#### 99 Advertisement or promotion of health services 99 Advertisement or promotion of health services (cf 1991 Act, s 10AN) > A person must not advertise or otherwise promote the provision of a health service in a manner that— > > > (a) is false, misleading or deceptive, or > > > (b) is likely to mislead or deceive, or > > > (c) creates, or is likely to create, an unjustified expectation of beneficial treatment. > > Maximum penalty— > > > (a) in the case of an individual—100 penalty units for a first offence or 200 penalty units for a second or subsequent offence, or > > > (b) in the case of a corporation—500 penalty units for a first offence or 1,000 penalty units for a second or subsequent offence. > > **pt 6, div 3 (ss 90–96):** Rep 2017 No 43, Sch 1 \[47\].
