58 Improvement notice—issue
(1) This section applies where an authorised officer has reasonable
grounds for believing that a person who is carrying on a public health
risk activity or performing a public health risk procedure is
contravening or likely to contravene this Act.
(2) Where this section applies, the authorised officer may issue an
improvement notice to the person carrying on the activity or
performing the procedure, as the case may be.
(3) If the person carrying on a public health risk activity to whom an
improvement notice is issued is not in charge of the premises where
that activity is carried on, the authorised officer must give a copy of
a notice under subsection (2) to the person in charge of those
premises.
(4) An improvement notice must specify the following matters:
(a) the contravention that the authorised officer believes is
occurring or is likely to occur and the reasons for that belief;
(b) a period or periods within which the person to whom the notice
is given is required to rectify the matters or activities to which
the notice relates.
(5) An improvement notice may specify action that the person to whom
the notice is given is to take in order to comply with the notice.
(6) An improvement notice continues in force until revoked in
accordance with section 60.
