37Recording disclosures of interests

#### 37 Recording disclosures of interests (1) A disclosure by a Council member under section 29 of the Public Governance, Performance and Accountability Act 2013 (which deals with the duty to disclose interests) to each other member of the Council must be recorded: (a) in any advice provided, or recommendations made, to the CEO by the Council; and (b) in any guidelines issued to the CEO by the Council. (2) Subsection (1) applies in addition to any rules made for the purposes of that section. (3) For the purposes of this Act and the Public Governance, Performance and Accountability Act 2013, the member is taken not to have complied with section 29 of that Act if the disclosure is not recorded as required by subsection (1) of this section. 135 Paragraph 40(e) Repeal the paragraph, substitute: (e) if the member fails, without reasonable excuse, to comply with section 29 of the Public Governance, Performance and Accountability Act 2013 (which deals with the duty to disclose interests) or rules made for the purposes of that section. 136 Paragraph 41A(2)(a) Omit “section 37”, substitute “rules made for the purposes of section 29 of the Public Governance, Performance and Accountability Act 2013”. 137 Part 6 (heading) Repeal the heading, substitute:
