What it does
The Public Health (Tobacco and Other Products) (Consequential Amendments and Transitional Provisions) Rules 2024 (the Rules) is a legislative instrument that operates a series of temporary suspensions, permissions and deeming provisions during defined windows between the old tobacco regulatory regime and the new one. It does not impose any new primary obligations. Rather, it carves out relief from certain provisions of the old Tobacco Plain Packaging Act 2011 (the old TPP Act) and the new Public Health (Tobacco and Other Products) Act 2023 (the new Act) for a limited time, and only for specific categories of regulated tobacco items and specified packaging features.
Mechanically, the Rules serve three functions. First, section 5 permits the insertion of health promotion inserts into retail packaging of tobacco products during the “main transition period” (the precise dates of which are defined in Schedule 2 to the transitional Act, not in the Rules themselves). Without this section, such inserts would breach section 23 of the old TPP Act, which prescribed the exact form of retail packaging. The section also contains a deeming provision: during the main transition period, retail packaging that includes the new inserts is taken to continue to comply with the old TPP Act for the purpose of subitem 13(2) of Schedule 2 to the transitional Act, as long as the packaging otherwise meets the old Act’s requirements.
Second, section 5A addresses on-product health messages on cigarettes, effective during the main transition period. It overrides section 26 of the old TPP Act to allow cigarettes to display a prescribed on-product health message (as set out in section 114A of the Public Health (Tobacco and Other Products) Regulations 2024 (the new regulations)). It also provides a transitional compliance deeming for cigarettes that display such a message and otherwise comply with the old Act. Critically, subsection 5A(3) states that during the main transition period a filtered cigarette is taken to comply with subsections 86(2), (3) and (4) of the new Act even if it does not display an on-product health message, provided the cigarette otherwise meets the appearance and physical feature requirements of those subsections. Subsection (4) further provides that cigarettes manufactured during the main transition period without an on-product health message are disregarded when working out equal display of messages in the 2025 calendar year under section 114C of the new regulations.
