#### 75 Unlawful release from detention 75 Unlawful release from detention (cf 1991 Act, s 34) > > (1) A person who, without lawful authority, releases, or attempts to release a public health detainee or a person arrested under this Division is guilty of an offence. > > > > Maximum penalty—100 penalty units or imprisonment for 6 months, or both. > > > (2) It is a defence to proceedings for an offence under this section if the defendant satisfies the court that the defendant’s action was not a risk to public health and that the defendant knew this to be so.
