Public Employment (Mobility) Act 1989

The Act’s core operational concepts are defined in s 3(1). “Employee” is defined broadly to mean a person who is an employee within the meaning of the Public Sector Employment and Management Act 1993 (the primary NT public sector employment statute), a member of the Police Force, a person otherwise employed by the Territory, or a person employed in or by a body corporate established by a law of the Territory, subject to specific exclusions. The exclusions are: persons employed on a casual or temporary basis or for a fixed term; a Local Court Judge; and a Supreme Court Judge (s 3(1) definition of “employee” paragraphs (a)-(c)). Notably, the definition originally excluded “Local Court Judge” after the 2016 amendments replaced references to “Magistrate” with “Local Court Judge”. The definition also excludes employees of local government councils, the Northern Territory Land Corporation, and the Conservation Land Corporation, as those bodies are carved out from the meaning of “public employment” (s 3(1) definition of “public employment” paragraphs (a)-(b) parenthetical exclusion). This means that a person moving from a council to a NT government department is not covered by the Act, and accrued conditions do not automatically transfer.

“Public employment” means employment within the Public Sector of the Northern Territory or the Police Force, any other employment by the Territory or in or by a body corporate established by a law of the Territory (again excluding the three named bodies), or employment within the Commonwealth Public Service or an authority of the Commonwealth where the Commonwealth granted the employee leave of absence without pay to take up public employment under the first two limbs (s 3(1) definition of “public employment” paragraph (c)). The inclusion of Commonwealth employees on leave is significant: it allows a person to move temporarily from the Commonwealth to the NT public sector and retain their Commonwealth accrued conditions during that period, and then transfer within the NT sector with those conditions if they remain in NT employment.

“Conditions of employment” is a closed list in s 3(1). It means only: recreation leave, long service leave, or sick leave; an allowance in the nature of a Northern Territory allowance (by whatever name called) or for living in or in a particular place in the Territory; an airfare entitlement or payment in lieu of an airfare entitlement; or automatic increments of salary or wages. This list is exhaustive. Important omissions include superannuation entitlements, redundancy benefits, maternity/parental leave beyond the listed types, salary packaging rights, and any other contractual benefits. Those conditions do not automatically transfer. The Act does not require that the new employer provide equivalent superannuation or redundancy terms; those are governed by other legislation or the new employer’s enterprise agreement. The limited scope means employers and employees must examine the actual leave and allowance policies to see what is carried over.

“Transfer” is defined as “the movement of an employee from the employment of one public employer to the employment of another public employer” (s 3(1)). It does not distinguish between voluntary and involuntary transfers, except that s 8 separately deals with compulsory transferees under old Acts. The definition is broad enough to cover lateral moves, promotions, and even demotions, provided the movement is between two distinct public employers. It does not apply to secondments where the employee remains employed by the original employer but works elsewhere, nor to internal transfers within the same public employer (e.g., between agencies within the same department). The definition also does not cover movement from a public employer to a private sector employer or to a local government council.

The Minister has the power to declare, by notice in the Gazette, that a person, class, or category of persons to whom this Act does or does not apply (s 3(2)). This is a broad discretionary power that can extend or restrict the operation of the Act beyond the legislative definitions. It could be used, for example, to extend coverage to employees of a newly created statutory authority that is not captured by the definition, or to exclude a particular class of employees for policy reasons. This power introduces flexibility but also uncertainty, as those declarations may change without legislative amendment and may not be widely known.

Finally, “public employer” has a corresponding meaning to “public employment” (s 3(1)). So each employer covered by the definition of public employment is a public employer for the purposes of the Act. The Act does not create any new employment relationship; it merely attaches rights to the employee when moving between these employers.

The Act directly affects current and former employees of the NT public sector who move between different public employers within the Territory, and also certain Commonwealth employees who take up NT public employment on leave without pay from the Commonwealth. The primary class of affected persons is employees as defined in s 3(1), which covers the bulk of the NT public service (including the Police Force and employees of statutory bodies) but excludes casual, temporary, and fixed-term employees, and judges. This exclusion means that a significant portion of the public sector workforce - those on non-ongoing arrangements - cannot benefit from the portability of accrued conditions. For those employees, a move to another public employer would likely require them to start anew with respect to leave and allowances, unless their individual contract or enterprise agreement provides otherwise. The exclusion may reflect a policy choice that short-term or contingent workers do not have the same claims to continuity, but it also creates a two-tier system where permanent employees have greater mobility rights.

The Act also affects the public employers themselves, because they must recognise and honour accrued conditions from previous public employers when they accept a transferring employee. This imposes a compliance burden on HR and payroll systems to track service history across multiple employers, determine the correct amount of accrued leave, and apply the new employer’s rules for future accrual. For example, if an employee transfers with 10 years of continuous service across three different NT government agencies, the new employer must calculate long service leave eligibility based on the earliest start date (s 4(2)), even if the employee’s service records from previous employers are incomplete. The new employer cannot treat the employee as a new starter for leave accrual purposes.

The Act also affects the previous public employer. While the previous employer has no obligation to take the employee back (s 7), it must release the employee’s accrued conditions, as they are not forfeitable on transfer. The previous employer may also need to certify the employee’s service dates and accrued entitlements so the new employer can apply the Act correctly. There is no provision in the Act requiring the previous employer to provide a statement, but in practice it would be necessary.

People excluded from coverage under the Act include employees of local government councils, the Northern Territory Land Corporation, and the Conservation Land Corporation. This means that a person moving from a council to a NT government department cannot rely on the Act to carry over their accrued conditions. However, the Act does not forbid the new employer from voluntarily recognising those conditions; it simply does not compel it. The exclusion likely reflects that local government and those land corporations are separate legal entities not part of the core NT public sector, and their employment conditions are governed by different industrial instruments.

The Minister’s power under s 3(2) to declare that the Act applies or does not apply to a person, class, or category adds an element of discretion. This means the Minister can, by gazette notice, extend the Act’s protections to additional employees (e.g., employees of a new statutory body not otherwise covered) or exclude certain employees (e.g., senior executives whose conditions are individually negotiated). Affected persons must monitor the Gazette for such declarations to know their rights.

Finally, the Act potentially affects Commonwealth employees on leave of absence without pay who take up NT public employment. Under the definition of “public employment” (s 3(1)(c)), such a person is considered to be in public employment for the purposes of the Act while they are on that leave. If they then transfer from one NT public employer to another, the Act protects their accrued conditions from the Commonwealth service, as long as the service is continuous. This is a significant benefit for Commonwealth employees seconded or recruited to the NT, as they do not lose long service leave or other entitlements accrued in the Commonwealth system. However, the Act does not oblige the Commonwealth to recognise NT service if the employee later returns, because the Act only applies to NT public employers.

The Act confers specific rights on transferring employees. The primary right is that all conditions of employment that have accrued to the employee at the time of transfer shall accompany and be available to the employee following the transfer (s 6(1)). This is a mandatory provision: the new public employer must honour the accrued conditions; the transfer does not extinguish them. For example, an employee with 150 hours of accrued sick leave in one NT government agency who moves to a different agency retains that 150 hours and can use it under the new employer’s sick leave policy, subject to the same evidentiary requirements. After transfer, further accrual of that condition occurs under the terms applicable to employment with the new public employer (s 6(2)). So if the new employer provides sick leave at 15 days per year instead of 12, the employee accrues at the higher rate from the transfer date; conversely, if the new employer’s rate is lower, the accrued balance remains but future accrual is at the lower rate.

Another right is that for the purpose of determining the terms of employment that will apply to an application for a transfer to a permanent vacancy, the employee is considered to be an employee of the public employer with which the vacancy exists (s 5(1)). This means the employee is treated as an internal applicant, not an external one. In practice, this may affect selection criteria, internal advertising requirements, and the right to appeal. For example, if the new public employer’s enterprise agreement gives preference to internal candidates for promotion, a transferring employee cannot be treated as an external applicant and disadvantaged. However, this only applies to “the purpose of determining the terms of employment which are to apply in relation to that application”. It does not guarantee the employee will be selected; it simply ensures they are considered under the same rules as existing employees of that employer. Subsection (2) adds that where the new public employer allows or is required to allow a right of appeal against a promotion, that right applies to the transferred employee if the transfer constituted a promotion. So a person who is promoted via transfer can appeal if the new employer’s promotion process permits appeals. This is a procedural right, not a substantive one.

The Act also confers a right to have continuous service recognised for the purpose of long service leave, recreation leave, and other service-based conditions. Section 4(2) provides that where a person has been employed by more than one public employer, the date on which they first commenced duty in public employment is the earliest date provided the periods of service with subsequent public employers are continuous. “Continuous” is not defined in the Act, which creates some ambiguity. Presumably it means without a break in employment, but a break of a few days between jobs might not break continuity depending on the circumstances. This is a risk area.

Crucially, the Act imposes no duty on the previous public employer to re-employ the person. Section 7 states clearly: “An employee who transfers from one public employer to another shall have no automatic right to return to the employment of the previous public employer.” This is a one-way transfer. Employees who are uncertain about the new role cannot rely on a right to return to their old position. They must weigh the risk of losing the security of their current employment. This may discourage mobility, especially for employees with long service who fear they may not like the new role.

For compulsory transferees - those to whom Part VI of the Public Service Act 1976 or Part VI of the Teaching Service Act 1981 applied - the Act preserves any rights conferred by those Acts, even if they transfer to other public employment (s 8). This is a saving provision; it ensures that the compulsory transfer schemes under those older Acts are not overridden by the mobility provisions. Since those Acts are now repealed (the current Act references the Public Sector Employment and Management Act 1993 instead), this section is likely only relevant for employees who were covered by those provisions before repeal and still retain residual rights.

The Act does not impose any corresponding duties on employees. There is no obligation to inform the new employer of accrued conditions, but failure to do so may result in the new employer not applying s 6. In practice, employees have the incentive to disclose their service history to obtain the benefits. Employers have a duty to recognise the accrued conditions once they become aware of the transfer and the employee’s service dates. The Act does not set a time limit within which the employer must action this, but it is implied that it should be done at or shortly after the transfer.

The Public Employment (Mobility) Act 1989 does not contain any offence provisions, penalties, or specific enforcement mechanisms. It creates statutory rights for employees, but it does not provide a private right of action, an administrative complaints procedure, or a designated enforcement body. This is a notable gap. If a public employer fails to recognise accrued conditions upon transfer, the employee’s remedy is not found within this Act. Instead, the employee would need to rely on other avenues: a grievance under the applicable enterprise agreement or the Public Sector Employment and Management Act 1993, an unfair dismissal or general protections claim under the Fair Work Act 2009 (if the employer is a national system employer), or a civil action for breach of a statutory duty or for restitution. However, because the Act is a Territory law and most NT government employers are not national system employers (they are covered by the NT industrial relations system), the Fair Work Act’s general protections provisions likely do not apply. The enforcement route would be through the NT industrial relations system, potentially via the Northern Territory Civil and Administrative Tribunal or the Supreme Court.

The absence of penalties means that an employer’s failure to comply carries no direct financial cost under this Act. The employer may be ordered to rectify the omission (e.g., credit the employee with the correct leave balance) but there is no civil penalty for non-compliance. This weakens the incentive for employers to proactively implement the Act. In practice, most NT government employers have policies and HR procedures that recognise the Act, because their own enterprise agreements often incorporate the Act or require them to comply with relevant legislation. But for smaller statutory bodies that may not have dedicated HR expertise, the risk of inadvertent non-compliance is real.

Another enforcement gap is that the Act does not require the new employer to obtain or verify the employee’s service history from the previous employer. The employee bears the burden of proving their accrued conditions. If the previous employer’s records are lost or incomplete, the employee may not be able to demonstrate continuous service. Sections 4(2) and 6(1) are preconditioned on the employee establishing the relevant facts. There is no power in the Act for the employee to compel the previous employer to provide a certificate of service. This can be a practical hurdle, especially in mergers or restructures where records may have been transferred or destroyed.

The Minister’s power under s 3(2) to declare that the Act applies or does not apply to a class of persons could lead to disputes about whether a particular employee is covered. Those declarations are legislative instruments (gazette notices) and may be subject to judicial review, but such challenges are rare and costly for individual employees. The Act does not create an independent oversight body; compliance is essentially self-enforced by employers.

The only express enforcement-related provision is the right of appeal under s 5(2) for transferred employees whose transfer constituted a promotion and who are subject to an appeal process. That appeal right exists within the employing agency’s internal promotion system, not under the Act itself. So the Act merely piggybacks on existing appeal rights; it does not create a separate appeals mechanism for Act-specific disputes.

Given the lack of penalties, the Act functions more as a set of entitlements that are expected to be honoured as a matter of standard HR practice, rather than as a coercive regulatory scheme. Employers who violate the Act may face industrial claims but no criminal or civil penalty. This design reflects a permissive rather than prescriptive approach, but it also means that employees without strong union backing or legal resources may find it difficult to enforce their rights.

The Act operates within a network of NT and Commonwealth legislation governing public sector employment. The most important interaction is with the Public Sector Employment and Management Act 1993 (PSEM Act). The definition of “employee” in the Public Employment (Mobility) Act specifically references employees within the meaning of the PSEM Act (s 3(1) definition of “employee”). This means that the class of employees covered by the Mobility Act is essentially the same as those covered by the PSEM Act, subject to the exclusions. However, the Mobility Act does not adopt all definitions from the PSEM Act; it has its own definitions for “conditions of employment”, “public employment”, and “transfer”. So there is a risk of inconsistency: what the PSEM Act may treat as a benefit (e.g., salary packaging) is not a “condition of employment” under the Mobility Act and thus does not transfer. Employers must maintain awareness of which regime applies to each entitlement.

The Act also references two now-repealed statutes: the Public Service Act 1976 and the Teaching Service Act 1981, in s 8 regarding compulsory transferees. Those Acts have been superseded, but s 8 preserves any rights that employees may have accrued under them. This means that any employee who was subject to a compulsory transfer under those old Acts retains those rights even after moving to another public employer under the Mobility Act. This provision is a transitional savings clause, but it remains live because the rights are not time-limited.

The Act specifically excludes from “public employment” employment with a local government council, the Northern Territory Land Corporation, and the Conservation Land Corporation. This means that the Act does not interact with the local government employment regime (governed by the Local Government Act 1993 and the Local Government (Administration) Act 2008). An employee moving from a council to a NT government department cannot rely on the Act, and vice versa. The amendments in 1993, 2008, and 2014 progressively updated these exclusions as local government and land corporation legislation changed. So the Act’s scope has narrowed over time as certain bodies were carved out.

The Act interacts with the Territory Insurance Office (Sale) Act 2014, but only to the extent that part of that Act never commenced and the amendments to the Mobility Act under that Act were limited to updating definitions. The Territory Insurance Office was a statutory body covered by the Mobility Act but was sold; employee transfers related to that sale would have been governed by the sale Act and possibly the Mobility Act if the employees moved to another public employer.

The Act also interacts with Commonwealth legislation through the definition of “public employment” including Commonwealth employees on leave of absence without pay (s 3(1)(c)). This means that if a Commonwealth public servant takes a temporary NT public sector role, they are treated as a “public employer” employee for the purposes of the Act. Their Commonwealth service counts for accrual under the Act, but the Commonwealth is not a party to the Act. Upon return to the Commonwealth, the Mobility Act doesn’t oblige the Commonwealth to recognise NT service. That would be governed by the Public Service Act 1999 (Cth) or relevant Commonwealth enterprise agreement.

The absence of a provision for superannuation portability is notable. The Superannuation Guarantee (Administration) Act 1992 (Cth) applies to all employers, but the choice of super fund may vary between employers. The Mobility Act does not require the new employer to accept the employee’s existing super fund or to provide equivalent employer contributions. Employees transferring may need to change super funds or maintain a separate account. This is a gap that employees must address separately.

Finally, the Act does not interact with the Fair Work Act 2009 (Cth) in a direct way, because most NT public sector employers are not national system employers. However, the Fair Work Act still applies to certain Commonwealth employees within NT and to any NT public employer that has been declared a national system employer. In those cases, the Fair Work Act’s general protections and unfair dismissal provisions may provide alternative remedies if a transfer is mishandled. But the substantive rights under the Mobility Act are distinct: they are about accrued conditions, not about general protection rights.

The Public Employment (Mobility) Act 1989 was assented to on 20 September 1989 and commenced on 1 November 1989 (Gazette G43, 1 November 1989, p 7). Its original text was brief, with nine sections. The most significant amendments relate to the exclusions from the definitions of “employee” and “public employment”.

Local Government (Consequential Amendments) Act 1993 (Act No. 84, 1993) amended s 3 to insert exclusions for local government councils. This was consequent to the enactment of the Local Government Act 1993. The amendment took effect from 1 June 1994.

Statute Law Revision Act (No. 2) 1995 (Act No. 42, 1995) and Statute Law Revision Act (No. 2) 2004 (Act No. 54, 2004) made minor formal amendments, likely updating references to other legislation and correcting drafting errors. The 2004 amendment commenced 27 October 2004.

Local Government (Consequential Amendments) Act 2008 (Act No. 28, 2008) further amended s 3 to update the exclusion of local government bodies following the repeal of the Local Government Act 1993 and its replacement with the Local Government Act 2008. It commenced 1 July 2008.

Local Government Amendment Act 2014 (Act No. 19, 2014) amended s 3 again, commencing its relevant provisions on 1 July 2014 and 1 December 2014, to align with further local government reforms.

Territory Insurance Office (Sale) Act 2014 (Act No. 41, 2014) amended s 3 and related provisions as part of the sale of the Territory Insurance Office. Notably, parts 6, divisions 1 and 2 of that Act never commenced (expired without ever coming into force), so those amendments were never operational. Division 3 (about other matters) commenced on 1 January 2015.

Local Court (Related Amendments) Act 2016 (Act No. 8, 2016) amended s 3 to replace references to “Magistrate” with “Local Court Judge”, reflecting the renaming of the Local Court. This amendment commenced 1 May 2016.

Finally, the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) made formal amendments to sections 1, 3, 8 and 9. These are general amendments of a formal nature (e.g., updating drafting conventions) and are not individually listed in the table of amendments.

The current version as at 1 May 2016 (the date of the reprint) incorporates all amendments up to that time. Any later amendments (including the 2018 amendments) are not reflected in the text provided but are noted in the endnotes. The Act has not been repealed and remains in force, though its practical significance has diminished as enterprise agreements and the PSEM Act have largely codified similar portability principles.

The supplied source does not contain any reference to litigation under this Act. No cases are mentioned in the text, and the endnotes do not list any case history. Given the narrow scope of the Act and the small size of the NT public sector, it is plausible that the Act has generated little to no reported litigation. The Act creates statutory rights but does not provide a unique cause of action, and disputes would likely be resolved through grievances or industrial tribunals rather than through judicial interpretation. The absence of reported litigation also means there is no judicial guidance on key questions such as the meaning of “continuous” in s 4(2) or what constitutes a “transfer” for the purposes of s 3(1). This lack of interpretive authority adds uncertainty for employers and employees attempting to apply the Act. The Minister’s declaration power under s 3(2) could theoretically be the subject of judicial review if a declaration were challenged, but no such challenge appears in the source.

Several provisions in the Act contain traps for the unwary. The first is the limited definition of “conditions of employment” in s 3(1). It covers only recreation leave, long service leave, sick leave, NT allowance, airfare entitlement, and automatic salary increments. Significant entitlements such as personal leave (beyond sick leave), parental leave, study leave, rostered days off, redundancy benefits, superannuation contributions, salary packaging, and performance bonuses are not included. An employee who transfers expecting all of their accumulated entitlements to carry over may discover that only these listed ones do. For example, an employee who has accrued a large bank of time off in lieu (TOIL) or purchased leave under a previous employer’s arrangement will lose those amounts unless the new employer voluntarily honours them. The Act does not compel the new employer to do so.

Second, the Act does not define “continuous” in s 4(2). It says the total period is continuous if “the period of service with [the earlier employer] taken with the periods of service with subsequent public employers is continuous”. What happens if there is a gap of a few weeks between positions? The Act does not specify a maximum break. This creates uncertainty. Employees who resign from one public employer and take up a new position with another public employer a month later may not be treated as having continuous service, depending on employer policy. The new employer may deem the service broken and reset the employee’s service date. There is no legislative guidance on whether a gap due to re-location or delayed start counts as a break.

Third, the Act excludes casual, temporary, and fixed-term employees. This means that a person who has worked in the NT public sector for 10 years on successive fixed-term contracts cannot rely on the Act when moving to another public employer on a permanent basis. Their earlier service may not be recognised under the Act if the new employer chooses not to recognise it. Enterprise agreements may provide otherwise, but the Act itself offers no protection.

Fourth, the ministerial declaration power under s 3(2) can be exercised without notice to affected employees. An employee may rely on the Act only to discover that the Minister has declared that the Act does not apply to their category. There is no requirement for consultation or for the declaration to be retrospective. This power undermines the certainty that the Act otherwise provides.

Fifth, s 7 removes any automatic right to return. Employees who transfer expecting to be able to go back to their old job if things do not work out are mistaken. They must negotiate a return with the previous employer, which may refuse. This is a significant risk, especially for employees with long tenure who might otherwise be confident of re-employment.

Sixth, the transitional provision in s 9 affects only employees who first commenced duty between 1 August 1987 and 24 October 1988 and who later transfer to the Power and Water Authority, Darwin Institute of Technology, or University of the NT. For those employees, their start date is deemed to be 25 October 1988 for the limited purpose of eligibility for NT allowance and airfare entitlements. This means they lose the benefit of any earlier service for those two conditions. This was apparently a deliberate policy to treat those bodies differently, but it is a trap for anyone in that cohort who does not check the precise dates.

Seventh, the Act does not impose any obligation on the previous employer to provide a certificate of service or to otherwise cooperate. The new employer may request service history, but the previous employer may be slow or unable to provide it. Since the Act does not deem information to be correct, the employee bears the risk of incomplete records.

Eighth, the exclusion of local government councils and the two named land corporations means that an employee moving from a council to a NT government department cannot invoke the Act. Similarly, a person moving from a NT government department to a council loses the protection of the Act for future transfers back to the public sector, because council employment is not “public employment” under the Act. This can create a trap for employees who take a job at a council thinking they can later return to the public sector with their accrued benefits intact; they cannot.

Finally, the Act uses definitions that reference other Acts (e.g., PSEM Act) and the Police Force. Employees who fall outside those definitions (e.g., a person working under a contract for service rather than a contract of employment) are not covered. The Act does not use modern employment terminology; the definition of “employee” is pre-Fair Work Act language and may need careful interpretation.

For NT public sector HR managers and payroll officers, compliance with the Act requires a systematic approach to recording and transferring accrued conditions when an employee moves between public employers. The first step is to identify whether the employee is covered. Check that the employee is not a casual, temporary, or fixed-term employee, and not a Local Court or Supreme Court Judge. Also confirm that the previous and new public employers are both within the definition of “public employer” under s 3(1). If either employer is a local government council, the Northern Territory Land Corporation, or the Conservation Land Corporation, the Act does not apply. If the employee is a Commonwealth employee on leave of absence without pay, the Act applies during that leave.

When a transfer occurs, the new employer must request from the employee (and, if possible, from the previous employer) a record of the employee’s service history with all previous public employers, including the dates of commencement and cessation. The new employer must then determine the earliest continuous start date under s 4(2). This requires verifying that the periods of service are continuous. If there are gaps, the employer must decide whether they are short enough to still be considered continuous. There is no statutory guidance, but a prudent approach is to treat any gap shorter than, say, one pay period as continuous unless the employee has been formally separated from the previous employer (e.g., resignation and re-employment). Documentation of the gap reason should be kept.

Next, the new employer must identify which accrued conditions from the closed list in s 3(1) the employee has. This includes recreation leave, long service leave, sick leave, any NT allowance or remote locality allowance, airfare entitlements, and automatic salary increments. Accruals for other leave types (e.g., personal carers leave, parental leave) do not transfer under the Act, but the employer may voluntarily recognise them if its policies allow. The employee’s accrued balances for the listed conditions must be credited to the new employer’s payroll system. The new employer must also adjust its leave liability calculations accordingly.

After the transfer, the employee’s conditions accrue under the terms applicable to employment with the new public employer (s 6(2)). So if the new employer provides 20 days annual leave per year instead of 15, the employee accrues at the higher rate from the transfer date. The previous employer’s accrual rate is no longer relevant.

When advertising permanent vacancies, HR must treat an internal applicant from another public employer as an employee of the advertising employer for the purpose of determining the terms of employment that apply to the application (s 5(1)). This means applying the same internal selection criteria, internal advertising process, and any preferential treatment given to existing employees. If the transfer constitutes a promotion and the new employer’s promotion process includes a right of appeal, that right must be extended to the transferred employee (s 5(2)). This may require updating appeal procedures to recognize inter-employer transfers.

The previous employer must cooperate by providing a record of the employee’s accrued conditions without delay. While the Act does not impose this duty, failure to do so may contravene other employment obligations and could lead to a grievance. Both employers should maintain a register of transfers falling under the Act for audit purposes.

For compulsory transferees (those covered by the old Public Service Act 1976 or Teaching Service Act 1981), the new employer must check what residual rights those Acts conferred and ensure they are preserved (s 8). This may require specialist knowledge of those repealed Acts, which are no longer in force but whose provisions survive for this limited purpose. Employers should seek legal advice if necessary.

The Minister’s declaration power (s 3(2)) means employers must periodically check the NT Gazette for notices that add or remove classes of employees from the Act’s coverage. This is often overlooked. Employers should assign a responsible officer to monitor Gazette notifications annually.

For employees: before transferring, verify your service history and accrued balances for the listed conditions. Ask the new employer in writing to confirm it will recognise them under the Act. Keep copies of all correspondence and payslips as evidence. Understand that the Act does not protect superannuation, redundancy, or other benefits. If you are transferring from a local government council, do not assume the Act applies; seek a voluntary agreement from the new employer. If you are a casual or temporary employee, the Act does not protect you; consider negotiating inclusion in your contract.

Finally, if a dispute arises, follow the internal grievance procedure of the new employer, then escalate to the Northern Territory Civil and Administrative Tribunal or the Supreme Court if necessary. Given the absence of penalties, the practical remedy is declaratory relief or an order for specific performance (e.g., to credit leave). Legal advice should be sought early, as the Act’s interpretation is untested in litigation.
