75Restriction on the application of secrecy provisions

#### 75 Restriction on the application of secrecy provisions (1) A provision of a law of the Commonwealth that prohibits the disclosure, recording or use of information does not apply to the disclosure, recording or use of information if: (a) the disclosure, recording or use is in connection with the conduct of a disclosure investigation; or (b) the disclosure, recording or use is for the purposes of the performance of the functions, or the exercise of the powers, conferred on a person by Part 3 or section 61 or 65; or (c) the disclosure, recording or use is in connection with giving a person access to information for the purposes of, or in connection with, the performance of the functions, or the exercise of the powers, conferred on the person by Part 3 or section 61 or 65; and the disclosure, recording or use is not contrary to a designated publication restriction. > Note: For designated publication restriction, see section 8. (2) However, this section does not apply if: (a) the provision is enacted after the commencement of this section; and (b) the provision is expressed to have effect despite this section.
