What it does
These Regulations declare specified public streets in Hobart to be "pedestrian malls" and "bus malls" for the purposes of the Public Health Act 1997. The operative instrument is regulation 4. Regulation 4(1) declares six named public-street areas to be pedestrian malls for the purposes of s 67B(1)(m) of the Act, and regulation 4(2) declares twelve mapped areas to be bus malls for the purposes of s 67B(1)(n) of the Act. Each declaration identifies an approximate area in square metres, a plan number in the Central Plan Register and the relevant Part of Schedule 1 where a reduced illustrative copy of that plan is set out.
Mechanically, the Regulations perform only a classificatory function: they link particular parcels of public land, identified by plan number and labelled areas on those plans, to the statutory categories used in the Public Health Act. The Regulations do not themselves set out prohibitions, compliance obligations, enforcement powers or sanctions. Instead, they state that the listed streets are to be treated as pedestrian malls under s 67B(1)(m) (regs 4(1)(a)-(f)) and as bus malls under s 67B(1)(n) (regs 4(2)(a)-(f)). The legal effect intended by that linkage is therefore dependent on the substantive content of the Public Health Act, which the Regulations reference through the defined term "Act" at reg 3.
The Regulations commenced on 12 February 2024 (reg 2) and were notified in the Gazette on 7 February 2024. They are administered in the Department of Health, a fact recorded at the end of the instrument. The scheduled plans are presented in Schedule 1 as Parts 1-12; each Part reproduces a reduced graphic of the Central Plan Register plan, and each plan is described in the text as "a reduced copy ... by way of illustration only". The plan references are Plan 9484 through Plan 9495 in the Central Plan Register, depending on the item.
