Public Holidays Act 2023

The Act is built around a small set of concepts that determine its legal operation. Each concept is defined implicitly by how it is used in the text, not by explicit definitional clauses in the Act.

• Public holiday. Section 3(1) lists the standard public holidays for each year. The Act then provides substitution rules where holidays fall on weekend days (s 3(2)-(4)) and allows the Governor to substitute another day by proclamation (s 3(5)). The effect is that the statutory calendar of public holidays is fixed unless and until altered by the Governor’s proclamation powers. The Act treats part‑day public holidays separately (s 4).
• Part‑day public holiday. The Act expressly makes the part of 24 December from 7 pm to midnight and the part of 31 December from 7 pm to midnight public holidays (s 4). The Act’s payment/compulsion rule does not treat these part‑day public holidays as full public holidays for the purposes of s 8(3). However, a proclaimed bank half holiday is treated as a full bank holiday for the purposes of the payments rule (s 8(3)-(4)).
• Bank holiday and bank half holiday. The Act equates Sundays and public holidays with bank holidays (s 7(1)). It then gives the Governor powerto replace a bank holiday, appoint an additional bank holiday, or appoint a bank half holiday (s 7(2)). The Act mandates closure of all ADIs on bank holidays and during bank half holidays, subject to a Governor authorisation permitting opening in a specified area (s 7(4)-(5)). The Act does not define ADIs in the text provided.
• Closure of public offices. The Act requires that all offices of the Public Service be closed on public holidays (s 6), with two exceptions: an office that is specially required by law to be kept open on the public holiday, and circumstances where the responsible Minister requires services during a public holiday in case of an emergency (s 6(a)-(b)). The Act therefore establishes a default closure rule and two statutory exceptions that permit continuity of legally mandated services and emergency staffing.
• Compellability of payment and acts. Section 8 introduces a single legal effect relating to timing of payment and performance obligations. It adopts a non‑compellability principle for public holidays, bank holidays and Saturdays, calibrated to existing Sunday practice before commencement, and a rule that postpones required performance to the next business day that is not a public holiday, bank holiday or Saturday, subject to statutory exceptions that continue to require performance on the day where another law expressly requires it (s 8(1)-(2)). The section excludes part‑day public holidays from its definition of public holiday (s 8(3)), but it treats a proclaimed bank half holiday as if the whole day were a bank holiday for the payments rule (s 8(4)).
• Governor proclamation powers. The Governor has recurring, substantive powers: to declare other days public holidays instead of scheduled days (s 3(5)); to appoint additional whole or part‑day public holidays, statewide or locally (s 5); and to substitute, add or appoint bank holidays and bank half holidays as well as authorise ADIs to open in specified areas (s 7(2)-(5)). Proclamation is the mechanism for temporary or local variation of the statutory calendar.
• Transitional references. The Act repeals the Holidays Act 1910 and supplies an interpretive transitional rule that a pre‑commencement reference to a public holiday under the repealed Act will be taken to include a Sunday unless a contrary intention appears (Schedule 1, Pt 24, cl 26). That transitional clause may alter the meaning of pre‑existing Acts and instruments that relied on the old Act’s scheme.

Each concept is operationalised by the specific sections cited. The Act does not include express penalty provisions for non‑compliance, nor does it set wages, trading hours or industrial entitlements; those matters are left to other statutes and instruments where they remain operative and have been amended as recorded in the legislative history.

The Act directly and indirectly affects the following legal and economic actors, as shown in the text.

• The general public. Every natural and legal person in the State will be affected by the calendar of public holidays, substitution rules and the payments rule (s 3, s 8). The payment and compellability rule in s 8(1)-(2) applies to any person who might be required to make a payment or perform an act.
• Public Service offices and public servants. Section 6 requires closure of all offices of the Public Service on public holidays. The duty to close is statutory; the Act also identifies two exceptions: offices specially required by law to remain open (s 6(a)), and a power for the responsible Minister to require services in an emergency (s 6(b)). Those two clauses directly affect which public offices and employees must work on public holidays and the circumstances in which ministerial direction can override the closure rule.
• ADIs. The Act mandates that all ADIs must be closed on bank holidays and during bank half holidays (s 7(4)). As the Act uses the acronym ADIs without defining it in the text provided, institutions referenced by that acronym will need to determine whether they fall within its scope by reference to related legislation or definitions in other instruments. The Governor may authorise opening in specified areas on a bank holiday or bank half holiday (s 7(5)), which affects ADIs operating in those areas.
• Banks and financial market participants. By designating Sundays and public holidays as bank holidays (s 7(1)) and creating bank half holidays (s 7(2)(c)), the Act imposes operational constraints on banks and potentially on services that depend on bank clearing and settlement cycles. The s 8 postponement rule will also affect payment timing.
• Businesses and employers generally. Businesses that operate on particular days will need to align operations to the statutory list of public holidays and any Governor proclamations substituting or adding days (s 3(5), s 5). Where businesses have contractual payment or performance obligations, s 8 may postpone those obligations to the next operable day unless another law requires performance on the particular day. Where businesses provide services that are legally required to be available on a public holiday, the statutory exceptions in s 6(a) may be relevant for public contractors or outsourced providers.
• Localised communities and industries. The Governor may proclaim additional public or part‑day public holidays or bank holidays that apply only within a specified district or locality (s 5(2), s 7(3)(b)), so geographically concentrated economic actors may be affected differently from the State at large.
• Legal drafters, statutory administrators and courts. The transitional provision in Schedule 1, Pt 24, cl 26, changes the interpretation of pre‑commencement Acts and instruments referencing a public holiday under the Holidays Act 1910 by treating such references as including Sunday unless a contrary intention appears. This will affect statutory interpretation and the operation of instruments made before the commencement of the 2023 Act.

The Act lists a number of statutes it amended and the Acts it repealed in its legislative history. Those amendments mean that operators subject to those statutes should check the amended provisions to determine how the new public holiday framework interacts with their existing statutory obligations. The Act itself does not enumerate industrial award or award‑style wage entitlements; those remain in other instruments and the industrial framework.

The Act creates a limited set of statutory duties and confers certain legal effects described below, with references to the precise provisions.

Duties

• Public offices closed. All offices of the Public Service are to be closed on public holidays (s 6). This is a statutory duty on relevant administrative units. The statute contemplates exceptions for offices that are by other law specially required to be kept open and for ministerial direction in case of emergency (s 6(a)-(b)). The responsible Minister may require services of officers in emergency circumstances, which imposes a potential duty on officers when that direction is lawfully made (s 6(b)).
• ADIs to close. All ADIs must be closed on bank holidays and during bank half holidays (s 7(4)). That is an express statutory duty, subject to a Governor authorisation permitting opening within a specified area on a bank holiday or bank half holiday (s 7(5)). The Act does not define sanctions for non‑closure in the text provided.
• Observe part‑day public holidays. The parts of 24 December and 31 December from 7 pm to midnight are public holidays (s 4). There is an implied operational duty to treat those parts of the day as public holidays for applicable legal purposes, except that s 8(3) expressly excludes part‑day public holidays from the payment postponement rule.

Rights and legal effects

• Non‑compellability of payment and acts. Section 8(1) gives a legal protection: no person is compellable to make a payment or do an act on a public holiday, bank holiday or Saturday that the person would not have been compellable to make or do on a Sunday before the commencement of the Act. This operates as a defensive right against compulsion to perform on those days.
• Postponement rule. Where, but for s 8, a person would be obliged to make a payment or do an act on a public holiday, bank holiday or Saturday, then s 8(2) postpones the obligation to the next calendar day that is not a public holiday, bank holiday or Saturday. Performance on that next non‑holiday day is treated as due, except where another law requires performance on the day. This determinative rule converts the timing of obligations rather than extinguishing them.
• Exclusion of part‑day public holidays from payments rule. Section 8(3) provides that a reference to a public holiday for s 8 does not include part‑day public holidays. Therefore s 8’s protection does not automatically apply where the relevant holiday is a part‑day public holiday such as the 7 pm to midnight periods on 24 and 31 December (s 4).
• Bank half holiday treatment. Conversely, if a bank half holiday is proclaimed under s 7(2)(c), s 8(4) treats the day as if the whole day had been proclaimed a bank holiday for the purposes of the payments rule, thereby subjecting the whole day to the postponement/compellability regime in s 8.

Discretionary administrative powers

• Governor proclamation powers. The Governor may, by proclamation, substitute other days for scheduled public holidays (s 3(5)), appoint whole or part‑day additional public holidays (s 5), and substitute, appoint or create bank half holidays and authorise opening of ADIs on bank holidays (s 7(2)-(5)). These statutory discretions permit executive variation of the calendar and create compliance obligations for officials and private actors responding to proclamations.
• Ministerial emergency direction. The responsible Minister has power to require services of officers of an administrative unit during a public holiday in case of an emergency (s 6(b)). That power imposes an operational duty on public service officers where lawfully exercised.

Notably absent

• The Act contains no express wage, penalty rate, or trading hours provisions. It does not set criminal penalties or civil sanctions for contravention in the text provided. It does not define key terms such as "ADIs" or "Public Service" within the Act text included here. Those matters will require cross‑reference to other laws and instruments.

Each duty and right must therefore be considered in context with existing industrial awards, contracts, banking regulations and other statutes that will govern pay, sanctions and definitions not supplied by the Act.

The Act, as presented in the text provided, creates few explicit enforcement or penalty mechanisms. The statutory architecture relies mainly on proclamation, statutory direction and consequential legal effects rather than on civil or criminal sanctions within the Act itself.

Absence of express penalties

• The Act does not specify criminal offences, monetary penalties, administrative fines or enforcement processes for non‑compliance with the closure rules, the requirement for ADIs to close, the proclamation powers, or any other statutory duty set out in the Act. The text contains no enforcement schedule or penalty clauses. Consequently, any enforcement or sanctioning of non‑compliance would need to derive from other legislation or from general administrative law remedies. That absence affects where and how unlawful non‑compliance would be remedied.

Proclamations and administrative observance

• The primary implementation tools are proclamations by the Governor to substitute or appoint public holidays, part‑day public holidays or bank holidays and to authorise ADIs to open in specified areas (ss 3(5), 5, 7(2)-(5)). Proclamations are executive acts that create legal variation under the Act; their authoritative effect will be realised through official publication mechanisms customary for proclamations. The Act does not specify the publication procedure in this text, nor does it outline mechanisms for review of proclamations beyond ordinary administrative law remedies.

Operational constraints with limited express remedies

• The Act imposes operational constraints such as the closure of public service offices (s 6) and closure of ADIs on bank holidays (s 7(4)). But the absence of statutory penalties in the Act means enforcement likely depends on sectoral regulatory regimes (for example, banking regulation for ADIs), contractual remedies, or public sector employment frameworks for public service closures. Those other regimes are not set out in this Act text and must be consulted separately.

Payment and timing rights with practical enforcement

• Section 8 establishes a legal timing rule for payments and other acts. The right not to be compellable to perform on specified days (s 8(1)) and the postponement rule (s 8(2)) are judicially enforceable legal rights in the sense that courts or tribunals could give effect to the timing rule in disputes about performance timing. The Act does not prescribe a specific enforcement body for disputes arising under s 8, so ordinary civil litigation or tribunal processes will be the route for enforcement.

Interpretive and transitional enforcement matters

• The transitional provision in Schedule 1, Pt 24, cl 26 alters how pre‑commencement references to public holidays under the Holidays Act 1910 are to be read; where such instruments are relied upon, interpretation disputes could arise and be determined by courts or tribunals. Again, the Act provides the interpretive rule but no specific remedial regime.

Practical consequence

• In practice, enforcement of the Act’s requirements will be implemented through governmental administration and sectoral regulation external to the Act. The Act creates duties and timing rights, but their enforcement is likely to be achieved through existing legal frameworks rather than by new, Act‑specific enforcement mechanisms.

The Act intentionally interacts with a network of pre‑existing statutes and instruments. The text sets out some of those interactions explicitly and signals others by omission.

Repeal and transitional interaction

• Repeal of prior Act. The Public Holidays Act 2023 repealed the Holidays Act 1910 (legislative history). That repeal means any references, definitions or operational rules provided by the old Act no longer apply, except where preserved or translated by this Act or transitional provisions.
• Transitional reinterpretation. Schedule 1, Part 24, clause 26 provides that a pre‑commencement Act or instrument that referred to a public holiday within the meaning of the Holidays Act 1910 will be taken to include a Sunday unless a contrary intention appears. This is an interpretive bridge from the old Act to the new regime for pre‑existing legislation and instruments. It can change the operative meaning of clauses in older statutes and instruments that relied on the Holidays Act 1910’s terminology. Legal drafters and statutory interpreters will need to apply cl 26 when construing pre‑2024 enactments and instruments.

Amendments to other Acts

• The Act’s legislative history records amendments to a long list of Acts, including the Shop Trading Hours Act 1977, the Fair Trading Act 1987, the Legislation Interpretation Act 2021 and others. The text does not reproduce the substantive amendments, but the record signals that the public holiday regime has been grafted into multiple sectoral statutes. Practitioners will need to consult the amending instrument(s) to understand specific changes to each named Act.

Banking and financial law interaction

• ADI closures. The requirement that ADIs be closed on bank holidays and bank half holidays (s 7(4)) interacts with any separate regulatory regime that defines ADIs and regulates opening hours, clearing arrangements and payments systems. The Act does not define ADIs; it uses the acronym and imposes a statutory closure obligation. To know how this interacts with banks’ regulatory duties, one must consult the legislation that defines ADIs and any prudential rules or payment system rules applicable to them. The Act does, however, provide for Governor authorisation to permit openings in specified areas (s 7(5)), which creates an interaction point for executive orders and sector regulation.

Employment, industrial and contractual interaction

• Public service closure. Section 6 imposes a closure duty for offices of the Public Service and permits ministerial directions in emergencies. The effect of those rules on pay, overtime entitlements and industrial awards is not contained in this Act. Industrial instruments, awards and contracts of employment will continue to govern pay and entitlements for work on public holidays. Where those instruments refer to the old Holidays Act 1910, Schedule 1, Pt 24, cl 26 may alter interpretation.
• Payments and performance. Section 8 operates in the sphere of private contracts and statutory obligations by postponing performance where the obligation would otherwise fall on a public holiday, bank holiday or Saturday. That rule will interact with contract terms, statutory deadlines, court filing rules, and payment systems. Parties should review contractual drafting and statutory timetables to ensure alignment with s 8’s timing rules.

Local government and local instruments

• Local proclamations. The Governor may make proclamations limited to a district or locality (ss 5(2), 7(3)(b)). That creates potential legal divergence within the State and interacts with local government responsibilities and local instruments that reference public holidays.

Interpretation Act and definition interaction

• The Act amends the Legislation Interpretation Act 2021, according to the legislative history. The Legislation Interpretation Act is the principal vehicle for statutory interpretation and definitions; any amendments there will affect how undefined terms in the Public Holidays Act are read, and will also affect other Acts that now reference the new public holiday definitions or transitional rules.

In short, the Public Holidays Act 2023 provides the core calendar and operational rules, but many operational consequences, sanctions and definitions depend on cross‑references into other legislative and regulatory regimes. Practitioners must consult the listed amended statutes and relevant sectoral laws for the full legal effect.

The Act’s text contains its own legislative history and recorded amendments. This section summarises the provenance and the subsequent recorded variation.

Principal Act

• Public Holidays Act 2023, No 39 of 2023. Assent date recorded as 7 December 2023 (legislative history). The Act repealed the Holidays Act 1910 (legislative history). The entry records that s 2 of the Act commenced on 1 January 2024. The table in the legislative history identifies the principal Act (2023 No 39).

Subsequent amendment

• Statutes Amendment (Industrial Relations Portfolio) Act 2024, No 2 of 2024. Assent date 29 February 2024. The legislative history records that Part 3 (ss 6 & 7) of that amending Act commenced on 28 March 2024 (Gazette 28.3.2024 p 510). The 2024 instrument amended s 3 and s 4 of the Public Holidays Act 2023 among other entries. The legislative history provides a mapping of which subsections of s 3 were amended by the 2024 Act: s 3(1) was amended by 2/2024 s 6(1)-(9), s 3(2) was amended by 2/2024 s 6(10), s 3(3) was amended by 2/2024 s 6(11), and s 3(4) was amended by 2/2024 s 6(12). Section 4 was amended by 2/2024 s 7(1), (2). The legislative history also notes the Legislation Revision and Publication Act 2002 was used to amend the long title and omit s 2 of the principal Act, with a recorded commencement of 28 March 2024 for those editorial changes.

Omitted provisions

• The legislative history notes that Parts 1-23 of Schedule 1 were omitted under the Legislation Revision and Publication Act 2002 on 28 March 2024. The only surviving transitional provision in the schedule as presented is Part 24, cl 26 (references to public holidays) which remains operative.

Acts amended by the principal Act

• The legislative history lists a set of Acts that the Public Holidays Act 2023 amended. The list includes, but is not limited to: Adelaide Cemeteries Authority Act 2001; Bail Act 1985; Bills of Sale Act 1886; Botanic Gardens and State Herbarium Act 1978; Building Work Contractors Act 1995; Children and Young People (Safety) Act 2017; Classification (Publications, Films and Computer Games) Act 1995; Fair Trading Act 1987; Fire and Emergency Services Act 2005; Land and Business (Sale and Conveyancing) Act 1994; Legislation Interpretation Act 2021; Magistrates Act 1983; Marine Parks Act 2007; Mental Health Act 2009; Mining Act 1971; Parliament (Joint Services) Act 1985; Public Trustee Act 1995; Residential Parks Act 2007; Retail and Commercial Leases Act 1995; Second‑hand Vehicle Dealers Act 1995; Shop Trading Hours Act 1977; Stock Mortgages and Wool Liens Act 1924. The legislative history records that the principal Act and its amendments are indexed in the legislative record, and the practitioner should consult the current consolidated statutes and the Gazette entries for authoritative commencement details.

Operational dates

• The principal Act’s internal commencement entries are sparse in the text supplied, but the legislative history records commencement events: the principal Act’s s 2 commenced 1 January 2024; various amending provisions in the Statutes Amendment (Industrial Relations Portfolio) Act 2024 commenced 28 March 2024.

Practical note

• The legislative history indicates that the Act was subject to both substantive amendments by the 2024 Statutes Amendment and technical editorial variation under the Legislation Revision and Publication Act 2002. Practitioners should consult the consolidated, current version of the Act on the official legislation site and review the Gazette notices for the dates and terms of any proclamations made under the Act.

The text provided contains no judicial decisions, reported cases or tribunal determinations that interpret the Public Holidays Act 2023. The Act’s legislative history does not list any litigation or cases that rely on the new statutory provisions.

Implication

• Because the Act is recent and no litigation is recorded in the provided text, there is no statutoryly provided body of case law to guide interpretation of the new provisions in this source. That means practitioners must rely on the statutory words themselves and on established principles of statutory interpretation, including how transitional clause 26 applies to pre‑existing Acts and instruments. Where disputes arise about the scope of terms used but not defined in the Act (for example ADIs, the Public Service, public offices), courts and tribunals will need to resolve those issues, potentially by reference to other legislation that defines those terms. Until such decisions emerge, uncertainty on contested points will persist.

Watch points for future litigation

• Interpretation of proclamation powers. The Governor’s power to substitute or appoint whole or part‑day holidays and to authorise opening of ADIs (ss 3(5), 5, 7(2)-(5)) is likely to feature in litigation challenging scope, limits or publication of proclamations.
• Interaction with pre‑existing instruments. Clause 26 of Schedule 1 is an interpretive bridge for pre‑commencement instruments; disputes about whether a reference to a "public holiday" under the old Act includes or excludes Sunday in a given instrument may reach courts.
• Effect of part‑day public holidays. Whether s 8’s non‑compellability applies in particular circumstances where part‑day public holidays intersect with payment systems or contractual performance may generate contentious cases, especially given s 8(3)’s exclusion.
• ADI obligations. The mandated closure of ADIs and the Governor’s power to authorise openings may generate litigation if sectoral regulators, customers or third parties dispute the legal effect of closures or openings.

At present, the Act does not supply case law; therefore practitioners should monitor reported decisions and administrative rulings after operation of the Act for authoritative interpretation.

The statute includes several features that create interpretive or operational pitfalls for practitioners, public authorities and private parties. The following list highlights precise mechanisms that commonly generate problems in practice, with section references.

• Undefined key terms in the Act text. The Act uses "ADIs" and "Public Service" and "offices of the Public Service" without defining those terms within the text supplied. That creates immediate uncertainty about scope for the closure rules and the ADI closure duty (s 6, s 7(4)). Practitioners must cross‑reference other statutes or the legislation interpretation framework to pin down those terms.
• Part‑day public holidays are excluded from the payments protection. Section 4 creates part‑day public holidays (7 pm to midnight on 24 and 31 December). Section 8(3) explicitly states that a reference to a public holiday in s 8 does not include a part‑day public holiday. Consequently, the protective compellability and postponement rule in s 8 will not apply to obligations falling within those part‑day windows unless another law provides for it. Operationally, payments or acts due in the evening of 24 or 31 December may not be automatically postponed by s 8.
• Bank half holidays treated as full bank holidays for payments rule. A proclaimed bank half holiday under s 7(2)(c) is treated as if the whole day were a bank holiday for the purposes of s 8 (s 8(4)). That produces an asymmetry: a statutory bank half holiday will trigger s 8’s postponement for the full day even though the bank half holiday itself might be limited in scope. The asymmetric treatment between part‑day public holidays and bank half holidays can be a source of confusion.
• Broad Governor discretion. The Governor can substitute, add and localise public holidays and bank holidays by proclamation (s 3(5), s 5, s 7(2)-(3)). These are wide executive powers with immediate operational consequences. Businesses and citizens must actively monitor proclamations because the statutory calendar can change by proclamation without legislative amendment. The Act does not set detailed procedural limits or publication requirements for those proclamations within the text provided.
• No express penalties or enforcement machinery. The Act imposes duties such as closure obligations (s 6, s 7(4)) but does not include express sanction or enforcement mechanisms. That can leave gaps where sectoral regulators or contractual remedies must be used to enforce compliance. Lawyers should not assume the Act provides direct penal sanctions.
• Transitional reinterpretation of pre‑existing instruments. Schedule 1, Pt 24, cl 26 changes the meaning of pre‑commencement references to public holidays under the repealed Holidays Act 1910 by treating such references as including Sunday unless a contrary intention appears. That change can alter obligations or rights embedded in older legislation, leases, licences or contracts, and may produce unintended retroactive interpretive effects. The "unless the contrary intention appears" saving will be litigated or require careful drafting to avoid misapplication.
• Interaction with industrial and contractual regimes not specified. The Act does not set wage rates, award penalties or shop trading obligations; these are dealt with in other instruments. Parties who assume this Act affects pay or penalty rates will be mistaken. Practitioners must check industrial awards, employment contracts and sectoral statutory regimes to determine the financial consequences of required closures or holiday work.
• Emergency ministerial direction. Section 6(b) allows the responsible Minister to require services from officers during a public holiday in an emergency. That creates a statutory override to the closure duty for public offices and may result in ad hoc staffing and pay disputes if not managed through public sector employment frameworks.
• Publication and notice risks. The Act relies on proclamations for variation, but it does not set the publication procedure in the text supplied. Parties who do not monitor official proclamations risk operating on the wrong assumption about whether a particular day is a public or bank holiday in their locality.
• Localised proclamation effects. Governor proclamations can be limited to a district or locality (s 5(2), s 7(3)(b)). Businesses operating across multiple localities must manage differential holiday calendars, which adds compliance and scheduling complexity.

These "gotchas" derive directly from the statutory text and the structure it establishes. They point toward practical steps to mitigate risk, set out below.

Compliance with the Public Holidays Act 2023 entails monitoring the statutory list of public holidays, responding to proclamations, adjusting operational schedules and managing the timing of payments and contractual performance. Below are concrete steps and checks that follow from the Act’s text.

1. Maintain a statutory holidays calendar and monitor proclamations (ss 3(1), 3(5), 5, 7(2))

   • Start with the statutory list in s 3(1) for the baseline public holidays each year.
   • Implement a notification process for Governor proclamations under ss 3(5), 5 and 7(2) because those proclamations can substitute or add whole or part‑day public holidays and bank holidays, and can be localised. Treat any Gazette publication or official proclamation channel as authoritative.
   • Record and circulate changes to all operational teams and update rostering, banking cut‑offs and contractual calendars immediately upon proclamation.

2. Treat part‑day public holidays and bank half holidays appropriately (ss 4, 8(3)-(4))

   • Treat the period 7 pm to midnight on 24 December and 31 December as public holiday time for staffing, safety and service continuity considerations (s 4).
   • Do not assume s 8’s postponement applies to part‑day public holidays, because s 8(3) excludes part‑day public holidays from the payments rule. For obligations due in those part‑day windows, confirm whether other laws or contract terms require performance.
   • If a bank half holiday is proclaimed, remember that s 8(4) treats the day as a whole bank holiday for payment postponement purposes; adjust payment processing and clearing expectations accordingly.

3. For banks and ADIs, follow statutory closure/authorisation rules (s 7(4)-(5))

   • If your organisation falls within the ADI acronym used in s 7(4), implement automatic closure procedures for bank holidays and bank half holidays, unless you have a Governor authorisation permitting opening in a specified area (s 7(5)).
   • Seek the text of any relevant Governor authorisation before opening on a proclaimed bank holiday, and retain documentary evidence of the authorisation on file.

4. Public service employers should implement closure and emergency staffing protocols (s 6)

   • Plan for statutory closure of public service offices on public holidays (s 6). Ensure employment contracts, award interpretations and departmental policies address pay entitlements, rostering, overtime and emergency stand‑by in line with award or employment law.
   • Prepare procedures for the responsible Minister to require services during an emergency, including documentation, lawful delegation, and record keeping of directions given under s 6(b).

5. Implement payment and performance timing controls (s 8)

   • For contractual deadlines, statutory filings, payment obligations and notice periods, adjust internal calendars so that obligations that would fall on a public holiday, bank holiday or Saturday are treated as falling due on the next non‑holiday day (s 8(2)), unless another law requires performance on the holiday.
   • Identify any obligations that by other law are required to be performed on the day despite s 8(2), and create exception handling for those items. Keep audit trails of communications where performance is postponed under s 8.

6. Audit pre‑commencement instruments and statutory references (Schedule 1, Pt 24, cl 26)

   • Review pre‑2024 contracts, licences, leases and statutory instruments that refer to "public holiday" under the Holidays Act 1910. Under cl 26, such references will be read as including a Sunday unless a contrary intention appears. Where that reinterpretation affects rights or obligations, amend or clarify instruments, or issue guidance to affected parties.
   • Where commercial parties or regulators rely on pre‑existing definitions or practices, document any change in practice and flag potential disputes early.

7. Cross‑reference other statutes for definitions and entitlements

   • Because the Act does not define "ADIs" or "Public Service" in the supplied text, consult the Legislation Interpretation Act 2021 and the sectoral statutes (such as banking and public sector Acts) that define these terms and provide pay or regulatory consequences. The legislative history records that the Legislation Interpretation Act 2021 was amended; therefore practitioners should consult the current consolidated text for up‑to‑date definitions.
   • Check any sectoral Acts listed in the legislative history for substantive amendments that might affect trading hours, licensing, or penalty rates.

8. Update contracts and client advice

   • For clients with time‑sensitive obligations, advise them to include express contract clauses dealing with public holidays, part‑day holidays and bank half holidays so that contractual performance timing is clear.
   • For businesses with cross‑jurisdiction operations, include clauses addressing competing holiday calendars and the effect of localised proclamations.

9. Document and retain proclamations and ministerial directions

   • Keep an auditable record of any Governor proclamations, Gazette notices and ministerial directions relied upon to open, close, postpone or require services. That documentation will be crucial if disputes arise about whether a particular day was a public or bank holiday in a locality.

10. Monitor litigation and administrative guidance

    • Because the Act is recent and case law is not yet available, monitor court and tribunal decisions for interpretation of contested points such as the scope of the Governor’s proclamation powers, the meaning of ADIs within the Act, and the application of clause 26 to pre‑existing instruments.

Following these steps will not, by itself, resolve every interpretive question in the Act. However, they implement the statutory mechanics in the text, reduce operational risk, and position organisations to respond quickly to proclamations and to enforceable timing rules under s 8.
