### 65 Decision by public body not to investigate
> > (1) If, under [section 64](#GS64@EN) , a public body decides not to investigate a disclosed matter, the public body must, within 14 days –
> >
> > > > (a) notify the person who made the disclosure of its decision and the reasons for its decision; and
> > >
> > > > (b) [*\[Section 65 Subsection (1) amended by No. 68 of 2009, s. 30, Applied:01 Oct 2010\]*](/view/html/inforce/2010-10-01/act-2009-068#GS30@Hpa@EN) notify the Ombudsman that the public body has determined that the disclosure will not be investigated.

> > (2) [*\[Section 65 Subsection (2) substituted by No. 68 of 2009, s. 30, Applied:01 Oct 2010\]*](/view/html/inforce/2010-10-01/act-2009-068#GS30@Hpb@EN) On receipt of a notification that a public body has decided not to investigate a disclosure matter, the Ombudsman must review that decision.
