Public Holidays Act 1981

The Act operates around two core categories of public holiday: the fixed holiday (Schedule 2) and the appointed holiday (ss 6, 7, 8). A fixed holiday occurs automatically each year on the dates or days specified in Schedule 2, subject to the substitution rules for weekends. An appointed holiday is a day or part of a day created by ministerial notice either as an additional holiday or as a replacement for a fixed holiday. Section 8 provides that both types must be observed “in accordance with the terms of the notice”. The notice may limit the holiday to a geographic part of the Territory or to a defined section of the community (s 6(b)). This concept of a partial or targeted public holiday is unusual: a public holiday is typically universal, but the Act explicitly permits the Minister to treat, for example, only government employees or only certain industries as observing the holiday. The practical effect is that whether a given person gets the day off (or receives penalty rates) depends on whether the notice applies to them.

A further key concept is the partial‑day holiday. Schedule 2 defines Christmas Eve and New Year’s Eve as public holidays only from 7.00 pm to midnight. The Act uses the phrase “part of a day” throughout (ss 5 (via Schedule), 6, 7, 8, 10). This means a holiday can be less than a full 24‑hour period, which creates ambiguity for employment awards that typically refer to a “public holiday” without specifying partial coverage. A part‑day holiday may trigger only fractional penalty rates or entitlements, depending on the governing industrial instrument.

The Act also introduces the notion of a “substituted holiday”. If a fixed holiday falls on a weekend, the schedule designates a specific weekday as the substitute (e.g., the following Monday). Additionally, under section 7, the Minister can replace any public holiday (including a substitute day) with an entirely different day in the same year. This power is not limited to weekends or emergencies; it can be used for any reason the Minister considers appropriate, and the only procedural safeguard is the 28‑day notice period (or the national‑agreement shortcut under s 10). There is no requirement to consult employers, employees, or the public before altering a holiday.

The concept of “public holiday” itself is not defined in the Act. The Act merely lists the days that are to be observed. The absence of a definition means that the legal meaning of “public holiday” in other statutes is supplied by the list and notices under this Act. For example, the Fair Work Act 2009 (Cth) section 115 says that a day is a public holiday if it is “a public holiday for the State or Territory” where the employee works. The Public Holidays Act is the sole source of that determination for the Northern Territory. Similarly, the Public Sector Employment and Management Act 1993 (NT) and various local government trading hours ordinances incorporate the Act by reference.

Finally, the Act preserves a ministerial power to declare that a day that “would, otherwise than by virtue of this Act, be observed as a public holiday” shall not be observed in that year (s 7(a)). This catches holidays that might arise from a royal proclamation, a common law tradition, or some other non‑statutory source. The Minister can extinguish that observance and substitute another day. This is a broad power that effectively overrides any non‑statutory holiday practice, reinforcing the Act’s role as the exclusive code for public holidays in the Territory.

The Act applies to all persons and organisations within the Northern Territory, but its effect is mediated by whether a given holiday notice applies to them. Under the fixed schedule, every person in the Territory is expected to observe the listed days as public holidays. In practice, however, the real impact falls on employers, employees, retailers, and anyone whose legal obligations (pay, hours, trading) are tied to the public holiday status of a day. The Act does not compel anyone to close their business or refrain from work; those consequences are imposed by other legislation such as the Fair Work Act (for employees covered by the National Employment Standards), the Public Sector Employment and Management Act (for NT public servants), or local council trading hours by‑laws.

The Minister’s power under section 6 to appoint a holiday for only a “section or sections of the community” creates a targeted effect. For example, the Minister could declare that only teachers, or only mining workers, or only Darwin residents must observe a particular holiday. This gives rise to a tiered system: a person may have a public holiday entitlement while their neighbour does not, simply by virtue of their industry or location. This is economically significant because it inserts state‑imposed asymmetry into the labour market and can distort competition between businesses that are treated differently. A retailer in Alice Springs might be required to pay penalty rates on an appointed holiday while a retailer in Katherine (if the notice exempts Katherine) operates under normal rates.

Businesses that rely on consistent operating calendars face uncertainty from the Minister’s power to alter holidays with only 28 days’ notice, and even less under section 10 if a national agreement is reached. Late‑notice holidays disrupt rosters, supply chains, and customer expectations. For small and medium enterprises with thin margins, a last‑minute public holiday can mean unexpected penalty payments or lost revenue if the business decides to close. The Act provides no compensation or adjustment mechanism for such disruption.

Public sector employees are directly affected because the Public Sector Employment and Management Act and related enterprise agreements often define public holidays by reference to this Act. Any alteration to the holiday list (including addition or substitution) automatically changes their entitlements. For private sector employees under the Fair Work Act, the national system applies: the modern award or enterprise agreement will specify pay rates for public holidays, and those rates are triggered on the days listed here. Employers must track not only the fixed schedule but also any ministerial notices published in the Gazette.

Self‑employed persons, sole traders, and independent contractors are also affected because client expectations often follow the public holiday calendar. A contractor who works on a public holiday may be able to charge a premium, but the Act itself does not create that right; it is a matter of private contract. The Act therefore primarily affects individuals and businesses through the second‑order legal frameworks that cross‑reference it.

The Public Holidays Act 1981 imposes remarkably few duties and creates no obvious private rights of action. The primary duty is on the Minister to publish notices in the Gazette (ss 6, 7, 9, 10). There is no duty on employers or individuals to “observe” a public holiday in the sense of refraining from work; the Act simply declares the day to be a public holiday, and other laws attach duties (e.g., to pay penalty rates, to close shops, to allow employees to absent themselves). The Act itself does not state that a person must not work on a public holiday. Former sections 16, 16A, and 17 were the only provisions that imposed enforceable obligations (such as opening a shop on a public holiday being an offence), and those sections were repealed in 2023. As at 1 June 2023, the Act contains no prohibition or positive command directed at private persons.

The Minister’s duties are procedural: to publish a notice under sections 6 or 7 at least 28 days before the appointed day (s 9), unless the shortened notice procedure of section 10 applies. The Minister also has a duty under section 10(b) to act “as soon as practicable” after receiving written advice from the Chief Minister in a national‑agreement scenario. These duties are likely enforceable by way of judicial review if a notice is published without compliance, but the Act does not specify consequences for a defective notice. For example, if the Minister publishes a notice only 20 days before a new holiday, but section 10 does not apply, the notice would appear to be invalid, and the holiday would not be legally established.

There are no private rights to a public holiday. An individual cannot sue the Minister for failing to appoint a holiday, nor can an employer sue the government for economic loss caused by a last‑minute alteration. The Act does not create any cause of action.

The only “right” that might be inferred is the right of members of the public to rely on the list in Schedule 2 as the baseline for planning purposes. However, that reliance is fragile because the Minister can alter or cancel any holiday under section 7. Moreover, the Schedule 2 list is subject to amendment by regulation or further amendment Acts, as it has been amended several times (most recently in 2023 to add the rule for Boxing Day when it falls on a Monday). A prudent planner cannot treat the Schedule as immutable.

An entity that is covered by a notice under section 6 (applying to a section of the community) might argue that it has a right to be treated according to the terms of the notice, but again, the Act does not specify enforcement mechanisms. Any dispute would likely arise under employment or industrial law, not this Act.

In summary, the Act functions as a statutory list and a delegation of power; duties and rights are parasitic on other legislation. The repeal of the penalty regime has made the Act even more of a “pure” declaratory instrument, reducing the state’s direct involvement in enforcement and leaving compliance to be determined by voluntary adherence to cross‑referenced laws.

As of the 2023 amendment, the Public Holidays Act 1981 contains no penalty provisions. All former offence‑creating sections (ss 16, 16A, and 17) were repealed. Previously, section 16 made it an offence for a person to open a shop on a public holiday (unless an exception applied), with a maximum penalty of 2 penalty units (later increased and then subject to indexing). Section 16A related to directors’ liability for corporate offences, and section 17 covered general penalties. Their removal means the Act now lacks any direct enforcement mechanism.

Enforcement of public holiday observance now relies entirely on other statutes. For example, the Fair Work Act 2009 (Cth) section 116 requires an employer to pay an employee at the applicable rate for public holidays (usually penalty rates set by awards or agreements). That section is enforced by the Fair Work Ombudsman through the federal compliance regime. Similarly, the Public Sector Employment and Management Act 1993 (NT) and relevant industrial instruments may create obligations for NT government employees. Local government trading hours regulations (such as the Darwin City Council By‑Laws) might also restrict commercial activity on certain public holidays, with their own penalties.

The absence of penalties in this Act reduces the cost of non‑compliance for businesses that choose to operate on a public holiday without paying the required rates under other laws. However, that is a function of the cross‑referencing regime, not a gap in this Act. The regime shift suggests that the Northern Territory government sought to streamline legislation by removing duplicative penalty provisions, perhaps on the assumption that the Fair Work Act and other laws already provide sufficient deterrence. For a business, the practical risk is not a fine under this Act but legal action under industrial law for underpayment or under an award.

The Act does not designate an enforcement body. No inspector, regulator, or court is given jurisdiction specifically under this Act. The only administrative actor is the Minister, whose role is limited to issuing notices. The Administrator is mentioned only in section 11 (regulations) and section 2 (commencement). The Act is therefore a relatively weak instrument from a command‑and‑control perspective. It sets the legal status of certain days, but leaves the coercion to other branches of law.

The repeal of the penalty regime may also affect the ability of local councils to enforce trading hour restrictions that reference “public holiday” as defined by this Act. If a by‑law says “no shop may open on a public holiday”, but the by‑law carries its own penalty, that penalty stands regardless of the repeal. The removal of the Act’s own penalties does not remove those by‑law penalties. However, if the by‑law simply adopts the definition from this Act, the operational effect is unchanged.

In summary, the Act imposes no monetary penalties or imprisonment for contravention. The enforcement landscape has shifted to employment and trade law, with this Act serving as a definitional source. This is a notable deregulatory move: the state no longer directly punishes breaches of the holiday observance; it instead relies on other mechanisms and on private litigation.

The Public Holidays Act 1981 is a quintessential delegating and defining statute. It sits at the apex of a network of laws that attach legal consequences to the identification of a day as a public holiday. The most significant interaction is with the Fair Work Act 2009 (Cth), which applies to most employees in the Northern Territory (the national system). Section 115 of the Fair Work Act provides that the National Employment Standards entitle an employee to a paid public holiday “for the State or Territory” in which the employee works. The identification of which days are public holidays for the Northern Territory is supplied by this Act. Therefore, any alteration to Schedule 2 or any ministerial notice under sections 6 or 7 automatically changes the public holiday entitlements of national system employees. Employers must monitor the Gazette for such notices.

For the Northern Territory public sector, the Public Sector Employment and Management Act 1993 (NT) and associated enterprise agreements define public holidays by reference to this Act. Similarly, the Public Holiday and Substitute Holidays Direction (an administrative instrument) might also rely on the Act. The effect is that the Minister’s power to add, substitute, or cancel holidays directly impacts the entitlements of thousands of government employees.

The Act also interacts with industrial instruments such as awards, enterprise agreements, and employment contracts. Many modern awards contain clauses like “the employee is entitled to be absent from work on a public holiday” or “the employer may direct an employee to work on a public holiday and must pay penalty rates”. These clauses are triggered by the public holiday days declared under this Act. When the Minister cancels a holiday under section 7 and substitutes another, the substituted day becomes a public holiday for award purposes, and the cancelled day loses that status.

Local government trading hours ordinances (for example, the Darwin City Council By‑Laws 2014 in relation to trading on Sundays and public holidays) often restrict shop opening hours on “public holidays”. Those by‑laws do not create their own list but rely on this Act to determine which days are public holidays. If the Minister creates an extra holiday under section 6, retail by‑laws that restrict opening on public holidays will automatically apply to that day, unless the notice specifically excludes the retail sector (which is possible under s 6(b)). This can cause confusion: a business might expect to trade on an ordinary Monday, but if the Minister appoints that Monday as a public holiday, local by‑laws may force closure.

The Act also interacts with workers’ compensation and occupational health and safety laws, though indirectly. For example, an injury occurring during travel on a public holiday might be treated differently for compensation purposes. Additionally, the Employment Agents Act 1980 (NT) or the Long Service Leave Act (NT) might reference public holidays for calculating service or leave accruals.

The Sentencing Act 1995 (NT) was previously referenced in section 16 (now repealed) for penalty calculation, but that link is gone.

The Interpretation Act 1978 (NT) is noted in section 11 for regulation‑making power, and it also contains general provisions about publication in the Gazette. The Statute Law Revision Act amendments over the years have cleaned up cross‑references.

One important interaction is with the Commonwealth Places (Mirror Taxes) Act - but that is tangential. Essentially, any law that distinguishes between a public holiday and an ordinary day will look to this Act as the source of truth for the Northern Territory. This makes the Act a high‑leverage instrument: a small change in the Schedule can have broad ripple effects across employment, retail, and administrative law.

The Act has been amended 16 times since its commencement in 1981. The most significant recent amendments are the Public Holidays Amendment Act 2023 (Act No. 15 of 2023), assented 31 May 2023 and commenced 1 June 2023. That amendment repealed sections 4, 16, 16A, and 17, substituted sections 10 and 11, and amended section 9 and Schedule 2. The repeal of the penalty provisions removed the entire enforcement regime from the Act, effectively turning it into a purely declaratory statute. The substitution of section 10 streamlined the shortened notice procedure for nationally agreed holidays, and the substitution of section 11 clarified the regulation‑making power (which is now subject to section 65 of the Interpretation Act 1978). Section 9 was amended to change the notice period for appointed holidays from “not less than 14 days” to “not less than 28 days”. This increased the minimum notice for most holidays, but the new section 10 retained the ability to give short notice (less than 28 days) when national leaders agree. The Schedule 2 amendment added the rule that if Boxing Day falls on a Monday, the public holiday moves to Tuesday, and also amended the substitute rule for 26 January and other days to use “following Monday” rather than “next Monday” for clarity. Section 4, which earlier dealt with interpretation (including defining “the Territory”), was repealed, possibly because those definitions are now in the Interpretation Act.

The Public Holidays Amendment Act 2022 (Act No. 23 of 2022) inserted section 5A to create the one‑off public holiday on 22 September 2022 for the National Day of Mourning for Queen Elizabeth II. This amendment commenced retrospectively on 19 September 2022, two days before the holiday itself, which demonstrates the ability to backdate legislation to create a holiday on short notice.

The Public Holidays Amendment Act 2016 (Act No. 33 of 2016) made several technical amendments: it amended ss 4, 5, 6, 7, 8, and 10, and amended Schedule 2. It changed the wording of the substitution rules (particularly for Anzac Day and Christmas) and introduced the first version of the shortened notice procedure in section 10 (allowing less than 28 days notice for nationally agreed holidays). It replaced the phrase “or, if that day falls on a Saturday or Sunday, the next Monday” with “or, if that day falls on a Saturday or a Sunday, the following Monday” for consistency.

Earlier amendments include the Criminal Law (Regulatory Offences) Act 1983 (Act No. 68 of 1983) which inserted section 16A (directors’ liability) and probably adjusted penalty provisions. The Statute Law Revision Act series (1989, 2001, 2004, 2018) made formal amendments: removing obsolete provisions, updating references, and correcting formatting.

The Penalties Amendment (Miscellaneous) Act 2013 (Act No. 23 of 2013) amended section 16 to increase the penalty unit amount (distinct from this Act’s specific penalty). The Statute Law Amendment (Directors’ Liability) Act 2015 (Act No. 26 of 2015) amended section 16A to align directors’ liability provisions with contemporary policy.

The Public Holidays Amendment Act 1982 and 1983 made minor changes, mostly to the schedule and penalty amounts.

Overall, the trend is toward centralising holiday determination in the Minister, reducing the Act’s own penal machinery, and increasing notice requirements for most holiday changes while retaining a fast‑track for national emergencies.

The source text does not record any litigation history. The endnotes list only amendment acts, not court cases. Based on the text alone, there is no evidence of judicial interpretation of the Act. This is not surprising for a small, mostly administrative statute. The Act’s provisions are relatively straightforward: the fixed list in Schedule 2 uses clear language, and the ministerial powers are broad but subject to procedural requirements (publication in the Gazette, timing). Most disputes about public holiday entitlements do not challenge the validity of the holiday itself; they arise under employment law about pay rates or whether a particular day qualifies as a public holiday under an award. Those disputes typically involve interpreting the Fair Work Act and the relevant industrial instrument, not the Public Holidays Act. For example, a worker might argue that the Minister’s notice under section 6 was invalid because it was not published within the required timeframe, but such a challenge would likely be heard in the Northern Territory Supreme Court. No such case is reported in the source.

The absence of litigation may also reflect the limited private enforcement mechanisms in the Act. Since it creates no private rights, there is no standing for an individual to sue for a breach of the Act. Judicial review of ministerial decisions is possible under the Administrative Decisions (Judicial Review) Act (NT) or the inherent jurisdiction of the Supreme Court, but the source does not indicate any such reviews.

One could speculate that the 28‑day notice requirement (s 9) and the shortened notice exception (s 10) are designed to reduce the likelihood of successful legal challenges by providing a clear, objective standard. As long as the Minister complies with the publication and timing rules, the decision to appoint a holiday is likely non‑justiciable on its merits. The Act does not impose a duty to consult, so there is no failure of natural justice claim.

The repeal of the penalty provisions may also reduce the incentive to litigate, as there is no direct fine to contest.

In summary, the Act has generated no reported litigation, and its design suggests that the main legal battles occur downstream in industrial and employment law contexts.

One of the most easily overlooked traps is the partial‑day holiday. Schedule 2 declares Christmas Eve and New Year’s Eve as public holidays only from 7.00 pm to midnight. Many employment instruments assume a public holiday runs from midnight to midnight. An employer that pays a full day’s penalty rates for Christmas Eve might be overpaying; an employer that pays none might be underpaying. The correct treatment depends on the award or agreement’s definition of “public holiday”. Some awards expressly adopt the full day for part‑day holidays; others do not. The Act itself gives no guidance.

A second gotcha is the Minister’s power to appoint a holiday for only part of the Territory or only a section of the community (s 6). A business located in Darwin might assume a day is a public holiday Territory‑wide, but the notice might exclude Darwin. Conversely, a business in a remote area might be caught by a holiday that only applies to their region. Checking the exact terms of the Gazette notice is essential; relying on industry gossip or media reports can lead to incorrect rostering. The Act does not require the Minister to justify the distinction, so it could be arbitrary.

Third, the substitution power under section 7 can cancel any public holiday, even one that would otherwise be observed under a non‑statutory source (e.g., a special day proclaimed by the Governor‑General). If an employer has granted a day off based on a non‑Act proclamation, the Minister can override that by declaring it not a public holiday. This can cause confusion if the employer relied on the non‑statutory holiday without checking the Gazette.

Fourth, the shortened notice procedure in section 10 is triggered only if all State and Territory leaders agree. If even one jurisdiction dissents, the full 28‑day notice applies. A holiday that seems nationally agreed might not be if, for example, Western Australia declines. Employers should not assume that a media announcement of a national holiday implies the NT will have it; they must wait for the Gazette notice.

Fifth, the Act no longer has its own penalties, but that does not mean a business can ignore public holidays without consequence. Other laws, such as the Fair Work Act, still impose obligations. A business that treats a public holiday as a normal working day without paying penalty rates risks underpayment claims, which can be backdated and attract interest and penalties. The repeal of this Act’s penalty provisions creates a false sense of security.

Sixth, the Schedule 2 substitution rules for Boxing Day are more complex than for other days. If Boxing Day falls on a Saturday, the holiday moves to Monday; if it falls on a Sunday or Monday (as amended in 2023), the holiday moves to Tuesday. This means the Monday substitute for Christmas Day (if Christmas falls on Saturday/Sunday) and the Tuesday substitute for Boxing Day can create a sequence of holidays that is not obvious from a glance. Employers should cross‑reference the calendar each year.

Seventh, the Act uses the phrase “part or parts of the Territory” in section 6, but there is no definition of “part”. It could be a suburb, a postcode, a local government area, or any arbitrary division. The Minister’s description in the notice is the only guide. If the description is ambiguous, the notice may be void.

Eighth, the Act was amended in 2023 to require 28 days notice for most appointed holidays, up from 14 days. This reduces the risk of last‑minute surprises, but the exception in section 10 still allows for very short notice (potentially one or two days) if a national agreement is reached. The practical catch is that section 10 only applies if the agreement is reached less than 28 days before the day in question. If the agreement is reached 30 days before, the full 28‑day notice applies. The clock starts from the agreement date, not from the publication date. This could create a timing trap for the Minister.

Because the Act imposes no direct obligations on private persons, “compliance” means ensuring that an employer’s or business’s obligations under other laws are correctly applied to the public holidays declared under this Act. The first step is to maintain a current list of public holidays for each year, incorporating both the fixed Schedule 2 holidays and any appointed holidays published in the Northern Territory Government Gazette. The Gazette is available online, and subscriptions or alert services can be used. The Minister’s notices under sections 6 and 7 must be published at least 28 days before the holiday (or sooner under s 10). A prudent business should check the Gazette at regular intervals (at least monthly) and immediately upon any announcement of a national emercy agreement.

Second, cross‑reference every public holiday against the applicable industrial instrument. For employees covered by the Fair Work Act and a modern award, the award will specify the penalty rates and the obligation to reasonably request an employee to work on a public holiday. For award‑free employees, the National Employment Standards provide that an employer may request an employee to work on a public holiday if the request is reasonable. The “reasonableness” test includes the nature of the workplace, the employee’s personal circumstances, and the availability of alternative staff. The Public Holidays Act does not define reasonableness; that is a matter of Fair Work Act jurisprudence.

Third, for part‑day holidays (Christmas Eve and New Year’s Eve from 7 pm), determine whether the applicable award or agreement treats a part‑day as a full public holiday or only as a partial entitlement. Some awards expressly state that a part‑day public holiday is treated as a public holiday for the whole day; others do not. If the instrument is silent, legal advice may be needed. In practice, many employers treat Christmas Eve as a full day off or pay penalty rates after 7 pm only. The Act itself does not require either.

Fourth, if the business operates in a specific locality (e.g., Darwin only), note that the Minister can appoint a holiday for only part of the Territory. The notice will specify the geographic area. Businesses with multiple branches across the Territory must apply the correct treatment branch by branch. A central payroll system should be configured to recognise differing holiday calendars.

Fifth, monitor notices under section 7 that cancel a public holiday and substitute another. If the Minister cancels, say, the second Monday in June and replaces it with a different Monday, the business must adjust rosters and pay accordingly. The cancelled day becomes an ordinary working day, and the substituted day becomes a public holiday. Employees who had already been granted the original day off may have to be rescheduled.

Sixth, maintain a written record of the Gazettes relied upon, in case an employment dispute arises about whether a particular day was a public holiday. The Act does not require such records, but good practice is to retain copies of the relevant notices.

Seventh, if the business is a retailer, also check local government trading hours by‑laws. A notice under section 6 that creates a public holiday may automatically trigger restrictions on shop opening under those by‑laws. Conversely, the notice might specifically exempt the retail sector (by applying only to a “section of the community”). Do not assume that because the Act allows trading, the by‑laws allow it.

Finally, if an employee or customer challenges whether a day is a public holiday, the definitive source is the Act as amended and the Gazette notice. Media reports or government press releases are not legal proof. The business should request a copy of the Gazette notice or check the official legislation website. The Act itself does not provide a compliance certification or safe harbour; reliance on erroneous information is no defence under the Fair Work Act if the employer underpays.
