#### 70 Offence not to comply with public health order 70 Offence not to comply with public health order (cf 1991 Act, s 28) > > (1) A person who fails to comply with a requirement of a public health order is guilty of an offence. > > > > Maximum penalty—100 penalty units or imprisonment for 6 months, or both. > > > (2) Proceedings for an offence under this section may be commenced only by the Secretary or a police officer. > > > (3) Proceedings for an offence under this section do not preclude action from being taken under section 73 for the contravention on which the proceedings are based.
