98 Secretary may declare optional variations (1) The Secretary may by notice in writing declare optional variations to risk management requirements in respect of a particular cooling tower system or a class of cooling tower systems if the Secretary is satisfied that the variation would not result in a higher health risk. (2) If a notice under subsection (1) applies to a class of cooling tower systems, the Secretary must publish a copy of the notice in the Government Gazette. (3) If the owner of a cooling tower system in respect of which a declaration under subsection (1) applies— (a) elects in writing to the Secretary to implement the variations to the risk management requirements which would otherwise apply in respect of the cooling tower system; and (b) complies with the risk management requirements as varied— the owner is to be taken to have complied with the risk management requirements under this Act or the regulations that would otherwise have applied.
