### 17 Confidentiality provisions do not apply > > (1)  Without limiting [section 16](#GS16@EN) , a person who makes a protected disclosure does not by doing so – > > > > > > (a) commit an offence under a provision of any other Act that imposes a duty to maintain confidentiality with respect to a matter or any other restriction on the disclosure of information; or > > > > > > > (b) breach an obligation by way of oath or rule of law or practice or under an agreement requiring him or her to maintain confidentiality or otherwise restricting the disclosure of information with respect to a matter. > > > (2)  [*\[Section 17 Subsection (2) amended by No. 68 of 2009, s. 13, Applied:01 Oct 2010\]*](/view/html/inforce/2010-10-01/act-2009-068#GS13@EN) [Subsection (1)](#GS17@Gs1@EN) does not apply to a person who makes a disclosure of information to which a protected disclosure relates to a person other than the person to whom the disclosure was originally made, except where the further disclosure of information is made in accordance with this Act.
