshold into a stigmatised and protected title enforced by criminal sanction. The Board’s role in approving courses and assessing fitness places curriculum and disciplinary history at the centre of access control. The statutory reference points and cross-references to external instruments mean the regime is functionally embedded in the broader legal profession regulatory architecture rather than standing alone.

The Act affects identifiable groups and creates obligations and incentives for each.

• Prospective notaries. Lawyers who intend to become public notaries are the primary group affected. They must qualify as an Australian lawyer (s 4(1)(b)), have completed an approved notarial course (s 4(1)(d)), satisfy the Victorian Legal Admissions Board as to fitness (s 4(2); s 5(4A)), and generally have held for 5 years an Australian practising certificate that authorises practice as a principal, subject to Board dispensation (s 4(1)(c); s 5(7)). They must apply for a certificate of eligibility to the Victorian Legal Admissions Board (s 5(1)) and then apply to the Supreme Court within 30 days of receiving the certificate (s 6(1)). Applicants pay the prescribed application fee to the Prothonotary (s 5(3)), and may pay Court fees (s 6(3)). Behavioural effects include investment in an approved course, maintaining or obtaining the principal practising certificate, preparing documentary evidence, and possibly engaging with disciplinary-history clearances and appearances before the Board.

• Current public notaries. Persons enrolled on the roll are directly affected by the Act’s operational rules. Signing the roll is the event that makes the appointment effective (s 8(3)-(4)), the Prothonotary must forward appointment details to the Victorian Legal Services Board (s 8(7)), and the Supreme Court must remove a name where the person ceases to be an Australian lawyer (s 8(6)). Practising notaries must therefore maintain their status as Australian lawyers and hold an Australian practising certificate authorising practice as a principal to lawfully hold out or practice as a public notary, since s 9 defines who may use the title. In short, ongoing professional credentials are required as a condition of ongoing notarial practice.

• Law firms and employers. Firms employing lawyers who are or may become notaries must adapt internal compliance to ensure employees have the required practising certificate and are lawfully enrolled before allowing notarial work. Firms risk vicarious or reputational exposure if staff hold out or practise improperly. The Court roll and the Victorian Legal Services Board notification mechanism create sources of truth for employers verifying status (s 8(1); s 8(7)).

• Consumers of notarial services (businesses, individuals, foreign authorities). The Act creates a statutory benchmark of professional status designers of contracts and public authorities can rely on when receiving notarial acts, because the Act preserves continuity of notarial powers and the validity of notarial acts done outside Victoria (s 10(a)-(b)). Consumers must still inquire whether a person is on the roll and carries the necessary practising certificate, since s 9 forbids unauthorised practice.

• Regulators and courts. The Victorian Legal Admissions Board acts as gatekeeper for eligibility and fitness (s 5). The Supreme Court constituted by the Chief Justice is the appointing authority (s 6). The Prothonotary of the Supreme Court administers fees, the roll and forwards appointment data to the Victorian Legal Services Board (s 5(3); s 8(3), (7)). The Governor in Council and the Supreme Court set regulations and rules respectively (s 11; s 5(2); s 6(2)). The Office of the Victorian Legal Services Board receives notifications and is positioned to coordinate oversight.

• Persons outside legal profession. The Act restricts use of the title and practice, criminalising holding out or practising as a public notary by unauthorised persons with a significant penalty (s 9). That deters non-lawyers and foreign operators from offering notarial services in Victoria without proper enrolment and a practising certificate.

The Act therefore concentrates regulatory control in the Victorian Legal Admissions Board and the Supreme Court, while imposing duties and risks on applicants, current notaries and employers. The requirement to hold a practising certificate that authorises practice as a principal narrows the pool of eligible lawyers, producing an implicit market effect: notarial services are restricted to senior or established lawyers who have been principals or who obtain dispensation from the Board.

The Act establishes explicit duties and confers specific rights on institutions and individuals. These are practical obligations that determine user behaviour and institutional workflows.

Duties imposed on applicants and notaries

• Apply for a certificate of eligibility to the Victorian Legal Admissions Board prior to seeking Court appointment (s 5(1)). The application must follow Supreme Court rules (s 5(2)) and be accompanied by evidence of eligibility criteria, including status as an Australian lawyer, practising-certificate history, completion of an approved notarial course, and fitness considerations (s 5(4)).
• Pay the application fee to the Prothonotary (s 5(3)). The Act specifies 29 fee units unless the regulations prescribe a different fee, so financial outlay is explicit and capable of variation by regulation.
• If issued a certificate by the Board, apply to the Supreme Court for appointment within 30 days (s 6(1)). The Court application must comply with the Supreme Court rules and attach the certificate, plus payment of any prescribed Court fee (s 6(2)-(3)).
• Sign the roll to make the appointment effective (s 8(3)-(4)). Until signing, the enrolment process is incomplete.
• Maintain Australian lawyer status and a practising certificate authorising practice as a principal, because the Act conditions lawful holding out and practice on both being on the roll and holding that practising certificate (s 9(1)(a)-(b)). If a notary ceases to be an Australian lawyer, the Court must remove the name from the roll (s 8(6)).

Duties of public bodies and court officers

• Victorian Legal Admissions Board must assess applications for eligibility and fitness, having regard to specific factors such as suspensions, professional misconduct or unsatisfactory professional conduct findings, and active investigations (s 4(2); s 5(4A)). The Board may request further evidence, cause the applicant to appear, and make enquiries (s 5(5)-(6)).
• The Supreme Court constituted by the Chief Justice has the duty and discretion to appoint and enrol people as public notaries upon receipt of the Board’s certificate and fee, and to maintain the roll (s 6; s 8(1)-4).
• The Prothonotary must forward appointment particulars to the Victorian Legal Services Board as soon as practicable after signing (s 8(7)). The Governor in Council may make regulations and the Supreme Court may set rules to implement the Act (s 11; s 5(2); s 6(2)).

Rights and procedural protections

• Applicants have a statutory right to appeal to the Supreme Court (constituted by the Chief Justice) against a Board decision refusing a certificate of eligibility; the appeal is by re-hearing and must be brought within 30 days of notification (s 7(1)-(3)). This provides judicial review through a rehearing rather than limited grounds review.
• Applicants who satisfy the Board and the Court have the right to enrolment and to perform notarial acts, subject to other legal obligations and the Oaths and Affirmations Act 2018 being applied to such acts (s 9A; s 10).
• Persons appointed under prior regimes are not subject to the offence provisions under certain transitional arrangements (s 9(2); s 12) where those transitional sections apply.

Enforcement rights

• The Act gives regulators the right to seek criminal penalties for unauthorised practice (s 9). It does not itself set out administrative disciplinary processes for removal beyond the automatic removal on loss of Australian lawyer status and removal at a notary’s request, but the Prothonotary’s notification to the Victorian Legal Services Board (s 8(7)) creates an information flow that a regulator may use.

In practice, these duties create a tiered gatekeeping structure that balances judicial appointment power, administrative vetting by the Board, and criminal protection of the notary title. The duty to maintain a principal practising certificate and the Board’s fitness gate shift compliance costs to applicants and ongoing costs to practising notaries.

The Act sets a clear criminal prohibition and establishes administrative enforcement pathways through duties on the Court and the Prothonotary. Enforcement is primarily title protection rather than a detailed scheme of ongoing professional discipline within the Act itself.

Primary criminal offence

• Section 9 creates the offence. A person who is not on the roll and does not hold an Australian practising certificate that authorises them to engage in legal practice as a principal must not hold out that they are entitled, qualified, able or willing to practice as a public notary, and must not practice as a public notary (s 9(1)(a)-(d)). The prescribed penalty is 120 penalty units as stated in the provision. The Act does not convert penalty units to dollar amounts; that calculation is done elsewhere in statute or by reference to the Monetary Units Act and regulations.

Scope and operation of the offence

• To fall foul of s 9, a person must both not be named on the roll and not hold the required practising certificate. The provision therefore protects both the enrolled title and the professional credential that the Act associates with lawful practice. There is an express transitional exception for persons deemed to be public notaries under prior provisions (s 9(2); s 12).

Administrative enforcement mechanisms

• The Supreme Court keeps the authoritative roll and is required to remove a name if the person ceases to be an Australian lawyer (s 8(1), (6)). That removal is an administrative gate that prevents a person whose legal practice entitlement has lapsed from lawfully holding out as a public notary.
• The Prothonotary is required to forward appointment details to the Victorian Legal Services Board as soon as practicable after signature on the roll (s 8(7)). That creates an information channel to the legal services regulator, which is positioned to monitor and, where necessary, take further action under the wider legal profession regulatory framework.

Indirect regulation through related laws

• Notarial acts are subject to Parts 2, 3 and 4 of the Oaths and Affirmations Act 2018 as applied (s 9A). That means procedural compliance for oaths and affirmations associated with notarial acts falls within the Oaths Act regime and any enforcement or remedy mechanisms under that Act, as modified and applied.
• The Act cross-references the Legal Profession Uniform Law (Victoria) for definitions and disciplinary concepts, and the Victorian Legal Admissions Board must take findings under that Law or corresponding laws into account in fitness assessments (s 5(4A)). Consequently, enforcement or disciplinary actions for misconduct or unsatisfactory professional conduct are likely to be taken under the Uniform Law regime rather than directly under the Public Notaries Act, but the Act uses those findings as inputs to eligibility decisions.

Practical enforcement consequences and gaps

• The Act creates criminal liability for unauthorised practice, but does not itself set out a continuing supervisory scheme specific to notaries (for example, it does not prescribe continuing professional development, renewal of enrolment, or a dedicated notaries disciplinary body). Ongoing enforcement therefore depends on coordination between the Supreme Court (roll management), the Prothonotary (notifications), the Victorian Legal Services Board and the Victorian Legal Admissions Board, and the broader legal profession disciplinary machinery under the Legal Profession Uniform Law. The Act’s enforcement design is therefore mixed: strong on initial gatekeeping and title protection, lighter on continuous oversight within the Act itself.

The Act was drafted as part of and later amended to align with Victoria’s broader legal profession regulatory architecture. It operates by cross-reference and procedural integration with other statutes and instruments.

Legal Profession Uniform Law and related instruments

• The Act imports definitions and disciplinary concepts from the Legal Profession Uniform Law (Victoria) and the Legal Profession Uniform Law Application Act 2014. The text explicitly states that terms such as Australian practising certificate have the same meaning as in the Uniform Law (s 3). The Victorian Legal Admissions Board must consider findings of professional misconduct or unsatisfactory professional conduct within the meaning of the Uniform Law, and corresponding laws, in determining fitness (s 5(4A)(b)-(c)). This links notary eligibility and fitness directly to Uniform Law disciplinary outcomes and investigations (s 5(4A)(d)).

Supreme Court Act and Court rules

• The appointing authority under the Act is the Supreme Court constituted by the Chief Justice. The Act defines Chief Justice as in the Supreme Court Act 1986 (s 3), and requires applicants to use the form and procedures prescribed by the Supreme Court rules when applying for the Board certificate and Court appointment (s 5(2); s 5(8); s 6(2)). The roll is kept by the Supreme Court and signing the roll triggers the effectiveness of appointment (s 8(1), (3)-(4)). The Court rules therefore control the shape of evidence, forms and the timeframe for applying to the Court after the Board’s certificate.

Oaths and Affirmations Act 2018

• The Act was amended in 2018 to apply Parts 2, 3 and 4 of the Oaths and Affirmations Act 2018, with necessary modification, to any notarial act (s 9A). That imports statutory procedures, formalities and possibly liabilities associated with taking oaths and affirmations into the execution of notarial acts in Victoria, meaning notarial acts are subject to the same legislative standards as other attested statements under that Act.

Monetary Units and regulations

• The fee specified in s 5(3) is stated as 29 fee units. The Monetary Units Act 2004 and associated regulations determine the monetary value of a fee unit. The Governor in Council may also prescribe fees and other matters by regulation under s 11, and the Supreme Court makes rules for forms and procedures (s 5(2); s 6(2)). The Act’s operation is therefore partially dependent on subordinate instruments for costs and administrative detail.

Transitional provisions and prior laws

• Section 10 preserves the powers, authorities and functions of the prior office of notary public or public notary as they existed immediately before commencement, and expressly preserves the validity of notarial acts done outside Victoria (s 10(a)-(b)). The transitional Part 4 includes s 12 applying amendments effected by the Legal Profession and Public Notaries Amendment Act 2012 to applications after the commencement of those sections. The endnotes record amendments made by multiple statutes over time, including the Legal Profession (Consequential Amendments) Act 2005, the Legal Profession and Public Notaries Amendment Act 2012, the Legal Profession Uniform Law Application Act 2014, and the Oaths and Affirmations Act 2018.

Division of regulatory labour

• In practice, the Act establishes a division of labour: the Victorian Legal Admissions Board handles eligibility, education approval and fitness; the Supreme Court performs appointment and roll-keeping; the Prothonotary administers fees and notifications; and the Victorian Legal Services Board receives notification of appointed notaries. Disciplinary matters and enforcement of professional standards are referenced to the Legal Profession Uniform Law and corresponding laws, not litigated within the Public Notaries Act itself.

In short, the Act functions as a specialised appendix to the Uniform Law framework and the Supreme Court’s appointment powers, relying on subordinate rules and other statutes for definitions, fee levels, disciplinary findings, oath procedures and administrative detail. This layered interaction means changes in the Uniform Law, Court rules, the Monetary Units Act, or the Oaths and Affirmations Act can materially affect how the notary regime operates.

The Act has been amended several times since assent in 2001. The endnotes included in the published version list amendments and their commencement details. The amendment history is important because it shows where the Act’s substantive shape has been adjusted to align with broader reforms in legal profession regulation and court procedures.

Key amendments recorded in the legislation text and endnotes

• Monetary Units Act 2004, No. 10/2004: Implemented changes affecting fee unit references, with the relevant amendment commencing 1 July 2004. This affects the monetary value of the 29 fee units specified in s 5(3).

• Legal Profession (Consequential Amendments) Act 2005, No. 18/2005: Commenced 12 December 2005. This Act introduced a number of amendments to the Public Notaries Act, including insertion of definitions and changes to references to the regulatory bodies and practising certificates, as reflected in the updated s 3 definitions and elsewhere.

• Justice Legislation (Miscellaneous Amendments) Act 2006, No. 14/2006: Commenced 12 April 2006, incorporated miscellaneous adjustments relevant to the Act.

• Statute Law Revision Act 2007, No. 28/2007: Commenced 27 June 2007. This Act repealed some transitional sections and performed statutory housekeeping, with the public notaries text adjusted accordingly.

• Legal Profession and Public Notaries Amendment Act 2012, No. 15/2012: Commenced 2 May 2012 for ss 16-18, and introduced significant procedural changes affecting Part 2, including the Board’s discretion to dispense with the 5-year principal practising certificate requirement in individual cases (s 5(7) insertion, see s 16 amendments). This Act reworked eligibility and application steps in light of evolving profession regulation.

• Legal Profession Uniform Law Application Act 2014, No. 17/2014: Commenced 1 July 2015 in respect of the items listed. This was a major structural reform, bringing the Public Notaries Act into alignment with the Legal Profession Uniform Law regime. Many definitions in s 3 were amended, and references to the Victorian Legal Admissions Board and Victorian Legal Services Board were updated to conform to the Uniform Law framework.

• Oaths and Affirmations Act 2018, No. 6/2018: Commenced 1 March 2019 for s 67 insertion, which added s 9A to apply the Oaths and Affirmations Act 2018 to notarial acts.

Nature and implications of the amendments

• The amendments after 2004 progressively integrated the notary framework into Victoria’s broader legal profession reforms. The 2012 amendments are significant for granting the Board flexibility to vary the 5-year principal requirement in individual cases subject to a materiality test (s 5(7)), which introduces administrative discretion designed to accommodate atypical but acceptable career paths.

• The 2014 Uniform Law Application Act changed core definitions and linked the Act closely to the Uniform Law’s disciplinary concepts, which affects fitness assessments and the interplay of disciplinary outcomes with eligibility.

• The 2018 Oaths and Affirmations insertion brought procedural uniformity in how notarial acts are treated with respect to oaths and affirmations.

Technical amendments and repeals

• Several definitions and provisions were amended, substituted or repealed across these Acts, as recorded in the marginal notes and the table of amendments in the endnotes. Section numbering and references were adjusted to maintain alignment with the Interpretation of Legislation Act 1984 style changes.

The cumulative amendment history shows a move from a standalone notaries regime towards integration with the legal profession’s uniform regulation, while retaining the Supreme Court’s formal appointment role and creating standardised administrative procedures. The Board’s discretionary power and the importation of the Oaths and Affirmations Act are two notable points of legislative evolution.

The Act itself does not supply case law or reported litigation in the text. The statute provides an internal appeal mechanism for administrative decisions and links into the Uniform Law disciplinary system, but the published version of the Act and its endnotes do not record any judicial decisions that interpret its provisions.

Statutory appeal route

• Section 7 provides a statutory right of appeal from a decision of the Victorian Legal Admissions Board with respect to an application for a certificate of eligibility. The appeal is to the Supreme Court constituted by the Chief Justice, must be lodged within 30 days of notification of the Board’s decision, and is conducted as a rehearing (s 7(1)-(3)). This avenue gives applicants a clear route to seek judicial review in substance, but the Act does not provide information on outcomes, standards of review, or costs consequences. Because the appeal is to the same Court that appoints notaries, applicants appeal to the judicial body that performs the appointment function.

No reported cases cited in the statute

• The Act text and endnotes contain no citations to decided cases under the Public Notaries Act. The endnotes do not include a litigation history section. Consequently, the statute as published does not document any authoritative judicial construction of its key provisions, such as the fit and proper test under s 4(2), the Board’s discretion under s 5(7) to dispense with the 5-year rule, or the operation of s 9’s offence in practice.

Likely litigation focal points (textually suggested)

• If litigation were to arise, textually obvious points of contest include: the scope of the Victorian Legal Admissions Board’s discretion to dispense with the 5-year principal practising requirement (s 5(7)), the substantive content of the fit and proper person test and the weight to be given to past disciplinary findings (s 5(4A)), the procedural adequacy of the Board’s decision and its amenability to judicial review on appeal (s 7), and the interpretation of s 9 in borderline cases where a person is on the roll but lacks the specifically required practising certificate, or where administrative removal lags behind the lapse of a practising certificate.

Absence of public decisions in the Act does not mean none exist

• The absence of reported decisions in the Act’s endnotes does not prove there is no litigation interpreting the statute; it simply means the statute itself does not record such authorities. Users who require reported case law will need to search law reports and databases for decisions on s 7 appeals, disciplinary findings under the Legal Profession Uniform Law that feed into s 5(4A), and any prosecutions under s 9. The Act’s provisions create clearly identifiable legal questions that would be fertile ground for appellate decisions, particularly around administrative discretion and the interaction with Uniform Law disciplinary findings.

The statute is concise and uses delegation to other bodies and subordinate instruments; that creates several practical pitfalls for practitioners, employers and regulators. The following are concrete operational gotchas grounded in the text.

Timing constraints

• Applicants who obtain a certificate of eligibility from the Victorian Legal Admissions Board have only 30 days to apply to the Supreme Court constituted by the Chief Justice for appointment as a public notary (s 6(1)). That tight statutory window requires applicants to coordinate Court filing and fee payment promptly. Similarly, meritorious applicants refused a certificate have only 30 days to lodge a s 7 appeal (s 7(2)). Missing these windows could forfeit rights without any discretion in the text to extend time.

Dual condition to lawfully hold out or practise

• Section 9 makes it an offence for a person who is not listed on the roll and does not hold an Australian practising certificate authorising practice as a principal to hold out or practise as a public notary (s 9(1)). This creates an important formality: being on the roll alone is not, insofar as s 9 reads, sufficient to lawfully hold out as a notary unless the person also holds the specified practising certificate. Conversely, having the practising certificate alone without being on the roll is also insufficient. The Act mitigates this by requiring removal from the roll when a notary ceases to be an Australian lawyer (s 8(6)), but there is scope for a temporal gap between a practising certificate lapsing and administrative removal where an individual might inadvertently fall into the offence trap.

Board discretion and the materiality test

• The Victorian Legal Admissions Board may dispense with or vary the 5-year principal practising-certificate requirement in individual cases subject to conditions if it considers the dispensation will not materially diminish the value of that requirement (s 5(7)). The Act does not define material diminution or set standards for how the Board should exercise that discretion. That vagueness can create uncertainty for candidates who lack five years as a principal and who must rely on the Board’s judgment, with no statutory guidance on predictability, precedents or factors beyond the general fitness considerations in s 5(4A).

Dependence on external regimes for fitness and discipline

• The Act relies on disciplinary findings and investigations under the Legal Profession Uniform Law and corresponding laws in the fitness assessment (s 5(4A)). That means an applicant’s eligibility can be affected by proceedings under the Uniform Law rather than under a notary-specific regime. Applicants must therefore be vigilant about their broader disciplinary record; conversely, the Board’s assessment may involve inquiries into matters that a practitioner assumed belonged to separate processes.

Limited statutory ongoing supervision

• The Act provides clear entry controls and a removal mechanism tied to loss of Australian lawyer status, but it does not establish a notary-specific ongoing supervision regime, such as periodic renewal, CPD specific to notarial practice, or a dedicated notaries disciplinary unit. Enforcement thus relies on inter-agency processes and the general legal profession regulatory framework. Practising notaries should assume that maintaining ordinary legal practice compliance remains the primary compliance route.

Form and evidence delegated to Court rules

• Several procedural details are left to the Supreme Court rules and to regulations (s 5(2); s 5(8); s 6(2); s 11). Applicants may therefore encounter variations in form requirements, prescribed documents or fees that are not spelled out in the Act. Failure to follow the Court rules precisely may cause delay or rejection.

Notification and information flow timing

• The Prothonotary must forward appointment details to the Victorian Legal Services Board as soon as practicable after signing the roll (s 8(7)). The Act does not specify timeframes or consequences for delay, so the effectiveness of the notification mechanism depends on administrative practice. In practice, stakeholders who rely on roll updates for verification (employers, foreign authorities verifying notaries) should treat the Supreme Court roll as the primary source, and not assume immediate synchronisation with regulator databases.

Oaths and Affirmations application nuances

• Parts 2, 3 and 4 of the Oaths and Affirmations Act 2018 apply to notarial acts with necessary modifications (s 9A). Users should not assume the procedural formalities for notarial acts are identical to those for other sworn statements; the phrase "with any necessary modification" indicates tailored application, the specifics of which will be determined by the Oaths Act and any judicial or regulatory interpretations.

These are concrete procedural and administrative risks that arise directly from the statutory text and delegation pattern. Practitioners should plan to manage timing, maintain practising certification, and retain documentary evidence of the Board’s certificate and the Court appointment to avoid exposure under s 9.

This section sets out a practical compliance checklist for lawyers seeking appointment and for employers or users who need to verify notarial status. All steps and obligations below are grounded in the statutory text.

For prospective public notaries , stepwise compliance

1. Verify baseline eligibility. Confirm you are an Australian lawyer within the meaning of the Legal Profession Uniform Law (s 3; s 4(1)(b)). If you do not currently hold an Australian practising certificate that authorises practice as a principal, evaluate whether you meet the usual 5-year requirement or whether you may satisfy the Victorian Legal Admissions Board that a dispensation is appropriate (s 4(1)(c); s 5(7)).

2. Complete approved notarial education. Undertake and complete a course of study related to notarial practice that has been approved by the Victorian Legal Admissions Board (s 4(1)(d)). Keep documentary proof of completion suitable for attachment to the Board application (s 5(4)).

3. Prepare evidence supporting fitness. Assemble materials demonstrating you are a fit and proper person, including records showing you have not been suspended from practice and disclosure of any findings of professional misconduct or unsatisfactory professional conduct under the Legal Profession Uniform Law or corresponding legislation, and whether any disciplinary investigations are pending (s 5(4A)(a)-(d)). Be ready to provide further evidence or to attend before the Board if requested (s 5(5)-(6)).

4. Apply to the Victorian Legal Admissions Board. Submit the application for a certificate of eligibility in the form prescribed by the Supreme Court rules (s 5(1)-(2)). Pay the application fee to the Prothonotary, currently set at 29 fee units unless the regulations prescribe otherwise (s 5(3)). Ensure the application includes the documents required by s 5(4).

5. Manage the 30-day Court application window. If the Board issues a certificate of eligibility, you must apply to the Supreme Court constituted by the Chief Justice for appointment within 30 days of issue (s 6(1)). Prepare the Court application in accordance with the Supreme Court rules (s 6(2)), attach the Board’s certificate, and pay any fee prescribed by the regulations for Court appointment (s 6(3)). File promptly to avoid missing the statutory time limit.

6. Sign the roll. When appointed, sign the roll kept by the Supreme Court, noting signing is the act that makes the appointment effective (s 8(3)-(4)). Retain proof of enrolment and the date of appointment for professional records.

7. Maintain practising certificate and Australian lawyer status. To lawfully hold out as a public notary and practise as one, maintain an Australian practising certificate authorising practice as a principal and remain an Australian lawyer. If your lawyer status changes, you must ensure the Supreme Court removes your name from the roll as required (s 8(6); s 9(1)(a)-(b)).

For current public notaries , ongoing compliance

• Keep practising certificate current. The Act conditions entitlement to hold out or practise on both being on the roll and holding the specified practising certificate (s 9(1)). Ensure renewal processes for practising certificates are completed on time.

• Monitor disciplinary exposure. Because prior findings and active investigations under the Uniform Law are relevant to eligibility and may affect ongoing standing, maintain good disciplinary compliance and respond promptly to any investigations (s 5(4A)).

• Understand oath and affirmation procedures. Notarial acts fall within the Oaths and Affirmations Act 2018 Parts 2-4 as applied (s 9A). Follow procedures for oaths and affirmations applicable to notarial practice.

For employers and clients , verification and risk management

• Verify roll membership and practising certificate. Before instructing a person to perform notarial acts, confirm they are on the Supreme Court roll and that they hold an Australian practising certificate authorising practice as a principal. The Court roll is the primary authoritative source (s 8(1)-(4)); the Prothonotary is mandated to notify the Victorian Legal Services Board (s 8(7)), which therefore receives an official record.

• Beware of gaps. Do not rely solely on an individual’s personal claim to be a notary; the Act criminalises holding out by unauthorised persons (s 9). Where timeliness is critical (for example, for foreign document legalisation), confirm the notary’s current practising certificate, because administrative delays in removal may create risk.

• Keep documentary evidence. For records and potential legal challenges, retain copies of the Board’s certificate of eligibility and the court appointment, including the date of signing the roll (s 5(8); s 8(3)-(4)).

Regulatory and procedural compliance

• Follow Supreme Court rules and regulations. Many procedural matters and forms are prescribed by the Supreme Court rules and by regulations made under s 11. Check the current Court rules for the application form, any prescribed documentary form, and Court fees (s 5(2); s 6(2); s 11).

• Plan for appeals. If the Victorian Legal Admissions Board refuses a certificate, an applicant must lodge a s 7 appeal within 30 days; the appeal is a rehearing (s 7(1)-(3)). Seek prompt legal advice if an adverse decision is likely to ensure the appeal is timely and framed according to the Board’s decision record.

Recordkeeping and internal controls for firms

• Maintain internal controls to ensure only properly enrolled, appropriately credentialed lawyers perform notarial acts. Establish verification procedures for incoming notarial work to avoid inadvertent exposure to s 9 offences and reputational risk.

These compliance steps are directly drawn from the Act’s text and the allocation of duties within it. Because many procedural details are delegated to Court rules and regulations, confirm the current rules and any prescribed fees before lodging applications or accepting notarial work.
