Public Health and Wellbeing (Quarantine Fees) Regulations 2020

The Regulations centre on a small number of legal and administrative concepts that control who pays, how fees are communicated and collected, and how hardship or other reasons justify waiver or deferred payment.

Designated facility: The Regulations define "designated facility" by reference to a specific Ministerial instrument dated 21 October 2020 published in the Government Gazette and any subsequent corresponding instrument (reg 4). The definition imports an administrative selection mechanism: the Minister designates the places where the prescribed fee structure applies.

Prescribed fees: The central substance is the fixed fee schedule: $3000 (primary adult, 14 days), $1000 (additional adult, 14 days), $500 (child aged at least 3, 14 days), with pro rata calculation for shorter detention (reg 5(1)). The figures are tied to a 14 day base period, which is the unit for pro rata arithmetic (reg 5(1)(a)(ii), (b)(i)(B), (b)(ii)(B), (c)(ii)). The Regulations treat age for fee purposes as the age on the date of entry into detention (reg 5(3)).

Exemptions and nil-fee categories: The Regulations explicitly provide nil fees for limited categories: children under 3 (reg 5(2)(a)), persons detained at a specified place of detention that is not a designated facility (reg 5(2)(ab)), persons who die during detention (reg 5(2)(d)), and survivors of human trafficking repatriated under an AFP program (reg 5(2)(e)).

Invoicing content and consumer information: The prescribed invoice content under reg 6(1) mirrors procedural transparency obligations. Invoices must inform recipients of the amount, due date, payment options, contact points, availability of payment plans and waivers, and warn of recovery and additional fees on issue of a payment reminder notice (reg 6(1)(a)-(h), (ea)). For nil-fee cases, simpler confirmation suffices (reg 6(2)).

Payment plans and suspension of enforcement: The Regulations create a suspension mechanism: when a person applies for a payment plan, the invoice due date is suspended until determination (reg 7(2)). Eligibility is automatic for Australian citizens or permanent residents (subject to limited exception), and discretionary for non-citizens demonstrating hardship (reg 7(1), 8(1)-(3)).

Waiver process: The instrument prescribes the information a waiver application must contain and the statutory 30-day period for making the application (reg 9(1)-(3)). It lists evidentiary categories that the applicant may use, including Commonwealth Centrelink recipients, State concession eligibility, refugees per Migration Act s 5H, survivors of family violence, persons with acute health issues, and those who purchased travel tickets before 10 July 2020 (reg 9(1)(c)(i)-(ix)). COVID‑19 Quarantine Victoria may accept late applications where exceptional circumstances exist (reg 9(3)). The decision notice content is prescribed (reg 11).

Administrative discretion and initiative waiver: The Regulations enable COVID‑19 Quarantine Victoria to initiate waivers where it would be impractical for a person to apply and prescribe circumstances where an initiative waiver may be used, for example, the person is a refugee per Migration Act s 5H, deceased, or there are compassionate grounds not to give notice (reg 12(1)-(2)).

Ancillary fees and recovery: The Regulations prescribe a specific further payment reminder notice fee of $59.20 (reg 13) and incorporate a notice requirement that non-payment may be recovered under s 262 of the Act (reg 6(1)(e)). The Regulations therefore set both the core debt amounts and an administrative fee associated with reminder notices.

Authorisation and sunset: The Regulations are made under specified sections of the Act (reg 2), and the endnotes specify the instrument will sunset 10 years after making under the Subordinate Legislation Act 1994 (endnote 1). The text also records amendments and their dates (Table of Amendments).

These concepts create the legal architecture by which detained persons are charged, informed, may seek relief, and ultimately can be subject to recovery. The allocation of decision-making functions is concentrated in COVID‑19 Quarantine Victoria, with defined responsibilities to approve or refuse payment plans and waivers, and to issue required notices and invoices.

Primary class: persons detained under the quarantine powers in the places designated as "designated facilities" are the primary subjects of financial liability under these Regulations (reg 4; reg 5(1)). The definition of designated facility references a Ministerial instrument dated 21 October 2020 and subsequent instruments, so which physical locations attract the fee is a function of ministerial designation (reg 4).

Liability by age and accommodation status: Adults detained alone are liable for the primary adult fee ($3000 for a 14 day period) or lesser pro rata amounts (reg 5(1)(a)). Where two or more adults share accommodation, there is a primary adult liable for $3000 and each additional adult is liable for $1000 per 14 day period (reg 5(1)(b)). Children aged at least 3 are charged $500 per 14 day period (reg 5(1)(c)), and children under 3 are expressly not charged (reg 5(2)(a)). The age used to determine liability is taken on the date of entry into detention (reg 5(3)), so the Regulations allocate risk around birthdays by a fixed rule.

Exempt classes and special categories: Persons detained at a specified place of detention that is not a designated facility are prescribed a nil fee (reg 5(2)(ab)). This creates a dichotomy between types of detention places; the Minister’s designation determines where fees apply (reg 4). Persons who die during detention are exempt from fee liability (reg 5(2)(d)). Survivors of human trafficking repatriated under an AFP program are exempt (reg 5(2)(e)).

Decision-making and administrative actors: COVID‑19 Quarantine Victoria is the decision-maker for payment-plan approvals, waiver determinations, issuing notices, and administering the processes created by the Regulations (regs 6-12). The Secretary to the Department of Transport is a prescribed body for the purposes of providing contact details on request under s 258A of the Act (reg 8A). The Minister’s office determines which places are designated facilities (reg 4).

Persons applying for relief or arrangements: Australian citizens and permanent residents have an express entitlement to a payment plan unless an exception applies (reg 8(1)-(1A)). Non-citizens may apply for a payment plan only if experiencing financial or other hardship and must provide documentary evidence (reg 7(1)(b), 7(3)). Persons seeking waivers must supply prescribed information and evidence, and must generally apply within 30 days of receiving the invoice (reg 9(1)-(3)).

Enforcers and potential creditors: The Regulations refer to recovery under s 262 of the Act and to the ability to issue payment reminder notices that attract an additional fee (reg 6(1)(e), (ea); reg 13). COVID‑19 Quarantine Victoria performs a quasi-creditor role when amounts remain unpaid and is responsible for issuing invoices and notices.

Third parties: The Regulations reference other statutory schemes and agencies for evidentiary purposes in waiver applications, for example the State Concessions Act 2004, Centrelink (Commonwealth payments), the Migration Act 1958 (refugee definition under s 5H), the Department of Families, Fairness and Housing’s Extreme Hardship Support Program, and the Australian Federal Police for trafficking survivors (reg 9(1)(c)(i)-(viii); reg 5(2)(e)). Those bodies are indirectly implicated because their recognitions or programs constitute prescribed grounds or evidence for relief.

Practical impact: In short, detained individuals in designated facilities bear the initial financial obligation; COVID‑19 Quarantine Victoria decides relief and installment structure; ministers determine which places are designated; and limited exemptions narrow the classes of persons who will not face a fee. The Regulations therefore reallocate financial responsibility for quarantine accommodation from the state to many detained persons, while building in administrative processes for relief and recovery.

Duties imposed on COVID‑19 Quarantine Victoria and administrative actors

• Issue invoices that contain the prescribed information. Under reg 6(1), invoices must include the name of the person liable, fee amount, payment due date, available payment methods, notice that unpaid amounts may be recovered under s 262 of the Act, notice that non-payment may trigger an additional fee on issue of a payment reminder notice (reg 6(1)(e), (ea)), details of any payment plan available and how to apply (reg 6(1)(f)), notice of the right to apply for waiver and the application process (reg 6(1)(g)), and contact details for queries (reg 6(1)(h)). For nil-fee cases, reg 6(2) prescribes confirmation of the nil amount and contact details for queries.

• Consider and determine payment-plan applications and waivers. The Regulations set out the decision-making duties. COVID‑19 Quarantine Victoria is required to approve a payment plan on application by an Australian citizen or permanent resident except where a prior plan exists and it is appropriate not to approve a further plan (reg 8(1)-(1A)). The body must consider the level of hardship and other relevant circumstances for non-citizens applying under hardship grounds and may request further information (reg 8(2)(a)-(b)). COVID‑19 Quarantine Victoria must notify in writing of its decision on payment-plan applications and must specify instalments and the period for payment where it approves a plan (reg 8(4)-(5)). For waiver applications, COVID‑19 Quarantine Victoria must have regard to evidence supplied and any other relevant matters, may request further evidence, and must provide prescribed information in a decision notice (regs 10-11).

• Consider initiating waivers on its own initiative where prescribed matters and circumstances apply. Reg 12 prescribes that COVID‑19 Quarantine Victoria may, on its initiative, waive fees where the person is eligible to apply and it is impractical for them to apply (reg 12(1)), and lists prescribed circumstances such as refugee status, death, or compassionate grounds for not giving notice (reg 12(2)).

• Apply suspension rules and recovery steps. COVID‑19 Quarantine Victoria must suspend the invoice due date while a payment-plan application is outstanding (reg 7(2)). The body is also the actor referred to in invoices as capable of recovering unpaid amounts under s 262 of the Act (reg 6(1)(e)) and to issue payment reminders that attract the prescribed $59.20 fee (reg 13).

Duties and rights of persons detained

• Right to receive a prescribed invoice and to be informed. Persons liable to pay must be given invoices containing prescribed information (reg 6). For those with a nil fee, a confirmation invoice is required (reg 6(2)).

• Right to apply for a payment plan. Australian citizens and permanent residents may apply for a payment plan without having to prove hardship; non‑citizens may apply if experiencing financial or other hardship and are required to provide documentary evidence of such hardship (reg 7(1)-(3)). The act of applying suspends the due date until determination (reg 7(2)).

• Right to apply for a waiver and to be informed of the decision. Persons may apply for waiver within 30 days of invoice (reg 9(2)), must provide prescribed information and evidence (reg 9(1)), and will receive the prescribed content of a decision notice (reg 11). COVID‑19 Quarantine Victoria may nevertheless consider late applications in exceptional circumstances (reg 9(3)).

• Obligation to pay if relief is refused or not obtained. If a payment plan application is refused, the person must pay the fee by the later of the invoice due date or the date in the refusal notice (reg 8(6)). If a waiver is refused, the decision notice must state the date by which the outstanding amount must be paid (reg 11(d)(ii)).

Other procedural duties

• Secretary to the Department of Transport is prescribed for the purpose of s 258A of the Act, which concerns provision of contact details on request (reg 8A). That duty places a procedural obligation on that Secretary to be a nominated source of contact information in certain contexts.

• Record-keeping and evidence handling duties are implicit in the Regulations given the documentary requirements for hardship and waiver applications: claims must be accompanied by income statements, bank statements, debt notices, statements of expenses, concession or welfare payment records, and health assessments where relevant (reg 7(3), reg 9(1)(c)).

Rights of administrative discretion and limitation

• COVID‑19 Quarantine Victoria has defined but significant discretion on hardship applications (reg 8(2)-(3)), discretion to request further evidence (regs 8(2)(b), 10(2)), and limited discretion to refuse a further payment plan where one has previously been approved (reg 8(1A)).

• The Regulations give COVID‑19 Quarantine Victoria authority to waive fees on initiative in defined circumstances (reg 12), which grants the administrative body procedural latitude to act without a formal application where the conditions in reg 12 are met.

These duties and rights define the procedural relationship between detained persons and the quarantine administrator: invoices trigger potential obligations to pay, applications suspend enforcement, and COVID‑19 Quarantine Victoria must process applications within the prescribed statutory framework, issuing written decisions with specified content.

Nature of enforcement: debt recovery and administrative fees

• The Regulations do not create criminal offences or penal sanctions in their own right. The principal enforcement mechanism described in the text is civil recovery of unpaid amounts under section 262 of the Public Health and Wellbeing Act 2008, which the invoice must warn may be invoked (reg 6(1)(e)). The Regulations thus operate primarily as a civil debt-creation and collection regime.

• Administrative additional fee: the Regulations prescribe that a payment reminder notice may attract an additional administrative fee. The invoice must include a notice that an additional fee may be payable on the issue of a payment reminder notice (reg 6(1)(ea)). Reg 13 prescribes the amount of the further payment reminder notice fee as $59.20 for the purposes of s 260D of the Act. The presence of a small, fixed administrative fee provides a mechanism to recoup some administrative costs associated with reminders.

Recovery process and timing consequences

• Suspension of due date: if a person applies for a payment plan the invoice due date is suspended until COVID‑19 Quarantine Victoria determines the application (reg 7(2)). This procedural suspension delays recovery action while an application is under consideration, creating a temporary protection for applicants.

• If a payment-plan application is refused, payment becomes due by the later of the original invoice due date or the date stated in the refusal notice (reg 8(6)). The decision notice must be in writing (reg 8(4)). For waiver refusals, the decision notice must state the date by which the outstanding amount must be paid (reg 11(d)(ii)). Those provisions fix the point at which active recovery can recommence.

• The invoice must inform the person that amounts may be recovered under s 262 (reg 6(1)(e)). The Act’s s 262 is not reproduced here, but the Regulations’ requirement places recovery powers in plain notice for the recipient and ties the process back into the Act’s enforcement framework.

Administrative discretion and safeguards

• COVID‑19 Quarantine Victoria is required to consider hardship and other circumstances in payment-plan and waiver decisions (regs 8(2), 10(1)). The Regulations provide procedural safeguards in the form of mandatory written notices detailing reasons and amounts waived or remaining, which frames the administrative record for any subsequent recovery action (reg 11).

• COVID‑19 Quarantine Victoria must specify instalments and the period within which fees are to be paid where a payment plan is approved (reg 8(5)). That duty converts discretionary relief into enforceable instalment terms.

Implications for creditors and third parties

• The Regulations do not expressly address assignment of debts, third-party recovery, insolvency, or interaction with insolvency law. They do, however, create a recorded debt owed to the state agency administering quarantine, which the agency may recover under the Act.

• Invoices must also include available methods of payment and contact details (reg 6(1)(d), (h)). That detail reduces transactional friction but also facilitates rapid recovery when payment is due.

Practical enforcement pathway

• The practical enforcement sequence is: issue of invoice consistent with reg 6; allowance for suspension during a payment-plan application (reg 7(2)); decision on payment-plan or waiver (regs 8-11); if unpaid, issuance of payment reminder notice which may attract the $59.20 fee (reg 13); and recovery under s 262 as stated in the invoice (reg 6(1)(e)). COVID‑19 Quarantine Victoria both administers relief and performs recovery functions under that sequence.

Costs to the state and administrative burden

• The Regulations envisage recovery costs, and the $59.20 fee signals a small administrative charge to compensate for reminder activity. The larger substantive debts (the $3000, $1000 and $500 figures) are the principal amounts to be recovered. The text implies an administrative burden on COVID‑19 Quarantine Victoria to determine applications, issue written notices, and manage recovery, but it does not quantify those costs.

Limitations and absent enforcement measures

• The instrument does not prescribe interest on unpaid balances beyond the reminder fee, nor does it specify enforcement methods in detail (for example, garnishee, registration as a judgment debt, or referral to debt collection agencies). The statutory recovery power in s 262 of the Act is referenced but not reproduced, so practitioners must consult the Act to identify specific enforcement tools available under that provision.

In sum, the Regulations rely on civil recovery of prescribed fees, augmented by a small administrative reminder fee, and create procedural constraints and safeguards in invoicing, payment-plan suspension, and decision-notice content that shape the timing and content of enforcement.

Authorising Act and specific Act references

• The Regulations are expressly made under sections 232, 238A, 238B, 238C and 239 of the Public Health and Wellbeing Act 2008 (reg 2). The Regulations repeatedly reference provisions of that Act, for example s 257 (purpose of prescribing fees), s 258(1) (invoicing), s 258A (provision of contact details), s 259 (waiver), s 260A (initiative waivers), s 260D (reminder notice fee), and s 262 (recovery). Those cross-references integrate the Regulations into the Act’s Part 14 regime. Practitioners must consult the Act for the operative statutory powers and enforcement mechanisms that these Regulations elaborate.

Interaction with immigration and federal statutes

• The Regulations identify "refugee" by reference to section 5H of the Migration Act 1958 of the Commonwealth when prescribing evidentiary categories for waiver or for initiative waivers (reg 9(1)(c)(vi); reg 12(2)(a)). That link imports federal statutory definitions into the waiver regime for identifying particular vulnerable classes eligible for relief.

Interaction with state concession and welfare frameworks

• Reg 9(1)(c)(i) and (ii) allow evidence that an applicant is an eligible person under the State Concessions Act 2004 or a recipient of a Commonwealth Centrelink payment to be considered in waiver applications. Reg 9(1)(c)(iii) references the Extreme Hardship Support Program administered by the Department of Families, Fairness and Housing. These references tie state and Commonwealth welfare and concession schemes into the evidentiary framework that COVID‑19 Quarantine Victoria must consider.

Administrative cross-appointments and contact provision

• For the purposes of s 258A of the Act (provision of contact details on request), the Regulations prescribe the Secretary to the Department of Transport as a prescribed body (reg 8A). This interacts procedurally with any statutory process requiring the supply of contact information from government agencies and places an inter-departmental administrative duty on that Secretary.

Subordinate legislation and sunset

• The endnotes state the Statutory Rule will sunset 10 years after making under s 5 of the Subordinate Legislation Act 1994 (endnote 1). That interaction sets a temporal limit on the Regulations as subordinate legislation and requires renewal if the regime is to continue beyond the sunset date.

Reference to AFP programs and international obligations

• The exemption for survivors of human trafficking repatriated under an Australian Federal Police program (reg 5(2)(e)) ties the Regulation to Commonwealth policing and victim support activities. The instrument therefore accommodates federal programs when defining state liability relief.

Missing cross-references and obligations left to other instruments

• The Regulations do not define "specified place of detention"; that term is drawn from the Act, so the cross-reference means users must consult the Act and any other subordinate instruments that specify places of detention. The "designated facility" concept is implemented by ministerial instruments (reg 4), so the Regulations interact with separate executive instruments that identify the geographic scope of the fee regime.

Practical consequence of cross-links

• Collectively, the Regulations form a node in a network of statutes, subordinate instruments and administrative programs. Determination of liability, eligibility for relief, the nature of evidence, and the agency authorised to act on behalf of the government therefore depend not only on these Regulations but on the Public Health and Wellbeing Act, ministerial designation instruments, federal Migration Act definitions, state concession and welfare systems, and AFP repatriation programs. Practitioners must read the Regulations alongside those instruments to understand the full legal picture.

Overview of amendments incorporated

• This version incorporates amendments as at 14 December 2021. The Table of Amendments lists two statutory rules that altered the original 2020 Regulations: the Public Health and Wellbeing (Quarantine Fees) Amendment Regulations 2021, S.R. No. 96/2021 (made 3 August 2021), and the Public Health and Wellbeing (Quarantine Fees) Further Amendment Regulations 2021, S.R. No. 165/2021 (made 14 December 2021). The text includes marginal notes indicating which provisions were substituted, inserted or revoked and the relevant amending instrument (see inter alia reg 4, reg 5, reg 6, reg 8, reg 9, reg 11, reg 12, reg 13).

Key changes by amendment instrument

• S.R. No. 96/2021 (3 August 2021): This amending instrument made multiple substantive changes. Notable amendments recorded in the text include:

  • Substitution and insertion in reg 4 to insert the definition of "designated facility" (reg 4 heading substitution and insertion of the definition by SR96/2021 reg 5(2)).
  • Substitutions in reg 5(1) concerning the pro rata clauses and amounts for adults and additional adults (reg 5(1)(a)(ii), 5(1)(b)(i)(B), 5(1)(b)(ii)(B), 5(1)(c)(ii) as substituted by SR96/2021 reg 7(1)).
  • Insertion of reg 5(2)(ab), making persons detained at a specified place of detention that is not a designated facility prescribed as nil-fee (reg 5(2)(ab) inserted by SR96/2021 reg 6).
  • Revocation of some prior paragraphs in reg 5(2) (noted as revoked by SR96/2021 reg 7(2)).
  • Amendments in reg 6(1)(a) and reg 6(2)(a) and substitution of reg 6(2)(b), indicating changes to what invoice information is prescribed (SR96/2021 reg 8(1), reg 8(2)).
  • Amendments to reg 7-11 relating to commencement timing (Table of Amendments notes regs 7-11 commenced 3.8.21) and to reg 8 in particular: reg 8(1) amended and insertion of reg 8(1A) providing a limited exception to the duty to approve payment plans for citizens and permanent residents (SR96/2021 reg 9).
  • Amendments to reg 9(1)(c)(iii) and reg 9(1)(c)(viii) and others (SR96/2021 reg 10), and to reg 11(a) (SR96/2021 reg 11).

The SR96/2021 amending instrument therefore refined the fee application rules, inserted the designated-facility gating mechanism, adjusted invoice content, and specified more detailed criteria and exceptions for payment-plan approvals and waiver evidence.

• S.R. No. 165/2021 (14 December 2021): This later amending instrument added and refined procedural provisions:

  • Insertion of reg 6(1)(ea) to require invoices to contain notice that the person may become liable to pay an additional fee on issue of a payment reminder notice (SR165/2021 reg 5).
  • Insertion of reg 8A prescribing the Secretary to the Department of Transport as a prescribed body for the purposes of s 258A of the Act (SR165/2021 reg 6).
  • Insertion of reg 12 (labelled reg 12 in the text) concerning waiver on initiative by COVID‑19 Quarantine Victoria, prescribing the matters to consider and the circumstances for initiative waiver (SR165/2021 reg 7).
  • Insertion of reg 13 prescribing the further payment reminder notice fee at $59.20 (SR165/2021 reg 7).

Commencement adjustments

• The Table of Amendments records the commencement details: regs 5 and 6 had effect from 7 December 2020 (reg 3(1)); regs 7-11 commenced 3 August 2021 (reg 3(2)); the further amendments in SR165/2021 had a commencement date of 14 December 2021.

Practical import of amendments

• The SR96/2021 changes introduced the "designated facility" concept and clarified who pays and under what pro rata rules. They also tightened the procedural framework for payment plans, including the insertion of an exception to the duty to approve for citizens or permanent residents (reg 8(1A)).

• The SR165/2021 changes formalised the reminder-fee regime and added the capacity for COVID‑19 Quarantine Victoria to exercise waiver powers on its own initiative in limited circumstances, and prescribed an administrative body for the supply of contact details.

Omissions and future amendment risk

• The instrument notes that this version does not contain amendments not yet in operation (endnote 3). The Regulations are also subject to the Subordinate Legislation Act sunset mechanism (endnote 1), meaning further amendments may be needed if the policy is to extend beyond the prescribed sunset.

For practitioners and compliance officers, the amendment history indicates iterative changes to scope, process and administrative fees. It demonstrates that the regime has been refined to incorporate ministerial designations, to streamline notice content, and to provide an avenue for initiative waivers and a defined reminder fee.

No litigation recorded in the instrument

• The Regulations as published and in their endnotes do not record any judicial decisions or litigation history arising from the instrument. The endnotes and Table of Amendments list the subordinate instruments and dates of making and commencement, but do not include reported cases or appeals.

Practical considerations for potential disputes

• While the instrument itself does not list cases, the Regulations create administrative decision-making functions , for example, COVID‑19 Quarantine Victoria’s decisions to approve or refuse payment plans (regs 7-8) and waivers (regs 9-11), and its capacity to initiate waivers (reg 12). Those decisions, as administrative acts, have the features that could generate disputes concerning whether the prescribed procedures were followed, whether the decision-maker properly considered relevant matters (such as the evidence categories listed in reg 9(1)(c)), or whether the body acted within the limits of its statutory discretion (for example, under reg 8(1A) the limited exception to approval of payment plans for citizens/permanent residents).

• The Regulations prescribe required content for written notices and invoices (reg 6; reg 11). Disputes may therefore arise about whether the prescribed notices were properly given, the accuracy of the invoice, or the timeliness of decision notices , matters that have procedural implications in any subsequent recovery action. The instrument itself creates the entitlement to receive certain information; lack of compliance with those requirements could be a ground for challenge or a factual defence to debt recovery.

Absence of recorded litigation does not preclude review

• The absence of recorded cases in the instrument does not mean there will be no litigation. Administrative decisions that affect financial liability typically attract review in the appropriate fora. The Regulations do not set out appeals mechanisms within the instrument; any contestation would proceed within the broader administrative law and civil recovery systems in Victoria. Practitioners should consult the Public Health and Wellbeing Act 2008, associated procedural rules, and Victorian court listings for any judgments or applications concerning these Regulations.

What to check for case law

• Search terms likely to surface any litigation include the instrument’s name, reference to COVID‑19 Quarantine Victoria decisions, and disputes concerning reg 5 fee liability, reg 6 invoice content, reg 8 payment-plan determinations, reg 9 waiver decisions, reg 12 initiative waivers, and reg 13 reminder-fee imposition. The relevant timelines for challenge will also depend on the statutory time limits and the contents of decision notices, which are prescribed in the Regulations.

Given the instrument does not record cases, readers requiring decisions on statutory interpretation, procedural compliance, or enforcement should undertake case law research in Victorian courts and tribunals, and review any reported administrative law decisions that might touch the Act and these Regulations.

Timing rules and pro rata arithmetic

• Fee base period and pro rata calculation. The prescribed fees are denominated by reference to a 14 day period and must be pro rated for shorter detention (reg 5(1)(a)(ii), (b)(i)(B), (b)(ii)(B), (c)(ii)). Practitioners should be precise when calculating pro rata amounts, because the Regulations specify the 14 day base and take age at "entry into detention" (reg 5(3)). Ambiguity in the moment of "entry into detention" can materially change whether a child is charged as under or at least 3 years (reg 5(3)).

Designated facility gating and its consequences

• Whether a person is liable depends on whether the person was detained at a designated facility as defined in reg 4. The definition imports a Ministerial instrument dated 21 October 2020 and any subsequent corresponding instruments (reg 4). If the detention occurred at a "specified place of detention that is not a designated facility" the prescribed fee is nil (reg 5(2)(ab)). A small drafting detail in reg 4 therefore governs substantial financial exposure: practitioners must check the ministerial designation instruments and the Gazette history to confirm whether the place of detention was designated.

Age and shared-accommodation allocations

• The "primary adult" concept in shared accommodation is not defined in the Regulations. The primary adult is nevertheless charged $3000 for 14 days while each additional adult is charged $1000 (reg 5(1)(b)). Lack of a statutory definition means disputes could arise over who is or was the primary adult in shared accommodation, especially where parties dispute responsibility for a shared booking or room assignment.

Exemptions that require careful proof

• Exemptions exist for survivors of human trafficking repatriated under an AFP program (reg 5(2)(e)). Proof of repatriation under that specific AFP program may be necessary. Similarly, waiver evidence categories list a number of programs and statutory references (reg 9(1)(c)), but the Regulations do not provide exhaustive rules about how to establish eligibility under those external programs. Applicants should assemble documentary proof to the standards implied by the Regulations, such as official letters, program identifiers, or agency confirmations.

Suspension of due date and procedural traps

• Applying for a payment plan suspends the invoice due date until COVID‑19 Quarantine Victoria determines the application (reg 7(2)). However, if the application is refused, the person must pay by the later of the original invoice date or the date in the decision notice (reg 8(6)). Practical risk exists where an applicant assumes the suspension indefinitely; the person must track the refusal notice and the payment date specified to avoid incurring reminder fees and recovery action.

Limited automaticity for payment plans and narrow exception

• For Australian citizens and permanent residents COVID‑19 Quarantine Victoria "must" approve a payment plan on application, but reg 8(1A) qualifies that duty where a prior plan was previously approved and it is appropriate not to approve a further plan. That one-line exception may prove material where a person seeks repeated payment plans. The criteria for what makes it "appropriate in all the circumstances" are not specified, so administrative discretion carries risk of inconsistent outcomes.

Waiver time limits and exceptional circumstances

• Waiver applications are prescribed to be made within 30 days after the invoice (reg 9(2)), but COVID‑19 Quarantine Victoria may consider late applications where exceptional circumstances apply (reg 9(3)). Applicants should not assume automatic acceptance of late applications. The Regulations expect early action.

Initiative waiver but narrow circumstances

• COVID‑19 Quarantine Victoria may waive fees on its own initiative in prescribed circumstances, including refugee status under Migration Act s 5H, death, or compassionate grounds (reg 12(1)-(2)). The initiative power is useful where it is impractical for a person to apply, but COVID‑19 Quarantine Victoria must still satisfy the prescribed matters, which may require cross-agency information and careful record-keeping.

Invoice content requirements are prescriptive

• Invoices must contain specific elements (reg 6(1)). Failure to include the prescribed notices or to supply contact details (including the prescribed body under reg 8A) could be a procedural defect that an applicant can exploit when resisting recovery. Administrators should use templates that mirror reg 6(1) verbatim to avoid technical non-compliance.

Reminder fee calculation and notice

• The reminder fee is fixed at $59.20 (reg 13) for the purposes of s 260D and the invoice must warn of possible additional fees (reg 6(1)(ea)). Operational practice should ensure that reminder notices are only issued where the person has been properly notified of the existing invoice and the invoice period has expired. Failure to follow the notice provisions could create contestable debt.

Evidence burden for hardship and waiver

• The Regulations list specific documentary categories that must be included in hardship applications and waiver applications (reg 7(3), reg 9(1)(c)). Applicants who fail to provide adequate evidence risk refusal and exposure to recovery action. COVID‑19 Quarantine Victoria may also request further evidence (regs 8(2)(b), 10(2)), which may extend the timeline for a decision.

Interplay with external programs and definitions

• Several cross-references to external statutes and programs (State Concessions Act 2004, Migration Act 1958, Centrelink payments, Extreme Hardship Support Program) mean that relief may depend on eligibility under laws and programs administered by other agencies (reg 9(1)(c)). Applicants should secure documentary proof from those agencies.

Record-keeping and administrative burden

• COVID‑19 Quarantine Victoria will need robust record-keeping to track dates of entry (for age determination reg 5(3)), invoices, applications, suspensions, decision notices, and any initiative waivers exercised (regs 5-12). Poor records risk procedural challenges once recovery is attempted.

In short, the main practical pitfalls arise from the designated-facility gatekeeping, the pro rata and age rules, documentary evidentiary requirements, tight time limits for waivers, the limited exception to payment-plan entitlements, and the need to get invoice content exactly right.

Checklist for administrators (COVID‑19 Quarantine Victoria and related agencies)

1. Confirm designated facilities. Maintain and publish a contemporaneous list of ministerially designated facilities as per the Ministerial instrument(s) referenced in reg 4, and ensure that invoicing and fee application are linked to those instruments.

2. Standardise invoices. Use a template that includes every item prescribed in reg 6(1): liable person name, fee amount, due date, available payment methods, notice about recovery under s 262 of the Act, notice about possible additional fee on issue of payment reminder notices (reg 6(1)(ea)), details and process for payment-plan applications, waiver application process, and contact details for COVID‑19 Quarantine Victoria. For nil-fee cases use the reg 6(2) format.

3. Record entry date precisely. Record and retain the exact date of entry into detention for each person, because age for fee purposes is determined on that date (reg 5(3)). This is necessary to decide whether a child is under 3 and to compute pro rata amounts accurately.

4. Compute fees to the 14 day base. Apply the 14 day denominator for pro rata calculations consistently for detentions of less than 14 days (reg 5(1)). Document the arithmetic for audit trails.

5. Implement payment-plan procedures. Create a streamlined intake process for payment-plan applications that: accepts applications from Australian citizens and permanent residents (reg 7(1)(a)), accepts applications from non-citizens only with sufficient hardship evidence (reg 7(1)(b), 7(3)), suspends invoice due dates upon receipt of applications (reg 7(2)), issues written decisions with required content (reg 8(4)-(5)), and retains records showing instalments and periods where plans are approved.

6. Maintain clear evidentiary standards. For hardship and waiver applications, publish a checklist of acceptable documentary evidence matching reg 7(3) and reg 9(1)(c) (income and bank statements, debt notices, statements of expenses, welfare/ concession records, and health assessments). Where applicants reference external programs (State Concessions Act eligibility, Centrelink, Extreme Hardship Support Program, or refugee status), require documentary certification from the relevant agency.

7. Streamline waiver intake and escalation. Provide a clear waiver application form referencing the prescribed categories (reg 9(1)), record the application date, evaluate within a reasonable timeframe, and issue the prescribed decision notice content (reg 11). Establish criteria to exercise initiative waivers in the circumstances in reg 12, including cross-checking refugees and deceased persons, and record grounds for exercising initiative.

8. Apply reg 8(1A) with policy guidance. Create internal guidelines for when a prior approved payment plan justifies refusing a further plan for an Australian citizen or permanent resident (reg 8(1A)). Document the rationale under an "appropriate in all the circumstances" test, retaining audit trails to resist procedural challenge.

9. Manage reminders and the $59.20 charge. Implement a reminder notice process consistent with reg 13 and reg 6(1)(ea). Ensure that reminder fees are only applied where the invoice and subsequent notices meet the Regulations’ requirements and that the person was given the prescribed invoice content.

10. Inter-agency coordination. For evidence or determinations tied to other programs (Migration Act refugee status, AFP repatriation, State concession eligibility), establish points of contact and clear protocols for obtaining corroborating documentation. Comply with reg 8A by liaising with the prescribed body (Secretary to the Department of Transport) for contact details when required.

Checklist for detained persons and their advisers

1. Confirm place of detention designation. Check whether the place where the person was detained is a designated facility as per the ministerial instrument(s) mentioned in reg 4; this determines whether the fee regime applies (reg 4; reg 5(2)(ab)).

2. Read the invoice carefully. Ensure the invoice contains all prescribed elements (reg 6(1)). If elements are missing, preserve the invoice and seek clarification from COVID‑19 Quarantine Victoria; procedural non-compliance may affect recovery steps.

3. Act promptly on payment-plan and waiver deadlines. If eligible, apply for a payment plan or waiver promptly. Payment-plan applications suspend the invoice due date until determination (reg 7(2)). Waiver applications are generally required within 30 days after the invoice (reg 9(2)); late applications will be considered only in exceptional circumstances (reg 9(3)).

4. Assemble documentary evidence early. If applying based on hardship, family violence, refugee status, Centrelink receipt, or other listed grounds, gather the specified documentary evidence in reg 7(3) and reg 9(1)(c) before applying. This reduces the likelihood of follow-up requests that delay the determination.

5. Track decision notices and payment dates. If a payment-plan application is refused, pay by the later of the invoice due date or the date specified in the refusal notice (reg 8(6)). If a waiver is refused, note the date by which payment must be made as stated in the refusal (reg 11(d)(ii)).

6. Use administrative avenues before litigation. The Regulations create administrative avenues (payment plans, waivers, and initiative waivers). Exhaust those routes and retain copies of all communications and decision notices before considering external legal action.

Operational and compliance templates to prepare

• Invoice template that replicates reg 6(1) verbatim, with fields for each prescribed item and audit trail for delivery.

• Payment-plan application form that collects identity, status (citizen/permanent resident or not), hardship summary, and attaches documentary evidence listed in reg 7(3).

• Waiver application form enumerating the grounds in reg 9(1)(c) and attaching relevant documentary proof.

• Decision notice templates for payment-plan approvals/refusals and waiver approvals/refusals that include the prescribed content per reg 8(4)-(5) and reg 11.

• Internal decision logs and file notes explaining exercise of discretion under reg 8(1A) and reg 12 initiative waivers.

Record-keeping and audit

• Retain records of entry dates, invoices issued, applications received, suspensions of due dates, decisions and their reasons, instalment schedules, reminders issued and fees charged, and any recovery actions taken. These records will be critical if recovery is contested.

Consult the Act and ministerial instruments

• Finally, these Regulations operate in tandem with the Public Health and Wellbeing Act 2008 and the Ministerial instruments designating facilities. For substantive enforcement powers, recovery mechanisms and the definition of "specified place of detention" practitioners should consult the Act and the relevant Ministerial instruments cited by reg 4.

Compliance therefore requires concurrent attention to document templates, timing obligations, evidentiary standards, and inter-agency coordination to align administrative practice with the Regulations’ prescriptive content.
