Public Notaries Act 1992

The Act is organised around a small set of core legal objects and processes. These concepts determine who may be a notary, what they may do, how their authority is recorded and revoked, and which external instruments are implicated.

• Appointment and judicial gatekeeping. Appointment is judicial: applications go to the Supreme Court, which evaluates character, competence and local need as conditions precedent to appointment (s 4(1)-(2)). The Court therefore exercises primary certification and gatekeeping functions, rather than an administrative regulator setting exhaustive regulatory rules.

• Certification and enrolment instruments. After appointment, the Registrar issues a certificate of office under the Court’s seal (s 4(3)). A person must take an oath of office in the form at Schedule 1 before being enrolled (s 5(1)-(2)). The Roll of Public Notaries is the public record of appointment and date, and the appointee must sign it (s 6(1)-(2)). The Registrar is tasked with maintaining the Roll and allowing fee‑free inspection during office hours (s 6(3)).

• Scope of notarial powers. The Act expressly enumerates several functions typical of transnational notarial practice: certifying documents for foreign filing/registration, taking affidavits for interstate or international use, protesting bills of exchange or bills of lading, verifying documents to comply with foreign law, and broadly, exercising those powers usually exercised by notaries in the United Kingdom (s 7). The list is permissive rather than exhaustive, but anchored to established notarial practice.

• Mutual recognition interface. For mutual recognition under Commonwealth law, the Registrar is designated the local registration authority for applications that relate to appointment as a public notary (s 4A). That creates a procedural gateway for practitioners recognised interstate under the Mutual Recognition Act 1992 to seek local registration.

• Removal, suspension and administrative recordkeeping. The Court can cancel or suspend appointments on due cause, on application by the Registrar or any person, or of its own motion (s 8(1)). Notations of suspension, cancellation and revocation are to be made in the Roll and certificates must be surrendered or returned to the Registrar when appointments cease or suspensions are revoked (s 8(2), (4); s 9). A suspended notary may apply for revocation of the suspension and the Court may impose terms and conditions on revocation (s 8(3)).

• Transitional continuity. Appointments under prior (imperial and colonial) Acts are preserved: persons appointed under the former Acts at commencement are deemed appointed under this Act and are exempted from taking the oath (s 11(2)-(3)). The Act repeals the listed Imperial Acts as laws of the Territory (s 10; Schedule 2).

Structural features: the Act delegates procedural detail to the Supreme Court Rules and to the Court’s discretion (s 4(1) referencing the Rules; s 3 definition of Rules). It is administratively light: it creates few regulatory mechanisms beyond a Roll and a certificate system and relies on judicial orders for discipline. The Act’s limited scope leaves many operational specifics, application forms, fees, proof of competence, detailed grounds for “due cause”, appeal or review processes, either to Rules, judicial practice, or other legislation referenced in the Act.

Primary persons and entities affected by the Act are:

• Applicants for appointment as public notaries. Any person who seeks appointment must apply to the Supreme Court in accordance with the Rules (s 4(1)). The applicant must satisfy the Court as to character, competence and local need (s 4(2)). The Rules determine procedural requirements for applications; the Act does not set application fees or documentary thresholds.

• The Supreme Court. The Court decides appointments, suspensions, cancellations and revocations (s 4(2); s 8(1), (3)-(4)). The Court exercises discretionary judgment on character and competence and on whether there is a need for a notary in the applicant’s intended area of practice (s 4(2)(a)-(b)). The Court also decides on due cause for cancellation or suspension and on terms when revoking suspensions (s 8(1), (3)).

• The Registrar of the Supreme Court. The Registrar issues certificates under the Court’s seal upon appointment (s 4(3)); keeps and maintains the Roll (s 6(1)); facilitates free inspection of the Roll during office hours (s 6(3)); annotates the Roll to record cancellations, suspensions and revocations (s 8(2), (4)); receives and returns certificates on cessation or revocation (s 8(2), (4); s 9). The Registrar acts also as the local registration authority under the Mutual Recognition Act 1992 for relevant applications (s 4A).

• Persons and organisations using notarial services. Entities that require certified documents for foreign filing or registration, affidavits for interstate or international use, or verification to meet foreign law requirements will rely on the statutory recognition of notaries’ capacities under s 7. The Act affects their transaction costs, as they must obtain notarial certification from someone appointed under this framework to rely on the document in specified contexts.

• Third‑party complainants. The Court may act on application by “any person” to cancel or suspend a notary’s appointment (s 8(1)). That means private individuals, commercial parties, or other public officials can initiate disciplinary proceedings in respect of a notary by bringing an application to the Court alleging due cause.

• Practitioners moving between jurisdictions. Practitioners subject to mutual recognition pathways under the Commonwealth Mutual Recognition Act 1992 will interact with the NT Registrar (s 4A). The Act therefore affects interstate mobility of notarial qualifications where that Commonwealth regime applies.

• The public record. The Roll is a public register maintained by the Registrar and is available for inspection without fee during office hours (s 6(1), (3)). The public has limited rights to verify who is enrolled as a public notary and when the appointment occurred.

Indirectly affected parties include foreign courts and registries that rely on instruments certified by Northern Territory notaries, and commercial counterparties in cross‑border transactions requiring notarial acts. The Act alters administrative burdens and procedural routes for these actors because the Act anchors notarial authority to an NT Supreme Court appointment and a sealed certificate (s 4(3); s 6).

Duties imposed and rights conferred by the Act are concentrated and specific. The principal statutory duties and rights include:

Duties and obligations on the appointee and officerbearers

• Take the oath and be enrolled. Before enrolment as a public notary, the person must take the oath of office in the form in Schedule 1; the oath must be administered by a Judge of the Court (s 5(1)-(2); Schedule 1). Persons appointed under prior legislation are exempted from the oath under the transitional provision (s 11(2)-(3)).

• Sign the Roll. An enrolled notary must sign the Roll once their name is entered (s 6(2)).

• Safeguard and deliver the certificate. The Registrar issues a certificate under the Court’s seal on appointment (s 4(3)). On cancellation, suspension or resignation the person must deliver the certificate to the Registrar without delay (s 8(2); s 9(2), (4)). When suspension is revoked the Registrar returns the certificate (s 8(4)).

• Observe notarial standards implicit in the oath. The Schedule 1 oath binds the notary to not make or attest any act, contract or instrument that the notary shall know involves violence or fraud, and to act uprightly and justly to the best of skill and ability. The oath is drafted to be taken in the form required by the Oaths, Affidavits and Declarations Act 2010 where that Act applies (Schedule 1; endnotes show substitution in 2010).

Rights and powers conferred on appointees

• Statutory notarial powers. The Act confers certain recognised notarial powers: certifying documents for foreign courts or registration overseas; taking affidavits for interstate or international use; protesting or noting protests of bills of exchange or bills of lading; verifying documents and taking affidavits to comply with foreign law; and “the exercise of the powers and authorities that are usually exercised by a public notary in the United Kingdom” (s 7). These are express rights to execute and authenticate documents in contexts where such notarial acts are required.

Administrative duties on public officers

• Registrar’s recordkeeping and ministerial role in mutual recognition. The Registrar must keep the Roll and make entries noting appointment date and any cancellations, suspensions or revocations (s 6(1); s 8(2), (4)). The Registrar is the local registration authority for mutual recognition applications relating to public notaries under the Commonwealth act (s 4A).

• Court’s disciplinary and supervisory powers. The Court may cancel or suspend an appointment on due cause shown, on application by the Registrar or any person, or on its own motion (s 8(1)). The Court also hears applications to revoke suspensions and may impose terms on any revocation (s 8(3)).

Procedural rights and limits

• Public access to the Roll. Any person may, without fee, inspect the Roll during Registrar office hours (s 6(3)). The Act does not provide for remote or electronic access; it is limited to inspection during office hours at the Registrar’s office.

• Mutual recognition procedural right. Applicants eligible under the Commonwealth Mutual Recognition Act 1992 have a statutory point of entry via the Registrar as local registration authority (s 4A). The Act does not itself change the substance of the Commonwealth regime but designates who performs the local registration task.

Notably absent provisions

• The Act does not specify disciplinary standards or a detailed complaints process beyond enabling the Court to act on application by “any person” (s 8(1)). It does not provide for administrative sanctions other than suspension or cancellation; it does not prescribe penalties or costs on cancellation applications; it does not set out appeal or review routes from Court orders within the Act; and it does not provide for fees for enrolment or re‑enrolment (those matters may be addressed in the Rules or elsewhere).

Taken together, the Act sets out a compact set of duties and rights aimed at conferring recognised notarial authority while leaving substantial procedural content and definitional detail to the Court’s rules and practice.

The Act’s enforcement scheme is narrow and judicially centred. It does not create criminal offences, civil penalty regimes or administrative fines. Enforcement is realised principally by the Court’s discretionary powers to suspend, cancel and reinstate appointments and by administrative recording requirements. Key enforcement mechanics are:

• Suspension and cancellation by the Court. The Supreme Court may cancel or suspend a person’s appointment as a public notary on due cause being shown. The power may be exercised on application by the Registrar, on application by any person, or on the Court’s own motion (s 8(1)). The Act does not specify what constitutes “due cause”; that term therefore imports judicial interpretation and common law norms or Rules that the Court may apply.

• Public recordation and certificate control. Where the Court cancels or suspends an appointment, the Registrar must annotate the Roll to record the cancellation or suspension, and the notary must deliver the certificate of appointment to the Registrar without delay (s 8(2)). Conversely, when the Court revokes a suspension, the Registrar must note the revocation and return the certificate (s 8(3)-(4)). These steps serve as administrative enforcement mechanisms: loss of a public certificate and a negative annotation on the Roll limit the notary’s capacity to present themselves as validly appointed.

• Revocation with terms and conditions. A notary suspended under s 8(1) may apply for revocation of that suspension (s 8(3)). If the Court revokes the suspension, it may do so subject to terms and conditions it thinks fit (s 8(3)). The Act therefore allows the Court to impose remedial or supervisory conditions on reinstatement.

• Resignation and cessation. A notary may resign by written notice to the Registrar accompanied by their certificate of appointment. Cessation also occurs on cancellation or suspension (s 9(1)-(4)). The obligation to deliver or surrender the certificate provides an enforceable administrative mechanism to prevent continued unauthorised practice under the appearance of authority.

Enforcement gaps and procedural uncertainties

• No specified standards or investigative process. The Act does not prescribe investigative powers for the Registrar or the Court, nor does it set timelines for hearing applications for suspension/cancellation, or for revocation applications. The absence of detailed procedural provisions implies reliance on the Supreme Court’s inherent power and the Rules of the Supreme Court to manage process.

• No statutory appeal or review pathway contained in the Act. The Act does not set out an internal appeal route from a Court order under this Act. Any appeal or review would proceed under general channels for reviewing Supreme Court decisions or by reference to the Rules, not by a statutory right created in this Act.

• No pecuniary penalties or professional discipline other than removal from the Roll. The only express remedies are administrative: suspension, cancellation, notation and certificate control. The Act does not provide for fines, compensation orders, or registry sanctions beyond these.

Practical enforcement consequence: loss of public recognition. The principal sanction is loss of official certificate and Roll entry (s 6; s 8; s 9). That affects the notary’s ability to perform acts that require a person appointed as a public notary and may lead to private contractual or reputational consequences in commercial and international dealings.

The Act intentionally cross‑references and delegates substantial substance to other legal instruments. These interactions shape procedure, evidentiary form and recognition across jurisdictions.

• Rules of the Supreme Court and the Supreme Court Act 1979. The Act repeatedly places procedural matters and the application process in the Rules’ domain. Section 4(1) requires applications to be made “in accordance with the Rules”; the Act defines Rules as the Rules of the Supreme Court made under the Supreme Court Act 1979 (s 3). That means detailed procedural, evidentiary and fee arrangements are expected to be handled by Rules rather than by the Act itself.

• Mutual Recognition Act 1992 (Commonwealth). The Registrar is expressly designated the local registration authority for the Mutual Recognition Act in relation to applications that concern appointment as a public notary (s 4A). That creates an interface with the Commonwealth mutual recognition regime governing occupational registration across jurisdictions. The Act thus provides a statutory channel for reciprocal recognition, subject to the Mutual Recognition Act’s substantive and procedural rules.

• Oaths, Affidavits and Declarations Act 2010. The Oath of Office in Schedule 1 is to be taken “as required by Oaths, Affidavits and Declarations Act 2010” (Schedule 1). The 2010 amendments substituted s 5 and amended Schedule 1 (endnotes list s 5 sub No. 40, 2010; sch 1 amd No. 40, 2010, s 109). That links the formality and validity of the oath to the Commonwealth‑modelled Territory statute governing oaths and declarations.

• Repealed Imperial and colonial Acts. The Act expressly repeals certain Imperial Acts insofar as they operated as laws of the Territory (s 10; Schedule 2). Schedule 2 lists historic acts regulating notaries in England and a South Australian act from 1859. The repeal means that statutory authority for notaries in the Territory is consolidated under this Act, with residual provisions now subject to this instrument and its cross‑references.

• Supreme Court’s inherent jurisdiction and general law. The Court’s powers to suspend, cancel or act on due cause are exercised against the background of its general jurisdiction and inherent powers. Because the Act does not define “due cause” or detailed procedural standards, judicially developed standards and the Rules will fill those gaps.

• Absence of interaction with professional regulation regimes. The Act does not link notarial appointment to other professional regulatory regimes (for example, legal admission, law practice regulation or legal practitioners’ disciplinary schemes) within the text. If competence or character standards are informed by another professional regulatory regime, that is left to the Court or the Rules to determine.

• Public international and foreign law requirements. The Act’s enumeration of powers (s 7) is framed with reference to use in foreign courts and compliance with foreign law. The Act therefore operates as a domestic recognition mechanism for acts intended for international legal processes but leaves the substance of foreign legal requirements to be met by the documents themselves and by the notary’s conduct.

In sum, the Act establishes a skeletal domestic framework and deliberately relies on adjacent statutes and the Rules of the Supreme Court to supply procedure, formality and inter‑jurisdictional recognition. Practitioners must therefore consult the Rules, the Mutual Recognition Act and the Oaths Act when applying or relying on notarial authority.

The Act’s endnotes record a concise amendment history and legislative timeline. Key dates and amendments recorded in the reprint are:

• Assent and commencement. Public Notaries Act 1992 (Act No. 37, 1992) received assent on 25 June 1992 and commenced on 1 August 1992 (Endnotes, list of legislation 2).

• Statute Law Revision Act (No. 2) 2001 (Act No. 62, 2001). This instrument inserted section 4A establishing the Registrar as the local registration authority for the purposes of the Commonwealth Mutual Recognition Act 1992 (Endnotes: list of amendments, s 4A ins No. 62, 2001, s 12).

• Oaths, Affidavits and Declarations (Consequential Amendments) Act 2010 (Act No. 40, 2010). This Act made two changes: it substituted section 5 (the oath provision) and amended Schedule 1 to align the form of the oath with the Oaths, Affidavits and Declarations Act 2010 (Endnotes: s 5 sub No. 40, 2010, s 108; sch 1 amd No. 40, 2010, s 109). The consequential amendments commenced on 1 March 2011 (Endnotes, list of legislation 2).

• General formal amendments. The Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) made general amendments of a formal nature to sections 1 and 3 and Schedule 1 (Endnotes 3), though those are described as formal in nature; the reprint notes these as not separately itemised in the table of amendments.

Schedule 2 (repeal) and Schedule 1 (oath) have been amended historically in the ways recorded above. The Act is otherwise short and the endnotes do not list further substantive amendments besides the insertion of s 4A and the 2010 changes to the oath. The endnotes confirm the dates of commencement for the amendments and the Acts responsible for them.

What the amendment history signals practically is that the statute has been maintained to reflect changes in related statutory frameworks: an explicit interface with the Commonwealth mutual recognition regime in 2001 and alignment with modernised oath and declaration provisions in 2010. The Act’s core mechanics, appointment by the Court, maintenance of the Roll, powers and discipline, remain as originally enacted, with procedural and cross‑reference adjustments adopted to ensure consistency with other evolving statutes.

The text of the Act and the accompanying endnotes do not record any litigation decisions, reported cases, or judicial interpretations that arise under the Act. There are no case names, reported judgments or annotated judicial developments contained in the source material supplied. The Act empowers the Supreme Court to exercise functions (appointment, suspension, cancellation and revocation) and therefore will generate decisions in individual cases, but the reprinted statute and endnotes do not provide examples of litigation outcomes, contested points of statutory construction, or appellate rulings arising under this Act.

Absent recorded litigation in the provided material, the following observations are limited to structural implications rather than documented case law:

• The Act’s use of open‑ended standards such as “good fame and character”, “competent to act”, and “due cause being shown” invites judicial interpretation and application in individual appointment and disciplinary proceedings (s 4(2); s 8(1)). Outcomes in those areas will depend on the Supreme Court’s formulation of those standards in practice and any subsequent appellate treatment, none of which is recorded in the source.

• Procedural gaps in the Act (for example, no statutory definition of “due cause”, no prescribed processes or timelines for suspension or revocation, no statutory appeal pathway) make it probable that Rules of the Supreme Court or the Court’s inherent powers will shape how disputes and applications are run. Again, there are no reported examples in the text.

• Mutual recognition cases may arise where an interstate practitioner seeks registration under the Mutual Recognition Act 1992 and the Registrar’s local registration authority role is engaged (s 4A). The Act makes that administrative link explicit, but the source contains no disputes concerning mutual recognition and notarial appointment.

To obtain litigation history, practitioners will need to search the Supreme Court’s databases, law reports and electronic case law services for decisions addressing s 4, s 8 and associated Rules. The Act itself provides the statutory hooks that litigants would use, but the source provided here records no such litigation.

The Act is compact but contains several practical pitfalls and implementation risks for applicants, administrators and users of notarial services. These are matters to flag because they impose obligations, open discretionary spaces or leave process to external instruments.

• “Need for a public notary in the area” is a statutory gate. The Court must be satisfied there is a need for a public notary in the area where the applicant intends to practise (s 4(2)(b)). That is a discretionary criterion that may be interpreted narrowly. Applicants should be prepared to demonstrate market demand, client base, or demonstrable transactional need for notarial services in the proposed area of practice. The Act provides no objective threshold; the determination is judicial.

• Character and competence are subjective and judicially assessed. The Act requires the applicant be “of good fame and character” and “competent to act as a public notary” (s 4(2)(a)). The Act does not define these terms or prescribe evidentiary requirements; the applicant’s professional standing, disciplinary record (if any), and demonstrable notarial competence will be assessed by the Court under the Rules. Applicants cannot assume a mere legal practice admission suffices; evidence may be demanded.

• The oath must be administered by a Judge. The oath of office must be administered by a Judge of the Court (s 5(2)). Practically, that requires arranging an appearance before a Judge and scheduling a formal ceremony, which can introduce delay and logistical burden compared with administrative swearing before a registrar or commissioner. The Schedule’s cross‑reference to the Oaths Act makes formality strict (Schedule 1).

• Certificate custody and prompt surrender. The Registrar issues a certificate under seal on appointment (s 4(3)). The notary must return the certificate on suspension, cancellation or resignation (s 8(2); s 9(2)). Failure to return a certificate is not addressed in terms of penalties in the Act; however, the duty to return is mandated and continued use of the certificate after cancellation or suspension would be unprotected. Practitioners should keep secure custody of the certificate and maintain records evidencing surrender where applicable.

• Any person may apply to the Court to seek suspension or cancellation. Section 8(1) allows “any person” to apply to the Court to cancel or suspend a notary’s appointment on due cause. That opens the disciplinary route to private parties and commercial rivals, which could be used strategically. The Act does not require complainants to be public officials.

• The Act does not define “due cause” or provide a procedural timeline. The absence of statutory process or an investigative framework can lengthen or complicate proceedings. Parties should expect reliance on the Supreme Court’s rules and inherent procedures.

• Roll access is limited to office hours and is physical. The Roll may be inspected without fee during the hours that the office of the Registrar is open (s 6(3)). There is no statutory requirement for electronic availability or certified extracts, potentially causing friction for interstate or international users who need verification outside office hours.

• Powers tied to foreign requirements may require specialist knowledge. The Act empowers notaries to verify documents to meet foreign law and to certify documents for foreign courts and registration (s 7(a), (d)). Practitioners must ensure they understand the targeted foreign formalities and attestation requirements. The Act does not confer any diplomatic or consular immunities; it simply recognises the function domestically.

• “Usually exercised in the United Kingdom” is a movable standard. The catch‑all in s 7(e) ties some powers to the practices of UK public notaries, which may evolve or differ in scope from local expectations. Relying on that phrase to justify particular acts may require reference to current UK practice, which is not supplied by the Act.

• Transitional appointees spared the oath. Persons appointed under the former Acts are deemed appointed under this Act without being required to take the oath (s 11(2)-(3)). There may be legacy differences in how these notaries were admitted and in the content of their original appointments.

• No express integration with other professional discipline mechanisms. The Act does not expressly connect notarial misconduct to other professional disciplinary regimes (for example, law society or legal practitioner rules). This may complicate cross‑disciplinary discipline where a notary is also a legal practitioner.

• No fee‑setting in the Act. The statute is silent on fees for application, enrolment, inspection or certificate issuance. Fees, if any, will be governed by the Rules or other administrative instruments, not the Act.

These points mean applicants and users should plan for judicial discretion, procedural forms set out in the Rules, and potential delays or uncertainty where the Act leaves matters to the Court’s practice.

Compliance under this Act is primarily procedural and revolves around meeting the Court’s criteria, following the Rules and observing administrative obligations. Practical steps and checklists follow, aligned to specific provisions:

For applicants seeking appointment (s 4(1)-(3))

1. Check the Rules. Begin by obtaining the applicable Rules of the Supreme Court governing applications for appointment as a public notary. The Act requires applications to be made in accordance with those Rules (s 4(1); s 3 definition of Rules).

2. Prepare evidence of the Court’s criteria. Assemble documentary evidence addressing:

   • Good fame and character. Provide certificates of good standing, references, disciplinary record (if any), and other probative materials to satisfy s 4(2)(a)(i).
   • Competence to act as a public notary. Provide evidence of training, prior notarial practice, professional qualifications, or experience in cross‑border transactions to address s 4(2)(a)(ii).
   • Need in the area of intended practice. Demonstrate client demand, business plans, or evidence of lack of existing notarial services where you intend to practise to satisfy s 4(2)(b).

3. Make the application to the Court per the Rules and timetable. File materials and attend hearings as required.

4. On successful appointment. Expect the Registrar to issue a certificate of office under the Court’s seal as soon as practicable after appointment (s 4(3)). Keep the certificate secure; it is evidence of appointment.

5. Take the oath and enrolment. Before being enrolled, take the oath of office in the Schedule 1 form, administered by a Judge (s 5(1)-(2); Schedule 1). If you were appointed under a former Act prior to commencement, the transitional provision may apply and the oath may not be required (s 11(2)-(3)).

6. Sign the Roll. Upon enrolment being recorded, sign the Roll of Public Notaries (s 6(2)).

For practising notaries

1. Exercise powers within the statutory scope. Limit notarial acts to those specified in s 7(a)-(e), and ensure that certifications intended for foreign use meet the requirements of the receiving foreign law or court.

2. Maintain records and custody of certificate. Keep the certificate issued under the Court seal accessible but secure. On resignation, cancellation or suspension, you must return the certificate to the Registrar without delay (s 9(1)-(2); s 8(2)).

3. Observe the oath’s standards. The oath requires avoiding attesting to acts you know involve violence or fraud and to act uprightly and justly according to your skill and ability (Schedule 1). Document due diligence in verifying identity and the integrity of documents to support that standard.

4. Be prepared to respond to complaints. Any person can apply to the Court for cancellation or suspension (s 8(1)). If faced with a complaint, engage counsel promptly and prepare to demonstrate competence and probity before the Court. If suspended, you may apply for revocation of suspension (s 8(3)). The Court may attach terms on revocation (s 8(3)).

For administrators and the Registrar

1. Maintain the Roll and annotations. Keep the Roll up to date with appointments, dates and any notations of cancellation, suspension or revocation (s 6(1); s 8(2), (4)).

2. Provide public access. Allow fee‑free inspection of the Roll during office hours (s 6(3)). Consider pragmatic arrangements for providing certified extracts if requested; the Act is silent on this but practical demand may arise.

3. Act as local registration authority for mutual recognition. Process applications under the Commonwealth Mutual Recognition Act 1992 when they relate to notarial appointments, coordinating with the applicant and the Court as necessary (s 4A).

4. Manage certificates. Issue certificates under the Court’s seal after appointment (s 4(3)) and ensure prompt retrieval of certificates upon notice of resignation, cancellation or suspension (s 8(2); s 9(2)).

Practical compliance risks and mitigations

• Logistical scheduling for oath before a Judge. Because s 5(2) requires a Judge to administer the oath, schedule this early to avoid delays in enrolment. Liaise with the Court registry for available sittings.

• Demonstrating “need”. Applicants should prepare market analysis, client lists or letters of intent from clients to establish need under s 4(2)(b).

• Operating across borders. For documents intended for foreign use, obtain confirmations of foreign requirements (authentication, apostille, consular certification) and ensure the notarial act aligns with what is required by the foreign authority; the Act empowers such acts but does not define foreign formalities (s 7(a), (d)).

• Handling complaints. Keep contemporaneous records of notarial acts and identity verification steps to be able to respond to complaints that may lead to a Court application under s 8(1).

• Mutual recognition logistics. If relying on interstate recognition, follow the Mutual Recognition Act procedures and liaise with the Registrar as the local registration authority (s 4A).

Checklist summary

• Read the applicable Supreme Court Rules before applying.
• Gather character, competence and need evidence.
• Apply to the Court and, if successful, arrange for the oath to be administered by a Judge.
• Obtain and safeguard the certificate under seal and sign the Roll.
• Keep records and be prepared to surrender the certificate and respond to any Court application for suspension or cancellation.
• Coordinate with the Registrar for mutual recognition matters.

Following these steps aligns operations with the Act’s requirements and addresses the principal administrative obligations created by the statute.
